WHEREAS, New Hanover County is interested in providing
financial support to agencies that serve public purposes
including economic and physical development, .cultural and
recreational programs, human services, industrial promotion, and
public safety; and
WHEREAS, New. Hanover County is interested in providing
financial support to agencies that benefit the citizens of the
County.
NOW. THEREFORE, BE IT RESOLVED by the New Hanover County
Board of Commissioners:
That the Chairman of the New Hanover County Board of
Commissioners is authorized and directed to enter into contracts
wi th the following agencies to fund amounts as approved in the
fiscal year 1988-89 New Hanover County Budget.

WHEREAS. hUr:l:icanes are common weather occurrences during
August, September and October, endangering coastal New Hanover
County, and
WHEREAS, damages from Hurricane Diana in 1984 and Hurricane
Gloria in 1985 totaled 74.2 million dollars, but were minor
compared to Hurricane Hazel, the most destructive storm ever to
hit the New Hanover County coast,
WHEREAS, a hurricane safety awareness campaign has been
developed in cooperation with the North Carolina Department of
Crime Control and Public Safety's Division of Emergency
Management, the Department of Administration's Division of Marine
Affairs, the National Weather Service; and the New Hanover County
Department of Emergency Services to help citize~s acquire a
knowledge of hurricane safety and preparedness guidelines.
NOW, THEREFORE, the New Hanover County Board of
Commissioners proclaims the week of June 12 through June 18, 1988
as
HURRICANE AWARENESS WEEK
in New Hanover County and encourages all citizens to assume
personal responsibility by! availing themselves of hurricane
safety ,information and be prepared to protect property and save
lives. The News Media and other Public Service and Safety
Agencies are urged to participate in the "Awareness Week"
activities.

AN ORDINANCE
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
The Board of Commissioners of New Hanover County, in
order to promote the more orderly and efficient delivery of law
enforcement, fire and emergency services, does hereby ordain that
Chapter 14, "Roads and Other Public Ways" of the New Hanover
County Code of Ordinances, is hereby amended as follows:
Chapter 14 "Roads and Other Public Ways" is amended by
the addition of a new Article, as follows:
Article III. House Numbering Procedures and Display of
Official Numbers.

Sec. 14 . 25 Duty of Property OWner.
It shall be the
duty of the property owner, agent, or occupant of any house,
building or mobile home fronting on a road or private easement in
the unincorporated area of the County to properly display the
number which has been assigned by the New Hanover County Planning
Department (hereinafter referred to as Planning Department).
Such number shall be a minimum of three inches in height. The
property owner, agent or occupant of such house, building or
mobile home shall place such number on their house or building
and mailbox, if detached, so that it may be plainly seen and
observed from the adjacent road.
Sec. 14.26 Duty of Planning Department.
It shall be

general direction of the County Commissioners to prepare and
maintain road address numbering maps of the County, and when a
new house, building or mobile home is completed, or for any
reason a number is required, to issue such number upon the
request of the owner.
It shall be the duty of the Planning Department from
time to time and upon request to resolve conf licts in numbers,
assign and reassign numbers or propose any changes which in their
opinion are necessary and in accordance with N.C.G.S. ~153A-240.
Sec. 14.27 Maps Generally. In the preparation of maps
and in assignment of numbers, the Planning Department shall
follow the New Hanover County Numbering Procedures as established
below.
Sec. 14.28 Renumbering. When due to conflicts, change
in character or amount of occupancy of any block, it becomes
necessary to assign and reassign numbers within that block, the
Planning Department shall prepare a map for the proposed
renumber ing of such area and submit this map to the County
Commissioners for their approval in accordance with N.C.G.S.
~153A-240. Upon approval, it shall be the duty of the Planning
Department to assign approved numbers to the property owners and
occupants of each building involved. All structures shall be
considered officially numbered when completed in accordance with
the plans adopted by the County Commissioners.
Sec. 14.29 House Numbering Procedures. The reference
Street system for New-Hanover County is generally defined along a
north-south and east-west axis. The north-south reference street

