EXTRACTS FROM MINUTES OF BOARD OF COMMISSIONERS
The Board of Commissioners of the County of New
Hanover, North Carolina, met in regular session in the General
Assembly Room, New Hanover County Courthouse, Wilmington, North
Carolina, the regular place of meeting at 7:00 o'clock, P.M.,
on October 3, 1988. The following commissioners were:
PRESENT: Nolan O'Neal, Chairman, Jonathan Barfield, Sr.,
W. Albert Corbett, Jr., Robert G. Greer and
Fred Retchin

A representative of The New Hanover County Industrial
Facilities and Pollution Control Financing Authority (the
"Authority") appeared before the Board and advised the Board
that the Authority had adopted a bond resolution authorizing
the issuance of revenue bonds in the principal amount of
$3,500,000 and the execution and delivery of financing
documents pertaining to the financing of industrial facilities
in New Hanover County for Applied Analytical, Inc. (the
"Company") .
The representative submitted to the Board drafts of an
Indenture of Trust between the Authority and Mellon Bank,
N.A., as Trustee, a Loan Agreement between the Authority and
the Company, a form of Letter of Credit to be issued by NCNB
National Bank of North Carolina and a Deed of Trust and
security Agreement. The representative further stated that

the Authority proposed to issue and sell the bonds to one or
more institutional investors at a price of 100% of the
principal amount thereof and requested that the Board approve
the issuance of the bonds.

WHEREAS, the Board of County Commissioners has created
a political subdivision and body corporate and politic of the
state of North Carolina known as "The New Hanover County
Industrial Facilities and Pollution Control Financing
Authority" (the "Authority"); and
WHEREAS, the Authority is authorized under the
Industrial and Pollution Control Facilities Financing Act,
Chapter 159C of the General statutes of North Carolina, as
amended (the "Act"), to issue revenue bonds for the purpose,
among others, of paying all or any part of the cost of any
industrial project for industry; to acquire, construct,
improve and equip any such project; and to make and execute
financing agreements, security documents and other contracts
and instruments necessary or convenient in the exercise of
such powers; and
WHEREAS, the Authority proposes to issue its revenue,
bonds in the principal amount of $3,500,000 (the "Bonds") and
to lend the proceeds thereof to Applied Analytical, Ipc. (the
"Company") to finance the costs of the acquisition, .
construction and installation of industrial facilities for the
manufacture of liquid and solid dosage forms of pharmaceutical
products in New Hanover County (the "Project") to be owned and
operated by the Company; and
WHEREAS, the Board has heretofore he~d a public
hearing, pursuant to public notice duly given, and has here-
tofore approved the Project in principle and the issuance of
revenue bonds to finance the Project; and
WHEREAS, the Act provides that no bonds shall be
issued thereunder unless the issuance thereof shall have been
approved by the governing body of the County and the Board
desires to approve the issuance of the Bonds by the Authority;
and

WHEREAS, the Board has considered the financing
documents presented to it setting forth the terms of the
revenue bond financing; and
WHEREAS, the State of North Carolina has allocated, or
will allocate, to the Authority for the Project $3,500,000 of
the private activity bonds volume limitation for the State of
North Carolina for the calendar year 1988;
NOW THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of New Hanover as follows:
(1) The issuance of the Bonds in the principal amount
of $3,500,000 by the Authority is hereby approved.
(2) The Clerk of the Board of Commissioners is hereby
authorized and directed to provide certified copies of this
resolution to the Local Government Commission and to Bond
Counsel.
(3) This resolution shall take effect immediately
upon its passage.

said meeting having been given as required by North Carolina
statutes, and minutes of said meeting have been duly recorded

minutes and of the whole thereof insofar as said minutes

Authority, the Company and Thornton, Farish & Gauntt (the

to the Bonds. The representative further stated that the
Authority proposed to sell the bonds to the Underwriter at a
price of 100% of the principal amount thereof plus accrued
interest and requested that the Board approve the issuance of
the bonds.

