Chairman Weaver called the meeting to order at 4:00. The Chairman welcomed the group and each introduced themselves. The September 2013 meeting minutes were approved and the PWBC fund balance was noted at $7,131.98. Chairman Weaver welcomed our new commission member Mr. Greg Washington and congratulated Vice-chair Neal Andrew for his appointment to the North Carolina(NC) Coastal Resources Commission (CRC). eceinber's PWBC C ineet ng will be held in the regular location in the Finance Conference Rooin #500 hach across the atria Current Business: • The US Army Corps of Engineers (USACE)Wrightsville Beach (WB)fiscal year (FY)14 coastal storm damage reduction (C SDR) project: • The USACE has formally requested the project's non-federal cost share ($2.15M). • NHC is preparing for the electronic fund transfer. • NC Division of Water Resources (NCDWR)is prepared to reimburse NHC for NC's share($1.075M). • USACE plans and specifications should be released in November with a targeted notice to proceed in late December. • The USACE held a meeting with state agency representatives (during the partial federal shutdown)to discuss the potential for a one month environmental window extension in the spring; the state agencies were amenable to considering the request if/once formally made by the USAGE. • NHC's Kure Beach (KB) CSDR Authorization: • A pre-application meeting was held at the NC Division of Coastal Management(Wilmington Regional Office) on 15 Oct 2013. • Applicable state agencies were present; the federal agencies were absent (during the partial federal shutdown). • There were no blatant challenges to the project or project approach by applicable state agencies. • During an informal meeting with the USACE (28 Oct 2013), potential consultation approaches were discussed. • The project is moving forward with a targeted application submittal in the first quarter of 2014. • The Shallow Draft Inlet Reconnaissance: • NHC comments on the DRAFT Reconnaissance Report have been submitted. • Preliminary discussions have been held with federal agencies; there is cautious optimism. • The Final Reconnaissance Report is anticipated in mid-December. • Shoreline Transect Contracting: • Interviews took place on 16 October 2013. • Contract negotiations have started with the Moffatt&Nichol team. • Carolina Beach CSDR Reauthorization: o Marlowe& Co. and our federal delegation continue reauthorization efforts during the Water Resources Reform and Development Act(WRRDA) conference committee meetings. • US Fish and Wildlife Service (USFWS) proposed Red Knot listing: • NHC submitted comments on the USFWS's proposed listing in terms of portended designation of critical habitat. • If NC is determined as critical habitat, NHC requested the same area designation as that of the piping plover. • NC Beach Inlet Waterway Assoc. New Business: • Carolina Beach Inlet(CBI), Funding Maintenance Dredging: • The next PWBC meeting's agenda will be centered on this topic. • Mr. Barbour and Mr. Shuttleworth brought forward the inlet maintenance need (approx. $1M/year) versus the current USACE emergency approach (approx. $500K/year). • Ms. Swearinger brought forward a cost/per capita discussion. • Staff brought forward a percentage of boats/jurisdiction (source: NHC tax office). • Vice-chair Andrew and former Colonel Woodbury suggested proximity should be a consideration. • Mayor Cignotti cited the $35M parks and recreation bond and how the inlet is very recreation oriented. • Mayor Cignotti reminded the group of the upcoming beach community breakfast as a venue to discuss locally received ROT dollars and the funding of CBI maintenance dredging. • Chairman Weaver proposed a potential weighted matrix including • Boats/jurisdiction, • Per capita, • Tax base and • Proximity. • General discussion and agreement was that an interlocal agreement should likely be developed. • Mr. Barbour and Ms. Swearinger noted the Carolina Beach Inlet Association's meeting scheduled for 6:00 pm, 20 November 2013 at the CB American Legion. From: Kathleen Riely To: Bedsole, Layton Subject: flood ins update Date: Thursday,November 14,2013 10:59:50 AM Hi Layton, Below is what was on the doc handed out at yesterday's meeting: The new legislation calls for a four-year delay in most rate increases and requires FEMA, which administers the flood program, to complete an affordability study and propose regulations that address affordability issues. The bipartisan deal comes after several weeks of negotiations with Democrats and Republicans in the House and Senate. Congresswoman Waters said that on Oct. 9, in the midst of the government shutdown, she convened a bipartisan meeting of nearly 20 House members, as well as Senate staff, to build consensus around an agreement to delay and fix the program. The legislation will impose a delay likely to total four years for the most vulnerable properties, by delaying implementation of rate increases until two years after FEMA completes an affordability study, which was mandated in Biggert-Waters but not undertaken. In addition, the legislation requires FEMA to propose regulations that address the affordability issues within 18 months after the completion of the study and establishes a six month moratorium thereafter to provide for Congressional review. The delay applies to: primary, non-repetitive loss residences that are currently grandfathered, all properties sold after July 6, 2012, and all properties that purchased a new policy after July 6, 2012. FEMA has estimated it will take two years to complete the affordability study before regulations can be issued and reviewed by Congress meaning rate increases would be delayed for approximately four years in total. In addition, Waters said the legislation: • Allows FEMA to utilize national flood insurance funds to reimburse policyholders who successfully appeal a map determination. • Eliminates the 50 percent cap on state and local contributions to levee construction and reconstruction • Protects the so-called "basement exception," which allows the lowest proofed opening in a home to be used for determining flood insurance rates. • Establishes a Flood Insurance Rate Map Advocate within FEMA to answer current and prospective policyholder questions about the flood mapping process. • Requires FEMA to certify that the agency has fully adopted a modernized risk-based approach to analyzing flood risk. FEMA Director Craig Fugate, under pressure from lawmakers to delay the premium increases,told Congress that legislation was necessary because he does not believe he has the authority under the Biggert-Water Act to stop the changes administratively.
