RESOLUTION
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
RATIFYING THE SURVEY OF A
BOUNDARY LINE BETWEEN PENDER COUNTY
AND NEW HANOVER COUNTY
WHEREAS, New Hanover County and Pender County have been
uncertain as to the exact location of the boundary between them
extending from the fork of Foy's Creek (now Futch's Creek) by a
direct line to the junction of Old House Branch with Island
Creek, and
WHEREAS, New Hanover County and Pender County pursuant
to the provisions of North Carolina General Statutes ~153A-18(a)
contracted with Robert H. Goslee & Associates to survey, mark and
map said boundary line, and
WHEREAS, Robert H. Goslee & Associates have surveyed,
marked and mapped the exact location of said boundary line and
have requested each county to ratify said survey in order to
prepare a map of the surveyed boundary for recordation in the
office of the register of deeds of each county and in the office
of the Secretary of State as by law provided.
NOW, THEREFORE, BE IT RESOLVED that the survey by
Robert H. Goslee & Associates of the boundary line between New
Hanover County and Pender County extending from the fork of
Foy's Creek (now Futch's Creek) by a direct line to the junction
of Old House Branch with Island Creek is herewith ratified by the
New Hanover County Board of Commissioners.

RESOLUTION OF INTENT
TO CLOSE A PUBLIC ROAD
WHEREAS, a petition has been filed pursuant to N;C.G.S.
~153A-241, requesting the Board of Commissioners of New Hanover
County to close the following described public road:
Beginning at a point in the eastern right-of-way
line of U.S. Highway 117 that is the northwestern
corner of Lot 10, Block 15, Castle Hayne as shown on
the plat of Castle Hayne, recorded in Plat Book 59,
Page 597 of the New Hanover County Registry; running
thence from said beginning point eastwardly along the
northern boundary line of Lot 10 and Lot 20, Block 15,
Castle' Hayne, 305 feet more or less to a point at the
northeastern corner of Lot 20, Block 15, Castle Hayne;
thence northerly along the western right-of-way line of
Blossom Street, 50 feet to a point that is the
southeastern corner of Lot 11, Block 11, Castle Hayne;
thence westerly along the southern boundary line of Lot
11 and Lot 1, Block 11, Castle Hayne, 305 feet more or
less to a point in the eastern right-of-way line of
U. S. Highway 117; thence southerly with the eastern
right-of-way line of U.S. Highway 117, 50 feet more or
less to the Point of Beginning. The same being that
portion of Hickory Street, 50 feet by 305 feet and
running from U.S. Highway 117 to Blossom Street.
NOW, THEREFORE, BE IT RESOLVED, that this Board is
considering closing said road to public use, and that a public
hearing on this question will be held on the 2nd day of ~prl~,
1990 at 7: 30 p.m. in the General Assembly Room of the County
Courthouse, 24 North Third Street, Wilmington, North Carolina, at
which time the Board will hear all interested citizens and make a
final determination as to whether the unopened road shall be
closed.
The foregoing resolution was adopted by the New Hanover
County Board of Commissioners on the 5th day of March, 1990.

IN THE MATTER OF RENAMING
A PUBLIC ROAD
ORDINANCE
It appearing to the Board of County Commissioners of New
Hanover County that consideration has been given to the renaming
of Blacktown Road (SR 1343), located in Cape Fear Township
commencing 500 feet east from the Orange Street, Holly Shelter
Road intersection, extending south 1,750 feet to its termination
and recorded as part of Plat Book 2, Page 92 Sherrin Subdivision
and it further appearing that a public hearing was held on
Monday, March 5, 1990, at which time all persons were heard on
the question of whether or not the renaming would be in the
public interest, and it further appearing that notice of said
hearing was transmitted to all resident owners and prominently
posted in at least two (2) locations along said road, and
published in the Star News local newspaper, and the Board of
County Commissioners is of the opinion that said road in New
Hanover County should be named and the naming of same is in the
public interest, the description of which is delineated on the
attached exhibit.
NOW', THEREFORE, IT IS ORDAINED AND DECREED that the above
6 described road is hereby named FULTON AVENUE.
IT IS FURTHER ORDERED that a copy of this ordinance be
recorded in the office of the Register of Deeds of New Hanover
County, North Carolina, and that notice of the action taken by
the Board of County Commissioners be transmitted to the
postmaster having jurisdiction over the road, the North Carolina
Board of Transportation and to any city within five (5) miles of
said road in accordance with N.C. General Statute 153A-240.

