WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the County of New Hanover requesting that the above de-
scribed road, the location of which has been indicated in red 9n the attached
map, be added, to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the
above described road should be added to the Secondary Road System, if the
road meets minimum standards and criteria established by the Division of
Highways of the Department of Transportation for the addition of roads to
the System.

NOW, THEREFORE, be it resolved by the Board of County Commissioners of
the County of New Hanover that the Division of Highways is hereby requested
to review the above described road, and to take over the road for maintenance
if it meets. established standards and criteria.

RESOLUTION PROPOSING ACCEPTANCE OF OFFERS TO PURCHASE
SURPLUS REAL PROPERTY
WHEREAS, certain parcels of real property owned jointly by New Hanover County
and the City of Wilmington have been offered for sale pursuant to N.C.G.S.
~60A-269; and
WHEREAS, the offerors indicated on the attached list have agreed to pay the
amounts indicated on the attached list for the parcels of real property shown; and
WHEREAS, the property is declared by the County Commissioners to be surplus
and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose of this
property in accordance with the negotiated terms and conditions.
NOW, THEREFORE, BE.IT RESOLVED:
1. That pursuant to N.C.G.S. 160A-269, the County Commissioners propose to
accept the offers to purchase indicated on the attached.1ist from the offerors
as indicated.
2. That the County of New Hanover and/or the City of Wilmington will retain any
deposit posted by an offeror when:
a. the offer is withdrawn after posting the deposit; or
b. the offeror fails to pay the balance of an approved offer, due in cash,
within ten (10) days of receipt of a notice by certified mail of
availability of the deed of conveyance.
3. That the County of New Hanover reserves the right to reject any and all
offers.
4. That the County of New Hanover will require the offerors to deposit five (5%)
percent of the offered prices immediately following adoption of this
resolution.
5. That the Clerk of the Board of Commissioners will publish a notice of the
offers as required by N.C.G.S. 160A-269.

Section 3. All appropriations shall firstly be paid from revenues restricted as to use and
secondly from general unrestricted revenues.
Section 4. The Superintendent is hereby authorized to transfer appropriations within a fund
under the following conditions:
a. He may transfer amounts between subfunctions and objects of expenditure within a
function without limitations, and without a report to the Board of Education being
required.
b. He may transfer amounts not to exceed $1,000 between functions of the same fund
with a report on' such transfers being required at the next meeting of this Board of
Education.

WHEREAS, a petition has been filed pursuant to G. S.
.153A-241, requesting the Board of Commissioners of New Hanover
County to close the following described public road:
Being a portion of Carl Street (SR 1801) in Harnett
Township, beginni~g at its intersection with the proposed
extension of Racine Drive extending northwest approximately 133
feet to termination and properly referenced as a part of Map Book
14, Page 40 of the New Hanover County Registry.
NOW, THEREFORE, BE IT RESOLVED, that this Board is
considering closing said road to public use, and that a public
hearing on this question will be held on the 5th day of October,
1987 at 7 o'clock p.m. in the Assembly Room of the County
Administration Building, 320 Chestnut Street, Wilmington, North
Carolina, at which time the Board will hear all interested
citizens and make a final determination as to whether the
unopened road shall be closed.

NEW
WHEREAS, G.S. Chapter 153A, Article 11 authorizes a
county to engage in fire protection activities; and
WHEREAS, G.S. 153A-235 authorizes a county to adopt
fire p~evention codes by reference;. and
WHEREAS, the Board of Commissioners desires, to adopt
that certain code known as NFPA 1 Fire Prevention Code, 1982
edition, which code has been approved by the State Building Code
Council; and
WHEREAS, the Board of Commissioners desires to make
minor local amendments to said code pertaining to appeals
procedures, penalties, definitions and permits; and
W~EREAS, G.S. 153A-234 authorizes a county to appoint a
fire marshal and employ persons as his or her assistants, and the
Board of Commissioners desires to set the duties for its
previously appointed fire marshal;
NOW, THEREFORE, BE IT ORDAINED by the Board of
Commissioners of New Hanover County, as follows:
~he ~ew Hanover County Code of Ordinances is amended by
deleting the existing Chapter 8, Article II entitled "Fire
Prevention Code" and replacing it with a new Chapter 8, Article
II entitled "E'ire Prevention Code and Fire Marshal" and reading
as follows:
ARTICLE II. FIRE PREVENTION CODE AND FIRE MARSHAL
Sec. 8-16 Title of Ordinance
This ordinance shall be known as the "New Hanover County
Fire Prevention Ordinance" or, in short form, the "Fire
Prevention Ordinance."
Sec. 8-17 Adoption of Ordinance
This ordinance adopts the 198.2 edition NFPA 1,
Fire Prevention Code of the National Fire Protection Association,
and its incorporated standards and codes as published in the
National Fire Prevention Code, save and except those portions
such as are hereinafter deleted, modified, or amended by Sections
8-20 through 8-25 of this ordinance. The same are adopted in
this ordinance by reference and incorporated as fully as if set
out at length herein. A copy of said NFPA 1 shall be available
for public in~pection at the offices of the Fire Marshal and the
Clerk to the Board of Commissioners.
Sec. 8-18 Purpose of this Ordinance
The purpose of this orqinance is to provide New Hanover
County with rules and regulations to improve public safety by
promoting the control of fire hazards; regulating the'
installation, use, and maintenance of equipment; regulating the,
use of structures, premises, and open areas; providing for the
abatement of fire hazards; establishing the responsibilities and
procedures for code enforcement; and setting forth the standards
for compliance and achievement of these objectives.

