RESOLUTION
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, the United States Congress has carried over a
Seven Million Dollar ($7,000,000) authorization for the revetment
program at historic Fort Fisher located at Kure Beach in New
Hanover County that is contingent on the allocation of matching
funds ($3.2 million) from the State of North Carolina; and
WHEREAS, the New Hanover County Board of Commissionersi
fully supports the Fort Fisher revetment program;
NOW, THEREFORE, BE IT RESOLVED THAT:
The New Hanover County Board of Commissioners urges the
State of North Carolina to allocate matching funds for the
protection of the environment surrounding historic Fort Fisher.

WHEREAS, the attached petition has been filed with the Board of
County commissioners of the County of New Hanover requesting that the
above described roads, the location of which has been indicated in red
on the attached map, be added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that
the above described roads should be added to the Secondary Road System,
if the roads meet minimum standards and criteria established by the
Division of Highways of the Department of Transportation for the
addition of roads to the System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of
the County of New Hanover that the Division of Highways is hereby
req\lested to review the above described roads, and to take over the'
road for maintenance if they meet established standards and criteria.

RESOLUTION PROPOSING ACCEPTANCE OF OFFERS TO PURCHASE
SURPLUS REAL PROPERTY
WHEREAS, certain parcels of real property owned by New Hanover Coun~y have
been offered for sale pursuant to N.C.G.S. 160A-269; and
WHEREAS, the offeror indicated on the attached list has agreed to pay the
amount indicated on the attached list for the parcel of real property shown; and
WHEREAS, the property is declared by the County Commissioners to be surplus
and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose of this
property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners propose to accept
the offer to purchase indicated on the attached list from the offeror as
indicated.
2. That the County of New Hanover and/or the City of Wilmington will retain any
deposit posted by an offeror when:
a. the offer is withdrawn after posting the deposit; or
b. the offeror fails to pay the balance of an approved offer, due in cash,
within ten (10) days of receipt of a notice by certified mail of
availability of the deed of conveyance.
3. That the County of New Hanover reserves the right to reject any and all
offers.
4. That the County of New Hanover will require the offeror to deposit five (5%)
percent of the offered prices immediately following adoption of this
resolution.
5. That the Clerk of the Board of Commissioners will publish a notice of the

BY THE CITY OF WILMINGTON AND/OR NEW HANOVER COUNTY
By resolutions duly adopted by the City Council of the City of
Wilmington and the Board of Commissioners of New Hanover County, the
City of Wilmington and New Hanover County propose to accept offers.to
purchase certain parcels of real property located in New Hanover County
owned by the City of Wilmington and/or New Hanover County. The
identification of the several offers is as follows:

OFFEROR: OSCAR A. GRAHAM
AMOUNT OF OFFER: $1,200.00
The offer to purchase is subject to the following terms and
conditions:
(1) That the offers are unconditional and may not be revoked.
(2) That the City of Wilmington and/or New Hanover County
shall retain as liquidated damages any deposit posted
if any offeror fails to pay the balance due in cash and
secure the deed within 10 days of notice by certified
mail or if returned undelivered within 10 days of the
last attempted delivery.
(3) That all sales are subject to final approval by the
City Council of the City of Wilmington and/or the Board
of Commissioners of New Hanover County.
(4) That the use of the property and construction of any
structures improvements, changes or additions shall at all
times comply with all applicable federal, state or local
laws, rules and regulations.
The proposed sale of this property is being conducted pursuant to
North Carolina General Statute 160A-269 and is subject to upset bid.
The public will take notice that within ten days after publications of
this advertisement, any person may raise the bid by not less than 10%
of the first $1,000 and 5% of the remainder. Upset bids may be in
writing and must be be delivered to the City Clerk, accompanied by a
deposit of 5% of the total increased bid. The deposit must be by cash,
cashier's check, certified check or bid bond. Upon receipt of an
upset bid, the City Clerk shall readvertise the offer at the increased
bid and otherwise follow the statutory procedures until no further
qualifying upset bids are received. When no further qualifying bids
are received, the City Council and/or the Board of Commissioners may
accept the offer and sell the property to the highest bidder for cash.
The City Council of the City of Wilmington and/or the Board of
Commissioners of New Hanover County reserve the right to reject any and
all offers at any time. The proposed sale is made subject to the above
conditions together with all outstanding taxes, liens or other
encumbrances, if any; title shall be conveyed by bargain and sale deed
without warranty; and the property will be sold in its present
condition "as is" without any improvements by the City.
The City Council of the City of Wilmington and/or the Board of
Commissioners of New Hanover County intend to decide whether it wiil
accept or reject the highest offer within a reasonable time not to
exceed thirty days from the date this advertisement is published. Any
and all deposits shall be forfeited if a bid is accepted by the City
and County and then withdrawn by the bidder.

