Approve Reduction of Department of Aging Medicare Transition Budget by $22,969
BRIEF SUMMARY:
The NHC Department of Aging applied for, but did not receive, a grant from the NC Health and Wellness Trust Fund
Foundation for 2007. Funds were budgeted during the budget process to cover salary for one part-time staff person and
operating costs for the Medicare Prescription Drug Program 07. (Such services were provided via grant funds during FY
05/06 and are much needed by our elderly citizens.)
Other resources will be identified so services can be provided at least one day a week at a cost of less than $10,000 for the
2007 fiscal year. The Department of Aging will apply for grant monies again for FY 07/08.
Commissioners are requested to approve reduction of the Medicare Transition Budget by $22,969.

BRIEF SUMMARY:
The NHC Department of Aging is eligible for additional Home and Community Care Block Grant funds (HCCBG) in the
amount of $72,616 to increase services. The NHC HCCBG Advisory Committee recommends the following distribution of
these funds for the Commissioner's consideration:

Request Commissioners accept Home and Community Care Block Grant funds of $72,616, authorize Chairman to execute
necessary documentation and approve accompanying budget amendment.

Will above action result in: New Position(s) Number of Positions: 1
Explanation: Request Commissioners approve a regular part-time Social Worker position to provide Case Assistance
support services to Home Delivered Meal clients. When the grant funding is ended, the position will end. There is sufficient
space in the Department of Aging to house the position. There is a 10% local match for this position which can be found by
adjusting line items in the Department of Aging.

Re: Additional Information for October 2, 2006 Agenda
Utilization of Additional Home and Community Care Block Grant (HCCBG) Funds
1. Case Assisted: $34,616
Funds will be used to hire one part time permanent Social Work to provide case
assistance and support to the most frail, at risk persons on the Home Delivered Meal
program. At present the Department of Aging has one Social Worker for 303 Home
Delivered Meal clients. The increase demands from federal guidelines, reassessment of
each client twice a year and the complexity of client's request for support case assisted
service is creating a task load impossible for one Social Worker. Today the waiting list
numbers 72 persons. This waiting list will continue to increase until additional staff is in
place. If approved, the new Social Worker will provide support for the most fragile
clients, thus allowing for some program growth.
2. Transportation: $12,000
Currently 169 persons are on the waiting list. Additional funds will allow for some
growth in the program.
3. Home Delivered Meals: $8,000
Additional funds will cover cost of meals for 20 new persons for the remainder of 2007.
4. In Home Aide: $14,000
Additional funds will allow some of the 90+ persons on the waiting list clients to receive
service.
5. Adult Day Care: $4,000
Additional funds will allow new clients to be added to the program. Current waiting list
of 90+ persons
Total additional HCCBG funds: $72,616

Additional HCCBG Fundina Allocations
The NC Division of Aging and Adult Services has received the first increase in HCCBG funding since
1998 from the NC General Assembly. The many efforts of the aging and adult services network have
helped to generate the largest amount of new RECURRING state appropriations for home and
community based services for any state fiscal year to date. The additional funding has been allocated
through the intrastate funding formula. Our region was allocated $202,442 and the increases for each
county are shown below.

with all the required documents and signatures to Melissa by September 29, 2006 if possible. If you

. Designs, develops, and implements curriculum-based educational programs for
school children in life cycles, environmental education, science or multi-
disciplines, in accordance with N.C. standards oflearning, and public educational
programs for all ages. Develops effective pre- and post-visit materials and
program kits.
. Teaches programs and/or secures other qualified program presenters. Supervises,
trains, schedules and assigns work to volunteers, matching experience and
program needs.
. Develops program calendars and coordinates program schedules.
. Makes public presentations to groups and assists in other marketing strategies to

the education staff, assuring their proper availability, storage, and safety.

Disposal of Surplus Equipment and Vehicles through County Auction to be Held October 28, 2006
BRIEF SUMMARY:
The County owns certain items of personal property that have become surplus for its current needs. North Carolina
General Statute 160A-270 (b) permits the County to sell such property by public auction. The statute requires the Board of
Commissioners to adopt a resolution at a regular meeting that authorizes an appropriate County official to dispose of the
property at public auction.
RECOMMENDED MOTION AND REQUESTED ACTIONS:
Adoption of resolution authorizing Finance Director's designated representative to dispose of surplus equipment and
vehicles through a public auction to be held October 28, 2006 at the Property Management Maintenance Facility.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, New Hanover County has possession of a number of items of personal property
which are surplus to its needs and desires to dispose of same; and
WHEREAS, the items to be disposed of are listed and submitted as an attachment to this
resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of New Hanover
County that the Finance Director's designated representative, pursuant to the provisions of
G.S. 160A-270 (b), is hereby authorized to dispose of all of the personal property as listed for cash,
check, MasterCard or VISA at an auction, a buyer's premium of twelve percent (12%) of the bid
price will be added to the price of each item purchased, buyers paying in the form of cash or check
will receive a two percent (2%) cash discount, and that said representative be further authorized and
directed to execute necessary documents, transfer title, add items to or delete items from the auction
list, and perform all necessary functions associated with this auction, to be held Saturday, October
28,2006 at 9:00 a.m. at the Property Management Maintenance Facility, Division Drive,
Wilmington, North Carolina.

deaccession have all been reviewed by the Curator, Director, Collections Committee, and Museum Advisory Board.
Recommendations for disposition are also provided. Many of the items on the list are identified for transfer to the
Demonstration Collection where they can be used in educational programs and hands-on exhibits. Some items may have
great value to another collecting institution, which may be listed in a directory sponsored by the American Association of
Museums. Any income earned from items sold at auction is kept in a restricted account that can only be used to purchase
artifacts more appropriate to the Museum mission. When no reuse can be identified, the object is destroyed.

NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, Coming Incorporated established a resister manufacturing facility in New
Hanover County, North Carolina in 1966; and
WHEREAS, Coming Incorporated invented the world's first low-loss optical fiber in 1970
and is the only remaining United States owned fiber manufacturer; and
WHEREAS, Coming Incorporated's New Hanover County, North Carolina fiber facility was
the world's first fiber manufacturing plant and today has the largest capacity in the industry; and
WHEREAS, resister manufacturing was relocated to Bradford, Pennsylvania and the initial
optical fiber manufacturing equipment was installed in the New Hanover County facility in 1978 and
the first low-loss optical fiber was produced in New Hanover County in 1979; and
WHEREAS, Coming Incorporated employs several hundred employees in the New Hanover
County facility and manufactures a full portfolio of fiber products to meet the demands of different
network applications from the desktop to the ocean; and
WHEREAS, continued excellence in manufacturing process control, automation and
productivity in New Hanover County allows Coming Incorporated to remain the highest quality and
lowest cost producer of fiber in the world.
NOW, THEREFORE, BE IT RESOLVED THAT the New Hanover County Board of
Commissioners recognizes and expresses its appreciation to Coming Incorporated for forty
outstanding years as a leading manufacturer in New Hanover County.

BY THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
DOMESTIC VIOLENCE AWARENESS MONTH
October 2006
WHEREAS, domestic violence transcends all ethnic, racial and socioeconomic boundaries, weakening
the very core of our community; and
WHEREAS, the effects of domestic violence are far-reaching, forcing battered women and their
children to seek safe shelter, law enforcement prosecutors to expend valuable resources and families and
friends to grieve at the loss of life; and
WHEREAS, 1,507 adults and children sought safe shelter or counseling at the Wilmington Domestic
Violence Shelter and Services in the year 2005; and
WHEREAS, the Wilmington Domestic Violence Shelter and Services, Inc. works toward the
elimination of violence and oppression against women and their children and provides emergency
support and services for victims and survivors of domestic abuse; and
WHEREAS, on Wednesday, September 4,2002, Gladys Bryant, an employee of New Hanover County
for more than two decades, was killed in an act of domestic violence exhibiting to all her coworkers and
friends, the prevalence of domestic violence and its consequences; and
WHEREAS, many other women throughout New Hanover County and the United States find
themselves in abusive relationships and need to find security and an end to their physical and mental
attacks;
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners
refuses to tolerate domestic violence in any form and wishes to create a society that promotes strong
values, fosters a safe and loving home environment for every family, and encourages our citizens to
redouble their efforts to obliterate the problem of domestic violence from our families, our
neighborhoods and our community.
BE IT FURTHER RESOLVED, that the New Hanover County Board of Commissioners proclaims
October 2006 Domestic Violence Awareness Month in New Hanover County.

WHEREAS, fire is a serious public safety concern both locally and nationally, and
homes are the locations where people are at greatest risk from fire; and
WHEREAS, the nonprofit National Fire Protection Association (NFP A) has documented
through its research that cooking is the leading cause of home fires. One out of three
home fires begins in the kitchen - more than any other place in the home; and
WHEREAS, New Hanover County first responders are dedicated to reducing the
occurrence of home fires and home fire injuries through prevention and protection
education; and
WHEREAS, New Hanover County residents are responsive to public education
measures and are able to take personal steps to increase their safety from fire; and
WHEREAS, using proper care when cooking will have a positive effect on the home fire
problem; and
WHEREAS, each cooking fire that is prevented in New Hanover County is an
opportunity to prevent painful injury and costly property damage; and
WHEREAS, the 2006 Fire Prevention Week theme, "Prevent Cooking Fires: Watch
What You Heat", effectively serves to remind us all of the simple actions we can take to
stay safer from fire during Fire Prevention Week and year-round.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of
Commissioners that October 8-14, 2006 be recognized as Fire Prevention Week and
urge all the people of New Hanover County to heed the important safety messages of Fire
Prevention Week 2006, and to support the many public safety activities and efforts of
New Hanover County Fire and Emergency Services.

