Our firm was has been tasked with evaluating the site, according to Section 55.1 of the New Hanover County Zoning Ordinance. According to the COD GIS layer available through the county’s website, there are 2 small areas of the site that are classified as pocosin, as well as areas mapped as longleaf pine and turkey oak woodland, and urban and developed land (see attached). The soils mapped in the area at the northwestern corner of the site don’t meet the Class IV soils requirement (Dorovan, Pamlico, Croatan) for this area to be classified as pocosin. There is an area mapped by the county as pocosin along the southern boundary of the site, within an area mapped as Pamlico soils. This soil type comes across the middle of the site. Our inspections revealed that there has been extensive historic backfilling of this entire area of Pamlico soil with non-hydric, non-Class IV soils. This is evidenced by the growth of vegetation not suited for Class IV soils, and indicative of past disturbance, such as Chinese privet, Carolina laurel cherry, grape, and wisteria vines. The Corps of Engineers visited this site on April 29, 2016. The only jurisdictional wetland on the site is located in the northwestern corner of the site. There are several jurisdictional ditches within the site, shown on the attached sketch. It is our opinion that there are no areas that should be subjected to regulations set forth in the New Hanover County Zoning Ordinance Section 55.1.
