RESO,LUTION ACCEPTING OFFER TO PURCHASE
REAL PROPERTY
SURPLUS
WHEREAS, certain offers to purchase parcels of real property owned by
New Hanover County and the City of Wilmington have been advertised for upset
bid in compliance with North Carolina General Statute 160A-269 and pursuant
to resolutions adopted by the City Council of the City of Wilmington and the
Board of Commissioners of New Hanover County; and
WHEREAS, there have been no further qualifying upset bids entered for
the property described on the attached list within the statutory period
allowed by North Carolina General Statute 160A-269; and
WHEREAS, the offerors indicated on the attached list have agreed to pay
the amount indicated on the attached list for those parcels of real property
shown thereon; and
WHEREAS, the property is declared by the County Commissioners to be
surplus and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose of
this property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners do
hereby accept the offers to purchase as indicated on the attached
list from those offerors as indicated.
2. That New Hanover County will retain any deposit posted by offeror
as liquidated damages if the offeror fails to pay the balance of
an approved offer due in cash within ten (10) days of receipt of a
notice by certified mail of availability of the deed of
conveyance.
3. That the Chairman of the Board of Commissioners of New Hanover
County be and is hereby authorized to execute a deed without
warranties to the offerors as designated on the attached list.

and the City of Wilmington have been offered for sale pursuant to N.C.G.S.
160A-269; and
WHEREAS, the offerors indicated on the attached list have agreed to pay the
prices indicated on the attached list for the parcels of real property shown; and
WHEREAS, the property is declared by the County Commissioners to be surplus
and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose of this
property in accordance with the negotiated terms and conditions.

NOW, THEREFORE, BE IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners propose to accept

2. That the County of New Hanover and/or the City of Wilmington will retain any

a. the offer is withdrawn after posting the deposit; or
b. the offeror fails to pay the balance of an approved offer, due in cash,
within ten (10) days of receipt of a notice by certified mail of
availability of the deed of conveyance.
3. That the County of New Hanover reserves the right to reject any and all
offers.
4. That the County of New Hanover will require the offerors to deposit five (5%)
percent of the offered prices immediately following adoption of this
resolution.
5. That the Clerk of the Board of Commissioners will publish a notice of the
offers as required by N.C.G.~. 160A-269.

ORDER
It appearing to the Board of County Commissioners of New
Hanover County that a Resolution of Intent to close a portion of
Jackson Street was adopted by the County Commissioners on the 6th

which time the County Commissioners would hear complaints and
comments of interested persons, and it further appearing that
notice of said hearing was published in the Wilmington Star News
Newspaper in accordance with the Road Closing Ordinance of New
Hanover County, and after conducting such hearing the County
Commissioners are of the opinion that a portion of Jackson Street
in the County of New ,Hanover should be closed and are satisfied
that the closing of same is not contrary to the public interest,
and that no individual owning property in the vicinity of the
roads will be deprived of reasonable means of ingress and egress
to his property by such closing: the legal description of said
road being as follows:
B~ing a portion of Jackson Street (50.foot right-of-way) in
Federal Point Township, commencing 200 feet northwest. from the
intersection wi th Set-c.ler-s Lane and extending northwest
approximately 500 feet to termination and properly referenced In
Map Book 4, Page 52 (Battle Ground P~rk) in the New Hanover
County Registry.
NOW, THEREFORE, IT IS ORDERED AND DECREED that the above
described road be and the same is hereby closed. It is further
ORDERED that a copy of this order be filed in the Office of the
Register of Deeds of New Hanover County, North Carolina.

T. 94-2 Outdoor Advertising Signs
(1) Purpose: Outdoor advertising signs are herein regulated for the purposes
of regulating excess signage, encou'raging the PQsitive economic
development of the County, preserving and improving tourism view~,
promoting the safety of the traveling public, protecting existing
property values in both residential and nonresidential areas, preventiDg
the overcrowding of land, and protecting the aesthetics of the County.

