(~C BEFORE THE BOARD OF COUNTY COMMISSIONERS 1459 0255 COUNTY OF NEW HANOVER JUH 9 8 52 AM '89 IN THE MATTER OF RENAMING ACORN BRANCH CROOKED ROAD (SR 1370) ORDINANCE 5 It appearing to the Board of County Commissioners of New Hanover County that consideration has been given to the renaming of Acorn Branch Crooked Road, located in Cape Fear Township commencing with its intersection at Old Wrightsboro Road extending east approximately 3/4 mile to its termination with the New Hanover County Airport and recorded as part of Plat Book 22, Page 11; and it further appearing that a public hearing was held on Monday~ February 6, 1989, at which time all persons were heard on the question of whether or not the renaming would be in the public interest, and iJc further appearing t-hat notice of said hearing was transmitted to all resident owners and prominently posted in at least two (2) locations along said road, and published in the Star News local newspaper, and the Board of County commissioners-is --of the opinion that said road in New Hanover County should be named and the naming of same is in the public interest, the description of which is delineated on the attached exhibit. NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above described road is hereby named Acorn Branch Road. IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the office of the Register of Deeds of New Hanover County, North Carolina, and that notice of the action taken by the Board of county Commissioners be transmitted to the postmaster having jurisdiction over the road, the North Carolina Board of Transportation and to any city within five (5) miles of said road in accordance with N.C. J' , ROAD RENAMING From: Acorn Branch Crooked Rood To : Acom Branch Road Scale: III = 600' r / / / ,. ,< !..r NORTH CAROLINA STATE DEPARTMENT OF TRANSPORTATION REQUEST FOR ADDITION TO STATE MAINTAINED SECONDARY ROAD SYSTEM North Carolina County of New Hanover Road Description: Silva Terra Drive in Silva Terra Subdivision (Div. file #607-N) WHEREAS, the attached petition has been filed 'with the Board of County Commissioners of the County of New Hanover requesting that the above described road, the location of which has been indicated in red on the attached map, be added to the Secondary Road System; and WHEREAS, the Board of County Commissioners is of the opinion that the above described road should be added to the Secondary Road System, if the road meets minimum standards and criteria established by the Division of Highways of the Department of Transportation for the addition of roads to the System. NOW, THEREFORE, be it resolved by the Board of Commissioners of the County of New Hanover that the Division of Highways is hereby requested to review the above described road, and to take over the road for maintenance if it meets established standards and criteria. An employee may have no more than one (1) outstanding promissory note; and may obtain approval of no more than two (2) promissory notes per calendar year. 3. If less time is actually utilized by the employee, than the amount of advanced leave approved on a promissory note, the. note will be adjusted accordingly, upon the employee's return to work. 4 . Employees whose leave records show negative leave amounts, and who have no approved promissory note on file, will not be paid for the amount of negative leave. ,~~ 5. An employee who has been employed with the County less than six (6) months is not eligible for promissory leave. 6. All requests for advanced sick leave must be made and fully approved prior to use of such leave, except in situations deemed as emergency by the department head. If not, such use will be treated as leave without pay. 7. A doctor's statement may be required for advanced leave, at the discretion of the Department Head. 8 . Upon termination of employment, all outstanding balances in advance leave, will be handled as dictated within the promissory note. ~ . AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby amended as follows: Section 110 110-1 Amending the Ordinance and Zoning Map The County Board of Commissioners may amend the text regulations and zoning map according to the fOllowing procedures: (1) Incitation of Amendments - Proposed amendments may be initiated by the County Commissioners, Planning Board, Board of Adjustment, or by one (I) or more interested parties. (2) Application An application for any amendment shall contain a description of the proposed zoning regulation or district boundary to be applied. Such application shall be filed with the Planning Department not later than fifteen (15) working days prior to the Planning Board meeting at which the application is to be considered. (3) Fees A fee to be established by the County Commissioners shall be paid to the County of New Hanover, North Carolina to cover necessary administrative and advertising costs. (8/2/82) (4) Property Owner Notices (a) Whenever a zoning classification change is proposed, the owner of the subject parcel and all owners of land abutting that parcel as shown on the county tax listing shall be mailed a notice of the proposed classification change by first class mail at the last address listed for such owner on the county tax abstracts. The person mailing such notices shall certify to the Board of Commissioners of that fact. Notices shall be mailed no later than ten (10) days prior to the first scheduled meeting. (b) The letter shall contain adequate information to notify such owners of the specific request of the applicant as well as the time, date, and location of the public hearing; (c) A list of all affected owners and addresses must accompany all such applications; . . . . -- (d) Failure of any addressee of such letter of notification to receive same shall not in any way invalidate or affect subsequent action on the petition for rezoning or application for Special Use Permit. (6/19/78) (f) A sign shall also be posted on the property to indicate the time, date and place of public hearing. The sign shall be posted no later than ten (10) days prior to the first scheduled meeting. Section 111 111-1 Action by the Planning Board Planning Board Consideration - The Planning Board shall consider and make recommendations to the County Commissioners concerning each proposed zoning amendment. The Planning Board shall review any proposed amendment at a regUlarly scheduled meeting held and advertised in accordance with its Rules of Procedure then in effect. In lieu of separate consideration, the Planning Board may review an amendment in a j oint meeting with the County Commissioners at a public hearing held in conformity with the requirements of Section 112-1 of this Ordinance. (6/4/79) Section 112-1 112-1 Action by the County Commissioners Notice and Public Hearing - No amendment shall be adopted by the County Commissioners until after public notice and hearing. Notice of Public Hearing shall be published once a week for two (2) successive calendar weeks in the local newspapers. Public notice shall also be posted on the property concerned indicating the time, date, and place of public hearing and all adjoining property owners shall be notified of the hearing as outlined in Section 110-1 (4) above. Amend Section 71(2) Adding. . . All adjoining property owners shall be notified of the request as outlined in Section 110-1 (4) of this ordinance. Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general welfare of the inhabi tants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. 2 0' r' :.