At 7:l5 o'clock, P.M., the Chairman announced that
the Board would hear anyone who wished to be heard on the
~dvisability of the proposed issuance of the refunding bonds
and the project and that a representative of the Authority was
present and was prepared to discuss the details concerning the
proposed bond issue.
The names and addresses of the persons who were
present, summaries of their oral comments and copies of their
written comments are set forth below:
Wallace C. Murchison, l6 North Fifth Avenue, Wilmington,
North Carolina 28401, attorney for the Authority, stated that in 1982-
the Authority issued two bond issues on behalf of Corning Glass Works
in connection with the expansion of its plant on College Road, one of
which was an industrial development issue and the other a pollution
control issue, that the bonds were to run until 2002, but after
October, 1988 they could be redeemed, that Corning had found that'
they could obtain a lower interest rate on a refunding bond issue,
that they asked the Authority to issue revenue refunding bonds in the
amount of $2,440,000 to cover pollution control bonds of the 1982
issue which will be coming due in the year 2002, that the revenue
refunding bonds will mature in the year 2004, and that the interest
rate is not known at the moment because the bonds will be sold
through an underwriter. Mr. Murchison explained that a public
hearing was required by the Internal Revenue Code, but it was a
hearing strictly on approval of issuance of the refunding bonds and
not on the project which had been completed many years ago.
Mr. Jack Boor, Manufacturing Controller of Corning Glass
Works, 310 North College Road, Wilmington, North Carolina 28405, said
that he agreed with the previous statements and would be glad to
answer questions. Mr. Corbett asked if the issue was done primarily
to save interest and Mr. Boor said this was true and that the esti-
mated savings was $300,000.
Mr. Corbett asked Mr. Murchison to state the county's
liability, if any. Mr. Murchison replied that New Hanover County did
not obligate itself for the revenue bonds issued by the Authority,
that the county's faith and credit was not involved, the buyers of
the bonds looking solely to payments by the industrial firm to the
local Authority, and that the bonds are not an obligation of New
Hanover County and do not involve tax dollars.
The Chairman asked if there were any other persons wishing
to be heard, but there were no others.

After the Board had heard all persons who requested to
be heard, Commissioner Barfield moved that the public hearing
be closed. The motion was seconded by Commissioner Corbett
and was unanimously adopted.

AN ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORTH CAROLINA AMENDING THE
ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN':
Section 1. That the Zoning Ordinance of the County of New
Hanover adopted October 6, 1969, as amended be and the same is
hereby amended as follows:
Add Section 69.12 Fire Hydrants
The construction or expansion of any commercial, office
and institutional or industrial project resulting in at least
25,000 square feet of floor space shall include adequate fire
protection through the provision of at least one fire hydrant,
provided the project has a water system meeting State
~equirements (Section .2101 Title 10 - Chapter laD NCAC) for fire
hydrants. These hydrants shall be conected with the water system
serving the project and shall be constructed to specifications
established by the County Fire Marshall cased on NFPA standards.
Section 2. Any ordinance or part of any ordinance in
conflict with this ordinance, to the extent of such conflict is
hereby repealed.
Section 3. This ordinance is adopted in the interest of
public health, safety, morals, and general welfare of the
inhabitants of the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.

AN ORDINANCE OF THE COUNTY OF

SUBDIVISION ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
CCTOBER 18, 196'5
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Subdivision Ordinance ,of the County of
New Hanover adopted October 18, 1965, as amended be and the same
is hereby amended as follows:
Ad Section 52-8 Fire Hydrants
The subdivider shall be responsib:le for providing adequate
fire protection for the subdivision through the provision cf fire
hydrants. These fire hydrants shall be constructed to
specifications established by the County Fire Marshall, based on
NFPA standards. Hydrants shall be required as follows:
(1) Subdivision with central water system
For any major subdivision served by central water system
meeting State requirements (Section .2101 Title 10 - Chapter
10D NCAC) for fire hydrants, the subdivider shall be
required to install a fire hydrant at the entrance to the
subdivision and additional hydrants equal either to the
total linear feet of roadway divided by 1000 or the total
number of lots/units divided by .1,0, whichever is greater.
These additional hydrants shall be spaced evenly through the
subdivision in order to px'ovide maximum f ire protection
coverage, as determined by ~he County Fire Marshall. In no
case shall a lot/unit be located more than 500 feet from a
hydrant.
(2) Subdivision with surface water bodies
For any major subdivision without an adequate central water
system, but either including or adj acent to an adequate
permanent surface water body, the subdivider shall be
required to do one of the following:
(a) Install a dry fire hydrant as close to the water source
as possible with the adequacy of the water source and
the location of the dr"( fire hydrant to be determined
by the County Fire Marshall; or
(b) Establish an easement or road to the water source
providing permanent a.tl-weather access that is adequate
for fire-fighting equipment and vehicles as determined
by the County Fire Marshall.

