HARRELL, Clerk of the Board of Commis- sioners of the County hereinafter described, DO HEREBY CERTIFY as follows: 1 A special . meeting of the Board of Commis- sioners of the County of New Hanover, located in the State of North Carolina, was duly held on January 26, 1987, proper notice of such meeting having been given as required by North Carolina statutes, and minutes of said meeting have been duly recorded in the Minute Book kept by me in accordance with law for the purpose of recording the minutes of said Board. 2. I have compared the attached extract with said minutes so recorded and said extract is a true copy of said minutes and of the whole thereof insofar as said minutes relate to matters referred to in said extract. 3. Said minutes correctly state the time when said meeting was convened and the place where such meeting was held and the members of said Board who attended said meeting. EXTRACTS FROM MINUTES BOARD OF COMMISSIONERS The Board of Commissioners of New Hanover County met in special session on Monday, January 26, 1987 at 9:00 o'clock a.m. in the Assembly Room, New Hanover County Administration Building, 320 Chestnut Street, Wilmington, North Carolina, with the following members present: Chairman Nolan O'Neal Vice Chairman John Dolan Commissioner W. Albert Corbett, Jr. Commissioner Jonathan Barfield, Sr. Commissioner Fred Retchin * * * * The Clerk of the Board of Commissioners reported to the Board of Commissioners that the bond order entitled, "BOND ORDER AUTHORIZING THE ISSUANCE OF $4,200,000 MUSEUM BONDS OF THE COUNTY OF NEW HANOVER", which had been introduced on January 19, 1987, had been published in a qualified newspaper on January 20th, 1987, with notice that the Board would hold a public hearing thereon on January 26, 1987. The Clerk also reported that the County's Finance Officer had filed in her office a statement of debt complying with the provisions of The Local Government Bond Act and such statement as filed showed the net indebtedness of the County to be 1.04 % of the appraised valuation of property in said County subject to taxation. Commissioner Corbett moved that the Board of commissioners proceed to hold a public hearing on the museum bond order. The motion was seconded byConmissioner Barfield and was unanimously adopted. At ll:03 o'clock, ~.M., the Chairman of the Board of Commissioners announced that the Board of Commis- sioners would hear anyone who wished to be heard on the ques- tions of the validity of the museum order and the advis- ability of issuing the bonds. At the direction of the Chair- man of the Board of Commissioners, the Clerk of the Board of Commissioners read said museum bond order and the published notice of hearing. After the Board of Commissioners had heard all persons who requested to be heard, Conmissioner Retchin moved that the public hearing be closed. The motion was seconded by Vice-Chairman Dolan and was unanimously adopted. Conmissioner Corbett moved that the Board of Commissioners adopt without change or amendment and direct the Clerk of the Board of Commissioners to publish as prescribed by The Local Government Bond Act the bond order entitled, 2 "BOND ORDER AUTHORIZING THE ISSUANCE OF $4,200,000 MUSEUM BONDS OF THE COUNTY OF NEW HANOVER", introduced at the meeting of the Board of commissioners held on January 19, 1987. The motion was seconded by Conmissioner Retchin and was adopted by the following vote: AYES: conmissioner Jonathan Barfield, Sr. Conmissioner W. Albert Corbett, Jr. Conmissioner Fred Retchin Vice-Chainran John Dolan Chainran Nolan O'Neal NAYS: moved the adop- tion of the following resolution which was read at length to Conmissioner Barfield the Board: WHEREAS, the Board of Commissioners of the County of New Hanover has adopted the bond order hereinafter described authorizing the issuance of $4,200,000 Museum Bonds and such bond order and the indebtedness to be incurred by the issuance of such bonds and the tax to be levied for the payment of such bonds should be submitted to the voters of the County of New Hanover for their approval or disapproval 3 in order to comply with the Constitution and laws of North Carolina; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of New Hanover, as follows: (1) The questions whether the qualified voters , of the County of New Hanover shall approve or disapprove (a) the indebtedness to be incurred by the issuance of the bonds of the Town authorized by said bond order, which indebtedness shall be secured by a pledge of the County's faith and credit, (b) the levy of a tax for the payment thereof, and (c) said bond order shall be submitted to the qualified voters of said County at an election to be held in said County on March 31, 1987. (2) The Clerk of the Board of Commissioners is hereby authorized and directed to publish a notice of said election which shall be in substantially the following form: 4 THE COUNTY OF NEW HANOVER. NORTH CAROLINA NOTICE OF SPECIAL BOND ELECTION NOTICE IS HEREBY GIVEN that a special bond election will be held in the County of New Hanover, North Carolina, on March 31, 1987, for the purpose of submitting to the qualified voters of said County the