A RESOLUTION
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, it has come to the attention of the New Hanover County Board of
Commissioners that persistent problems plague Jasmine Cove Assisted Retirement Community,
formerly known as The Meadows; and
WHEREAS, Jasmine Cove Assisted Retirement Community has been cited for thirty rule
violations since January 29, 2006; and
WHEREAS, these rule violations include improper nutrition for residents with special
dietary needs, failure to check blood sugars or give insulin to diabetics, failure to store medications
properly, inadequate amounts of food on hand, failure to provide proper supervision, failure to report
accidents involving injuries, failure to seek outside medical care, and most egregious, staffs
admission that male construction workers were allowed to sleep overnight in a room adjacent to
quarters occupied by female residents; and
WHEREAS, Jasmine Cove Assisted Retirement Community has failed to consistently
maintain compliance as evidenced by the number of allegations reported to the Department of Social
Services; and
WHEREAS, New Hanover County Department of Social Services staff visited the facility
eighty-three times to respond to complaints;
NOW, THEREFORE BE IT RESOLVED that in concurrence with the New Hanover
County Board of Social Services, the New Hanover County Board of Commissioners hereby seeks
assistance from the North Carolina Division of Facility Services, Adult Care Licensure Section for
the immediate revocation of Jasmine Cove Assisted Retirement Community's license to operate.

PROCLAMATION BY THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
DECLARING OCTOBER 7, 2006 AS
NEW HANOVER COUNTY BIG SWEEP DAY
WHEREAS, New Hanover County is rich in natural resources and beauty; and
WHEREAS, water is a basic and essential need for all life; and
WHEREAS, trash fouls our waterways as well as our landscapes; and
WHEREAS, every citizen should contribute to keeping our environment clean and
healthy by working together to preserve clean water and the natural beauty of our
surroundings; and
WHEREAS, North Carolina Big Sweep is a statewide community effort to
retrieve trash from North Carolina's waterways and landscapes;
NOW, THEREFORE, BE IT PROCLAIMED that the Board of Commissioners
does hereby declare October 7,2006 as New Hanover County Big Sweep Day and
does further hereby urge every citizen to do his or her part to restore the beauty and
function of our beaches, lakes, streams and rivers by volunteering in the Big Sweep
event.

RESOLUTION OF THE
BOARD OF COMMISSIONERS
NEW HANOVER COUNTY
WHEREAS, Fire Services is in the process of working with Finance to prepare a capital project ordinance for the constr~ction
of a fire station at Murrayville Road with the station to serve as a centrally located station in the northern portion of New
Hanover County; and '
WHEREAS, the capital project ordinance for the construction ofthe fire station and the installment financing will be brought
back to the Board of Commissioners at a later date for approval; and .
WHEREAS, an extensive land search has been conducted and a time sensitive buy-sell agreement, New Hanover County
Contract # 06-0301, has been negotiated with the current land owner for 3.5 acres ofland, located at 5807 Murrayville Road; and
WHEREAS, environmental assessment, land surveying, and a special use permit have all been obtained; and
WHEREAS; pursuant to Section 143-64.31 of the General Statutes of North Carolina, a Request for Qualifications was
completed to select the best qualified firm for the architectural services for the design of the Murrayville Fire Station; and
WHEREAS, the County received qualifications in response to the announcement from the following architectural firms:
Sharpe Architecture .
BMS Architecture
Stewart Cooper and Newell Architecture; and
WHEREAS, Stewart Cooper and Newell Architect was determined by the evaluation committee to be the best qualified firm due
to the following factors: 1) Stewart Cooper and Newell Architect is the only firm of the three that specializes in public ~afety
architecture; 2) the County's prior and current experience with Stewart Cooper and Newell Architect through the Federal: Point
facility and the Joint Emergency Services Training Facility have been positive; and :
WHEREAS, time is ofthe essence in securing the property and architectural services in order to move forward on the capital
project, and therefore approval of budget amendment # 07-036 is being requested to appropriate from fund balance' three
hundred eighty-five thousand one hundred dollars and no cents ($385,100.00) to secure the land and award the architectural
contract; and :

WHEREAS, the expenditures for the land and the architectural services would not be financed and no reimbursement language
is required for these expenses; and .
WHEREAS, through approval of budget amendment # 07-036 one hundred seventy-five thousand one hundred ($ 1 75, 1 00:00)
dollars will be budgeted in account 23040200-800200 and two hundred ten thousand ($210,000.00) dollars will be budg~ted in
account 23040200-700000; and i
WHEREAS, the New Hanover County Fire Commission recommends and supports the purchase ofthe land and the selection of
the Architect; I
NOW, THEREFORE BE IT RESOLVED by the New Hanover County Board of Commissioners that:
1. the buy sale agreement, contract # 06-0301 for the purchase of 3.5 acres of land at 5807 Murrayville Road ;in the
amount of one hundred seventy-five thousand one hundred ($175,100.00) dollars be approved; and ' .
2. the contract for architectural services for the Murrayville Road Fire Station, contract # 07-0133 is awarded to Steward
Cooper Newell Architect in the amount of two hundred ten thousand ($210,000.00) ; and
3. the County Manager is hereby authorized and directed to execute the buy sale agreement, contract # 06-0301, and
Architectural contract # 07-0133; contract form to be approved by the County Attorney; and I
4. budget amendment # 07-036 is approved. I