is Market Street. East-west reference streets are highway 421
from the Pender County line to the City limits of Wilmington,
River Road from the City limits to Snow's Cut, and Dow Road from
Snow's Cut to Kure Beach.
Sec. 14 . 30 Methods as to East - West Streets. Each
street running west to east or substantially in that course
shall, for the purpose of numbering under this section, have its
beginning along a route as identified in Section 14.29, the
numbering to begin with the 100 block and increasing eastwardly
to a new block where new block begins at each new intersection or
every 800 feet not to exceed 1,000 feet, nor less than 300 feet
unless the distance between two intersecting streets is less than
300 feet.
Sec. 14.31 Methods as to North-South Streets. Each
street running north to south or substantially in that course
shall, for the purpose of numbering under this section, have its
beginning along a route as identified in Section 14.29, the north
and south side of Market Street, the numbering to begin with the
100 block and increasing north or south of said street.
Sec. 14.32 Location of Odd and Even Numbers. Even numbers
shall be placed on the right hand side of the street and odd
numbers on the left hand side of the street as dictated from the
reference streets identified in Section 14.29.
Sec. 14.33 Penalties.
(a) Violation of this article shall constitute a
misdemeanor. Any person convicted of violating this
article shall be punished by a fine not to exceed fifty

dollars ($50.00) or by imprisonment not to exceed
thirty (30) days. Each day during which a violation
continues shall be determined a separate and distinct
offense.
(b) In addition to the criminal penalties herein
provided, violations of this article may be endorsed by
the institution of proceedings in the form of a civil
action for equitable and injunctive relief to restrain
or prohibit the violation.
The proceeding shall be
brought in the Superior Court of New Hanover County.
The institution of any proceeding for equitable or
injunctive relief under this subsection shall not
relieve any party to such proceedings for any criminal
penalty prescribed for violations of any part of this
article.

Money!;' shall be' deposited into the official depository no
later than: 2:00 p.m. to ensure that the deposit will be credited
for that day. The deposits shall be made by the finance director
or by department officers or employees duly authorized to do so.
Any department officers or employees authorized to make'
deposits shall promptly forward. copies of deposit tickets to the
finance director for deposit verification. When the amount of
the deposit is in excess of $10;,000, notification is required to
be given to finance department by phone immediately when amount
of deposit is known.
Once the daily deposit reports have been_ received, the
finance director shall review the deposits and disbursements made
on that_ day to determine the amount of moneys available for in-
vestment. If. an investment shall be made, the finance director
will select and purchase that investment by 11: 00 a.m. the fol-
lowing' morning.

All moneys received by the County from the state shall be
wired through. theGover~erltal... Moneys Transfer System (GMTS) in
order to ensure-~-lmmedfate ~1nvestment of those moneys on the
transfer date. The finance director shall also maintain an
account with the North Carolina Cash Management Trust in order
for GMTS moneys to be wired into that account.
The County shall remain 100% invested at all times with the
exception of moneys held out for petty cash and change purposes.
(100% invested refers to actual investments as well as the use of
interest-bearing checking accounts.)
Investments
Eligible investments shall be limited to obligations allowed
by G.S'- 159-30. Repurchase agreements (repos) shall be permit-
t.ed, provided the seller of the repo transfers the underlying
securities to the County's custodian who shall place them in an
account in the name of the County. Repo agreements with less
than one day maturity (overnight) are not required to be placed
with the Courity's custodian. Reverse repos are not permitted.
Collateralization for deposits shall be in accordance with
Title 20, Chapter 7 of the North Carolina Administrative Code.
All deposits for the County shall be fully protected through
deposit insurance and eligible collateral securities pursuant to
20 NCAC 7. When utilizing. an Option 1, -the finance director
shall inunediately require additional collateral to be pledged

should the value of securities pledged for the. County's deposits:
fall to a level that is materially less than the amount of de-
posits. All escrow agreements for Option 1: financial institu-