The regulations are designed to prevent their overconcentration, improper
p~cement, and excessive height, bulk, number and area. It is recognized
t~at, unlike on-premise identification signs which ate in actuality a
part of},a business, outdoor advertising is a separate and distinct use of
thepubiic thoroughfare. With a view to this distinction, outdoor
advertising signs are regulated differently from ori-premise signs.
(2) Design Regulations: Except for ordinary maintenance, poster panel
replacements, copy changes, or repair not involving structural, material,
or electrical changes, no outdoor advertising signs, or part thereof,
shall be erected, altered, constructed, changed, converted, reerected,
additionally illuminated, enlarged, or moved unless the e?tire outdoor
advertising sign and structure are brought into conformity with this
code.

(a) Area of outdoor advertising signs: No outdoor advertising sign
facing streets with fou~ (4) or more traffic lanes.may exceed one
hundred and fifty (150) .square feet; outdoor advertising signs
facing streets with fewer than four (4) traffic lanes may not exceed
seventy-five (75) square feet. The allowable sign area of signs
with equal size and shape for both double-faced (back-to-back) and
V-type signs is measured by computing the area of only one side of
the sign. Both sides of a double-faced or v-type sign shall be of
equal size. No point on either side shall be more than 15 feet from
the nearest point of the other side.

(b) Height: No outdoor advertising sign or part thereof, including
base, apron, supports, supporting structures, and trim, may exceed
thirty (30) feet in height. Rooftop outdoor advertising signs are
prohibited.
(c) Construction standards:

Each outdoor advertising sign shall comply with the applicable
setba~k requirements of the district in which it is located.
In no case, however, shall an outdoor advertising sign be
located less than ten (10) fe~t from any right-of-way or
property line.
Corner lots: No part of an outdoor advertising sign may be
located within a triangular area formed by the street
right-of-way lines and a line connecting them at points fifty
(50) feet from the right-of-way intersection.
Spacing of signs: No part of any outdoor advertising sign
shall be lo<(ated less than one thousand (1,000) feet from any
part of another outdoor advertising sign.
The backs of all outdoor adver~ising signs shall be painted in
a neutral color to blend with the surrounding area and to
prevent the reflection of car lights and sun light.

Sign messages which advertise a discontinU:~d activity or
a building or pre~ise shall ge~ remove8 wlt~rn sixty (60)
from the date the activity or~se was ter~in~ted. Signs
advertising ,events such as sho'ts, disp1,qys, festivals,
circuses, fairs, athletic contests, dan~es, fund drives,
elections, exhibits; meetings, conventi6iJs and the like ~hall
be removed within thirty (30) days after the date of
'termination of such event.
Outdoor advertising signs shall not b~~cofistructed within areas
designated under the Special Highway Overlay District (SHOD),
in accordance with Section 59.6.

Outdoor advertising signs and structures which comply with the
provisions of this Ordinance are permit~ed in 1-1, 1-2, and A-I
zoning districts provided the specific sign location is four
hundred (400) feet or more from any residential zoning
district, place of worship, public park, or school.
7.
All nonconforming outdoor advertising signs shall be
discontinued' 9r made conforming (amortized) within five and
one-half (5 1/2) years from the effective dpte of this section
unless explicitly prohibited by state statute. All outdoor
advertising signs which are made nonconfor~ing by an amendment
to this chapter, or to the official zoning map, or extension of
the areas in which this section is applicable shall be
discontinued or made conforming (amortiz~d) within five and
one-half (5 1/2) years after the date of;such amendment or
extension, unless explicitly proh~ited by state statute.

That the Zoning Ordinance of the courlty of New
Han&ver adopted October 6, 1969, as amended be and th~ same is
hereby amended as follows:
Amend Special Highway Overlay District as followS:
59.6-3 Applicability - It is hereby required that all

Section 2. Any ordinance or part of any ordinance in
conflict with this ordinance, to the extent of such conflict is
hereby repealed.
Section 3. This ordinance is adopted in the interest of