STAFF SUMMARY
The subject property is located on an interior parcel of land northeast of Piner Road near
its intersection with S. College Road at Monkey Junction in the Mott's Creek watershed drainage
area. Adjacent and to the west is an existing business and office park.
This rezoning petition proposes a change to allow higher residential density in a new R-
10 district. Such a change would allow a residential policy shift from 2.5 units per acre to 3.3
units per acre on performance residential design. High density residential would not be allowed
because the property does not front on a collector or higher level street. For this parcel, the
resultant maximum potential would increase from 46 units to 61 units under optimum conditions.
Public water and sewer is available in this vicinity.
The area is currently dominated to the west and southeast by commercial or office use
and to the north, south and east by lower density R-15. One subdivision further east is zoned R-
IO (Waterford Place). Access to the site will be a significant issue. Clayton Horn Dairy Rd. is
currently the only access. It is an unimproved right of way connecting to Piner Road just at the
end of an existing traffic median. Road stubs exist on the east side of the property on Mallard
Crossing Dr. in Wood Duck Forest Subdivision and north ofthe property on Wood Ridge Dr. in
Greenbriar Subdivision for future connectivity. The existing Junction Park office complex
adjoins to the west. A defunct preliminary plat within the office complex showed a street stub
into this property.
Traffic in the area is significant. Level of Service is rated as F (failing) on both Piner Rd.
and S. College Rd. Piner Rd. is a major collector which has experienced about a ]2% increase in
traffic between 2001 and 2005. The Monkey Junction intersection traffic increased about ]0%
between 200] and 2003.
A flood zone special hazard area exists on a portion of the property and a small area of
protected pocosin is located at the northeast corner. These factors make up the Conservation
portion ofthe property.

LAND USE PLAN CONSIDERATIONS:
The Transition Classification allows for densities higher than 2.5 units per acre where
urban services are provided. Policies in the land use plan encourage preservation of the character
of existing neighborhoods and quality of life with the primary strategy to integrate development
and growth with input from residents, and also to develop design standards to replace use
standards. The purpose of the Conservation class is to provide for effective long-term
management and protection of significant, limited or irreplaceable natural resources while also
protecting the rights of the property owner. Management of these areas may be required for a
number of reasons, including natural, cultural, recreational, productive or scenic values, but are
primarily flood prone areas.
Although the land classification does not discourage higher density in this location, the
character ofthe surrounding residential development would be somewhat compromised by higher
density since the County requires interconnectivity with these neighborhoods.

Based on the foregoing analysis, it is the staff position that the current zoning
classification is reasonable and consistent with surrounding established residential development,
and staff recommends denial of the rezoning.

adopting or rejecting any zoning amendment, the governing board shall adopt a statement
describing whether the action is consistent with an adopted comprehensive plan and

STAFF SUMMARY
The subject property is located off Castle Hayne Road at the signalized intersection with N. Kerr
A venue. Access to the site is via an access easement through the shopping center driveway
(roughly an extension ofN. Kerr Ave.) onto Castle Hayne Road. Level of Service was F on
Castle Hayne Road as of April 2005. Kerr Avenue is not rated for LOS on this westernmost
segment. Castle Hayne Road is classified as an arterial roadway which experienced a 23%
increase in traffic volume between 2001 and 2005. The impact of opening of the MLK Parkway
and the 1-140 bypass has not been evaluated at this time. N. Kerr Ave. is a major collector which
has experienced about a 4% increase in traffic between 2001 and 2005.
The subject property is currently vacant. Adjacent property to the south is zoned R-15 and is
developed in single family residential use. North of the subject property, zoning is R-20
Residential and is developed along Horn Place Drive. To the east, zoning is a combination of B-2
Highway Business and SC Shopping Center occupied by Wrightsboro Plaza Shopping Center,
another small strip center and associated out-parcels.
The property is relatively near the airport and is identified within the airport transition zone
indicated by the Airport Height Ordinance, however, elevations below 182' would not need
special authorization from the FAA. The property is located within the Ness Creek watershed
drainage area and is slightly influenced by flood zone on the extreme west portion of the site.
Land Use Plan Considerations:
The 2006 Update of the Joint CAMA Plan describes the Transition classification as areas
providing for future intensive urban development on lands that have or will have urban services.
The property is within the Urban Services Boundary and public water and sewer are available in
the vicinity.

Becker WoodslNautical Green Project History
In February, 2005, the County's Technical Review Committee (TRC) approved the
preliminary site plan for Becker Woods Subdivision for 29 single family lots. The vote
by TRC was 3-1. The preliminary approval of the project required that a road stub be
created and platted between lots 2 & 3 (see attached site map). The TRC required that
the road be cleared, graded, and curb cut from Spencer Court to the property boundary
(see Becker Woods approval letter). This action by the TRC would also allow potential
buyers of lots 2 & 3 notice that a road would be built sometime in the near future. The
road stub was required by the TRC to reduce the required length of the Spencer Court
cul-de-sac in accordance with Section 41-1(7h) of the Subdivision Ordinance which
states that cul-de-sac lengths shall be no longer than 500 feet. Section 41-1 (7h) continues
by stating that longer cul-de-sacs may be authorized provided there is no option for
providing stub streets or connectivity... Street Connectivity requirements would also be
improved as specified in Section 41-1 (7t) of the Subdivision Regulations by providing
adequate access for emergency and service vehicles and enhance non-vehicular travel for
pedestrians and bicycles. Roads within the Becker Woods project are private. The road
system within The Cape subdivision is also private.

