ORDINANCE

It appearing to the Board of County Commissioners of New
Hanover County that consideration has been given to the renaming
of Acorn Branch Crooked Road, located in Cape Fear Township
commencing with its intersection at Old Wrightsboro Road
extending east approximately 3/4 mile to its termination with the
New Hanover County Airport and recorded as part of Plat Book 22,
Page 11; and it further appearing that a public hearing was held
on Monday~ February 6, 1989, at which time all persons were heard
on the question of whether or not the renaming would be in the
public interest, and iJc further appearing t-hat notice of said
hearing was transmitted to all resident owners and prominently
posted in at least two (2) locations along said road, and
published in the Star News local newspaper, and the Board of
County commissioners-is --of the opinion that said road in New
Hanover County should be named and the naming of same is in the
public interest, the description of which is delineated on the
attached exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above
described road is hereby named Acorn Branch Road.
IT IS FURTHER ORDERED that a copy of this ordinance be
recorded in the office of the Register of Deeds of New Hanover
County, North Carolina, and that notice of the action taken by
the Board of county Commissioners be transmitted to the
postmaster having jurisdiction over the road, the North Carolina
Board of Transportation and to any city within five (5) miles of
said road in accordance with N.C. General Statute 153A-240.

REQUEST FOR ADDITION TO STATE MAINTAINED SECONDARY ROAD SYSTEM

Road Description: Silva Terra Drive in Silva Terra Subdivision (Div.
file #607-N)
WHEREAS, the attached petition has been filed 'with the Board of
County Commissioners of the County of New Hanover requesting that the
above described road, the location of which has been indicated in red
on the attached map, be added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that
the above described road should be added to the Secondary Road System,
if the road meets minimum standards and criteria established by the
Division of Highways of the Department of Transportation for the
addition of roads to the System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of
the County of New Hanover that the Division of Highways is hereby
requested to review the above described road, and to take over the road
for maintenance if it meets established standards and criteria.

WHEREAS, the New Hanover County Sheriff's Department
and Health Department's purpose is to ensure the Health and
safety of children in motor vehicles; and
WHEREAS, statistics prove that consistent seat belt and
safety seat usage will save children's lives and prevent
serious injuries,
NOW, THEREFORE, the New Hanover County Board of
Commissioners does hereby proclaim the week of February 12
through February 18, as
CHILD PASSENGER SAFETY AWARENESS WEEK
in New Hanover County, and encourage citizens to be aware of
the extreme importance of the use of seat belts and safety
seats for children in motor vehicles.

ADVANCING SICK LEAVE POLICY
1. ONLY sick leave will be advanced and will total no more than
twelve (12) days per request. No personal leave with be
advanced.
2. An employee may have no more than one (1) outstanding
promissory note; and may obtain approval of no more than two
(2) promissory notes per calendar year.
3. If less time is actually utilized by the employee, than the
amount of advanced leave approved on a promissory note, the.
note will be adjusted accordingly, upon the employee's
return to work.

Employees whose leave records show negative leave amounts,
and who have no approved promissory note on file, will not
be paid for the amount of negative leave.

5. An employee who has been employed with the County less than
six (6) months is not eligible for promissory leave.
6. All requests for advanced sick leave must be made and fully
approved prior to use of such leave, except in situations
deemed as emergency by the department head. If not, such
use will be treated as leave without pay.
7. A doctor's statement may be required for advanced leave, at
the discretion of the Department Head.
8 .
Upon termination of employment, all outstanding balances in
advance leave, will be handled as dictated within the
promissory note.

RESOLUTION ACCEPTING OFFER TO PURCHASE SURPLUS
REAL PROPERTY
WHEREAS, an offer to purchase a parcel of real property owned by New
Hanover County and the City of Wilmington has been advertised for upset bid
in compliance with North Carolina General Statute 160A-269 and pursuant to
resolutions adopted by the City Council of the City of Wilmington and the
Board of Commissioners of New Hanover County; and
WHEREAS, there has been no further qualifying upset bid entered for the
property described on the attached list within the statutory period allowed
by North Carolina General Statute 160A-269; and
WHEREAS, the offeror indicated on the attached list has agreed to pay
the amount indicated on the attached list for the parcel of real property
shown thereon; and
WHEREAS, the property is declared by the County Commissioners to be
surplus and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose of
this property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners do
hereby accept the offer to purchase as indicated on the attached
list from the offerors as indicated.
2. That New Hanover County will retain any deposit posted by offeror '
as liquidated damages if the offeror fails to pay the balance of
an approved offer due in cash within ten (10) days of receipt of a
notice by certified mail of availability of the deed of
conveyance.
3. That the Chairman of the Board of Commissioners of New Hanover
County be and is hereby authorized to execute a deed without
warranties to the offeror as designated on the attached list.