For all_ deposits held in financial institutions which
utilize the Option 2 method of collateralization, the finance
director shall maintain all necessary documentation to show that
the responsibility of monitoring. collateralization levels is now
with the State Treasurer.
The finance director shall be- responsible for obtaining cus-
tody and providing safekeeping of securities and deposit certifi-
cates according to G.S.159-30(d). All securities to. be held'.
longer than one day, purchased by the County, shall be delivered
to the finance director or -the County I s custodian and placed in_
the County's custody account. The custodian agent will promptly
provide the County wi th a custody receipt. All such custodial
agreements shall. be between the County and the custodian.
Certificates of deposit with. a maturity greater than one
day, purchased by the County, shall be delivered to the finance
director or the County's custodian.
The finance director shall ensure proper diversification of
the investment portfolio in order to minimize risks brought on by
economic and market changes. To achieve this diversification:

The finance director shall constantly monitor the investment

securi ty, realize a gain from. the premium and invest in
other eligible investments. Conversely, if the market value
is significantly below the cost of the security, the finance
director should pursue measures to liquidate the security to
avoid further losses.

to the COUNTY all statements that may subsequently adversely
affect the BANK's financial condition.
(15) The occurrence of any of the following shall,constitute a
"BANK Default":
( a) I f the Repurchase, pr ice is not paid to the COUNTY on
the Repurchase Date as specified in paragraph 4;
(b) If the BANK shall fail with regard. to a term Repurchase
Agreement to remit a Margin Deficit as specified in
paragraph (12) above, and such default is not corrected
within one business day after notice;
(c) If the representations about the BANK's financial con-
dition made under paragraph 14 hereof were incorrect in
any material respect when made;
(d) If the BANK shall make .a general assignment for the
benefit of creditors; admit in writing its inability to
pay its debts as they become due; file a petition in
bankruptcy or a petition seeking any reorganization,
arrangement, composition, readjustment, liquidation,
dissolution or similar relief under any present or
future bankruptcy, reorganization, insolvency or
similar statute, law or regulation or seek the appoint-
ment of any trustee, receiver, custodian or liquidator
of the BANK or of all or substantially all of its
. properties;
(e) If a proceeding is commenced against the BANK seeking
relief or an appointment of a type described in para-
graph 15 (d) above and such proceeding is not dismissed
within 30 days after the commencement thereof; or
(f) If a. final judgment for the payment of money in. excess

REGULATIONS FOR PUBLIC USE OF THE.'
NEW HANOVER COUNTY COURTHOUSE ASSEMBLY ROOM'
1. The Assembly Room is. available for use by educational,
cultural, civic, and governmental groups to conduct meetings
or to hold such other functions deemed appropriate by the
County Manger.
2. The Assembly Room and adjacent public space shall not. be
used for any unlawful purpose. Persons using the room are
subject to all policies. and regulations regarding County
facilities.
3. An admission fee may only be charged by the group using the
room when such fees are of a non-profit nature or are for
short-term educational classes, institutes or forums.
4. Reservations for the room shall be arranged on a first-come,
first-serve basis. Standing reservations will not be
accepted. The Assembly Room capacity is 225 persons.
5. The fOllowing fees. will be charged for the u:;e of the room:
$50.00 utility fee_and $15.00Ihour (or any part thereof)

The room is available Monday through Friday from 8: 00 a.m.
until 10:00 p.m. Bookings for Saturdays, Sundays, and

not disrupt the use of the Courthouse by others.
8. The person or organization reserving the ~oom shall be

furnishing and. handling their own exhibits, audio-visual
equipment, and other supplies. The County does not accept
responsibility for any damage or theft to property brought
into the facility.
10. Only the serving of food and/or beverages is allowed in the
Assembly Room; no cooking or other food preparation is
permissible. Groups must provide their own equipment and
supplies and are responsible for clearing the area,
including disposal of garbage.
Smoking is not permitted in the Assembly Room or any other
room in the Courthouse.

