SURPLUS REAL PROPERTY
WHEREAS, certain parcels of real property owned jointly by New Hanover County
and the City of Wilmington have been offered for sale pursuant to N.C.G.S.
160A-269; and
WHEREAS, the offerors indicated on the attached list have agreed to pay the
amounts indicated on the attached list for the parcels of real property shown; and
WHEREAS, the property is declared by the County Commissioners to be surplus
and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose of this
property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners propose to
accept the several offers to purchase indicated on the attached list from the
offerors as indicated.
2. That the County of New Hanover and/or the City of Wilmington will retain any
deposit posted by an offeror when:
a. the offer is withdrawn after posting the deposit; or
b. the offeror fails to pay the balance of an approved offer, due in cash,
within ten (10) days of receipt of a notice by certified mail of
availability of the deed of conveyance.
3. That the County of New Hanover reserves the right to reject any and all
offers.
4. That the County of New Hanover will require the offerors to deposit five (5%)
percent of the offered prices immediately following adoption of this
resolution.
5. That the Clerk of the Board of Commissioners will publish a notice of the
offers as required by N.C.G.S. 160A-269.

This letter is
to explain our understanding of the
arrangements
for the
services we are to perform for New Hanover County
with respect
to the
eight volunteer
fire departments located within and
funded by the
County
and their year
ended June 30, 1986, and their six
months ended
Decem-
ber 31, 1986.
We ask that you either confirm or amend that understand-
ing.
We will compile financial statements for the above mentioned periods
from the adjusted trial balances and other data furnished to us by fire
department employees. We will not audit or review such financial state-
ments. Our report on the June 30, 1986, financial statements is pres-
ently expected to read as follows:
"We have compiled the accompanying combined balance sheet of the
New Hanover County Fire Service District funded volunteer fire
departments as of June 30, 1986, and the related combined statement
of revenue and expense and changes in fund balance for the year
then ended in accordance with standards established by the American
Institute of Certified Public Accountants.
A compilation is limited to presenting in the form of combined fi-
nancial statements information that is the representation of the
fire departments. We have not audited or reviewed the accompanying
combined financial statements and, accordingly, do not express an
opinion or any other form of assurance on them.
Our report on the December 31, 1986, financial statements is presently
expected to read as follows:
"We have compiled the accompanying combined balance sheet of the
New Hanover County Fire Service District funded volunteer fire
departments as of December 31, 1986, and the related combined
statement of revenue and expense and changes in fund balance for
the six months then ended in accordance with standards established
by the American Institute of Certified Public Accountants.,

combined financial statements and, accordingly, do not express an
opinion or any other form of assurance on them."
We anticipate accompanying information will be provided to include indi-
vidual fire department budget versus actual comparisons.
We must emphasize that our engagements are not examinations made in ac-
cordance with generally accepted auditing standards for the purpose of
expressing opinions on the fairness of the financial statements mention-
ed above. Furthermore, the services that we will perform are not de-
signed and cannot be relied upon to disclose errors, irregularities in-
cluding defalcations or illegal acts, should any exist; however, we will
inform you of any such matters that come to our attention.
We direct your attention to the fact that fire department personnel have
the responsibility for the proper recording of the transactions in the
books of account, for the safeguarding of assets and for the substantial
accuracy of the financial statements which are the representations of
management.
We will render such accounting and bookkeeping assistance only as we
find necessary for the preparation of the aforementioned financial
statements or as may be arranged with you or your authorized employees.
We will try to initiate ideas or observations that we believe will help
achieve the objectives of the fire departments and the New Hanover
County Fire Service District. To this end, we will review the aeneral
procedures in effect at each fire department and report to you those op-
portunities for improved internal controls and operational efficiencies
we note.
The assistance to be supplied by fire department personnel in the prepa-
ration of schedules and analyses of accounts will be discussed and co-
ordinated through Cam McAbee and/or Allan Mozingo. Any assistance pro-
vided will assist us in achieving an efficient performance of our work.
Our fees are based on the time required by the individuals assigned to
the engagement, plus direct expenses. Individual hourly rates vary ac-
cording to the degree of responsibility involved and the skill required.
Interim billings will be submitted as services are rendered and as ex-
penses are incurred. For the purpose of this engagement, individual
hourly rates to be used will be as follows:

