NORTH CAROLINA STAlE DEPARTMENT OF TRANSPORTATION REQUEST FOR ADDITION TO STATE MAINTAINED SECONDARY ROAD SYSTEM North Carolina County of New Hanover Road Description Banbury Land and Gregory Road Windemere SUbdivislon, Section 10 (Division File #568-N) WHEREAS, the attached petition has been filed with the Board of County Commissioners of the County of New Hanover requesting that the above de- scribed road, the location of which has been indicated in red on the attached map, be added to the Secondary Road System; and WHEREAS, the Board of County Commissioners is of the opinion that the above described road should be added to the Secondary Road System, if the road meets minimum standards and criteria established by the Division of Highways of the Department of Transportation for the addition of roads to the System. . NOW, THEREFORE, be it resolved by the Board of County Commissioners of the County of New Hanover that the Division of Highways is hereby requested . to review the above described road, and to take over the road for maintenance if it meets established standards and criteria. . Nfw ){UUOUef QIllUll}Jj 1Bnarll nf QLnululil1l1 inut'ra mf5ulutifl'H WHEREAS, in North Carolina the Lead Regional Organizations, as voluntary organizations serving municipal and county governments, have est~blished productive working relationships with the cities and counties across this state~ and WHEREAS, many counties and cities need assistance in pursuing economic and community development opportunities, but federal assistance in the form of intergovernmental revenues has been severely curtailed in recent years~ and WHEREAS, the 1987 General Assembly recognized this need through the appropriation of $990,000 to help the Lead Regional Organizations assist local governments with grant applications, economic development, community development, and to support local industrial development activities and other activities as deemed appropriate by their local governments~ and WHEREAS, these funds are not intended to be used for payment of member dues or assessments to a Lead Regional organization or to supplant funds appropriated by the member governments~ and WHEREAS, in the event that a request is not made by the County of New Hanover for release of these funds to our regional Council, the available funds will revert to the state's General Fund~ and WHEREAS, in Region "0" funds in the amount of $55,000 will be used for economic and community development planning and grants administration, regional data center activitie~, local technical assistance, and other functions approved by our Executive Committee, ,.. The allocation was divided equally among the 18 organizations, each receiving $55,000. The 1987 session of the State Legislature approved continuation of the funding for two additional years at the same level (HB 1515 - Appropriations to Non State Entities). Recommended continuation of funding was also included in the Governor's budg~t proposal. Legislation continues to carry the stipulation that the $55,000 allocation be apportioned to each local government within the jurisdiction at a level based on its percentage of the region's total estimated population. The money cannot be utilized by the local unit of government except to authorize its use by resolution to the regional entity for approved purposes. The local government cannot use the funds for other purposes. If the required resolution is not passed by a local unit of government, that portion reverts to the state's general fund. Attached please find a sample resolution that contains the required language including the sum allocated for approval by your unit of local government. Please transfer the language to your local format, present the resolution to your board for approval, and return an original copy to the COG office. Action at the next regular meeting of your board will be greatly appreciated. Please be reminded that the adopted resolution requires two signatures (one being the, chief elected official present) and the other being that of another~ board member. To be certified by the state the resolution must also have an imprint of the local governments seal affixed. The t10? extension is primarily due to delays caused by relocation of the underground fuel tanks. Change Order 4: Provides for a $93.00 credit received by the County due to a change in the type of lens on the fluorescent light fixtures. Change Order 8: Provides for a change in the location of t~vo pay telephone ou.tlets. The amount of the change order is $175.00 Change Order 7: Provides for power to the sewage pump station that was previously added to the project. The amount of the change order is $1,530.00. The following change orders are for Miller Building: Change order 4: Change Order 10: e Change Order 11: Provides an increase of $17,644.20 for the removal of six abandcned underground fuel storage tanks. Ori9inally, two tanks were discovered, however, as excavat ion t,;as done, four additional taGks were found. All were removed and disp0sed of in accordance with State Environmental requirements. Provides for various minor alterations to the building and. site amountin':j to $2,999.00. The changes include additional gable and corner trim, encasement of a structural steel beam, removal of ~sphalt, elimination of color striping around the building, and addition of bulkheads and smoke partitions. Provides for the addition of a windm.,r in the arrival vestibule in the hold rooln. This was done at the request of l\rnerican Eagle. The amount uf the change is $816.00. The Site Grading and Utilities contract with Mac Construction has been issued a final change order (#7) to make the final adjustment for quantities of work performed. The final adjustment increases the contract amount by $10,875.57. He have not made final pa~nent to Mac Construction due to threat of lien by two of Mac's sub-contractors. As soon as this is resolved, final payment will be made providing for the penalty previously discussed. The new terminal complex has change order 1 for Miller Building in the amount of $74,360.00. 