The site is classified Transition in the 2006 CAMA land use plan. Item 2: Market Street Corridor Study – Consider the recommendations outlined for the portions of the study relating to the unincorporated county. Technical Review Committee Report (November) The Planning Board may consider substantial changes in these petitions as a result of objections, debate, and discussion at the meeting, including rezoning to other classifications. The Board must find that the use will not materially endanger the public health or safety where proposed and developed according to the plan as submitted and approved. A. Carolina Beach Road is designated as an urban principle arterial roadway in the WMPO Roadway Functional Classification plan. B. Current Level of Service on Carolina Beach Road is F. C. The site is not within the 100 year floodplain. D. The site is not located within the Special Highway Overlay District. E. Pocosin encompasses two pockets of the property; however, neither is located within the proposed development area. Therefore, no Conservation Overlay District regulations are applicable. 2. The Board must find that the use meets all required conditions and specifications of the Zoning Ordinance. A. Setbacks shall be in accordance with Section 52.5. B. Landscaping, including buffers, shall be in accordance with Section 67. C. Lighting shall be in accordance with 72-28(6). D. A stormwater management plan will be required to meet the standards outline in the County’s standards. E. A driveway permit will be required from NCDOT. F. Signage shall be in accordance with Section 94-4 (1) (c). 3. The Board must find that the use will not substantially injure the value of adjoining or abutting property or that the use is a public necessity. A. No evidence has been submitted that this project will decrease property values of residents who live nearby. B. The structure will maintain a 266 foot setback off of adjacent residential property immediately south. C. The use may be considered to be a public necessity so that delivery of emergency services can be improved in the area. 4. The Board must find that the location and character of the use if developed according to the plan as submitted and approved will be in harmony with the area in which it is to be located and in general conformity with the plan of development for New Hanover County. A. The 2006 Joint CAMA Plan Update shows land classification as Transition. B. Immediately north of the site is a Conditional Office and Institutional district, housing a veterinary office. Both east and south of the site is R-15, medium residential district. West, across from Carolina Beach Road, is currently zoned B-2, highway business, and uses contained in this strip development, include a gas station, restaurants, and a boat repair and sales shop. Cautious site design for the fire station will help preserve the residential character of the area while allowing for improved community safety. C. The vision statement in the 2006 CAMA Plan expresses the need to “adapt to growth as we preserve the values that make our community a great place to live.” Enhancing the County’s ability to improve its emergency response in growing areas of the county would be consistent with the vision. D. Approximately 0.8 acres of the 42.55 acre site will be developed as part of this proposal. Note: A Special Use Permit is a quasi-judicial action requiring an evidentiary hearing and findings of fact. ACTION NEEDED: (Choose one) 1. Conservation/Historic/Archaeological Resources: Pocosin encompasses two pockets of the property; however, not located in development area. Soils: Kureb and Rimini sands (both Class I), Lynn Haven fine sand and Leon (both Class III) Septic Suitability: Kureb and Rimini sands are both suitable with slight limitations. Leon and Lynn Haven fine sands both contain severe limitations and require extensive modification and intensive maintenance. At your November 4 meeting, it was decided that the Board would discuss and possibly send forward a recommendation on the study (but not the ordinance portion) at your December meeting. Staff has not been able to selectively extract materials from the digital plan, so we are simply enclosing the table of contents. Mike Kozlosky, Executive Director of the Wilmington Metropolitan Planning Organization, will attend the meeting to respond to your questions and assist with your discussion.