STREET HOUSE NUMBERS
ORDER
It appearing to the Board of County Commissioners of New
Hanover County that consideration has been given to the
assignment of house numbers on Rockhill Road, 1300 to 2600
numerical range; Old Wrightsboro Road, 2000 - 2700 range; and
Winter Park Road, 2000-2700 range; all located in Cape Fear
Township.
WHEREAS, ready and accurate identification of developed
property is important for the delivery of general County
services, for the operation of commercial enterprises, for the
response of emergency and pUblic safety vehicles, and for the
convenience of the general public; and
WHEREAS, a comprehensive and systematic property numbering
system is an efficient means of identifying property within the
County; and
WHEREAS, such a system will promote the health, safety, and
welfare of the citizens of New Hanover County.
THEREFORE, it further appearing that a public hearing was
held on the 6th day of February, 1989, at which time all persons
were heard on the question of whether or not assigning house
numbers would be in the public interest, and it further appearing
that notice of said hearing was prominently posted in at least
two (2) locations along said street, that notice of the time,
place and subject matter of the hearing was prominently posted at
the County Courthouse, and published in a newspaper of general
circulation in the County.

NOW, THEREFORE, it is ordained and decreed that the above
House Number Assignment be made.
It is further ordered that a copy of this ordinance be
transmitted to the postmaster having jurisdiction over the road,
to the Board of Transportation, Sheriff's 911 dispatcher and to
any city within five miles of said road in accordance with N.C.
General Statutes 153A-240.

WHEREAS, after due advertisement, bids were received and publicly
opened by Centralized Purchasing at 2:00 p.m. on the 4th day of
January, 1989, at 138 North Fourth Street, Wilmington, North Carolina, and
the following bids were received for Bid No: NHC 14-189 for Two (2) Ford
350 4 x 4 Cabs and Chassis:

AND WHEREAS, Centralized Purchasing, the New Hanover County Airport,
the Finance Director and the County Manager recommend that the contract be
awarded to Capital Ford, Inc., of Raleigh, N. C., the lowest responsible
bidder, in the amount of Twenty-Eight Thousand Fifty-Six Dollars and
Twenty-Eight Cents ($28,056.28);
AND WHEREAS, funds have been previously appropriated and are now in
Account No. 600-450-4530-06-5940 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
New Hanover County that the contract for Two (2) Ford 350 4 x 4 Cabs and
Chassis, Bid No: NHC 14-189, be awarded to Capital Ford, Inc., of
Raleigh, N. C., in the amount of Twenty-Eight Thousand Fifty-Six Dollars and
Twenty-Eight Cents ($28,056.28); and that the Chairman of the Board of
County Commissioners or the County Manager is hereby authorized and directed
to execute the contract on behalf of New Hanover County, contract form to be
approved by the County Attorney and bid deposit to be retained until the
successful bidder has executed and delivered the contract and, if required,
satisfactory bond.
BE IT FURTHER RESOLVED that the Purchasing Agent is hereby authorized
to return the bid deposits of the unsuccessful bidders.