'Ihis provides funds for the removal of unsuitable soil under the buildjng, hol~ room, and retaining walls. The Conmissioners previously a~proved r~moval of this material from under the main building only, at an approximate cost of $46,000. This amount is included in the new figure. The increase is based on an estimated quantity and will be subject to a final adjustment at the end of the project. e e e e .' (. This was done by ch"3r1<~e order 13. The work was necessary because the poor condition of the wood r~quired unanticipated replacement of the beams. Sewer System Change Order 2 for R. H. Moore provides an increase of $121,147.50 for sewer system construction. Of this amount, $18,825.50 is due to modifications to the system caused by state and local health requirements relatir,,(> to dist,.3nce from drinking water supply wells for indi vid.ual hO(\18S. TO PROVIDE SCHEDULED NON-EMERGENCY AMBULANCE SERVICE (CATEGORY II) WITHIN NEW HANOVER COUNTY AND SCHEDULED NON-EMERGENCY (CATEGORY II) AND EMERGENCY (CATEGORY I) SERVICE ORIGINATING WITHIN NEW HANOVER COUNTY WITH AN OUT-OF-COUNTY DESTINATION THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY, NORTH CAROLINA, DOES ORDAIN: Section I. Grant. Subject to the terms and conditions of the New Hanover County Ambulance Service Ordinance and the terms and conditions of this ordinance, Medical Transportation Specialists, Inc., its successors and assigns, is hereby granted, from and after the effective date hereof, the right privilege and franchise to provide Scheduled Non-Emergency Ambulance Service (Category II) wi thin New Hanover County and Scheduled Non-Emergency (Category II) and Emergency (Category I) Ambulance Service originating within New Hanover County with an out-of-county destination, for the purpose of providing adequate ambulance service_, of these types, to the citizens of New Hanover County; all subj ect to present and future ordinances of the County relating thereto. Section II. Term. This franchise is gran~ed for the term of five (5) years from and after the effective date hereof; provided that either party, at its option, may terminate the franchise upon one hundred and twenty (120) days written notice to the other party. !". section III. Territory. This franchise shall apply to all of New Hanover County. Section IV. Renewal. This franchise is renewable at the option of the Board of Commissioners of New Hanover County. Section V. Non-Exclusive. The right herein granted shall be non-exclusive, and New Hanover County reserves the right to grant similar franchises to any person or persons at any period during the present franchise or any extension thereof. Section VI. Standards. The standards for this franchised ambulance service, its drivers and attendants, its vehicles and equipment, and its communications facilities shall, at all times during the term of this franchise or any extension hereof, comply with all of the laws and requirements of the State of North Carolina and the requirements of the New Hanover County Ambulance Service Ordinance, all of the terms and conditions of which are herein incorporated by reference and made a part hereof, the same as if fully set forth. Section VII. Insurance. The grantee herein shall, at all times during the term of this franchise and any extension thereof, maintain in full force and effect insurance coverage, issued by an insurance company licensed to do business in the State of North Carolina, sufficient to provide all the insurance necessary to meet the requirements of Section 6-28 of the New Hanover County Ambulance Service Ordinance. Section VIII. Records. Grantee shall keep and maintain all of the records required of the grantee by the New Hanover County Ambulance Service Ordinance and to permit the County to inspect 2 ~':-. grantee's records, premises and equipment at any time in order to ensure compliance ,with the New Hanover County Ambulance Service Ordinance. Section IX. Rates and Charges. Grantee shall submit a schedule of rates to New Hanover County for approval and shall not charge more than the approved rates without specific approval by New Hanover County. Section X. Acceptance of Franchise. This franchise and the right, privileges and authority hereby granted shall take effect and be in force from and after final passage hereof, as provided by law, provided that within thirty (30) days after the date of the final passage of this ordinance, the grantee shall file with the Clerk to the Board of Commissioners its unconditional acceptance of this franchise and promise to comply with and abide by all of its provisions, terms and conditions, and said acceptance to be in writing and in the form and executed in the manner as provided in this franchise. Section XI. Grantee's Representation and Covenants. The acceptance of this franchise ordinance by Medical Transportation Specialists, Inc. shall