We will use County employees to assist us in compiling and processing
the financial statements as they are made available to us in an effort
to minimize the cost of our engagement.
We agree that our fees under these arrangements will not exceed $8,000
without prior permission from the County. We will keep the County ad-
vised on our progress on an ongoing basis.
We note that the County plans to utilize these combined reports in its
1987-88 budget preparation, and to that end, we will make every effort
to have the combined financial statements completed by March 31, 1987.
If you intend to publish or otherwise reproduce the financial statements
and make reference to our firm name, you agree to provide us with print-
ers' proofs or masters for our review and approval before printing. You
also agree to provide us with a copy of the final reproduced material
for our approval before it is distributed.
Julie Moore and I will be in charge of all the work we will perform for
you and it will be our responsibility to ensure that you receive good
service. We will call upon others in the firm for a second point of
view or specialized knowledge, as necessary.

Computers with Texas Instrument Laser Printers for use in the Register of
Deeds office.

AND WHEREAS, Centralized Purchasing, the Register of Deeds, the Finance
Director and the County Manager recommend that the contract be awarded to
Entre' Computer Center, Wilmington, N. C., the lowest responsible bidder, in
the amount of Twenty Six Thousand Seven Hundred Seventy Dollars and No Cents
($26,770.00);
AND WHEREAS, funds have been previously appropriated and are now in
Account No. 110-4180-6400 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
New Hanover County that the contract for Two (2) Computers with Printers,
Bid No: NHC 26-187, be awarded to Entre' Computer Center, in the amount of
Twenty Six Thousand Seven Hundred Seventy Dollars and No Cents ($26,770.00);
and that the Chairman of the Board of County Commissioners or the County
Manager is hereby authorized and directed to execute the contract on behalf
of New Hanover County, contract form to be approved by the -County Attorney
and bid deposit to be retained until the successful bidder has executed and
delivered the contract and, if required, satisfactory bond.
BE IT FURTHER RESOLVED that the Purchasing Agent is hereby authorized
to return to bid deposits of the unsuccessful bidders.

AN,ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORTH CAROLINA AMENDING THE
ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Zoning Ordinance of the County of New
Hanover adopted October 6, 1969, as amended be and the same is'
hereby amended as follows:
Section 69.4 High Density Development 2/16/87
Purpose: The purpose of this section is to encourage high
density development in Transition areas where adequate services
are available, provided that environmental impacts are minimized
and adequate open space is provided.
All High Density Developments shall comply with the following
requirements:
(1) Thoroughfare Requirements - The development shall have
direct access, as required in Section 69.9, to and from an
existing major or minor arterial, as indicated in the New
Hanover County Thoroughfare Classification Plan. All
interior drives shall be designed so as to provide adequate
access for emergency service vehicles.
(2) Buffer Strip - Buffer strips shall be required in accordance
with Section 67. (5/6/85)
(3) Site Capacity Standards
A. Purposes - Site capacity for any proposed high
density residential development is equal to the BASE
SITE AREA multiplied by the density factor. The
purpose of this section is to determine the extent to
which a site may be used given its locational and
physical characteristics.
B. Definition of BASE SITE AREA
1. Gross site area as determined by actual on site
survey of parcel ... acres.
2. Subtract land constituting paved roads (excluding
parking) and land within ultimate rights -of -way
of existing and proposed roads ... acres.
3. Subtract water bodies and other areas below mean
high water line, if tidally influenced, or below
mean water line, if non -tidally influenced
.• acres.
4. Subtract land used as open space in prior
residential developments acres.
5. Subtract land used for commercial, office and
institutional, and light industrial purposes in
the Planned Development District .. acres.

C. IMPROVED RECREATIONAL LAND and OPEN SPACE Requirements
1. The following minimum amounts of the BASE SITE
AREA shall be either OPEN SPACE or IMPROVED
RECREATIONAL LAND:

