1981-03-30 Special Meeting 790 MINUTES OF SPECIAL MEETING, MARCH 30, 1981 ASSEMBLY The New Hanover County Board of Commissioners met in Special Session on Monday, M~rch 30, 1981, at 7:00 o'clock A.M. in the Assembly ~oom"New Hanover County Administration Building, Wilmington, North Carolina. Members present were Commissioners Howard L. Armistead, Jr.; Donald P. Blake; Karen E. Gottovi; Chairman Claud O'Shields, Jr.; County Manager G. Felix Cooper; County Attorney James C. Fox; and Clerk to the Board, Alyce B. Rusmisell. Comm. Jonathan Barfield was absent. The following members of the County's Legislative Delegation, Wilmington City Council and Wrightsville Beach Town Board were als? present: Senator J. A. Wright Representative Harry Payne Representative S. Thomas Rhodes Mr. B. B. Halterman, Mayor of Wilmington Mr. Joe Dunn, Wilmington City Council Mr. Luther Jordan, Wilmington City Council Mr. Ralph Roper, Wilmington City Council Mr. William Schwartz, Wilmington City Council Mr. Robert Sawyer, Mayor of Wrightsville Beach o Chm. O'Shields called the meeting to order and stated that the Special Meeting had been called to discuss local legislation with New Hanover County's legislative delegation and members of Wilmington City Council and take any action necessary with regard thereto. DISCUSSION ON ACT TO ALLOW NEW HANOVER COUNTY ORDINANCES REGULATING WASTE DISPOSAL TO APPLY COUNTYWIDE Chm. O'Shields commented on the bill that the Commissioners had asked the legislators to introduce requesting that New Hanover County be given the authority to control the flow of the solid waste in the County if the County was going to think about going to an incineration program. Gottovi County Attorney Fox Mr. Bob Cobb, Wilmington City Manager SENATOR WRIGHT LEFT THE MEETING AT 7:50 O'CLOCK A.M. AND WAS ABSENT FOR THE REST OF THE MEETING. The following persons offered comments on the bill: Comm. Armistead Councilman Roper' Mayor Sawyer ~ Chm. O'Shields stated that he felt the proposed bill was an attempt to control the flow of the waste to a' certain point, be it incineration or what have you, and then to a landfill,or that that which could not be~ncinerated go to a landfill, and that it was not his intent to tell anyone ,how much to charge or how to pick the garbage up. o Comm. Blake concurred in Chm. O'Shields feelings on the 'intent of the bill. Chm. O'Shields suggested that the bill be introduced and held until such time as the Legislators were asked to bring it to the floor for action. Representative Rhodes commented. Blake MOVED, SECONDED by Comm. Gottovi, that New Hanover County ask the County's legislators to present enabling legislation assigning owner- ship of the waste stream in New Hanover County to the County Governing Board and to approve the proposed bill. Barfield DISCUSSION ON CIVIC CENTER BILL Mayor Halterman commented on the City of Wilmington's reasons for requesting a bill to authorize counties to expend tax funds and exercise the power of eminent domain for purposes of public auditoriums, coliseums and convention and civic centers and to otherwise authorize establishment and support of same. Comm. Armistead expressed his oppqsition to such a bill. The following persons commented: Comm. Gottovi Comm. Blake Chm. O'Shields City Attorney Jones Comm. Gottovi MOVED, SECONDED by Comm. Barfield DISCUSSION ON BILL TO AUTHORIZE SALES OR LEASES OF PROPERTY BETWEEN GOVERNMENTAL UNITS City Attorney Jones and County Attorney Fox commented on the bill entitled "An Act to Authorize Sales or Leases of Real or Personal Property Between Govern- mental Units Without Restriction". DISCUSSION ON KURE BEACH ABC BILL Chm. O'Shields requested information on the bill that Rep. Payne had introduced at the request of Kure Beach regarding the mixed beverage profits. Rep. Payne commented on the reasons the bill was requested by Kure Beach. Chm. O'Shields stated that he would like to see some figures before he would be able to support the legislation. THE MEMBERS OF WILMINGTON CITY COUNCIL AND COMM. ARMISTEAD LEFT AT 9:11 O'CLOCK A.M. AND WERE ABSENT FOR THE REST OF THE MEETING. DISCUSSION ON FUNDING REQUESTED FOR MQDEL LANDFILL Chm. O'Shields commented on the legislation requested for state funding for the proposed model landfill for New Hanover County. The following persons commented: Representative Rhodes Representative Payne County Manager Cooper DISCUSSION ON INCORPORATION OF AREA IN NORTHERN PART OF COUNTY Rep. Rhodes reported that he had'been requested by a group of citizens to introduce a bill incorporating an area ih the northern part of the County. I DISCUSSION ON ENABLING LEGISLATION FOR FAIR HOUSING The Commissioners and Legislators d~scussed briefly the enabling legislation the Commissioners had requested to incluae fair housing in the County's Fair Employment Practices Ordinance. Rusmisell Clerk to the Board o MINUTES OF SPECIAL MEETING, APRIL 2, 1981 ASSEMBLY The New Hanover County Board of Commissioners met in Special Session on Thursday, April 2, 1981, at 1:00 o'clock P.M. in the Assembly Room, New Hanover County Administration Building, Wilmington, North Carolina. Members present were Commissioners Howard L. Armistead, Jr.; Jonathan Barfield; 'Donald P. Blake; Karen E. Gottovi; Chairman Claud O'Shields, Jr.; County Manager G. Felix Cooper; and Clerk to the Board, Alyce B. Rusmisell. Chm. O'Shields called the meeting to order and announced that the Special Meeting had been called to discuss and take any action necessary with regard to the Capital Improvements Program. DISCUSSION ON CAPITAL IMPROVEMENTS PROGRAM County Manager Cooper Commented on the importance of a Capital Improve- ments Program and the impact it would have on the budget. He also outlined the actions the Board could take in regard to the program. The following persons commented: o County Finance Officer Andy Atkinson County Planning Director Dexter Hayes Commissioner Gottovi DISCUSSION ON COUNTYWIDE WATER & SEWER PROJECT Mr. Henry von Oesen, of Henry von Oesen & Associates, Consulting Engineers, appeared before the Board to explain the proposed water and sewer project. He commented on the effect ,the City of Wilmington annexation would have on the proposed countywide system and answered questions from the Board on the project. The funding necessary in the 1981/82 budget for the water & sewer project would be $670,000. DISCUSSION ON AIRPORT CAPITAL PROJECTS Airport Manager R. C. Shackelford, Jr. appeared before the Board to explain and answer questions from the Commissioners on the proposed capital projects at the Airport. The funding nec~ssary in the 1981/82 budget for these projects would amount to $445,000. DISCUSSION ON PARKS & RECREATION CAPITAL PROJECTS Parks & Recreation Director Mike Waters appeared before the Board to answer questions and explain the proposed capital projects for the Parks and Recreation Department. The Commissioners requested information on some type of public beach access in conjunction with the Parks & Recreation Department. The funding necessary in the 1981/82 budget for the Parks and Recreation capital projects would amount to $214,670. o BREAK Chm. O'Shields recessed the meeting for a break from 3:00 o'clock P.M. until 3:10 o'clock P.M.
