APPROVING OFFER TO PURCHASE PROPERTY
The County Commissioners authorized the County Manager to make a
joint offer with the City of Wilmington to purchase the property
owned by W. K. Hobbs located at the intersection of Third and
Chestnut Streets, subject to certain terms and conditions.
The property owner has agreed to accept the total amount of
$326,000 for the property under the threat of condemnation.
The County Commissioners have determined that it is in the best
interest of the County to cooperate with the City in the purchase of
this property.
NOW, THEREFORE, BE IT RESOLVED BY THE NEW HANOVER COUNTY
COMMISSIONERS THAT:
1. The County Commissioners hereby approves the payment by the
County of the amount of $163,000 as one-half of the purchase price of
the above described property.
2. Such payment shall be subject to the execution of an interlocal
agreement with the City of Wilmington. The County hereby approves
the execution of an Interlocal Agreement with the City of Wilmington
for the purchase of said property.
3. The Chairman and Clerk to the Board are hereby authorized to
execute all necessary documents in connection with the purchase of
said property.
4. The County is further authorized to share equally in any closing
costs associated with the transfer of title including but not limited
to the cost of a title search, title insurance, taxes and fees.

WHEREAS, Health professionals rely on many people and
organizations to inform our residents of the latest
developments in battling disease and to furnish resources
for continued research, education and support services, and
WHEREAS, widespread publicity has focused the world's
attention on Acquired Immunodeficiency Syndrome, or AIDS.
AIDS has swiftly become a maj or health problem for our
nation and state. Until scientists develop a vaccine or
cure, education will remain the best way to prevent the
spread of the disease, and
WHEREAS, immediate programs of public information are
needed to educate people about how they can avoid
contracting AIDS, to dispel myths about casual transmission
of AIDS and to foster a reasoned and compassionate response
to this epidemic throughout North Carolina, and
WHEREAS, in order to supply our citizens with accurate
information about AIDS, the Department of Human Resources'
Division of Health Services along with local health
departments, hospitals and other health care agencies
throughout North Carolina must continue to conduct an
intensive campaign about AIDS, how AIDS is and is not
transmitted, how AIDS can be prevented and how to provide
comprehensive care to people afflicted with A1DS.
NOW, THEREFORE, the New Hanover County Board of
Commissioners does hereby proclaim October 1990 as
AIDS PREVENTION AND AWARENESS MONTH

NEW HANOVER, NORTH CAROLINA AMENDING THE
ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN,:
Section 1. That the Zoning Ordinance of the County of New
Hanover adopted October 6, 1969, as amended be and, the same is
hereby amended as follows:

Any ordinance or part of any ordinance in
conflict with this ordinance, to the extent of such conflict is

inhabi tants of' the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.

RESOLUTION PROPOSING ACCEPTANCE OF OFFERS TO PURCHASE
SURPLUS REAL PROPERTY
WHEREAS, certain parcels of real property owned by New Hanover County have
been offered for sale pursuant to N.C.G.S. 160A-269; and
WHEREAS, the offeror indicated on the attached list has agreed to pay the
amount indicated on the attached list for the parcel of real property shown; and
WHEREAS, the property is declared by the County Commissioners to be surplus
and not needed for public purposes; and

WHEREAS, it is in the best public interest and welfare to dispose of this
property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners propose to accept
the offer to purchase indicated on the attached list from the offeror as
indicated.
2. That the County of New Hanover and/or the City of Wilmington will retain any
deposit posted by an offeror when:
a. the offer is withdrawn after posting the deposit; or
b. the offeror fails to pay the balance of an approved offer, due in cash,
within ten (10) days of receipt of a notice by certified mail of
availability of the deed of conveyance.
3. That the County of New Hanover reserves the right to reject any and all
offers.
4. That the County of New Hanover will require the offeror to deposit five (5%)
percent of the offered prices immediately following adoption of this
resolution.

