Sincerely, RO~~ ~..} AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby amended as follows: I. Add 23-88 Collection Facility - Collection facilities are those centers and apparatus used as drop points for temporary storage of recyclable materials, such as metal, glass, plastics and/or newspapers. There are two types: Small Facility - A facility typically not over 500 square feet in size which may be a mobile unit or separate containers, such as igloos, or kiosks located on host lots. Large Facility - A facility that buys or accepts recyclable materials for the purpose of storage until enough has accumulated for shipment. The facility is usually larger than 500 square feet and occupies a single site. Add 23-89 Processing Facility - An enclosed facility or building that uses power-driven machinery to prepare recyclable materials for shipment. Machinery used in the processing of the materials includes shredders, balers, brickers and can compactors. Add 69.13 Recycling Facilities - The following site requirements shall apply to the location of small and large collection facilities and processing facilities as defined in Section 23. These locational requirements for recycling facilities are designed to: (1) Maintain aesthetic quality and visual character while reducing litter. (2) Promote the availability of recycling sites while promoting the sound conservation and re-use of valuable resources, (3) Establish a review procedure which ensures collection and processing facilities are designed to reduce land use conflicts and to promote harmony of development. 69.13-1 Permits - Before any collection and/or processing facility is established, a building permit shall first be obtained from the Director of Inspections for New Hanover County in accordance with the following criteria: , '.-- (1 ) Collection Facilities A small collection facility shall be permitted by right in the B-1, B-2, SC, A-I, PD, I-1 and I-2 Districts, subject to the district requirements and the following: (a' The facility may not exceed 500 squ~re feet in size. (b) The facility shall be limited to receiving only paper, glass, metal and plastic recyclable products. (c) The facility may be located on a host tract, provided it does not occupy needed parking of the principal use. (d) The facility shall be set back at least ten (10) feet from any street right-of-way and at least fifty (50) feet from all residentially zoned property. (e) No power-driven equipment i~ allowed. (f) Containers shall be constructed of durable, waterproof and rustproof materials. (g) No material storage outside the container is allowed. (h) Signs: The storage container may have an identification logo not exceeding 10 square feet. (i) At least one (1) parking space shall be designated for attendants. (j) The name, address, and phone number of the organization and/or persons responsible for pick-ups and maintenance of the facility shall be displayed on the container. (k) The facility shall not reduce the landscaping required for any concurrent use. (1' A site plan shall be submitted illustrating the above before a permit can be issued by the Inspections Department. (2) Large Collection Facilities - These facilities may be located in all industrial districts and the B-2 Business District subject to the district requirements and the following standards: (a) The facility may be larger than 500 square feet and on a separate property or tract of land. (b) The facility and its appurtenant uses shall not be located closer than one hundred (100) feet to any residentially zoned property. All landscaping shall be in accordance with Section 67 of this Ordinance. (c) All loading and outside storage shall be to the side and/or rear of the building. storage or loading conducted on the side of the building shall be screened from view from the adjacent right-of-way. All exterior storage shall be in containers or under shelters which are covered and secured. No outside storage shall be visible from the residentially zoned property. . '. (d) The facility may not operate between the hours of 7:00 p.m. and 7:00 a.m. when adjacent to residentially zoned property. (el A site plan illustrating the above shall be submitted before an occupancy permit is issued by the Inspections Department. (3) Processing Facilities - Processing Facilities may be permitted in the I-I and I-2 Industrial Districts, subject to the district requirements and the following: (a) The facility and its appurtenant uses shall not be located closer than one hundred and fifty (150) feet to any residentially zoned properties. (b) The facility shall meet the applicable setback requirements of Section 69.11 and landscaping requirements of Section 67. (c) Power-driven equipment is permitted. (d) All loading and exterior storage shall be to the side or rear of the building. Storage or loading conducted on the side of the building shall be screened from