RESOLUTION OF INTENT
TO CLOSE A PUBLIC ROAD
WHEREAS, a petition has been filed pursuant to N.C.G.S.
~153A-241, requesting the Board of Commissioners of New Hanover
County to close a portion of the following described public roa~:
Beginning at a point in the southern right-of-way
line of Lord Tennyscn Road that is the northwestern
corner of lot 36 as shown on the plat of Kings Grant
Subdivision Section 2, recorded in Plat Book 10, Page 7
of the New Hanover County Registry; running thence from
said beginning point southerly along the western
boundary line of Lot 36 and Lot 1 as shown on the plat
of Crestwood Subdivision Section 5, recorded in Plat
Book 10, Page 2 of the New Hanover County Registry for
a distance of 300 feet more or less to a point at the
southwestern corner of Lot 1, thence westerly 60 feet
to a point at the southeastern corner of Lot 27,
Crestwood Subdivision Section 5; thence northerly 300
feet more or less to a point at the northeastern corner
of Lot 35, Kings Grant Subdivision Section 2; thence
easterly 60 feet to the point of beginning.
NOW, THEREFORE,
BE IT RESOLVED, that this Board is
considering closing said road to public use, and that a public.
hearing on this question will be held on the 7th day of May, 1990
at 7:30 p.m. in the General Assembly Room of the County
Courthouse, 24 North Third Street, Wilmington, North Carolina, at
which time the Board will hear all interested citizens and make a
final determination as to whether the unopened road shall be
closed.

STAFF RECOMMENDATION:
SC-49, 5/90 Close a Portion of Plymouth
Drive
The subject road, encompassing a 300 foot portion of
Plymouth Drive, is located between Lord Tennyson Road to the
north and North Crestwood Road to the south in Crestwood/Kings
Grant Subdivision. This portion of Plymouth Drive is an
unimproved 60 foot right-of-way.
As displayed on the attached map, Plymouth Drive is the only
connecting link between Kings Grant and Crestwood subdivisions.
The closest viable vehicular access between these two (2)
developments is Darwin Drive approximately half a mile to the
east in Wildflower Subdivision. Separate road entrances for
Kings Grant and Crestwood exist from North College Road (Hwy.
132) 800 feet west of the proposed closing.
The Planning Staff recommends that. Plymouth Drive remain
open. In addition to access, future utilities such as sewer and
drainage may be able to utilize the existing right-of-way.
County Engineering has already expressed interest in retaining at
lea.st 30 feet for sewer purposes 0 Future needs for vehicles /
pedestrians, and service access outweigh the benefits of closing
the road. For these reasons, the Board may not want to consider
the closure petition.

WHEREAS, New Hanover County and the City of Wilmington
jointly prepared and adopted a CAMA Land Use Plan in 1986 and
jointly updated it in 1982 a~d again in 1987; and
WHEREAS, the N.C. Coastal Area Management Act requires the
Plan to be updated approximately every five years; and
WHEREAS / the County recognizes that efficient and orderly
growth can be best accomplished by coordination and cooperation
in making planning and service provision decisions; and
WHEREAS / plans for land uses and development by residents
and private industry are best served by a single, coordinated set
of public growth policies;
NOW / THEREFORE, BE IT RESOLVED that New Hanover County
enters into an agreement with the City of Wilmington to jointly
prepare and adopt a CAMA Land Use Plan Update in accordance with
CAMA guidelines, as implemented by a workplan to be agreed upon
by City and County staffs.

BRANCH LIBRARY
BE IT ORDAINED,
by the Board of Commissioners of New
Hanover County
1.
New Hanover County
(County)
is engaged in the
construction of the Branch Library Project, which capital
project
involves the construction and/or acquisition of
capital assets.
2. County desires to authorize and budget for said
capital project
in a project ordinance adopted pursuant to
North Carolina General Statute $159-13.2, such ordinance to
authorize all appropriations necessary for the completion of
said project.
NOW, THEREFORE, WITNESSETH THAT:
1. This project ordinance is adopted pursuant to North
Carolina General Statute $159-13.2.
2. The capital project undertaken pursuant to this
ordinance is the construction of the Branch Library Project,
which project is herewith authorized.
3. The revenue that will finance said project 1S:

WHEREAS, the Congress of the United States, the General
Assembly of Nort,hCarQlina, and the Board of Commissioners
in New 'Hanover County have established, authorized, and
funded programs of public assistance for the purpose of
ensuring that eligible and needy citizens receive essential
benefits;
WHEREAS, over the past two decades the primary programs
of public assistance, Aid to Families with Dependent
Children, Medicaid, and Food Stamps have become increasingly
complex, complicated, confusing, and incomprehensible to
commissioners, boards, administrators, social services
staff, clients, and the community-at-Iarge;

WHEREAS, over 15 years ago, litigation was commenced by
the Legal Services Corporation in the federal court at
Charlotte, against the Director of the North Carolina
Division of Social Services to force the state through the
several county departments of social services to provide
public assistance benefits to eligible citizens in a timely
and expeditious manner consistent with the purpose of those
programs;

WHEREAS, the worthy goal of this litigation, Alexander
vs. Hill, has long been lost in legal and bureaucratic
battles between the State and Legal Services who both lack
basic understanding of the process from the perspective of
either the client or a county department of social services;
WHEREAS, a Consent Order and Settlement Agreement in
Alexander vs. Hill, executed on December 14, 1989, calls for
even more complicated regulations, more monitoring of staff
and creates an almost certainty of substantial financial
sanction to the various counties with the inevitable result
that the goal of the litigation and the interest of the
people of North Carolina will be subsumed to the
bureaucracy;