SALE OF SURPLUS PROPERTY
BY THE CITY OF WILMINGTON AND/OR NEW HANOVER COUNTY
By resolutions duly adopted by the City Council of the City of
Wilmington and the Board of Commissioners of New Hanover County, the City of
Wilmington and New Hanover County proposes to accept an offer to purchase a
certain parcel of real property located in New Hanover County owned by the
City of Wilmington and/or New Hanover County. The identification of the
offer is as follows:
TAX PARCEL NO: R0048-17-008-007.000
ADDRESS: 905 Grace Street
OFFEROR: Todd Toconis
AMOUNT OF OFFER: $750.00
The offer to purchase is subject to the following terms and conditions:
(1) That the offers are unconditional and may not be revoked.
(2) That the City of Wilmington and/or New Hanover County shall retain
as liquidated damages any deposit posted if any offeror fails to
pay the balance due in cash and secure the deed within 10 days of
notice by certified mail or if returned undelivered within 10 days
of the last attempted delivery.
(3) That all sales are subject to final approval by the City Council
of the City of Wilmington and/or the Board of Commissioners of New
Hanover County.
(4) That the use of the property and construction of any structures
improvements, changes or additions shall at all times comply with
all applicable federal, state or local laws, rules and
regulations.
The proposed sale of this property is being conducted pursuant to North
Carolina General Statute 160A-269 and is subject to upset bid. The public
will take notice that within ten days after publications of this
advertisement, any person may raise the bid by not less than 10% of the
first $1,000 and 5% of the remainder. Upset bids may be in writing and must
be delivered to the City Clerk, accompanied by a deposit of 5% of the total
increased bid. The deposit must be by cash, cashier's check, certified
check or bid bond. Upon receipt of an upset bid, the City Clerk shall
readvertise the offer at the increased bid and otherwise follow the
statutory procedures until no further qualifying upset bids are received.
When no further qualifying bids are received, the City Council and/or Board
of Commissioners may accept the offer and sell the property to the highest
bidder for cash.
The City Council of the City of Wilmington and/or the Board of
Commissioners of New Hanover County reserve the right to reject any and all
offers at any time. The proposed sale is made subject to the above
conditions together with all outstanding taxes, liens or other encumbrances,
if any; title shall be conveyed by bargain and sale deed without warranty;
and the property will be sold in its present condition "as is" without any
improvements by the City.

The city Council of the City of Wilmington and/or the Board of
Commissioners of New Hanover County intend to decide whether it will accept
or reject the highest offer within a reasonable time to to exceed thirty
days from the date of advertisement this is published. Any and all deposits
shall be forfeited if a bid is accepted by the City and then withdrawn by
the bidder.

County; and
WHEREAS, such a system will promote the health, safety, and
welfare of the citizens of New Hanover County.
THEREFORE, it further appearing that a public hearing was
held on the 1st day of October, 1990, at which time all persons
were heard on the question of whether or not assigning house
numbers would be in the public interest, and it further appearing
that notice of said hearing was prominently posted in at least
two (2) locations along said street, that notice of the time,
place and subject matter of the hearing was prominently posted at
the County Courthouse, and published in a newspaper of general
circulation in the County.
NOW, THEREFORE, it is ordained and decreed that the above
House Number Assignment be made.
It is further ordered that a copy of this ordinance be
transmitted to the postmaster having jurisdiction over the road,
to the Board of Transportation, Sheriff's 911 dispatcher and to
any city within five miles of said road in accordance with N.C.
General Statutes 153A-240.

WHEREAS, the month of October has been proclaimed
"National Disability Employment Awareness Month" by the
President; and
WHEREAS, the employment of persons with disabilities is
an investment in America's future; and
WHEREAS, there are many with persons 'in the County of
New Hanover who are qualified and capable of working; and
WHEREAS, many employers have been slow to employ such
persons, even though work~lace adjustments may be relatively
minor.
NOW, THEREFORE, the New Hanover County Board of
Commissioners hereby proclaims the month of October, 1990,

WHEREAS, after due advertisement, bids were received
and publicly opened by the Finance Department at 10:00 a.m.
on the 18th day of September, 1990, at the County
Administration Building, 320 Chestnut Street, Wilmington,
North Carolina, and the following bids were received for

AND WHEREAS, the Sheriff's Department, the Finance
Director and the County Manager recommend that the contract
be awarded to American Uniform Sales, Inc. of Fayetteville,
North Carolina, the lowest responsible bidder, in the amount
of Nineteen Thousand six Hundred Two Dollars and Twenty-five
Cents ($19,602.25);
AND WHEREAS, funds have been previously appropriated
and are now in or will be available in subsequent year's
budget in Account No. 110-431-4311-3000-4400 to cover this
contract for a period of one year;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the contract for
Uniforms for the Sheriff's Department, Bid # FIN 90-0315 be
awarded to American Uniform Sales, Inc. in the amount of
Nineteen Thousand Six Hundred Two Dollars and Twenty-five
Cents ($19,602.25); and that the County is hereby authorized