RESOLUTION ACCEPTING OFFER TO PURCHASE SURPLUS
REAL PROPERTY
WHEREAS,' offers to purchase certain parcels of real property owned by
New Hanover County and the City of Wilmington have been advertised for upset
bid in compliance with North Carolina General Statute 160A-269 and pursuant
to resolutions adopted by the City Council of the City of Wilmington and the
Board of Commissioners of New Hanover County; and
WHEREAS, there have been no further qualifying upset bids entered for
the property described on the attached list within the statutory period
allowed by North Carolina General Statute 160A-269; and
WHEREAS, the offerors indicated on the attached list have agreed to pay
the amount indicated on the attached list for the indicated parcels of real
property shown thereon; and
WHEREAS, the property is declared by the County Commissioners to be
,surplus and not nccd~d for public purposes; nnd
WHEREAS, it is in the best public interest and welfare to dispose of
this property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners do
hereby accept the offers to purchase as indicated on the attached
list from the offerors as indicated.
2. That New Hanover County will retain any deposit posted by offeror
as liquidated damages if the offeror fails to pay the balance of
an approved offer due in cash within ten (10) days of receipt of a
notice by certified mail of availability of the deed of
conveyance.
3. That the Chairman of the Board of Commissioners of New Hanover
County be and is hereby authorized to execute a deed without
warranties to Elizabeth R. Stone for 211 Turners Alley and 620 N.
Fourth Street and Willow Pelzer for 1213 Orange"Street. as
designated on the attached list.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, after due advertisement, bids were received
and publicly opened by the Finance Department at 3:00 p.m.
on the 27th day of February, 1990, at the County
Administration Building, 320 Chestnut Street, Wilmington,
North Carolina, and the following bids were received for One
(1) 1990 Customized Van, Bid # FIN 90-0047:
A. 1. D.
R & R Speed and Cycle Shop, Inc.
$71,760.00
$76,578.00
AND WHEREAS, the Finance Director and the County
Manager recommend that the contract be awarded to A. I. D.
of Fort Lauderdale, Florida, the lowest responsible bidder,
in the amount of Seventy-one Thousand, Seven Hundred, Sixty
Dollars and no cents ($71,760.00);
AND
and are
contract;
WHEREAS, funds have been previously appropriated
now in Account No. 110-431-4318-6450 to cover this
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the contract for
One (1) 1990 Customized Van, Bid # FIN 90-0047 be awarded to
A. I. D. in the amount of Seventy-one Thousand, Seven
Hundred, Sixty Dollars and no cents ($71,760.00); and that
the County is hereby authorized and directed to execute the
contract, contract form to be approved by the County
Attorney,

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, after due advertisement, bids were received
and publicly opened by the Finance Department at 3:00 p.m.
on the 20th day of February, 1990, at the County
Administration Building, 320 Chestnut Street, Wilmington,
North Carolina, and the following bids were received for One
Set of Replacement Wheels for Caterpillar for the New
Hanover County Landfill, Bid # FIN 90-0037:
Gregory Poole Equipment Company
$30,159.00*
AND WHEREAS, the New Hanover County Landfill, the
Finance Director and the County Manager recommend that the
contract be awarded to Gregory Poole Equipment Company a
Delaware Corporation, the lowest responsible bidder, in the
amount of Thirty Thousand, One Hundred, Fifty-nine dollars
and no cents ($30,159.00);

WHEREAS, funds have been previously appropriated
now in Account No. 700-480-4191-3920 to cover this
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the contract for
One (1) Set of Replacement Wheels for caterpillar for the
New Hanover County Landfill Bid # FIN 90-0037 be awarded to
Gregory Poole Equipment Company in the amount of Thirty
Thousand, One Hundred, Fifty-nine Dollars and No Cents
($30,159.00); and that the County is hereby authorized and
directed to execute the contract, contract form to be
approved by the County Attorney and bid deposit to be
retained until the successful bidder has executed and
delivered the contract and, if required, satisfactory bond.

IN THE' MATTER OF RENAMING
A PUBLIC ROAD
ORDINANCE
It appearing to the Board of County Commissioners of New
Hanover County that consideration has been given to the renaming
of a public road, located in Cape Fear Township approximately
1,700 feet north of Lynn Avenue in the Community of Castle Hayne
and recorded as part of Deed Book 52, Page 597 and it further
appearing that a public hearing was held on Monday, March 5,
1990, at which time all persons were heard on the question of
whether or not the renaming would be in the public interest, and
it further appearing that notice of said hearing was transmitted
to all resident owners and prominently posted in at least two (2)
locations along said road, and published in the Star News local
newspaper, and, the Board of County Commissioners rs--0f the
opinion that said road in New Hanoyer County should be renamed
and the naming of same is in the public interest, the description
of which is delineated on the attached exhibit.

NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above
described road is hereby renamed NORTHEAST AVENUE.
"IT IS FURTHER ORDERED that a copy of this ordinance be
recorded in the office of the Register of Deeds of New Hanover
County, North Carolina, and that notice of the action taken by
the Board of County Commissioners be transmitted to the
postmaster having jurisdiction over the road, the North Carolina
Board of Transportation and to any city within five (5) miles of
said road in accordance with N.C. General Statute 153A-240.

AN ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORTH CAROLINA AMENDING THE
ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Zoning Ordinance of the County of New
Hanover adopted October 6, 1969, as amended be and the same is
hereby amended as follows:
Revise 69.4 (5) Band C as follows:
69.4 (5) Setbacks and Uses
B, Attached Residential development adjacent to any existing
detached residential structure or platted lot (not including
Mobile Home Parks, Planned Developments, or other High Density
developments, shall meet the following additional requirements:
1. The density within the 200 foot wide strip in the High
Density development adjacent to the existing detached
residential development shall be no greater than three times
the maximum performance residential density permitted within
the existing detached residential development.
2. The minimum required setback for attached dwelling units
within this strip from the existing detached residential
development shall be calculated as follows:
(a) Required setback = (Building Height) x (3.73)
(b) The required setbacks may be reduced as specified in
Section 67. In no case, however, shall the minimum setback
be less than 50 feet.
(c) The part of the yard adjacent to the existing detached
residential use shall be used only for buffer strips and as
specified in Section 67; (3/5/90)

Section 2.
Any ordinance or part of any ordinance in
conflict with this ordinance, to the extent of such conflict is
hereby repealed.
Section 3.
This ordinance is adopted in the interest of
public health, safety, morals, and general welfare of the
inhabi tants of the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.