In March 2006, the County's TRC reviewed the preliminary site plan for Nautical Green
for 35 single family lots. In a vote of 4-0, the TRC denied the project due to the lack of
improved access through Becker Woods as required by Section 41 of the Subdivision
Ordinance and as platted in the Becker Woods approval. Primary access from the
Linksider Townhomes (see map) project was questionable by the TRC due to the lack of
platted right of way and the fact that the area was recorded as "common area" (see site
map). The developer for Nautical Green officially appealed the TRC's decision to the
Planning Board based on the fact that a recorded and platted right of way existed to the
project and that the developer was willing to construct the stub road in Becker Woods to
his property boundary. The appeal was set to be heard by the Planning Board in May
2006 but was "continued" by the Nautical Green developer in the hopes of working with
the developer of Becker Woods in order to determine a cost share of the road stub
improvements.
In July 2006, the developer for Nautical Green approached the County and indicated his
willingness to construct the platted road stub from Becker Woods (see map) to his
property and build a road to the property line of Linksider Townhomes. Based on the
developer's willingness to build the roads and in consultation with County Legal staff,
the appeal to the Planning Board was placed on hold in favor of placing the project back
on the TRC agenda for their reconsideration. On July 26, 2006, the TRC reversed their
March decision and voted to approve Nautical Green for 35 lots. The approval ofthe
plan required the construction of the road stub located in Becker Woods Subdivision
leading into Nautical Green prior to final plat approval. Road construction connecting to
the Linksider Townhomes project was also required (see attached letter).
The Appeal
Becker Woods residents Ellis & Sherry McElroy have appealed the TRC's July 26,2006
decision approving Nautical Green for 35 lots. County Legal staff has determined that
the McElroys have standing since their property adjoins the platted and unimproved road
stub (see site map). Their basis for the appeal is that the "TRC did not follow established
County procedures on July 26, 2006 when it approved Nautical Green subdivision while
a formal appeal and notice of public hearing process was underway." According to the
appeal application, the TRC approval of the project was "arbitrary and capricious"
because:

As a result of extraordinary behind-the-scenes meetings with the Nautical Green subdivision
developer, New Hanover County Planning Department denied citizen petitioners with a
significant interest equal protection and due process. The Technical Review Committee (TRC)
did not follow established County procedures on July 26, 2006, when it approved the Nautical
Green subdivision plan while a formal appeal and NOTICE OF PUBLIC HEARING process was
underway. That formal appeal process remains open and unresolved even while affected citizens
are patiently awaiting their opportunity to testifY. Further, the Planning Department did not
provide advance notification to affected petitioners with a significant interest, as they had
requested in writing on June 7, 2006, of the meeting held on July 26 that "reconsidered" and
approVed the Nautical Green subdivision plan that includes a street connection to Spencer Court.

FILING A NOTICE OF APPEAL
Appeals must be reviewed by the Planning Department and County Attorney for completeness and eligibility to appeal
prior to being heard. Appeals will be limited to individuals with a significant interest in the plan (legal standing). A
$150.00 fee payable to New Hanover County must accompany the appeal from the TRC. An additional $150.00 is
required for any appeal from the TRC to the Board of Commissioners.
The appeal must state the alleged error(s) the Technical Review Committee or the Planning Board made in
rendering the decision being appealed and specifY why the decision was in error. The Scope of the appeal shall be limited
to those errors identified on this form.
Subdivision appeals are first acted upon by the New Hanover County Planning Board. Appeals from the Planning
Board may be made to the County Commissioners. Appeals must be submitted to the Planning Department within ten
(10) working days after the decision being appealed.
Upon receipt of a complete and eligible appeal, the Planning Department will prepare a staff report summarizing
the case. No later than five (5) business days prior to the appeals hearing, responding parties with standing may present
written submittals to the Planning Department Stafffor inclusion in the appeal.
The Planning Department staff will prepare a notice of the appeal hearing to be published in a local newspaper as
part ofthe scheduled agenda. The Appellant Board may affirm, modifY or supplement the decision of the Technical
Review Committee or Planning Board.

On or about August 8, 2006, Sam Burgess, Principal Development Planner, informed petitioner
Ellis R. McElroy no advance notice was provided because"... the public has no right to attend
TRC meetings." The TRC approval action on July 26, 2006, was arbitrary and capricious in that:
(a) No new facts were presented by proponent to justify reversal ofTRC's previous disapproval,
(b) Affected individuals with a significant interest were denied opportunity to voice their
concerns, (c) Specific adverse impacts cited in a petition dated March 3, 2006, and signed by 26
homeowners were not considered or discussed by TRC, (d) Objections stated in letters from Ellis
and Sherry McElroy and Neil and Joyce Bergmark were not considered or addressed by TRC, (e)
TRC is inappropriately imposing "connectivity" requirements of Section 41-1 (7)(F) between
privately owned streets, across privately owned property, all of which is located within a private
gated community, and (f) Proponent has not established legal road access through Becker Woods
or Linksider subdivision property as required by the TRC <;lenialletter dated March 9, 2006.
STATEMENT OF ALLEGED ERROR/BASIS FOR APPEAL
TRC deviated from its Subdivision Approval Procedures and from New Hanover County
Planning Subdivision Appeal Procedures: TRC disregarded comments submitted by individuals
with a significant interest: TRC denied individuals with a significant interest the opportunity to
address adverse safety and {Jroperty value impacts that would result from the proposed Nautical
Green subdivision. The New Hanover County Planning De{Jartment is operating a seriously
flawed "Subdivision Appeal" process that readily collects a $150.00 fee from appellants but does
not afford individuals with a significant interest a fair and impartial hearing of their grievances
before a Planning Board with authority to implement appropriate remedies.