NEW HANOVER COUNTY ADOPTED

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Mobile Home and Trailer Park Ordinance
of the County of New Hanover adopted March 2, 1970, as amended be
and the same is hereby amended as follows:
Add to Section V 5.4(1)
retained by the Planning Department. A final site
development plan for all or part of the approved preliminary plan
shall be submitted to the Planning Department within one (1) year
of the preliminary approval date. Otherwise, the preliminary
plan shall become void unless a written extension of time is
applied for prior to expiration. The Director may approve a
one-year extension of preliminary site development plans.

Section 2. Any ordinance or part of any ordinance in
conflict with this ordinance, to the extent of such conflict is
hereby repealed.
Section 3. This ordinance is adopted In the interest of
public health, safety, morals, and general welfare of the
inhabitants of the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.

It appearing to the Board of County Commissioners of New
Hanover County that consideration has been given to the
assignment of house numbers on Castle Hayne Road, located in Cape
Fear Township (map attached) , numerical range 1100-3000
respectively.
WHEREAS, ready and accurate identification of developed
property is important for the delivery of general County
services, for the operation of commercial enterprises, for the
response of emergency and public safety vehicles, and for the
convenience of the general public; and
WHEREAS, a comprehensive and systematic property nUmbering
system is an efficient means of identifying property within the
County; and
WHEREAS, such a system will promote the health, safety, and
welfare of the citizens of New Hanover County.
THEREFORE , it further appearing.that a public hearing was
held on the 2nd day of May, 1988, at which time all persons were
heard on the question of whether or not assigning house numbers
would be in the public interest, and it further appearing that
notice of said hearing was prominently posted in at least two (2)
locations along said street, that notice of the time, place and
subject matter of the hearing was prominently posted at the
County Courthouse, and published in a newspaper of general
circulation in the County.
NOW, THEREFORE, it is ordained and decreed that the above
House Number Assignment be made.
It is further ordered that a copy of this ordinance be
transmitted to the postmaster having jurisdiction over the road,
to the Board of Transportation, Sheriff's 911 dispatcher and to
any city within five miles of said road in accordance with N.C.
General Statutes 153A-240. .

EXTRACTS FROM MI}WTES OF BOARD OF COMMISSIONERS
The Board of Commissioners of the County of New
Hanover, North Carolina, met in regular session in the Assembly
Room, County Administration Building in Wilmington, North
Carolina, the regular place of meeting at 7:00 o'clock, P.M.,
on June 6, 1988. The following Commissioners were:

The Chairman stated that The New Hanover County
Industrial Facilities and Pollution Control Financing Authority
had amended its inducement agreement with Applied Analytical
Industries, Inc. to increase the principal amount of revenue
bonds for that company's project from $2,500,000 to $3,500,000
and that it was therefore necessary that the Board hold another
public hearing and reapprove the project. The Chairman then
stated that a notice had been published on May 21, 1988 that
the Board would hold a public hearing on June 6~1988 on the
proposed project and the issuance of revenue bonds to finance
the project.
Commissioner Retchin moved that the Board
proceed to hold a public hearing on the project and the
issuance of revenue bonds to finance the project. The motion
was seconded by Commissioner Barfield and was
unanimously adopted.
At 7:20 o'clock, R.M., the Chairman announced that
the Board would hear anyone who wished to be heard on the
advisability of the proposed project and the issuance of
revenue bonds to finance the project and that a representative
of the Authority was present and was prepared to discuss the
details concerning the proposed project and bond issue.
The names and addresses of the persons who were
present, summaries of their oral comments and copies of their
written comments are set forth below:
Wallace C. Murchison, Wilmington, North Carolina,
attorney for the New Hanover County Industrial Facilities
and Pollution Control Financing Authority, explained that on
March 9th a bond issue of $2,500,000 for Applied Analytical
Industries, Inc. had been approved in principle by the
County Commissioners, following a public hearing, that the
company had asked the bond Authority to increase the amount
of the bond issue to $3,500,000, that on May 16th the
Authority had approved the change, and that the matter was
back before the Commissioners for another public hearing.
Mr. Murchison introduced Mr. Scot Bannerman, Wilmington,
North Carolina, Controller of Applied Analytical Industries,
Inc. Mr. Bannerman said that the extension project at
1206 North 23rd Street had not changed, other than in size,
and that the company needed the additional $1,000,000 for
additional equipment for pharmaceutical manufacturing.
Mr. Corbett asked if all the money was for equipment.
Mr. Bannerman said that the issue was for additional
equipment, that the company was planning to finance the
additional equipment through conventional means and their
bank suggested getting it under the industrial revenue bond.
He added that the company's schedule for adding jobs in
Wilmington was ahead of schedule, that they had scheduled
about 31 more jobs this year and that they had already added
over 50 jobs since January 1st. Commissioners Corbett and
O'Neal asked for a brief explanation of the county's obliga-
tion or role. Mr. Murchison explained that the bond Authority
was created by the County Commissioners and has authority to
issue revenue bonds which are repaid not by taxes but by the
companies for whose benefit the bonds are issued, that the
bond interest is tax free under the Internal Revenue Code,
which produces lower bond interest rates, and that the
county is not obligated in any way to pay for the bonds and
the county's credit is not pledged for the bonds. Commissioner
Retchin said that the specific purpose of industrial revenue
bonds is to increase jobs in the community. Mr. Murchison
commented that the company in this case was purchasing and
renovating the building and buying equipment and all this