OF THE
BOARD OF COUNTY COMMISSIONERS
OF
NEW HANOVER COUNTY

WHEREAS, after due advertisement, bids were received and publicly opefled
by Centralized Purchasing at 3:00 p.m. on the 5th day of January, 1989, at
138 North Fourth Street, Wilmington, North Carolina, and the following bids
were received for Bid No: 42-1288 for One (1) Tandem Axle Dump Truck:
Atlantic Mack
Tractor Trailer Truck Parts
and Equipment, Inc.
$62,958.00
49,921. 00
AND WHEREAS, Centralized Purchasing, the Engineering Department, the
Finance Director and the County Manager recommend that the contract be
awarded to Tractor Trailer Truck Parts and Equipment, Inc., Wilmington,
N. C., the lowest responsible bidder, in the amount of Forty-Nine Thousand
Nine Hundred Twenty-One Dollars and No Cents ($49,921.00);
AND WHEREAS, funds have been previously appropriated and are now in
Account No. 700-480-4192-6400 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
New Hanover County that the contract for One (1) Tandem Axle Dump Truck, Bid
No: 42-1288, be awarded to Tractor Trailer Truck Parts and Equipment, Inc.,
Wilmington, N. C., in the amount of Forty-Nine Thousand Nine Hundred
Twenty-One Dollars and No Cents ($49,921.00); and that the Chairman of the
Board of County Commissioners or the County Manager is hereby authorized and
directed to execute the contract on behalf of New Hanover County, contract
form to be approved by the County Attorney and bid deposit to be retained
until the successful bidder has executed and delivered the contract and, if
required, satisfactory bond.
BE IT FURTHER RESOLVED that the Purchasing Agent is hereby authorized to
return the bid deposits of the unsuccessful bidders.

AN ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORTH CAROLINA AMENDING THE
ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Zoning Ordinance of the County of New
Hanover adopted October 6, 1969, as amended be and the same is
hereby amended as follows:
Section 110
110-1
Amending the Ordinance and Zoning Map
The County Board of Commissioners may amend the text
regulations and zoning map according to the fOllowing
procedures:
(1) Incitation of Amendments - Proposed amendments may
be initiated by the County Commissioners, Planning
Board, Board of Adjustment, or by one (I) or more
interested parties.
(2) Application An application for any amendment
shall contain a description of the proposed zoning
regulation or district boundary to be applied.
Such application shall be filed with the Planning
Department not later than fifteen (15) working days
prior to the Planning Board meeting at which the
application is to be considered.
(3) Fees A fee to be established by the County
Commissioners shall be paid to the County of New
Hanover, North Carolina to cover necessary
administrative and advertising costs. (8/2/82)
(4) Property Owner Notices
(a) Whenever a zoning classification change is
proposed, the owner of the subject parcel and
all owners of land abutting that parcel as
shown on the county tax listing shall be
mailed a notice of the proposed classification
change by first class mail at the last address
listed for such owner on the county tax
abstracts. The person mailing such notices
shall certify to the Board of Commissioners of
that fact. Notices shall be mailed no later
than ten (10) days prior to the first
scheduled meeting.
(b) The letter shall contain adequate information
to notify such owners of the specific request
of the applicant as well as the time, date,
and location of the public hearing;
(c) A list of all affected owners and addresses
must accompany all such applications;

(d) Failure of any addressee of such letter of
notification to receive same shall not in any
way invalidate or affect subsequent action on
the petition for rezoning or application for
Special Use Permit. (6/19/78)
(f) A sign shall also be posted on the property to
indicate the time, date and place of public
hearing. The sign shall be posted no later
than ten (10) days prior to the first
scheduled meeting.
Section 111

Action by the Planning Board
Planning Board Consideration - The Planning Board
shall consider and make recommendations to the County
Commissioners concerning each proposed zoning amendment.
The Planning Board shall review any proposed amendment
at a regUlarly scheduled meeting held and advertised in
accordance with its Rules of Procedure then in effect.
In lieu of separate consideration, the Planning Board
may review an amendment in a j oint meeting with the
County Commissioners at a public hearing held in
conformity with the requirements of Section 112-1 of
this Ordinance. (6/4/79)

Action by the County Commissioners
Notice and Public Hearing - No amendment shall be
adopted by the County Commissioners until after public
notice and hearing. Notice of Public Hearing shall be
published once a week for two (2) successive calendar
weeks in the local newspapers. Public notice shall also
be posted on the property concerned indicating the time,
date, and place of public hearing and all adjoining
property owners shall be notified of the hearing as
outlined in Section 110-1 (4) above.
Amend Section 71(2) Adding. . . All adjoining property owners shall be
notified of the request as outlined in Section 110-1 (4) of this
ordinance.
Section 2.
Any ordinance or part of any ordinance in
conflict with this ordinance, to the extent of such conflict is
hereby repealed.
Section 3.
This ordinance is adopted in the interest of
public health, safety, morals, and general welfare of the
inhabi tants of the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.