In regular session on February 9, 2005, the County's Technical Review Committee (JRe)
voted 3-1 to approve the conversion of Becker Woods (29 lots) from Conventional Subdivision
standards to Performance Residential. The descending vote by the TRC was based on the road
stub between lots 2 and 3 not being constructed prior to final plat approval. The approval of the
Becker Woods project comes with the following requirements.
1) The road stub located between lots 2 and 3 will be cleared, graded, and curb cut at Spencer
Court to the development property line prior to final plat approval.
2) All terms and conditions of the original preliminary plan approved by TRC on June 23, 2004
will remain in effect.
Attending the meeting were TRC Chairman Frank Smith (Planning Board), Sam Burgess
(Planning staff), Mike Kozlosky (City/County MPO), and Jim Craig (County Engineering). Also
attending the meeting were Holt Moore (County Legal), Dexter Hayes & Baird Stewart (Planning

Re: Nautical Green (Performance Site Plan)
Dear Mr. Malpass:
In regular session on March 8, 2006, the County's Technical Review Committee
(TRC) voted 4-0 to deny Nautical Green subdivision for 35 lots as shown on your
preliminary site plan. The subdivision was denied by the TRC due to the lack of road
access as required by Section 41 of the Subdivision Ordinance and Section 65 of the
Zoning Ordinance. Street connectivity is also required in Section 41-1 (7) (F) of the
County's Subdivision Ordinance. All roads within your development shall have access to
a public or private road.
In accordance with Section 32-3 (4) of the County's Subdivision Ordinance, an
appeal from a decision made by the TRC regarding a preliminary site plan must be
submitted to the Planning Department within 10 business days after the decision being
appealed or March 22, 2006. The notice of appeal application must be completed and
state the alleged error the TRC made and specify why the decision was made in error.
The scope of the appeal shall be limited to those issue(s) identified in the appeal form.
Attending the TRC meeting were acting Chairman Sam Burgess (Planning staft),
David Hollis (County Engineering), David Heath (County Fire Services), and Alllni
Reddi (City/County MPO). Also attending the meeting were Jim Iannucci (County
Engineer), Tom Sosebee (County Fire Services), Bobby Harris & Steve Candler

In regular session on July 26, 2006, the County's Technical Review Committee (TRq
approved the preliminary site plan for Nautical Green for a total of 35 lots as displayed on
your site plan design. Site plan approval is valid for a period of two (2) years. The vote by the
TRC was 4-0 and comes with the following requirement(s):
1) Construction of the road stub located in the Becker Woods subdivision leading into
Nautical Green will be required prior to final plat approval for all or a porti~n of the project.
Road construction connecting the project to the Linksider Townhome development will also be
required prior to final plat approval.
Attending the meeting were TRC Chairman David Adams (Planning Board), David
Heath (Fire Services), Aruna Reddi (City-County MPO), David Hollis (County Engineering),
and Sam Burgess (Planning staff). Also attending the meeting were Bobby Harris (Planning
staft), Holt Moore (County Legal), Tom Sosebee (Fire Services), Jim Iannuc~i (Engineering),
Robert Calder (Attorney for SECOF), Jeff Malpass (engineer for project), Don Demuth
(President Cape Homeowners Association), an.d you.
Nautical Green will be valid as a preliminary site plan for two (2) years. If a final plat
for all or a portion of the project is not submitted within a 24 month time frame, the plat must
be resubmitted as a preliminary plan in accordance with the Subdivision Regulations.
Otherwise, the preliminary approval shall become void. A one year extensio~ to the site plan
may be requested through the TRC prior to expiration.

In the future, this project may be served by County sewer. However, due to the limited
capacity of the County's wastewater treatment facilities, sewer capacity may not exist.
DEHNR wastewater sewer construction and operations permits and/or final plat approval of
sections may be withheld, ifin the opinion of the County Engineer, adequate sewer capacity
does not exist. Please also be advised that all other local, State, and Federal regulations will
be applicable to Nautical Green.
As you know, final plat approval for all or a portion of the project can not be obtained
until construction piau drawings are submitted and approved by County Engineering staff. N()
significant trees appeared to be located within the road right of way as noted on your site plan.

TRC did not follow established County procedures on July 26, 2006, when it approved Nautical
Green subdivision while a formal appeal and notice of public hearing process was underway.
TRC action was arbitrary and capricious in that: (a) No new facts were presented by proponent to
justify reversal ofTRC's previous disapproval, (b) Affected individuals who had asked Planning
Department for advance notification of any hearing that would address proposed construction of
a street connecting to Spencer Court were denied opportunity to voice their concerns, (c)
Specific adverse impacts cited in a petition dated March 3, 2006, and signed by 26 homeowners
were not considered or discussed by TRC, (d) Objections stated in letters from Ellis and Sherry
McElroy and Neil and Joyce Bergmark were not considered or addressed by TRC, (e) TRC is
imposing inappropriate "connectivity" requirements on private streets located within a private
gated community, (t) Proponent has no legal access through Becker Woods or Linksider
subdivision property.
FILING A NOTICE OF APPEAL
Appeals must be reviewed by the Planning Department and County Attorney for completeness and eligibility to appeal
priorto being heard. Appeals will be limited to individuals with a significant interest in the plan (legal standing). A
$150.00 fee payable to New Hanover County must accompany the appeal from the TRC. An additional $150.00 is
required for any appeal fi'om the TRC to the Board of Commissioners.
The appeal must state the alleged en'or(s) the Technical Review Committee or the Planning Board made in
rendering the decision being appealed and specifY why the decision was in error. The scope of tile appeal shall be limited
to those errors identified on this form.
Subdivision appeals are first acted upon by the New Hanover County Planning Board. Appeals from the Planning
Board may be made to the County Commissioners. Appeals must be submitted to the Planning Department within ten
(10) working days after the decision being appealed.
Upon receipt of a complete and eligible appeal, the Planning Department will prepare a staff report summarizing
the case. No later than five (5) business days prior to the appeals hearing, responding parties with standing may present
written submittals to the Planning Department Staff for inclusion in the appeal.
The Planning Department staffwill prepare a notice of the appeal hearing to be published in a local newspaper as
part of the scheduled agenda. The Appellant Board may affirm, modifY or supplement the decision of the Technical
Review Committee or Planning Board.
The Planning Depaliment can advise you regarding these appeal procedures.