If the development shall consist of detached
single :family units on subdivided lots no less
than 6,000 square feet, however, the above
minimum amounts for OPEN SPACE or IMPROVED
RECEREATIONAL LAND may be reduced by one-half.
2. IMPROVED RECREATIONAL LAND Requirements -
IMPROVED RECREATIONAL LAND shall consist of
grassed and landscaped areas or areas occupied
by recreational activities. Recreational
activities may include, but are not limited to,
swimming pools, tennis courts, golf courses,
ballfields, basketball courts, soccer fields,
tot lots and community recreational buildings.
The amount of IMPROVED RECREATIONAL LAND shall
be equal to at least 15% of the BASE SITE AREA.
3. OPEN SPACE Requirements - The following additional
types of permanent OPEN SPACE shall be provided
and may be used to meet the minimum total amount
of OPEN SPACE required in Section 69.4(3)c(1):
(a) 100 year flood plains - The determination
of all flood plain boundaries shall be
based on areas of special flood hazard as
determined in Article I, Section 3 of the
County Flood Plain Management Regulations.
At least fifty percent (50%) of such areas
shall be permanent OPEN SPACE.
(b) Lake and pond shorelines - The shorelines
of lakes and ponds consist of the area
within 50 feet inland of the mean water
line. At least 25% of all such areas shall
be permanent OPEN SPACE.
(c) Waterfront shorelines - Waterfront shorelines
consist of the area within 75 feet inland,
of the mean high water mark of sounds,
estuaries or ocean. At least 25% of all -
such areas shall be permanent OPEN SPACE.
(d) Conservation Resource Areas - Conservation
resources consist of those important
environmental resources described in
Section 59.4-3. The minimum amounts that
shall remain conservation space shall be
calculated as described in Section 59.4-4.

(e) Other Areas - Other land areas shall be
designated OPEN SPACE as needed to satisfy
the minimum total required amounts specified
in Section 69.4(c)l.
(f) OPEN SPACE, with the exception of Conservation
Resource areas, may be improved and used.to
satisfy the requirements for IMPROVED
RECREATIONAL NEEDS.
(9) OPEN SPACE shall remain undivided and be
reserved and used in accordance with
Section 69.1.
D. Determination of site capacity
1. The maximum number of dwelling units that may be
built may be determined by multiplying the BASE
SITE AREA by the appropriate density factor from
the table below.

2. Each high density development shall be located
either totally or primarily in areas classified
Transition in the Wilmington - New Hanover
Land -Use Plan. In cases where a high density
development includes primarily Transition areas
than 2.5 unr is
per net tract acre in areas classified Conservation, Rural or
Resource -Protection in the Wilmington - New Hanover Land -Use
Plan, except under the following circumstances. If a development
encompasses Resource Protection or Rural areas, and Conservation
areas, then density may exceed 2.5 units per acre in the Resource
Protection or Rural area, provided the number of units in the
Conservation area is reduced by an equal amount. At no time shall
the overall density of the project exceed the limits specified in the
respective residential zoning districts.
AMEND Section 53.5 Planned Development District
53.5-2(2) Maximum Building Height The maximum building ... forty feet; except
that the maximum height for buildings located within the Transition
area defined by the 1986 Wilmington - New Hanover Land -Use Plan and
fronting along a minor or major arterial as indicated on the County's
Thoroughfare Classification Plan shall be eighty (80) feet.
(6) Maximum Densit
A.I. Allowable density ... gross site area. The residential density
factor of the PD district shall be five (5) dwelling units per
acre if the PD shall be located within the Transition area.
The residential density factor of the PD district shall be 2.9
dwelling units per base site acre if the PD shall be located
beyond the Transition areas
or Resource Protection in the Wilmington - New Hanover Land -Use
Plan. In cases where a Planned Development includes Rural or
Resource Protection areas, and Conservation areas, then density
may exceed 2.5 units per acre in the Resource Protection or
Rural area, provided the number of units in the Conservation
area is reduced by an equal amount.
C. Tf the Planned Development shall be located within the Transition
area, the residential density ....
(11) Thoroughfare Requirements - The development shall have direct
access, as required in Section 69.9, to and from an existing major
or minor arterial, as indicated in the New Hanover County Thoroughfare
Classification Plan. All interior drives shall be designed so as to
provide adequate access for emergency service vehicles.
AMEND Section 69.6 Sewage Treatment and Collection Systems
A..' Sewage disposal and collection facilities shall be approved by the
appropriate State or local health agency.
B. Private centralized sewage treatment systems shall be located only
in those districts in which the use they are serving is permitted.
However, private sewage treatment systems serving uses in more than
one district may be located in any of those use districts.
AMEND Section 69.2 Site Plans
(23) High Density Development plans shall show the calculations necessary
to determine the BASE SITE area as well as the types of OPEN SPACE
and IMPROVED RECREATIONAL LAND.