BOARD OF COMMISSIONERS
WHEREAS, the New Hanover County Board of Commissioners
finds that the current methods of recycling used within the State

are not fully reducing the amount of disposable funds in the
wastestream;
NOW, THEREFORE, BE IT RESOLVED THAT:
The Board of Commissioners requests that the North
Carolina Association of County Commissioners seek legislation for
source reduction of disposable goods in order to further reduce
the wastestream and to increase funding to achieve this
reduction.

creating positions in the Department of Environmental, Health and
Natural Resources; and

Counties

encountering
increasing
environmental concerns,
involving landfill permitting and
monitoring; and
WHEREAS, Counties need assistance from the State in

NOW, THEREFORE, BE IT RESOLVED THAT:
The New Hanover County Board of Commissioners urges the
State of North Carolina to add field staff in the Department of
Environmental Health and Natural Resources, especially Waste
Management
Specialists who can assist

permitting and monitoring.

RESOLUTION

BOARD OF COMMISSIONERS
WHEREAS, Counties presently collect personal property
taxes on vehicles; and
WHEREAS, if the State collected such taxes when the
owner of a motor vehicle renewed their vehicle registration, the
taxes would be collected more efficiently and result in the
collection of more revenue;
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The state of North Carolina, through the Department
of Motor Vehicles collect personal property taxes on all motor
vehicles when a person renews their vehicle registration.
2. The State distribute the revenues collected to the
Counties.

RESOLUTION
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, G.S. 143-129 mandates the procedures for the
letting of public contracts by Counties; and G.S. 143-131 and
143-132 provide that such contracts be let to the "lowest
responsible bidder"; and
WHEREAS, the term "lowest responsible bidder" is not
defined in the statutes, thereby giving Counties no objective
criteria upon which to evaluate a contractor or to be able to
reject a bid from a contractor with whom the County has had
previous conflicts and problems adverse to the County's interest.
NOW, THEREFORE, BE IT RESOLVED THAT the New Hanover
County Board of Commissioners requests the North Carolina
Association of County Commissioners to seek legislation that
would amend the public bidding laws to:
1. Define "lowest responsible bidder".
2. Include objective criteria upon which a County may
reject a bid from a contractor with whom the County has had prior
conflicts, Le. the County has previously become involved in a
dispute with the Contractor involving a contract awarded pursuant
to 143-129, or the County has assessed liquidated damages against
the Contractor, or the County has taken action against the
Contractor's performance bond.

WHEREAS,
the State of North Carolina determines the
court fees to be assessed within the judicial system; and
WHEREAS, Counties provide physical facilities and
financial services to the courts; and
WHEREAS, the current court fees assessed are less than
the actual costs of the resources expended by the Counties;
NOW, THEREFORE, BE IT RESOLVED THAT:
The New Hanover County Board of Commissioners requests
that the State increase court fees to meet the actual costs of
operating judicial facilities and return all such fees to the
Counties.