We, the undersigned, Becker Woods homeowners object to the forced construction of a paved
street between Lots 2 and 3. This street is proposed to connect Spencer Court with future real
estate development north of Becker Woods subdivision at The Cape. We want to preserve the
character of our neighborhood and avoid the detractions of through-traffic. If this street is so
important, its need should have been resolved before any construction permits were issued.
In large part, we purchased homes in Becker Woods for the peace and tranquility afforded by our
cul-de-sac. Spencer Comt also has a paved public sidewalk which we, our children, and
grandchildren can safely use without concern for crossing automobiles. Few neighborhoods in
New Hanover County have such an amenity. This attractive subdivision was well planned to
promote quiet, privacy, safety, and security; these all remain important considerations.
Becker Woods subdivision plat included a 45-foot wide "Private Right-of-Way" owned by the
developer, Tommy Davis Construction, Incorporated. Mr. Davis assured us, however, that he
now has no intention to ever construct a street on this right-of-way since he was unable to
purchase the adjacent land for construction of additional homes. Had he been able to acquire the
parcel, Mr. Davis said he would incorporate brick privacy walls within the right-of-way to
minimize the street's impact on affected homeowners. Although New Hanover County Planning
Board is pressuring Mr. Davis to build this street, access to the adjacent parcel can and should
rightfully be accomplished via another right-of-way that does not connect to Spencer Court.
The County's policy to promote connecting streets between various neighborhoods certainly has
merit in particular situations. In this specific case, however, the proposed street will not reduce
congestion, expedite traffic, or facilitate emergency access. It will, however, interfere with the
safe and unimpeded use of our sidewalk. The street will not be an efficient use of private capital
or valuable open green space. It is incongruous with planning implemented years ago for The
Cape. With few exceptions, other subdivisions at The Cape including Pinehurst, Linksider,
Bernmda Dunes, Fairways, and Riparian Village have all been developed on limited-access
streets radiating from the three primary collectors: The Cape Boulevard, Lakeside Drive, and
Sedgley Drive. This proven land use concept has been well accepted; it should not be disturbed.
As homeowners, we paid a premium for lots with a safe sidewalk and limited exposure to traffic.
We urge the Board to waive its requirement for construction of this intrusive street.

Hanover County planning policy to connect our neighborhood with a future subdivision being developed
nearby by another firm. If this new street were absolutely essential for the public good, its construction should
have been mandated from the start before any permits were issued for Becker Woods. Potential homebuyers
have an absolute right to such disclosure. A copy of the Becker Woods Subdivision Plat is attached.
Before purchasing Lot 3, we inquired regarding ownership and planned use of the "45' Private Right-of-
Way" indicated on the plat. The land owner and developer, Tommy Davis, told us it could have provided him
access to property behind Lot 3 for construction of more homes, however, since he was not successful in
attempts to purchase that parcel, Mr. Davis assured us he had no intention to ever build a costly street on his
private land or to release that land for use by another competing builder. Furthermore, if he built this street,
Mr. Davis said he would be obligated to obtain approval from The Cape to include expensive brick privacy
walls within the right-of-way to shield the adjacent lots. As a consequence, our home contract with Mr. Davis
conveys to us use of the eastern half of this right-of-way and, in fact, holds us responsible for its maintenance.
A sjfnilar contract agreement for the western half of the right-of-way was reached with the owner of Lot 2.
As a result of these contracts, houses on Lots 2 and 3 have been constructed as close as possible to the
right-of-way to even-out spacing between homes along Spencer Court. We were assured by legal counsel at
contract settlement that our developer had authority to adjust the structural setbacks in this manner. The
windows of our master bedroom and bathroom are located only seven feet from the right-of-way. Auto noise
and light emanating from a new street will undoubtedly disturb our sleep and seriously impose on our privacy.
While the County's policy of connecting neighborhoods m~y be prudent, it should not be implemented in
this particular case. Becker Woods was developed like every other subdivision at The Cape. The Cape's
planning concept is popular with homeowners and efficient; modifications should not be imposed at this late
date. Regarding the tract north of Becker Woods, independent access needs to be provided. If there isn't
another adequate route, that real estate should not be developed. Our quiet cul-de-sac, Spencer Court, must
not become a thoroughfare for crews, delivery trucks, contractors, and homeowners in another subdivision.