MOBILE HOf1E AND TRAVEL TRAILER PARK ORDINANCE
NEW HANOVER COUNTY ADOPTED
MARCH 2, 1970
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Mobile Home and Travel Trailer Park'
Ordinance of the County of New Hanover adopted March 2, 1970,- as
amended be and the same is hereby amended as follows:
Add Section 7.2(15)(a) Fire Hydrants
1.
Mobile home parks with central water systems
(a) For any mobile home park with three or more spaces
that is served by a public or private central
water system meeting State requirements (Section
.2101 Title 10 Chapter 10D (NCAC) for fire
hydrants, the developer shall be required to
install a fire hydrant at at the entrance to the
mobile home park.
(b) For any mobile home park with ten or more spaces
served by a central water system, meeting State
requirements (Section .2101 Title 10 - Chapter 10D
NCAC) for fire hydrants, the developer shall be
required to install additional hydrants equal to
the total linear feet of roadway divided by 1000
or to the total number of spaces divided b'( 40,
whichever is greater. These additional hydrants
shall be spaced evenly throughout the mobile home
park in order to provide maximum fire protection
coverage, as determined by the County Fire
{\Jarshall. In no case shall a space be located
more than 500 feet from a hydrant.

WHEREAS, the New Hcmover County Sheriff's Department
and Healtrl Department's pur.pose is to ensu:re the health and
safety of all motor vehicle occupants; and
WHEREAS, statistics prove that consistent seat belt
usage will save lives and prevent serious injuries, and
WHEREAS, North CaJ:olina mandates the use of seatbelts
by law;

ORDER
It appearing t,o the Board of County COHUllissioners of New Hanover
County that consideration has been given to the assignment of house
numbers on North College Road (NC132) commencing at the North College
(NC132)/Market Street (NC17) intersection extending north 6.8 miles to
its terminus with Castle Hayne Road. This area is located in Cape
Fear Township, with a numerical range of 100-5200. (See attached map.)
WHEREAS, ready and accurate identification of developed property
is important for the delivery of general County servi.ces, for the
operation of commercial enterprises, for the response of emergency and
public safety vehicles, and for the convenience of the general public;
and
WHEREAS, a comprehensive and systematic property numbering system
is an efficient means of identifying propel:ty within the County; and
WHEREAS, such a system will promote the health, safety, and
welfare of the citizens of New Hanover County.
THEREFORE, it further appearing that a public hearing was held on
the 3rd day of October, 1988, at which time all persons were heard on
th.e question of whether or not assigning house numbers would be in the
public interest, and it further appearing that notice of said hearing
was prominently posted in at least two (2) locations along said
street, that notice of the time, place and subject matter of the
hearing was prominently posted at the County Courthouse, and published
in a newspaper of general circulation in the County.
NOW, THEREFORE, it is ordained and decreed that the above House
Number Assignment be made.
It is further ordered that a co:?y of this ordinance be
transmi t'ted to the postmaster having jurisdiction over the road, to
the Board of Transportation, Sheriff's 911 dispatcher and to any city
within five miles of said road in accordance with N. C. General
Statutes 153A ~240.

REQUEST:
To dssign/reassign house and business numbers along Blue
Clay Road from the intersection of 23rd Street/Blue Clay Road
extending north 6.5 miles to its terminus with Holly Shelter
Road. This area is located in Cape Fear Township (See attached
map) .
ANALYSIS:
A field and research examination reveals that the
above-referenced road has a mixture of rural route and non-grid
numbering which is not consistent with the County's address
system. The assignment of house and business numbers to Blue
Clay Road will provide a sequential and accurate identification
for developed property. Deli very of general County services,
response of emergency and safety vehicles, and the convenience or
the general public depends on an accurate system of
identification. Approximately 115 property owners will be
affected. The effective date for this change will be
November 10, 1988.