was part of the $3,500,000. Commissioner Corbett stated
that if this company or any others for which revenue bonds
were issued went broke, there would be no liability on the
part of the county. Mr. Murchison agreed and said that the
bonds in this instance would be secured by letter of credit
from NCNB National Bank. Chairman O'Neal asked if anyone in
the audience had a question or comment, but no one spoke up.

After the Board had heard all persons who requested to
be heard, Commissioner RArf;plrl moved that the public
hearing be closed. The motion was seconded by Commissioner
Retchin and was unanimously adopted.

WHEREAS, the Board of County Commissioners has created
a political subdivision and body corporate and politic of the
State of North Carolina known as "The New Hanover County
Industrial Facilities and Pollution Control Financing
Authority" (the "Authority"); and
WHEREAS, the Authority is authorized under the
Industrial and Pollution Control Facilities Financing Act,
Chapter 159C of the General Statutes of North Carolina, as
amended (the "Act"), to issue revenue bonds for the purpose,
among others, of paying all or any part of the cost of any
industrial project for industry, to acquire, construct and
equip any such project, and to make and execute financing
agreements, security documents and other contracts and
instruments necessary or convenient in the exercise of such
powers; and
WHEREAS, the Authority has determined to issue its
revenue bonds in the principal amount of not more than
$3,500,000 to pay all or a portion of the costs of the
acquisition, construction and installation of an industrial
facility in New Hanover County for the manufacture of liquid
and solid dosage forms of pharmaceutical products, including
the acquisition of an approximately 5-acre site and an
approximately 28,000 square foot building at 1206 North 23rd
Street in Wilmington, the construction of building renovations
and the acquisition and installation of machinery and equipment
(the "Project") to be owned and operated by Applied Analytical
Industries, Inc.; and
WHEREAS, the Authority intends to file an applicati~n
for approval of the Project with the Secretary of the
Department of Commerce (the "Department"), as required by the
Act; and
WHEREAS, the Department has, by regulation, provided
that no application for approval of a project will be
officially received until the elected board of county
commissioners of the county from which the application is made
has, by resolution after a public hearing, approved the issue
of revenue bonds and approved in principle the proposed project
and a certified copy of such resolution has been provided to
the Department; and

WHEREAS, the Board of County Commissioners, pursuant to
public notice duly given, has held a public hearing on the
advisability or the Project and the issuance of revenue bonds
to finance the Project and has considered the comments of
persons who requested to be heard; and
WHEREAS, in accordance with Executive Order 37 of the
Governor of the state of North Carolina pursuant to Section 146
of the Internal Revenue Code of 1986, the Authority has applied
on behalf of the Project for an allocation of the private
activity bonds volume limitation for the State of North
Carolina for the calendar year 1988 and the Authority and the
Board of County Commissioners understand that such allocation
may be used only for the Project and that, to the extent that
the face amount of the revenue bonds issued by the Authority to
finance the Project is less than said allocation, such excess
allocation shall revert to the State of North Carolina; and
~iHEREAS, the Board of County Commissioners desires to
approve the Project in principle and the issuance of revenue
bonds to finance the Project;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of New Hanover as follows:
(1) The Project is hereby approved in principle.