Sec. 8-19 Conflicts
The requirements of this ordinance are designed to maintain
the safety requirements of the State Building Code.
This
ordinance shall not be construed to add requirements to those
stated in the State Building Code, and where the Code and this
ordiria~ce conflict, the requirements of the Code shall prevail.
In accordanc~ with G.S. 142-140 and 143-141, only those decisions
and i~terpretations of local enforcement agencies relating to the
provisions of the State Building Code Council.
Sec. 8-20 Definitions
For the purposes of this article, whenever the following
words and phrases appear in NFPA 1, and applicable Appendices,
they shall be held to mean as follows:

corporation Counsel: County Attorney
* Fire Chief: Fire Marshal
Fire Department: Inspections Department
Municipality: County
*Does not apply to fire suppression.
Sec. 8-21 Duties of the Fire Marshal
The Fire Marshal shall have the duties and authority set
forth in NFPA 1, as amended by this ordinance, and in G.S. 153A-
234. Duties and authority shall include but are not limited to:
(a) Advising the Board on improvements in the fire-fighting
or fire prevention activities under the county's supervision or
control.

Coordinating fire prevention activities under the

(c) Assisting incorporated volunteer fire departments in
developing and improving their fire-fighting or fire prevention
capabilities.
(d) Haking fire prevention inspections, including the
periooic inspections and reports of school buildings required by
Chapter 115 and the inspections of day-care facilities required
by Chapter 110.
The Fire Marshal shall not make electrical
inspections unless he or she is qualified to do so under G.S.
153A-351.
Sec. 8-22 Permits
The ~'ire Marshal shall not be required to issue permits.
Consequently, the following sections of NFPA 1 are deleted: 1-4.4
and 1. 7 .
Sec. 8-23 Appeals
.A thr~e-member panel, composed of Fire Commissioners
appointed by the Chairman'of the Board of Fire Commissioners
under such procedures as may be set by said Board, shall hear and
decide appeals from and review. any order, requirement, decision
or determination made by the Fire Marshal. Appeals shall be
taken within thirty (30) days of the date of the Pire Marshal's
decision, and shall be accomplished by filing a "Notice of
Appeal" with the f'ire Marshal. The Fire Marshal may establish
reasonable fees to compensate the County for appeal costs. 'l'he

filing of the appeal shall not stay any action taken by the Fire
Marshal, and the Fire Marshal's decision shall remain in effect
and shall be binding on the appellant until said decision is
modified or reversed on appeal.
Sec. 8-24 NF'PA 1 Annex and Appendices
NFPA 1 Annex A, and Appendices Band E are adopted by
reference and incorporated into this ordinance as fully ~s if set
,
out at length herein~ provided that NFPA 101 shall be deleted
from Annex A, and NFPA 704 ("Placarding System for Hazardous
Materials Identification") shall be added to Annex A.
Sec. 8-25 Enforcement and Penalties
As provided in Section 1-15 of this Code, violations of this
article may be enforced by anyone or more of the remedies
authorized by G.S. 153A-123, including but not limited to the
. following:
(a) 'l'he F'ire Marshal may issue a citation which subj ects
the offender to a civil penalty of $50.00 to be recovered by the
County in a civil action in the nature of debt if the offender
does not pay the penalty within 20 days after being cited for a
violation.
(b) A misdemeanor warrant may be issued either immediately
or upon the issuance of a citation and the violator's failure to
pay the same.
(c) A civil action seeking an injunction ana order of
abatement may be commenced against the violator. Each day's

continuing violation of this ordinance is a separate and distinct

Change Order Report #2

In accordance with authorization granted to the County
Manager by the Board of Commissioners on July 7, 1987, the
following change orders have been approved since the last
report:
Airport
All Span Building Systems is doing repair/construction
improvements to the Piedmont Air Cargo Building. Work on
the gutter system is required that was not a part of the
original scope of services. The total change is $1,076.00.
Sewer
Three additional domestic wells were required to be drilled
due to relative locations of existing private wells to our
sewer lines. Certain horizontal distances are required
between domestic wells and sewer lines. Total change order
is $2,741.00 to Dale Todd Well Drilling.
Change Order #1 to R. H. Moore for $11,700 is for payment of
concrete pipe piers where standard installation could not
work in wetland areas plus the pipe line had to be shifted
along Oleander Drive to avoid a conflict with several trees.

Change Order #3 for T. A. Loving is
$175,925.55. This is for Areas 2B and 3
quantities except for meters and electrical.

Change Order #3 for Cape Fear Electric Company in Area 1 for
the amount of $778.00 to relocate CP&L electric meters
outside of our secured pump station enclosures as per
request by CP&L.
Change Order #3 for Dellinger, Inc. in Area 1 provides a
credit of $4,913.00 for the deletion of pavement and fencing
at pump stations where not necessary and consistent with
surrounding roads and station location.
Change Order #2 for T. A. Loving in Area 1 provides a net
credit of $745,777.87 based on final installed quantities to
date except for meters.