(5) In no case shall any part of a structure containing
dwelling units be located closer than 20 feet to any part
of another structure containing dwelling units nor 10 feet
to any adjoining property line.
(6) Parking shall be provided in accordance with Article VIII
of this Ordinance.
(7) A drainage plan (complying with the requirements set forth
by the County or appropriate local or State agency) shall
be submitted.
(8) Sewage disposal facilities shall be in accordance with
Section 69.6.
(9) This section may be used to subdivide land. When a
subdivision development is submitted under this Ordinance,
the approval of the site plan under this Ordinance shall
constitute the equivalent of preliminary plan approval
under the County Subdivision Regulations, and the applicant
shall not be required to submit a separate subdivision
application. However, final plats and fees shall be
submitted in accordance with the Subdivision Regulations.
(10) A site plan conforming to the requirements of Section 69.2
shall be submitted.
(11) A homeowners association meeting the requirements of
Section 69.3 shall be established. (3/22/82)
(12) Maximum allowable height for stuctures shall be 35 feet.
However, the maximum allowable height for piling supported
primary structures which are located in "Coastal High
Hazard Areas, V-Zones," as defined by Article 4-74 of the
New Hanover Code shall be 44 feet.
(13) Signs shall be in accordance with Article IX.
Section 69.9 Thoroughfare Requirements - These requirements shall apply to
Planned Developments and High Density developments:
A. Access to Thoroughfares - The property to be developed must have
direct access to and from an existing major or minor arterial
roadway, as indicated on the New Hanover County Thoroughfare
Classification Plan. The direct access requirement may be satisfied
as follows:
1. One or more property boundary lines is contiguous with and
utilizes access to and from said thoroughfare; or
2. The property is connected to said thoroughfare by a public
street designed and built to the specifications of "Residential
Collector Streets" as defined in N.C. Department of Transportation
Subdivision Construction Standards, or as thereafter amended.
This connecting street shall be designed to serve only traffic
originating from or going to the development, or other existinq
Planned Developments or High Density developments, or any
future residential development.
High Density Development (Permitted only within Transition areas)

Section 2. Any ordinance or part of any ordinance in
conflict with this ordinance, to the extent of such conflict is
hereby repealed.
Section 3. This ordinance is adopted in the interest of
public health, safety, morals, and general welfare of the
inhabitants of the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.

It appearing to the Board of County Commissioners of New
Hanover County that consideration has been given to the
assignment of house numbers on a portion of Middle Sound Loop
Road, (phase I) numerical range 100 - 2000; Anaca Point Road,
numerical range 7200 - 7500; Trinity Avenue, numerical range 2000
- 2099 and Sneeden Drive, numerical range 1900 - 1999; with said
roads being located off Middle Sound Loop Road (attached map).
WHEREAS, ready and accurate identification of developed
property is important for the delivery of general County
services, for the operation of commercial enterprises, for the
response of emergency and public safety vehicles, and for the
convenience of the general public; and
WHEREAS, a comprehensive and systematic property numbering
system is an efficient means of identifying property within the
County; and
WHEREAS, such a system will promote the health, safety, and
welfare of the citizens of New Hanover County.
THEREFORE, it further appearing that a public hearing was
held on the 16th day of February, 1987, at which time all persons
were heard on the question of whether or not assigning house
numbers would be in the public interest, and it further appearing
that notice of said hearing was prominently posted in at least
two (2) locations along said street, that notice of the time,
place and subject matter of the hearing was prominently posted at
the County Courthouse, and published in a newspaper of general
circulation in the County.
NOW, THEREFORE, it is ordained and decreed that the above
House Number Assignment be made.
It is further ordered that a copy of this ordinance be
transmitted to the postmaster having jurisdiction over the road,
to the Board of Transportation, Sheriff's 911 dispatcher and to
any city within five miles of said road in accordance with N. C.
General Statute 153A-240.

NEW HANOVER COUNTY
WHEREAS, New Hanover County is preparing to
construct a new cell, to receive solid waste, at the County
landfill site off Highway 421 North, and such construction
necessitates clearing and removal of timber from a thirty
(30) acre site at the landfill; and
WHEREAS, Sylvain Enterprises, Inc., P. O. Box 52,
Leland, North Carolina 28451 has made an offer to buy said
timber and to cut and remove it from the site; and
WHEREAS, New Hanover County is authorized by
N.C.G.S. 160A-266(b) to dispose of property by private
negotiation and sale with respect to property valued at less
than five thousand dollars.
NOW, THEREFORE, BE IT RESOLVED that the New
Hanover County, pursuant to N.C.G.S. Chapter 160A, Article
12, authorizes and directs C. Ed Hilton, Jr. to dispose
of the timber on the thirty acre site at the landfill on
Highway 421 North, by private sale to Sylvain Enterprises,
at a negotiated price.