view from the adjacent right-of-way. All exterior storage shall be in containers or under shelters which are covered and secured. It shall not be visible to residentially zoned property. (e) The facility shall not emit dust, smoke fumes or vibrations detectable on adjacent properties. (f) A site plan shall be submitted illustrating the above items to the Inspections Department before a building permit is issued. STATE OF NORTH CAROLINA /' COUNTY OF NEW HANOVER BEFORE THE BOARD OF COUNTY COMMISSIONERS IN THE MATTER OF ASSIGNING STREET HOUSE NUMBERS ORDER It appearing' to the Board of County Commissioners of New Hanover County that consideration has been given to the assignment of house numbers on Truesdale Road, located from its intersection with Acorn Branch Road north to its termination with North Kerr Avenue, block range 2200 to 2300 and on Acorn Branch Road, located from its intersection with Old Wrightsboro Road east to its termination with the New Hanover County Airport, numerical range 2400-3100. WHEREAS, ready and accurate identification of developed property is important for the delivery of general County services, for the operation of commercial enterprises, for the response of emergency and public safety vehicles, and for the convenience of the general public; and WHEREAS, a comprehensive and systematic property numbering system is an efficient means of identifying property within the County; and WHEREAS, such a system will promote the health, safety, and welfare of the citizens of New Hanover County. THEREFORE, it further appearing that a public hearing was held on the 3rd day of January, 1989, at which time all persons were heard on the question of whether or not assigning house numbers would be in the pUblic interest, and it further appearing that notice of said hearing was prominently posted in at least two (2) locations along said street, that notice of the time, place and subject matter of the hearing was prominently posted at the County Courthouse, and published in a newspaper of general circulation in the County. NOW, THEREFORE, it is ordained and decreed that the above House Number Assignment be made. It is further ordered that a copy of this ordinance be transmitted to the postmaster having jurisdiction over the road, to the Board of Transportation, Sheriff's 911 dispatcher and to any city within five miles of said road in accordance with N.C. ~ r' General Statutes 153A-240. Adopted this the 3rd day of January, 1989. ~~an Attest: ~\/~ Cl to the Board RESOLUTION OF THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS WHEREAS New Hanover County's Policies for Growth and Development stipulate that adequate public, recreational and utility facilities will be provided and maintained in proportion to area needs ; and WHEREAS it is a function of local government to make available recreational opportunities and provide public utilities for all citizens and State policy has declared such opportunities a basic right of all residents; and WHEREAS various streets in New Hanover County have been offered for dedication to the public use by the recordation of a subdivision plat or other map; and WHEREAS N.C.G.S. ~153A-138 authorizes counties to acquire a fee or lesser interest in real property by gift, grant, or other lawful method; and WHEREAS New Hanover County desires to accept the offer of dedication of one such street or roadway for the public purpose of utilities and of providing recreational opportunities; NOW THEREFORE BE IT RESOLVED as follows: New Hanover County hereby accepts the offer of dedication to the public a portion of Rosemary Street (50 ft. right-of-way) running between Blossom Street and orange Street as shown on a map of Castle Hayne Subdivision recorded in Plat Book 59, Page 597, New Hanover County Registry. NOW, THEREFORE, BE IT RESOLVED that the County Attorney is authorized and directed to dispose of the HALL HOUSE at public auction, pursuant to N.C.G.S. 160A-270(b), according to the following terms and conditions: 1) Hall House, located at 6 South Ninth Street, Wilmington, N.C., is a wood-frame structure, consisting of 2,150 square feet, 42 feet wide by 36 feet deep (including porches). 2) This structure will be sold at public auction, at its present site 6 South Ninth Street, at 12 0' clock noon on Tuesday, January 17, 1989. 3) The successful bidder will be required to deposit 10% of the final bid with the County Finance Director on the day of sale and to pay the balance of the purchase price on or before February 1, 1989. 4) Buyer shall remove Hall House off and from its present site on or before but no later than March 15, 1989 and buyer must obtain Certificate of Appropriateness from Historic District Commission prior to moving the house. 5) Buyer shall to the best of his ability and as conditions permit preserve the historical and architectural integrity of the structure which was built in 1908.