It appearing to the Board of County Commissioners of New
Hanover County that consideration has been given to the naming of
a private drive (easement) to Shoemak~r Lane located In
Masonboro Township approximately 1,350 feet north of
Captain I s/Masonboro Loop Road intersection commencing from said
point east 3,600 feet to its terminus with the Intracoastal
Waterway and recorded as a portion of Map Book 6, Page 88 and it
further appearing that a public hearing was held on Monday,
October 3, 1988, at which time all persons were heard on the
question of whether or not the naming would be in the public
interest, and it further appearing that notice of said hearing
was transmitted to all resident owners and prominently posted in
at least two (2) locations along said road, and published in the
Star News local newspaper, and the Board of County Commissioners
is of the opinion that said road in New Hanover County should be
named and the naming of same is in the public interest, the
description of which is delineated on the attached exhibi~.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above
described road is hereby name~ Shoemaker Lane.
IT IS FURTHER ORDERED that a copy of this ordinance be
recorded in the office of the Register of Deeds of NevJ Hanover
County, North Carolina, and that notice of the action taken by
the Board of County Commissioners' be ,transmitted to the
postmaster having jurisdiction over the road, the North Carolina
Board of Transportation and to any city within five (5) miles of
said road in accordance with N.C. General Statute 153A ~240.

BOARD OF COl1MISSIONE:RS'
WHEREAS Nevi Hanover County's Policies for Growth and
Development
stipulate
that
adequate
public
recreational
facilities will be provided and maintained in proportion to area
needs; and
WHEREAS it is a function of local government to make
available recreational opportunities for all citizens and State
policy has declared such opportunities a basic right of all
resi.dents; and
WHEREAS various streets in New Hanover County have been
offered for dedication to the public use by the recordation of a
subdivision plat or other map; and
WHEREAS G.S. 153A-158 authorizes counties to acquire a
fee or lesser interest in real property I)y gift, grant, or other
lavJful method; and
WHEREAS New Hanover County desires to accept the offer
of dedica'tion of one such street or :roadway for the public
purpose of providing recreational opportunities;
NOW THEREFORE BE IT RESOLVED as follows:
New' Hanover County hereby accepts the offer of
dedication to the public of that certain old 15' roadway running
between Oleander Drive and Old Military Road as shown on a map of
Bradley Drive Subdivision recorded in Ma.p Book 8, Page 16, New
Hanover County Registry.

In the Matter of 'Closing
An Unnamed Road
ORDER'
It appearing to the Board of County Commissioners of New
Hanover County that a Resolution of Intent to close all of an
unnamed road was adopted by the County Commissioners on the 6th
day of September, 1988 and it further appearing that said
resolution called for a hearing to be held on the 3rd day of
October, 1988, at which time the County Commissioners would hear
complaints and comments of interested persons, and it further
appearing that notice of said hearing was published in the
Wilmington Star News Newspaper in accordance with the Road
Closing Ordinance of New Hanover County, and after conducting
such hearing the County Commissioners are of the opinion that all
of the unnamed road in the County of New Hanover should be closed
and are satisfied that the closing of same is not contrary to the
public interest, and that no individual owning property in the
vicinity of the roads will be deprived of reasonable means of
ingress and egress to his property by such closing: the legal
description of said road being as follows:
Being all of an unnamed road right-of-way fifteen
(15) feet wide in Harnett Township commencing 200 feet
southwest of the Bradley/Oleander Drive intersection
extending from that point 1,200 feet southeast to its
terminus with the western right-of-way of Old Military
~r~ ,Road and duly recorded as a portion of Bradley Drive
~i Subdivision, Plat Book 8, Page 16 of the New Hanover
County Registry.
NOW, THEREFORE, IT IS ORDERED AND DECREED that the above
described road be and the same is hereby closed. It is further
ORDERED that a copy of this order be filed in the Office of the
Register of Deeds of New Hanover County, North Carolina.