WHEREAS, the offerors, indicated on the attached list have agreed to pay the

1. That pursuant to N.C.G.S. 160A-269, the County Commissioners propose to
accept the offers to purchase indicated on the attached list from the offerors
as indicated.
2. That the County of New Hanover and/or the City of Wilmington will retain any
deposit posted by an offeror when:
a. the offer is withdrawn after posting the deposit; or
b. the offeror fails to pay the balance.'of an approved offer, due in cash,
within ten (10) days of receipt of a notice by certified mail of
availability of the deed of conveyance.
3. That the County of New Hanover reserves the right to reject any and all
offers.
4. That the County of New Hanover will require the offerors to deposit five (5%)
percent of the offered prices immediately following adoption of this
resolution.
5. That the Clerk of the Board of Commissioners will publish a notice of the
offers as required by N.C.G.S. 160A-269.

RESOLUTION ACCEPTING OFFER TO PURCHASE SURPLUS
REAL PROPERTY
WHEREAS, certain offers to purchase parcels of real property owned by
New Hanover .County and the City of Wilmington have been advertised for upset
bid in compliance with North Carolina General Statute 160A-269 and pursuant
to resolutions adopted by the City Council of the City of Wilmington and the
Board of Commissioners of New Hanover County; and
WHEREAS, there have been no further qualifying upset bids entered for
the property described on the attached list within the statutory period
allowed by North Carolina General Statute 160A-269; and
WHEREAS, the offerors indicated on the attached list have agreed to pay
the amount indicated on the attached list for those parcels of real property
shown thereon; and
WHEREAS, the property is declared by the County Commissioners to be
surplus and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose of
this property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners do
hereby accept the offers to purchase as indicated on the attached
list from those offerors as indisated.
2. That New Hanover County will retain any deposit posted by offeror
as liquidated damages if the offeror fails to pay the balance of
an approved offer due in cash within ten (10) days of receipt of a
notice by certified mail of availability of the deed of
conveyance.
3. That the Chairman of the Board of Commissioners of New Hanover
County be and is hereby authorized to execute a deed without
warranties to the offerors as designated on the attached list.

WHEREAS, at the request of local interests the U. S.
Army Corps of Engineers District, Wilmington was authorized
to investigate a beach erosion control project for Fort
Fisher, North Carolina in November 1976, and
WHEREAS, preliminary funding of the above project
allowed completion of the advanced engineering and design in
1982, and
WHEREAS, the said general design memorandum for the
above project recommended implementation of a beach erosion
control project for Fort Fisher in phases, and
WHEREAS, after having been advised
the project for construction in 1983,
Carolina has expressed no interest~ nor
taken to initiate said project, and
of the readiness of
the State of North
has any action been
WHEREAS, the beach erosion problem at Fort Fisher
continues to exist, seriously threatening this national
historical monument, and the North Carolina Aquarium
facility adjacent thereto, and
WHEREAS, if no positive action is taken in the
reasonably near future, under current regulations the
federal project could be de-authorized, thereby denying its
benefits to the people of North Carolina for the indefinite
future;
THEREFORE, NOW BE IT RESOLVED that the New Hanover
County Board of Commissioners requests that responsible
state and federal authorities initiate immediate actions to
facilitate the recommended and authorized beach erosion
control project for the national historical monument at Fort
Fisher, North Carolina. .

