All appropriations shal1 firstly be paid from revenues restricted as to use and secondly from general unrestricted revenues. Section 4. The Superintendent IS hereby authorized to transfer appropriations under the following conditions: - With respect to Local Current Expense, Capital Outlay, Food Service, Trust Fund and Pension Fund; a. He may transfer amounts between subfunctions and objects of expenditure within a function without limitations and without a report to the Board of Education being required. b. He may transfer amounts not to exceed $1,000 between functions of the same fund with a report on such transfers being required at the next meeting of this Board of Education. c. He may not transfer any amounts between funds nor from any contingency appropriation within a fund. - With respect to the State Public School Fund; a. He may transfer amounts within program report codes with a report to the Board. - With respect to the Federal Grants Fund; a. He may transfer amounts within program grants with a report to the Board. Section 5. Copies of the Budget Resolution shall be immediately furnished to the Superintendent and School Finance Officer for direction in carrying out their duties. J ,.. ~ IJ NORTH CAROLINA STATE DEPARTMENT OF TRANSPORTATION 'REQUEST FOR ADDITION TO STATE MAINTAINED SECONDARY ROAD SYSTEM North Carolina County of New Hanover Road Descr iption: A Portion of Sandybrook Road and Boon Road in Sandybrook Subdivision (Division File *621-N)) WHEREAS, the, attached petition has been filed with the Board of County Commissioners of the County of New Hanover requesting that the above described roads, the location of which has been indicated in red on the attached map, be added to the Secondary Road System; and WHEREAS, the Board of County Commissioners is of the opinion that the above described roads should be added to the Secondary Road System, if the roads meet minimum standards and criteria established by the Division of Highways of the Department of Transportation for the addition of roads to the System. NOW, THEREFORE, be it resolved by the Board of Commissioners of the County of New Hanover that toe Division of Highways is hereby requested to review the above described roads, and to take over the road for maintenance if they meet ,established standards and criteria. EXTRACTS FROM MINUTES OF BOARD OF COMMISSIONERS The Board of Commissioners of the County of New Hanover, North Carolina, met in regular session in the Old County Courthouse, Wilmington, North Carolina, the regular place of meeting at 9:00 o'clock, ~.M., on August 21, 1989. The following Commissioners were: PRESENT: Fred Retchin, Chairman, Jonathan Barfield, Sr., w. Albert Corbett, Jr., E. L. Mathews, Jr., and Nolan O'Neal ABSENT: None * * * * * The Chairman stated that The New Hanover County Industrial Facilities and Pollution Control Financing Authority (the "Authority") had adopted a bond resolution authorizing the issuance of refunding revenue bonds in the principal amount of $7,500,000 for Siemens Energy & Automation, Inc. (formerly Siemens-Allis, Inc.) and the execution and delivery of financing documents pertaining to the refunding of outstanding revenue bonds issued by the Authority in 1983 to finance industrial facilities in New Hanover County for Siemens-Allis, Inc. The Chairman then submitted to the Board drafts of an Indenture of Trust between the Authority and The First National Bank of Atlanta, as Trustee, a Loan Agreement between the Authority and Siemens Energy & Automation, Inc. and a form of Letter of Credit to be issued by Trust Company Bank. The Chairman further stated that the Authority proposed to issue and sell the refunding revenue bonds to one or more institutional investors at a price of 100% of the principal amount thereof and requested that the Board approve the issuance of the bonds. . , . Commissioner Corbett introduced the fol- lowing resolution which was read at length: WHEREAS, the Board of County Commissioners has created a political subdivision and body corporate and poli- tic of the state of North Carolina known as "The New Hanover County Industrial Facilities and Pollution Control Financing Authority" (the "Authority"); and WHEREAS, the Authority is authorized under the Industrial and Pollution Control Facilities Financing Act, Chapter 159C of the General Statutes of North Carolina, as amended (the "Act"), to issue revenue bonds for the purposes, among others, of paying all or any part of the cost of any industrial project for industry; to acquire, construct, improve and equip any such project; to issue refunding revenue bonds to refund outstanding revenue bonds of the Authority; and to make and execute financing agreements, security documents and other contracts and instruments necessary or convenient in the exercise of such powers; and WHEREAS, the Authority proposes to issue its revenue bonds in the principal amount of $7,500,000 (the "Bonds") and to lend the proceeds thereof to Siemens Energy & Automation, Inc. (formerly Siemens-Allis, Inc) (the "Company") to refund outstanding revenue bonds issued by the Authority in 1983 to finance a project for Siemens-Allis, Inc.; and WHEREAS, the Act provides that no bonds shall be issued thereunder unless the issuance thereof shall have been approved by the governing body of the County and the Board desires to approve the issuance of the Bonds by the Authority; and WHEREAS, the Board has considered the financing documents presented to it setting forth the terms of the revenue bond financing; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of New Hanover as follows: (1) The issuance of the Bonds in the principal amount of $7,500,000 by the Authority is hereby approved. (2) The Clerk of the Board of Commissioners is hereby authorized and directed to provide certified copies of this resolution to the Local Government Commission and to Bond Counsel.