NOW, THEREFORE BE IT RESOLVED that the New Hanover
County Board of Commissioners, affirms to the Secretary of
the North Carolina Department of Human Resources; the
Governor of North Carolina; the county's representatives to
the North Carolina General' Assembly; and the county's
representatives in the Congress of the United States, that
the constitutional purpose of these programs of public
assistance and the purpose of the Alexander vs. Hill court
order is the timely and appropriate provision of benefits to
the eligible citizens of North Carolina.
FURTHER BE IT RESOLVED that David T. Flaherty,
Secretary of the North Carolina Department of Human
Resources be informed that it is the sincere and serious
request of the New, Hanover County Board of Commissioners
that he renegotiate the most recent Settlement Agreement and
Consent Order in Alexander vs. Hill involving the counties
in a meaningful and substantial manner using the suggestions
contained in "People vs. Paper Revisited."
BE IT RESOLVED that the New Hanover County
Commissioners requests the North Carolina
of Human Resources to immediately institute
presumptive eligibility.

Board of Commissioners affirms to the North Carolina
Association of County Commissioners, the North Carolina
General ,Assembly and the Congress of the United States the
desperate need to seriously pursue drastic simplification of
these essential programs so that the focus can return to
people in need rather than the paperwork.

WHEREAS, the attached petition has been filed with the Board of
County Commissioners of the County of New Hanover requesting that the
above described roads, the location of which has been indicated in red
on the attached map, be added to the Secondary Road System; and
WHEREAS, the Board of County. Commissioners is of the opinion that
the above described roads should be added to the Secondary Road System,
if the roads meet minimum standards and criteria established by the
Division of Highways of the Department of Transportation for the
addition of roads to the System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of
the County of New Hanover that the Division of Highways is hereby
requested to review the above described roads, and to take over the
road for maintenance if they meet established standards and criteria.

This letter

is being prepared in response to your letter of
1990, and our meeting of February 7, 1990 regarding
the above referenced sludge at the New Hanover County
.
Based on the information which you have provided, I would like to
offer the following comments:
1. The Solid Waste Management Division of the North Carolina
Department of Environment, Health and Natural Resources has
authorization through G.S. 130A-294 to regulate and evaluate
waste that may pose a threat to the environment or to public
health and subsequently prohibit disposal of these waste at
a sanitary landfill. A waste determination procedure has
been developed to determine if a waste is sui table for
sanitary landfill disposal.
The department has determined through historical analytical
data that sludges from water treatment plants pose no.
environmental or health problems and exempts water treatment
plant sludges from the waste determination procedure. Even
so, I believe it is in the best interest of the City and
County to have analytical data provided on the sludge at the
concentrations of which it would be landfilled.

2. The waste must not contain free liquids. This determination
is made by performing the Paint Filter Liquids Test SW-846
Method 9095 on a representative sample of the waste. From
our conversations we have concluded that the sludge will
most likely have to be dried to a 40% solids to achieve a
"Pass" on this test.

3. A formula has been devised to determine the tipping fee
for "special waste" based on the comparative density of
the special waste to routine municipal solid waste.
This methodology attempts to adapt the fees to
accommodate the space utilized by all waste as equally
as feasible.
Using the formula and waste density estimate which you
provided of 75 lbs/cubic foot, or 2,025 lbs/cubic yard,
the calculated tip fee is $7.00 per ton. There is also
a possibility of an additional 50% surcharge of $3.50
per ton should special handling be required. I don't
anticipate any problems requiring 'special handling at
this time.
The actual recommended tip fee will be determined upon
laboratory certification of a specific weight of the
waste. The ultimate tip fee will be established by the
Board of County Commissioners upon their approval to
accept the waste. Also, be aware that an increase in
the tip fee for municipal solid waste will cause an
increase in the special waste tip fee unle"ss
specifically exempted by the Board of County
Commissioners.

A. The waste will not cause an impact on the disposal
facilities' permit requirements.
B. The waste will not cause, or possess the potential
to cause, a detriment to the operation of the
disposal facility.

significantly and that the waste continues to pass
the Paint Filter Test. In the event that a
significant change is indicated, the approval is
voided, and reevaluation of the waste will be
required prior to continued disposal.

ascorbic acid (Vitamin C)
I. Special requirements: Same as A.
II. Recommendation: Same as A.
III. Tipping fee: Same as A.
IV. Rate of disposal: Nine (9) tons per month.
2. Arcadian Corporation (formerly W.R. Grace)
A. Diatomaceous earth and sand residue from the prilled
ammonium nitrate process
I. Special requirements: Must be incorporated into
the final cover (State requirement).
II. Recommendation: Accept at the Landfill and use to
cover edge of liner at terminus of cell #2 closure
liner. Has characteristics similar to clay.
Future deliveries may be incorporated into final
cover and realize benefits of soil amendment and
low grade fertilizer.
III. Tipping fee: Based on the density to MSW formula,
the calculated tip fee is $8.40 per ton. An
addi tional fifty percent ( 50%) surcharge is
necessary for a total of $12.60 per ton due to
additional work required to relocate the material
and incorporate into final cover.
IV. Rate of disposal: One hundred-fifty (150) cubic
yards once per year.
