HomeMy WebLinkAbout1987-03-02 RM Exhibits RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, New Hanover County is preparing to perform certain work at Hugh McRae Park, which work requires the clearing and removal of timber from a designated portion of said park; and WHEREAS, Canal Wood Corporation of Lumberton, P. O. Box 33, Riegelwood,N. C. has made an offer to buy said timber and to cut and remove it from the site; and WHEREAS, New Hanover County is authorized by N. C. G. (;( /~ ~~Board of Commissioners County of Hevl Hanover Form SR-2 (7-77) PLEASE NOTE: Forward direct with request to the Division Engineer, Division of Highways ',_I I I / .~ " . ~, AN AMENDMENT TO RESOLUTION FOR ESTABLISHMENT OF POLICY AND PROCEDURES FOR APPOINTMENTS TO COUNTY BOARDS, COMMISSIONS, COMMITTEES OR AUTHORITIES WHEREAS, the New Hanover County Board of Commissioners, by Resolution~ on the twentieth day of June, 1983, amended the seventh day of October, 1985, established policy and procedures for appointments to County boards, commissions, committees and authorities; and WHEREAS, the Board of Commissioners desires consistent, regular attendance at all meetings of such boards and wishes to curb absenteeism on the part of its appointees; and WHEREAS, the Board of Commissioners intends to amend its present policy and procedures for appointments to its various boards to attain greater attendance at all meetings of such boards. NOW, THEREFORE, BE IT RESOLVED that Section 1. E) of the policy of New Hanover County governing the policy and procedures for appointment to various County boards be amended to include two additional paragraphs, as follows: "Three consecutive unexcused absences on the part of any appointee automatically constitutes resignation, on the part of the appointee, from such board, committee, commission or authority and constitutes automatic acceptance of such resignation of the appointee, by the Board of Commissioners. '='--= "'I" ~~ ','::s:!t; ...', ~ I} ~ AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New , Hanover adopted October 6, 1969, as amended be and the same is hereby amended as follows: Amend Section 53.5-2(6)(B)3,6 Planned Development Districts 3. Adequate public elementary school facilities shall be available to serve the PD District. The developer will be required to do one of the following two options: (a.) The developer may donate by gift deed land to the County Board of Education provided the following conditions are met. 1. The amount of land dedicated shall be equal to the following: acreage of land = (# of units in PO) x (,0217 Acres/Unit) 2. The value of the land donated shall be equal to or greater than the fee. The value of the land shall be determined either by its tax assessed market value or by a certified appraiser, who shall be chosen by the County and whose fee shall be paid by the developer. 3. The land to be donated must be evaluated and accepted by the Board of Education with regard to such criteria as location, access, physical characteristics, and size. In the event that land is not so donated and accepted, then section (b) applies. (b.) The developer may pay a fee to New Hanover County for the benefit of the County Board of Education equal to the tax assessed market value of the amount of land calculated in subsection (a) 1 above, for unimproved land in the PD site. 6. A fee shall be paid to New Hanover County for use by the Fire Department servicing the PD District. The Fire Service District Commission shall recommend the most appropriate use of the fee to provide adequate fire protection in the District. The fee shall be calculated as follows: Fee (# of units in the PO) (Ave. household size in Unlncorporated County) x x (Present total assessed property valuation in Unincorporated County) (Total population in Unincorporated County) x (Present Fire Service x 2 District tax rate) ":,,:;,.., ~ !,.. AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of ,New Hanover adopted October 6, 1969, as amended be and the same is hereby amended as follows: Amend Article II, Definitions, Section 23 by adding the fOllowing' . two subsections: 23-84 Sanitary Landfill - shall mean a facility for the disposal of solid waste on land in a sanitary manner according to all applicable North Carolina Solid Waste Management Rules. 23-85 Demolition-Landscape Landfill - shall mean a Sanitary Landfill that is limited to receiving stumps, limbs, leaves, concrete, brick, wood, uncontaminated earth or other solid wastes as approved by the N.C. Department of Human Resources, Solid and Hazardous Waste Branch. Amend Article VI, Supplementary District Regulations by adding a new Section 69.8 to read: 69.10 Demolition Landscape Landfills - A site plan for a proposed demolition landscape landfill shall be submitted to County Engineering and County Inspections for review and approval. The site plan shall be submitted in accordance with North Carolina Solid Waste Management Rules, Section .0500, adopted April 1, 1982 and as thereafter amended. 69.10-1 Purpose - The following regulations are designed to accommodate demolition - landscape landfills in order to: (1) Maintain the aesthetic quality, visual character and overall harmony of the area; (2) Promote the maint~nance of the area's environmental integrity and the overall health, safety, morals and welfare of the community by providing a review mechanism to ensure demolition-landscape landfills are designed and developed in compliance with local regulations as well as those set forth by the Department of Human Resources, Solid and Hazardous Waste Management Branch, 10 NCAC 10 G, as amended. 69.10-2 Applicability - Compliance with the provisions set forth below shall apply to all proposed landfill sites as defined in Section 23-85 of this Ordinance; except, that the disposal of on-site generated material in residential developments shall not be subject to the regulations herein. 69.10-4 Permits - In accordance with the Department of Human Resource Solid and Hazardous Waste Management Branch, 10 NCAC 10 G, the applicant shall obtain an approval letter from the Director of Inspections of New Hanover County having zoning authority over the area where the site is to be located. A letter of approval or denial shall be issued only after review of the site plan by the County Engineering and County Inspections Office. ~ 69.10-:-5 pecordation of Disposal Site - After obtaining all necessary permits, the owner/developer shall have prepared a legal description that would be sufficient as an instrument of conveyance of the property. This description, along with a site map and a certified copy of applicable permits shall be filed for recordation with the Register of Deeds. The documents shall be filed under the name of the owner and shall specifically state that the site was granted a permit, for disposal of demolition debris. 69.10-6 County Review - The developer/owner of the disposal site shall provide free and unobstructed access during normal operation hours to County officials charged with the administration of this Ordinance. 69.10-7 ~xisting Demolition Landscape Landfills All existing landfills that do not have a valid permit shall comply with these regulations immediately. Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption.
