COUNTY OF NEW HANOVER DEMOLITION/RELOCATION POLICY OBJECTIVE The primary objective of the Demolition/Relocation Program is to provide assistance to displaced low and moderate income residents in obtaining replacement housing in standard condition, through a replacement housing payment based on family size. GENERAL DISPLACEMENT SECTION ADMINISTRATION The New Hanover County Planning Department shall be responsible for the administration of the Demolition/Relocation Program. The Community Development Block Grant Program Administrator shall assign staff as approved and cooperatively utilize existing staff of all County Departments to promote maximum program efficiency. ASSISTANCE PROVIDED TO FAMILIES AND INDIVIDUALS The County will provide relocation advisory assistance to displaced persons which include: a. Referrals to other Social Service Agencies. b. Information on available standard housing. c. Assistance in arranging financing for purchase or construction of replacement dwelling. d. When applicable, home ownership counseling prior to moving and after relocation. e. Other appropriate assist~nce as may be needed. . . . 1. RELOCATION STANDARDS Dwelling units occupied by Qualified program participants which are considered as a Relocation Resource shall meet (a) the State Building Code, if a newly constructed unit, or (b) the State Housing Code and Section 8 Housing Quality Standards as a minimum, if an existing structure. Compliance with these standards will insure that the unit: a. is in good repair and weather tight with no leakage or dampness; b. has no health, fire, or safety hazards; c. has hot and cold running water and a bathroom that includes a flush toilet connected to a sanitary sewer- system, tub, shower (optional), and lavatory; d. has reasonable kitchen facilities including an operable stove and shelves or other storage space for food and, utensils; e. is adequately wired for electricity; f. provides connections for laundry appliances; g. is located in a neighborhood free from industrial or other nuisances; and h. is large enough for occupancy by the family intended to occupy the premises without overcrowding. 2. OCCUPANCY PER BEDROOM In addition, the following occupancy standards shall be observed: a. Two persons of opposite sex may not occupy the same bedroom unless they are husband and wife or are less than six (6) years of age. b. Only husband and wife, 9.ependent minor children, and family members 62 years and older will be included when computing family size. c. Occupancy standards listed below shall be used as general guidelines for determining the number of bedrooms needed: 2 bedrooms 3 bedrooms 4 bedrooms 5 bedrooms 6 bedrooms Persons 2-4 6 8 10 12 2 . . . 3 . ELIGIBILITY CRITERIA A person will be deemed eligible for relocation assistance and payments as set forth in this Relocation Plan if the following criteria is met: The owner occupies a dwelling unit which: a. Is located within the County's Community Development Program service area; b. Is found to be unfit for human habitation in accordance with standards set forth in the State Housing Code; c. Has been determined to be economically and structurally unfeasible for rehabilitation by the Community Development Division; d. The owner agrees to permit the County to have the dilapidated structure demolished; and e. The owner's family income is equal to or less than 100% of the Section 8 Family Income Guidelines limits. 4. TEMPORARY RELOCATION Families selected under this program will make every effort to obtain temporary housing on their own. If they are unable to find temporary housing, the County will attempt to assist with securing temporary housing through the Section 8 Program or a unit set aside for this purpose. 5. REPLACEMENT HOUSING BENEFITS In accordance with 24 CFR 570.606D, the County may provide relocation assistance to persons that are displaced voluntarily. To qualify, homeowners must meet all guidelines specified herein. 3 . . . 6. HOMEOWNER/OCCUPANTS A displaced person is eligible for replacement housing benefits if he/she: a. has actually owned and occupied the dwelling to be demolished under an agreement for code enforcement for not less than 360 days prior to execution of such an agreement; b. agrees to sign a lien against the property which would prohibit the sale of or placement of secondary mortgages on the property for a period of ten (10) years after construction or acquisition of a new or renovated- structure; and c. does not meet the applicable occupancy requirement and . prior relocation was the result of extremely poor housing conditions that contributes to the poor health of the homeowner. Replacement housing benefits for conventional housing (block or frame) shall meet minimum HUD standards as implemented by N.C. Department of Economic Community Development. 7. MOVING EXPENSE Moving and storage of all household furnishings will be. provided at no expense to the homeowner during the relocation process. This expense shall only include one (1) move from existing dwelling to central storage location and one (1) move from central storage location to relocation dwelling. Due care will be taken to protect furnishings during the move, however, the County will not.be responsible for any items lost, stolen, or damaged during this process. 8. PROPERTY OWNERSHIP REQUIREMENTS FOR REPLACEMENT HOUSING Applicant must have full, undivided marketable title to the subject property when Replacement Housing is to be provided. Life Estates and Tenancies in common are ineligible for Replacement Housing participation. 4 . . . 9. 10. CIVIL RIGHTS ENFORCEMENT The Demolition/Relocation Policy shall be implemented in a~cordance with Fair Housing and Equal Opportunity provisions found at Section 570.904 of the Comn1unity Development Block Grant Regulations. Any violations found, will be reported to the proper federal authorities. COMPLIANCE WITH FEDERAL UNIFORM RELOCATION ACT REGULATIONS AND NORTH CAROLINA CDBG PROGRAM REGULATION All applicable federal and state regulations shall be satisfied, including any required relocation notices. All such relevant rules and regulations, including, but not limited to Title 24CFR, are incorporated herein by reference. No person shall be required to move from a displacement' dwelling unless comparable replacement housing is available to such person. No person shall be made to waive any required benefit or relocation payment in order to participate in entitlements hereunder. 5 . . . COUNTY OF NEW HANOVER CDBG DEMOLITION/RELOCATION NOTICE The New Hanover County Demolition/Relocation Policy. and applicable federal and state regulations have been explained to me by the County CDBG Program Administrator and I understand this policy. I voluntarily accept the County's relocation assistance in accordance with the County's demolition/relocation policy. I agree to voluntarily relocate until permanent replacement housing is provided me. I will be given reasonable relocation advisory services to help me successfully relocate. I will voluntarily move at the earliest possible opportunity. I understand that pursuant to this notice I have at least 90 days before I have to move. I would not have to move before , 199 .