questions whether they shall approve or disapprove (1) the indebtedness to be incurred by the issuance of bonds of said County of the maximum principal amount of $4,200,000, which indebtedness shall be secured by a pledge of the County's faith and credit, and, (2) the levy of a tax for the payment of such bonds, and (3) the bond order entitled, "BOND ORDER AUTHORIZING THE ISSUANCE OF $4,200,000 MUSEUM BONDS OF THE COUNTY OF NEW HANOVER", adopted by the Board of Commissioners to authorize the issuance of said bonds and the levy of such tax. The $4,200,000 Museum Bonds are authorized to pay capital costs of improving the County Museum, including the renovation of existing museum facilities and construction of a new building, and including the acquisition of land and including the acquisition and installation of furnishings and equipment therefor. The ballots to be used at said election shall contain the words, "SHALL the order authorizing $4,200,000 of 5 bonds secured by a pledge of the faith and credit of the County of New Hanover to pay capital costs of improving the County Museum, including the renovation of existing museum facilities and construction of a new building, and including the acquisition of land and including the acquisition and installation of furnishings and equipment therefor, and a tax to be levied for the payment thereof, be approved?", with squares labelled "YES" and "NO" beneath or beside such words in which squares the voter may record his choice. In the event a majority of the qualified voters voting at said election vote to approve the order, the incurring of indebtedness and the levy of a tax related thereto, said bonds shall be issued and taxes shall be levied for the payment of such bonds. The polls for the election will open at the hour of 6:30 o'clock, A.M. and will close at the hour of 7:30 o'clock, P.M. The registration records for said election will be kept open at the office of the New Hanover County Board of Elections, at 320 Chestnut Street, in Wilmington, from 8:00 o'clock A.M., until 5:00 o'clock, P.M., each weekday, through March 2, 1987. Additionally, the Registrars and Judges of Election may register voters through March 2, 1987. The Registrars and Judges may be reached through the Board of Elections at the address set forth above. The last day of registration for the special election shall be March 2, 1987. Any qualified voter who (1) expects to be absent from the County during the entire period that the polls are open on said election day, or (2) because of sickness or other physical disability will be unable to be present at the polls to vote in person on said day, or (3) is incarcerated 9 and otherwise entitled to vote in said election or (4) is an employee of the New Hanover County Board of Elections and his assigned duties on the day of election will cause him to be unable to vote in person, may apply for an absentee ballot to be used in voting at said election. Information concerning the time and manner for applying for an absentee ballot, including the last day for making such application, can be obtained from the New Hanover County Board of Elections at the Board's office in Wilmington, North Carolina. "BOND ORDER AUTHORIZING THE ISSUANCE OF $4,200,000 MUSEUM BONDS OF THE COUNTY OF NEW HANOVER" WHEREAS, the Board of Commissioners of the County of New Hanover deems it advisable to make the improvements hereinafter described; and WHEREAS, the Board has caused to be filed with the Secretary of the Local Government Commission of North Carolina an application for commission approval of the bonds hereinafter described as required by The Local Finance Act, and the Secretary of the Local Government commission has notified the Board that the application has been filed and accepted for submission to the Local Government Commission; NOW, THEREFORE, BE IT ORDERED by the Commissioners of the County of New Hanover, as follows: Section 1. The Board of commissioners of the County of New Hanover has ascertained and hereby determines that it is necessary to improve the County museum, including the renovation of existing museum facilities and construction of a new building, and including the acquisition of land and including the acquisition and installation of furnishings and equipment therefor and to pay capital costs of such improvements. - 2 - section 2. In order to raise the money required to pay capital costs of providing the improvements as set forth above, in addition to any funds which may be made available for such purpose from any other sources, bonds of the County of New Hanover are hereby authorized and shall be issued pursuant to The Local Government Finance Act of North Carolina. The maximum aggregate principal amount of said bonds authorized by this bond order shall be $4,200,000. section 3. A tax sufficient to pay the principal of and interest on said bonds when due shall be annually levied and collected. section 4. A sworn statement of the County's debt has been filed with the Clerk of the Board of commissioners and is open to public inspection. Section 5. This bond order shall take effect when approved by the voters of the County at a referendum.