WHEREAS, local government incarceration facilities are
frequently filled to maximum capacity with pre-trial and
convicted prisoners; and
WHEREAS, the population of these f aci Ii ties could be
reduced
if
judges were
allowed
to
reduce
an
inmate's
incarceration period by giving the inmate the option of
performing supervised community service work;
NOW, THEREFORE, BE IT RESOLVED THAT:
The New Hanover County Board of Commissioners requests
the State to allow pre-trial inmates to perform community service
work as a condition of bail and to allow inmates convicted of
misdemeanors to perform community service work as a condition of
early release from incarceration.

The Board of Commissioners of the County of New .
Hanover, North Carolina, met in regular session in Room 301,
Old County Courthouse Building, North Carolina, the regular
place of meeting at 9:00 o'clock, A.M., on September 17, '1990.
The following Commissioners were:

A representative of The New Hanover County Industrial
Facilities and Pollution Control Financing Authority (the
"Authority") appeared before the Board and advised the Board
that the Authority had adopted a bond resolution authorizing
the issuance of revenue bonds in the principal amount of
$3,250,000 and the execution and delivery of financing
documents pertaining to the financing of industrial facilities
in New Hanover County for Wilmington Machinery Incorporated
(the "Company").
The representative submitted to the Board drafts of a
Trust Indenture between the Authority and The South Carolina
National Bank, as Trustee, a Loan Agreement between the
Authority and the Company and a form of Letter of Credit to be
issued by Branch Banking and Trust Company. The representative
further stated that the Authority proposed to issue and sell
the bonds to Donaldson, Lufkin, Jenrette Securities Corporation
for resale to one or more institutional investors at a price of
not less than 98% of the principal amount thereof and requested
that the Board approve the issuance of the bonds.
Commissioner Fred Retchin introduced the following
resolution which was read at length:

RESOLUTION APPROVING THE ISSUANCE OF UP TO BUT
NOT MORE THAN $3,450,000.00 PRINCIPAL AMOUNT OF
INDUSTRIAL REVENUE BONDS (WILMINGTON MACHIN~RY
INCORPORATED PROJECT), SERIES 1990
WHEREAS, the Board of County Commissioners has created
a political subdivision and body corporate and politic of the
state of North Carolina known as "The New Hanover County
Industrial Facilities and Pollution Control Financing
Authority" (the "Authority"); and
WHEREAS, the Authority is authorized under the
Industrial and Pollution Control Facilities Financing Act,
Chapter 159C of the General Statutes of North Carolina, as
amended (the "Act"), to issue revenue bonds for the purpose,
among others, of paying all or any part of the cost of any
industrial project for industry; to acquire, construct, improve
and equip any such project; and to make and execute financing
agreements, security documents and other contracts and
instruments necessary or convenient in the exercise of such
powers; and
WHEREAS, the Authority proposes to issue its revenue
bonds in the principal amount of up to but not more than
$3,450,000.00 (the "Bonds") and to lend the proceeds thereof to
Wilmington Machinery Incorporated (the "Company") to finance
the costs of the acquisition, construction and installation of
an industrial facility for the manufacture of primary plastics
machinery in New Hanover County (the "Project") to be owned and
operated by the Company; and
WHEREAS, the Board has heretofore held a public
hearing, pursuant to public notice duly given, and has here-
tofore approved the Project in principle and the issuance of
revenue bonds to finance the Project; and
WHEREAS, the Act provides that no bonds shall be issued
thereunder unless the issuance thereof shall have been approved
by the governing body of the County and the Board desires to
approve the issuance of the Bonds by the Authority; and
WHEREAS, the Board has considered the financing
documents presented to it setting forth the terms of the
revenue bond financing; and
WHEREAS, the State of North Carolina has allocated to
the Authority for the Project $3,250,000 of the private
activity bonds volume limitation for the State of North
Carolina for the calendar year 1990 and an additional
allocation will be requested;

NOW THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of New Hanover as follows:
(1) The issuance of the Bonds in the principal amount
of up to but not more than $3,450,000.00 by the Authority is
subject to further approval. .
