MinutesPackage 12June2013 WILMINGTON-NEW HANOVER PORT, WATERWAY& BEACH COMMISSION 121une2013 Meeting Minutes Port, Waterway & Beach Commission (PWBC) meeting participants: (attendance sheet attached). Chairman Weaver called the meeting to order at 4:00. The Chairman welcomed the group and each introduced themselves. The minutes of the May 2013 meeting were approved and the PWBC fund balance was noted at ^'$10,410.00. Old Business: • The US Army Corps of Engineers (USACE) coastal storm damage reduction (CSDR) project on Carolina Beach (CB) was completed on 28May2013; final placement volumes have been requested of the USACE. • The US Senate passed a 2013 Water Resources Development Act (WRDA) Bill including CB reauthorization language with minimal review elements and a potential 15-year authorization extension. The US House is anticipated to initiate a similar bill later this summer. • The NC Division of Water Resources (NCDWR) and the Division of Coastal Management (NCDCM) have released a request for proposals (RFP) for qualified firms to develop cost and schedule estimates for a general and an individual umbrella permitting path for USACE shallow draft inlet participants (Bogue, New Topsail, CB, Lockwoods Folly and Shallotte). This investigation phase is estimated at $24,000 cost-shared 50/50. The NCDWR has their estimated half and each shallow draft participant would share the remaining half. If New Hanover County (NHC) proceeds into the permitting phase, the permitting costs would be room occupancy tax (ROT) eligible. • A USACE planning survey task order is being prepared for the FY14 USACE CSDR project on Wrightsville Beach (WB). • NHC, CB and Kure Beach (KB) submitted comments and public hearing requests regarding the US Fish and Wildlife Service's (USFWS) proposed critical habitat rule for loggerhead sea turtles. Additional comments may be submitted during the second public comment period for the USFWS's economic assessment currently in progress. New Business: • The PWBC unanimously approved a "Resolution Eliminating Annual Port, Waterway and Beach Commission Affiliation Fees" (copy attached). • The PWBC revised charter will be taken to the County Commissioners for approval (copy attached). The only substantive change was the addition of an ex-officio (non- voting) member, the Figure 8 Home Owners Association President (or designee). • Chairman Weaver, in a dramatic reading, shared the PWBC's letter of thanks to the Chamber of Commerce for their years of logistical coordination and support (copy attached). • Mr. Andrew brought to the PWBC's attention potential actions by the Masonboro Island Preservation Association and their policy discussions for compatible uses of Atlantic Intracoastal Waterway (AIWW) upland confined disposal facilities (cdf). The PWBC asked Mr. Andrew to bring additional information regarding the potential policy change and the potential effects on local cdf uses. PWBC General Discussion Points: • Mayor Lambeth noted the loss of sand on KB as a result of"Andrea" • Councilman Bridges noted the escarpment on CB as a result of"Andrea" • Mr. Kellam initiated a brief discussion regarding the potential new Cape Fear River area of environmental concern (AEC) being evaluated by the NC Division of Coastal Management. A public information session will be held on 261une2013 in the Southport Community Bldg. at 1:00 pm. • A brief discussion was held regarding the NC Water Resources Congress acknowledgment of potential FY14 state matching funds to continue the Wilmington Harbor Improvement Plan. The continued feasibility study addresses three hot spots within the -42-foot project (the turning basin, the Battery Island turn and the Harbor entrance alignment). • Discussion was held regarding each municipality's consideration of FY 14 budgeting for Carolina Beach Inlet's maintenance dredging. As requested, previous PWBC documentation was provided to all members by email on 131une2013 @ 8:16 a.m. Public Comment: • Mr. Barbour briefly spoke of the potential state legislation ensuring a dedicated source of state funding for shallow draft inlet maintenance dredging. • Ms. Riely briefly spoke of potential legislation regarding economic development zones; Ms. Riley emailed the proposed legislation to all on 131une2013 @ 1:09 p.m. The meeting was adjourned at approx. 4:55 pm. OA u c ®� v rzuj Mil o c coy ; 1 , ' N cr G! co C w z V� C E d � ! p 4 = a e Z ir 3 0 o 0 on Al Or cr z 5c . .................................................. 4 ti q.J J e 1r d rc LU r4 O aj `7 WILMINGTON-NEW HANOVER PORT, WATERWAY& A Resolution Eliminating Annual Pt Waterway .& Beach Affiliation Commission Whereas during the 10 April 2013 Port Waterway& Beach Commission (PWBC) meeting, the PWBC voted to recommend ending the requirement for annual membership fees for the City of Wilmington, the Beach Towns and New Hanover County; Whereas the PWBC agreed that future member expenditures, such as for NC Water Resource Congress trips, would be the responsibility of their respective organizations; Whereas the PWBC fund balance will be managed by New Hanover County; Whereas the North Carolina Beach, Inlet, and Waterway Association (NCBIWA) has been instrumental in the support of coastal management issues; Therefore, the PWBC resolved to recommend the use of the remaining fund balance of approximately $10,400.00 for support of the semi-annual public meetings of the NCBIWA until such time as the fund balance is depleted; Therefore, the PWBC further resolves that, during NCBIWA's annual fall conference and during NCBIWMs spring local government meeting, two sponsorships should be funded in the names of(1) The Towns of Carolina Beach, Kure Beach and Wrightsville Beach and (2) The City of Wilmington and New Hanover County. Commissioners added member from NC Shore & Beach Preservation 5/16/05; approved Finance Director as special appointee 2/16/2004 and approved an ex-officio member of Figure 8 Homeowners Association 4/10/13. Purpose of Commission: To investigate, initiate and support water resource development projects including, but not limited to: (1) Port, waterway and river improvements supporting the shipping industry, (2) Beach nourishment and conservation in conjunction with inlet management and (3) Water resource development projects that will serve industry; encourage tourism; commercial/charter fishing; recreational boating and mitigate the threats of storms and flooding. Division of Water Resources and other federal and state agencies in the pursuit of projects that may benefit our community. The Commission will also work with elected officials including federal and state officials and such groups as the NC Water Resources Congress and NCBIWA in order to obtain support, approval and funding as appropriate. The Commission will pursue these projects with full consideration of potential environmental effects.