On March 8, 2006 I attended the Technical Review Committee meeting on the
Nautical Greens subdivision. At that meeting, r read a letter from the president
of The Cape Homeowners Association to the TRC.
Upon receipt of Notice of Public Hearing scheduled for May 4,2006, r prepared a
letter to Sam Burgess stating my position on the Nautical Greens subdivision. I
asked the Cape Homeowners President to read this letter at the meeting of May 4
since r had to be out of town. This meeting was postponed several times and when
it was finally scheduled on July 26, 2006, I was again out of town.
I am enclosing a copy of my letter of Apri I 29, 2006 for your consideration
together with a copy of the notice of the May 4,2006 hearing.
It should be noted that there is a drainage ditch behind the homes on Sedgley
Drive marked I, 8, 7, 2, and 4 on the enclosed map. While the Nautical Greens area
was unimproved it was sufficient to prevent flooding on the aforementioned
Sedgley Drive property. With the additional Nautical Greens homes to be built
along this ditch, it will be necessary to enlarge the ditch and expand the catch
basin that connects this ditch and the pipe under Linksider Drive.

Because of the brief time limitations set forth in your Notice of Public Hearings
dated May 4,2006, we will make this short.
The Cape is a gated community consisting of seven miles of private roads and
approximately ten miles of drainage ditches. It has three main roads with one
entrance on Rt. 421 and two entrances on River Road. All of the other roads in The
Cape are cul-de-sacs which connect to these three major streets. Nautical Greens
with a connection through Linkside Drive to Sedgley Drive would be similar to the
other neighborhoods in The Cape. Nauticc11 Greens is the development of the last
large piece of land in The Cape and is a' welcome addition.
We do, however, object to the unimproved road stubs connecting Becker Woods
and Nautical Greens.
On the map submitted with this appeal, the road at Linksider is shown as a line
while the other roads show a wider area. In fact, the road at Linksider measures
24 feet excluding curbs and is the same as the other roads in The Cape.
The reason the stubs are unnecessary are as follows:
1. They are not necessary for entrance or egress for emergency vehicles.
2. Drainage is a problem in The Cape and we need all the green space we
can get for absorption. Paving these stubs would create additional
impervious surfaces.
3. Paved road in the stub area will increase the cost of maintenance of
roads in The Cape for our existing homeowners.
We recommend the proposed road stubs be deeded to each adjacent lot owner and
become part of their lots or deeded to The Cape to be used as green space at the
time the roads are deeded upon completion of the subdivisions.

Staff Summary
In June 2006, NCDOT officially opened the 1-140 Wilmington Bypass that extends from
US Highway 421 North to US Highway 17 North/Market Street near the Porters Neck
Community. As a result of the highway design reconfiguration and the need to serve
local resident traffic, a service road consisting of two segments was constructed between
Porters Neck and Futch Creek Roads. This improved service road runs parallel to US
Highway 17 North/Market Street and is separated by a grassy median (see attached site
map). The length of the entire service road is approximately 4,400 feet and is intersected
by Futch Creek Road.
With the opening of the service road, questions have been raised by emergency service
personnel concerning the need to officially name the road. At the present time, a number
of residential homes and a business exist along the road that are identified by a Market
Street address. Most of these addresses were assigned by the County in early 1991. In
order to differentiate between the existing portion of US Highway 17 North/Market Street
that runs parallel to the service road, a proposal was made to name the service road Old
Market Street.
Staff Recommendation
The creation of a new road name to Old Market Street will have a positive benefit to the
Porters Neck Community residents by providing a timely response of emergency service
delivery to the area. Old Market Street has been accepted as an unduplicated street name
by E-911. County Fire Services also supports the new name. If the road name is
adopted, existing residents along the road will have approximately 90 days to make the
necessary changes to their correspondence. The County will be responsible for the
creation and erection of new street signs. Planning staff recommends approval.

Dear County Resident,
The New Hanover County Planning Department is responsible for assigning address numbers to
properties, renamIng duplicate street names and naming unnamed streets within the
unincorporated areas of the County for the purpose of coordinating services such as ambulance,
fire fighting, law enforcement and postal delivery.
As you may be aware, the former portion of Market St that serves as access to your property is no
longer accessible by Market St. We have discussed, by phone, with many of the property owners
about possibly naming the two portions of the new service road to Old Market Street to
differentiate both roads in the event of an emergency. Please see the enclosed map. Because
these properties are no longer directly accessible from Market St, the Planning Department and
Emergency Services support naming this road.
We will present this case to the Board of County Commissioners at a public hearing on October
2nd, 2006 at 5:30pm, at the Old County Courthouse on the corner of Princess and 3'd streets. You
are invited to attend, however, your attendance is not required. If the naming is approved, the
Planning Department will send you notification. The department will also install new street signs
and send all affected property owners a letter informing them that their address has changed to
Old Market St.

