1989-05-15 RM Exhibits / 't', NEW HANOVER COUNTY BOARD OF COMMISSIONERS PROCLAMATION WHEREAS, hurricanes are common weather occurrences during August, September and October, endangering coastal New Hanover County, and WHEREAS, damages from Hurricane Diana in 1984 and Hurricane Gloria in 1985 totaled 74.2 million dollars, but were minor compared to Hurricane Hazel, the most destructive storm ever to hit the New Hanover County coast, WHEREAS, a hurricane safety awareness campaign has been developed in cooperation with the North Carolina Department of Crime Control and Public Safety's Division of Emergency Management, the Department of Administration's Division of Marine Affairs, the National Weather Service, and the New Hanover County Department of Emergency Services to help citizens acquire a knowledge of hurricane safety and preparedness guidelines. NOW, THEREFORE, the New Hanover County Board of Commissioners proclaims the week of June 4 through June 10, 1989 as HURRICANE AWARENESS WEEK in New Hanover County and encourages all citizens to assume personal responsibility by availing themselves of hurricane safety information and be prepared to protect property and save lives. '" ",,, ""H,,,I,I" ~fI;L Fred Retchin Chairman ~ I', l' -" '. , -'\ '. ~" I, RESOLUTION OF THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS ~ WHEREAS, 160A-461 authorizes inter local G.S. cooperation between units of local government; WHEREAS, New Hanover County owns certain property located at 1020 Rankin Street that formerly housed the Social Services Department; and WHEREAS, New Hanover County granted the City of Wilmington the right and option to purchase said property for housing for lower income residents of the City; and WHEREAS, the City desires that Wilmington Housing Finance and Development, Inc., undertake renovation of said property; and WHEREAS, a survey of said building reveals the presence of asbestos that should be removed prior to modification of said structure; NOW, THEREFORE, BE IT RESOLVED THAT: New Hanover County shall negotiate with the City of Wilmington regarding an inter local agreement whereby the City will provide up to Forty Nine Thousand ($49,000.00) Dollars to pay for costs of asbestos removal in the building at 1020 Rankin Street that formerly served as the New Hanover County Social Services Building. To assist the asbestos abatement, County will pay City a sum for asbestos removal, in an amount not to exceed Forty Nine Thousand ($49,000.00) Dollars. C. General Statute, Chapter 90, Article 5, in New Hanover County; and WHEREAS, major resources for law enforcement agencies in the battle against drug traffickers are the assets of traffickers which may be seized and forfeited under federal and state drug laws; and, WHEREAS, the constitution of North Carolina, Article IX, Section 7, provides that the proceeds of all penalties, forfeitures, and fines in the countiei for any breach of the penal laws of the State, shall be used exclusively for maintaining free public schools; and, WHEREAS, the federal government through current legislation has announced that as of October 1, 1989, its law enforcement agencies will no longer share the assets of forfeitures from drug prosecutions with states and local governments which do not appropriate such forfeitures to law enforcement agencies; and, WHEREAS, every county in North Carolina may lose a significant resource for drug investigations if amendments to the North Carolina Constitution and statues are not implemented. NOW, THEREFORE, BE IT RESOLVED by the New Hanover County Board of Commissioners that the local delegation to the North Carolina General Assembly is requested to consider the introduction and support of legislation to amend Article IX, Section 7 of the North Carolina Constitution to allow fines and forfeitures recovered under the North Carolina Controlled Substances Act and the N. BE IT FURTHER RESOLVED, the Board requests the local delegation to introduce and support legislation to amend North Carolina General Statute 90-95.1 and North Carolina General Statute 75D-5(j)(2), to provide for local law enforcement agencies to retain forfeitures and the proceeds from the sale of forfeitures of property for the benefit of the law enforcement agency in enforcing controlled substance statutes. BE IT FURTHER RESOLVED, that the Board requests any new legislation regarding controlled substances include a provision requiring the total forfeiture of all assets of a convicted drug trafficker, and that said legislation shall become effective upon ratification.
