Dear Mr. J. Michael Hutson:
The typical process for establishing a no wake zone begins when a local government with
jurisdiction over the area in question formally requests that the Wildlife Resources
Commission [WRC] undertake rulemaking. In our phone conversation this afternoon
you indicated that the local government you will be dealing with is New Hanover
County. I recommend that you take this letter and accompanying form to the clerk for
the New Hanover County Board of Commissioners.
Before WRC will consider a request for the establishment of a "no wake zone," the local
government must have held an advertised public hearing on the question of establishing a
no wake zone for that area. This hearing should be advertised in whatever paper is most
likely to be read by the local citizenry. Please note that this hearing must have been
held rp for to the local government's adoption of a resolution requesting rulemaking
from WRC.
After the public hearing, the local government may apply for a no wake zone from WRC.
An application for a no wake zone consists of the submission of a completed form [D1,
enclosed] and a resolution adopted by the local government that formally requests the
Wildlife Resources Commission [WRC] to undertake rulemaking for purposes of
establishing a no wake zone. The application should also include reference to the
newspaper in which the public hearing was advertised, and the date and location of the
public hearing.
When I have received the resolution and the completed application, a WRC enforcement
officer will be sent to investigate. If the officer determines that conditions warrant a "no
wake zone," WRC will begin the process of rulemaking.