Blue Clay Road Proposed Adventure Park
BRIEF SUMMARY:
The County owns approximately two hundred eight (208) acres on Blue Clay Road, which includes the sites for the New
Hanover County Detention Center, the Juvenile Center and an EMS station. The site also includes a ropes course and an
Alpine Climbing Tower owned and operated by Coastal Horizons, Inc. on the southeastern corner of the property.
The Parks Department was approached several years ago by off-road bicycle enthusiasts wanting to see BMX-type bicycle
facilities developed on the site. This discussion was put on hold until completion of the detention center. Since then, these
bicycle enthusiasts have proposed that the County designate the remaining property for the development of an "Adventure
Park," with an emphasis on off-road bicycling and support facilities (parking, picnic shelter, rest rooms, etc.), so that
planning for the park could begin.
The Parks & Recreation Advisory Board adopted a motion on September 6, 2006 to request that the Board of County
Commissioners formally designate the property for development as an adventure park site.
Upon approval by the Board of County Commissioners, the Parks Department will initiate a process to meet with interested
parties to explore how best to develop this facility. Consideration will be given to how partnerships with businesses and
interest groups can contribute to the design and development of the park, including options for funding.
Prior to any movement on this project, the Parks Department will meet with the New Hanover County Sheriff, the Juvenile
Center, EMS officials and Coastal Horizons, Inc. to discuss compatibility, access and other issues.
At this time there is no request for funding to develop the park. Future funding may be required to design and build the
facility. If necessary, such a request will be made at a later date.
RECOMMENDED MOTION AND REQUESTED ACTIONS:
Designate the Blue Clay Road property as a County Park, for the purpose of developing an "Adventure Park," with an

There is a need to revise County Ordinance Section 26-32 to include the appendices in the back of the NC Fire Code book.
A recent commercial plan review by the Fire Marshal's division presented issues with regard to fire code compliance when
a developer was reluctant to make changes as advised because they were not required in the main body of the fire code.
The parameters of the two particular issues were in the appendix of the fire code, and therefore, are not enforceable without
approval of the local governing body. This Ordinance revision will eliminate this scenario in the future.
The appendices in the fire code provide the fire code official with a tool for providing a detailed outline for determining Fire
Department road access, fire hydrant distribution, flame-retardant chemicals, cryogenic fluids, hazard ranking/categories
and fire-flow requirements. These appendices are not enforceable without specific reference in the local ordinance.
Copies of the appendices are available for review in the County Manager's Office.
RECOMMENDED MOTION AND REQUESTED ACTIONS:

Re: Mason's Landing Private Water System
Mr. Hollis,
The subject development is proposing a new water system. The proposed water
system will have two wells, storage, and pressurization as is necessary to provide service
and fire protection for the proposed development. The attached plot shows a preliminary
representation of the proposed system superimposed on the site plan. The developer will
turn this system over to a utility capable and desirous of owning, operating and
maintaining the system. Discussions have already been undertaken with Carolina Water
Service to this end. This because the water service is already in the area. If a more
feasible opportunity presents itself through the exercise then the developer will consider
it on its own merit. We would like for the New Hanover County Water and Sewer
District to consider this request of a private water system to enable the Mason Landing
development. Any effort that can be afforded towards placing this on the next possible
District agenda would be greatly appreciated. Please advise as to when we can expect to
have this heard.

Award of Contract for Bald Eagle Water Line, Porters Neck Intersection
New Hanover County Water System Enhancements
BRIEF SUMMARY:
In June 2006, New Hanover County Commissioners agreed to receive bids for the construction of approximately 3,360
linear feet of 16-inch and 12-inch water lines to improve water quality, flow, and pressure in the Porter's Neck Area.
Approximately 2,000 linear feet of 16-inch concentrate discharge line associated with the County's Water Treatment Plant
project shares the same routing. In an effort to reduce cost, a portion of the concentrate line was included in this contract to
be constructed in the same trench and right-of-way or easement with this project.
On September 7,2006, bids were received for the new line and associated connections to wells and other water lines in the
immediate vicinity. The successful bid was $980,900 by T. A. Loving Company. The associated budget amendment is
required to cover the expense.
RECOMMENDED MOTION AND REQUESTED ACTIONS:
Staff recommends award of the contract to T. A. Loving in the amount of $980,900 and requests approval of associated
budget amendment 2007-27. Also, please authorize the Chairman of the Water and Sewer District to execute the contract.

Consideration of Dedication and Naming of the Landfill Constructed Wetlands in Honor of Raymond "Ray" Lee
Church, Jr.
BRIEF SUMMARY:
Commissioner Pritchett requests the Board to consider dedicating and naming the landfill constructed wetlands at the
Department of Environmental Management in honor of Raymond "Ray" Lee Church, Jr.
Under the direction of Ray Church, the Department of Environmental Management along with N. C. State University and
Sea Grant conducted a pilot study of the use of constructed wetlands to treat liquid leachate from the landfill. Results of
this study led to the creation of a full scale wetland treatment system through funding by the North Carolina Clean Water
Management Trust Fund. The constructed wetlands system allows New Hanover County to reduce and eventually
eliminate its discharge of treated leachate into the Northeast Cape Fear River and adjacent waterways through the use of a
natural ecosystem.
The following awards were received by the Department of Environmental Management for this project:
NCACC Outstanding County Program Award for 2000
National winner of Crown Communities Award for 2003
NACo Achievement Award for 2005
Mr. Church's commitment to New Hanover County and the environment has and will continue to have a positive impact for
years to come.

event, a luncheon, at their annual conference November 13-14, 2006 in Carolina Beach. The cost of the event is $6,000.
New Hanover County is being asked to jointly sponsor the event with the Town of Carolina Beach and the City of
Wilmington ($2,000 each).