The wilmington/New Hanover County Port, Waterway and
Beach commission requested the County Commissioners to
reinitiate action for implementation of the authorized beach
erosion control project for the Fort Fisher Historical
Monument. After discussion of this request, the Board of
Commissioners unanimously adopted the enclosed resolution
requesting immediate action of appropriate authorities to
proceed with the proposed project recommended by the U. S.
Army Corps of Engineers and authorized by tpe U. S.
Congress.
The Fort Fisher Battleground and Park are well known
historical sites throughout the State and long-term
preservation of these areas is of utmost importance to New
Hanover County as well as the State of North Carolina. Your

2. In accordance with ds. 75A-15, the above-named local governing unit hereby recommends to the North Carolina Wildlife Resources
Commission the promulgation of special rules and regulations with reference to the safe and reasonable operation of vessels applicable
to the waters of .

3. Enclosed herewith are the following:
a. A certified copy of the resolution of the above-named governmental unit:
( I) requesting the special rules and regulations for the waters named in Item 2 and
(2) requesting fi.JII implementation of the Uniform \Vc1terway Marker System in all waters within the governmental unit(if this has
not previously been done) ,,- , $'
(3) stating that public notice was given of the intention to make application to the Wildlife Resources Commission;ror the
regulations which are being proposed. I
b. A draft of the proposed regulations. ,.
c. Two copies of a map of the waters concerned showing the exact location and type of each waterway marker which will be
necessary to the enforcement of the proposed regulations.
d. Two copies of a scale drawing of each type of watenyay marker so necessitated.

4. Each waterway marker required will comply in color, site, shape, and structural design with the Uniform \Vc1terway Marker System
and the supplementary standards for such markers adopted by the North Carolina Wildlife Resources Commission pursuant thereto.
No other waterway marker will be placed or allowed to' remain in waters in which the Uniform Waterway Marker System has been
fully implemented without approval of the Wildlife Resources Commission. .

5. It is understood that, if the regulations hereby recommended are promulgated by the North Carolina Wildlife Resources Commission,
placement of the waterway markers necessary to enforcement thereof must be approved by the United States Coast Guard and the
U.S. Army Corps of Engineers. The recommending g~rnmental unit agrees to submit applications for such approval, together with
necessary additional copies of maps and specification fawings, through the Wildlife Resources Commission.
6. If the special rules and regulations for the federal wate~s named in Item 2 above are promulgated by the North Carolina Wildlife
Resources Commission and placement of the necessary regulatory waterway markers is approved by the federal agencies, such
markers will be erected or installed within 1 n days after receipt of notification of the last such official action, and thereafter
maintained in good condition. (If erection or maintenance of the markers is to be by someone other than the governmental unit,
two copies of a memorandum giving full particulars asito the person to whom this duty will be d~legated is attached.) ..

BOARD OF COUNTY COMMISSIONERS
NEW HANOVER COUNTY
WHEREAS under authority of North Carolina General
Statutes section 75A-15(a) any subdivision of the State of North
Carolina may at any time, after public notice, make formal
application to ~he Wildlife Resources Commission for special
rules and regulations with reference to the safe and reasonable
operation of vessels on any water within its territorial limits,
and
WHEREAS New Hanover County has given public notice of
its intention to make formal application to the Wildlife
Resources Commission for special rules regulations with reference
to the safe and reasonable operation of vessels on the Northeast
Cape Fear River within the territorial limits of New Hanover
County, and for the implementation of the Uniform Waterway Marker
System in the waters of Northeast Cape Fear River at the site of
the Wildlife Boat Ramp east of Hwy 117 bridge at Castle Hayne
located in said County, the pertinent substance of which proposed
regulations is as follows:
Establish "No Wake Zone" at site of Wildlife Boat Ramp
east of Hwy 117 bridge on the southern bank of the
Northeast Cape Fear River at Castle Hayne, North
Carolina, with implementation of Waterway Markers.
BE IT FURTHER RESOLVED that the said Board of
Commissioners requests said Commission to promulgate regulations
fully implementing the Uniform Waterway Marker System in all of
these waters of the said County.