constitute representations and covenants by it that: a. It accepts and agrees to all the provisions of this ordinance and those instruments and documents incorporated herein by reference; b. It has examined all of the provisions of this and the New Hanover County Ambulance Service Ordinance and waives any 3 t', claim that any provisions hereof are unreasonable, arbitrary or void; c. It recognizes the right of New Hanover County to make reasonable amendments to the franchise ordinance or franchise agreement during the term of the franchise, provided that no such change shall compromise the ability of Medical Transportation Specialists, Inc. to perform satisfactorily its obligations or right under this ordinance. It further recognizes and agrees that New Hanover County shall in no way be bound to renew the franchise at the end of the franchise term; d. It acknowledges that its rights hereunder are subject to the police power of New Hanover County to adopt and enforce general ordinances necessary for the safety and welfare of the public, and it agrees to comply with all applicable general laws enacted by New Hanover County pursuant to such power. Section XII. Effective Date. This ordinance shall be in full force and effect from and after its final adoption by the Board of Commissioners of New Hanover County, North Carolina. Name - The name of this advisory committee to the County Commissioners for the Fire Service. District shall be the New Hanover County Board of Fire Commissioners (hereinafter referred to as the Board oI Fire Commissioners). Section 2. , Purpose - The purpose of the Board of Fire Commissioners shall be to: 2.1 Review budget requests from the indblidual volunteer fire d~partments, evaluate these requests, and present the recomnended budget for the Fire Service District to the County Commissioners. 2.2 Assist the County in planning and administering the Fire Service District. 2.3 Make recommendations to the County Commissioners on fire related matters such as the need for additional fire legislation, the need for addi tional fire prevention regulation and enforcement, for fire safety requirements that should be required when developers are permitted to develop new areas in the County, and on the annual con tr acts between the individual volunteer fire departments and the County. 2.4 To serve as an appeals board as prescribed in the Fire Board of Appeals bylaws in matters related to decisions rendered by the office of the Fire Marshal. 2.5 Article II: Membership and Composition Section 1. The Board of Fire Commissioners shall consist of nine members. Section 2. Four of the members shall be selected by the County Commissioners from four different fire service areas. The volunteer fire departments in the fire service areas that ,e Section 3. 3.1 . . . f' e are not represented by the four County Conunissioners' appointees shall select one representative per department to serve on the Board of Fire Commissioners. One County Conunissioner shall serve on the Board of Fire Conunissioners. No member of a volunteer fire department will be appointed by the County Conunissioners to represent a Fire Service Area. Appointment -' Members shall be appointed for a two year term. Terms shall start July 1. One-half of the first appointees shall serve one year and the other one-half shall serve two years. Members serving one year terms will be chosen at random with one-half being fire departments' appointees and ,one-half County Conunissioners' appointees: '.' 'Following the first appointments, fire service areas represented by fire departments' appointees will be represented by County Commissioners' appointees. Service Areas represented by County conunissioners' appointees will be represented by fire departments'appointees. No representative may serve more than one term consecutively. 3.2 The Chairman' of the Board of Fire Conunissioners shall advise the County Conunissioners on members who should be replaced, because of resignation or limited interest and participation. 3.3 Any person appointed to term shall be appointed duration of that vacancy. fill an unexpired to serve for the Article III: Officers Section 1. A quorum will be majority of the total membership. will be a. simple 1.4 A summary shall be taken at every meeting and distributed at least five days prior to the subsequent meeting. Article V: Miscellaneous Section 1. Amendments - The bylaws may be amended or repealed and new bylaws adopted by the affirmative vote of two-thirds of the total membership of the Conunittee at any regular or special meeting of the Board of Fire Commissioners ca1led for that purpose, with subsequent approval by the New Hanover Board of Commissioners. The bylaws shall become effective upon approval by the New Hanover County Board of Commissioners. Section 2. Attendance at Meetings - If a member of the Board of Fire CommIssioners is absent for more that 25 percent of the meetings held during any calendar year and if these absences are unexcused, the Chairperson will report such action to the County Conunission in keeping wi th Section 1. BY LAWS FOR FIRE BOARD OF APPEALS -e Section 1. Creating the Board of Appeals. The New Hanover County Board of Fire Corrunissioners shall provide for appointment of a three member board to hear appeals from decisions of the Office of the Fire Marshal. For the purpose of fairness in the meetings, the three member panel will vary in membership depending upon 'which area of the county the appeal may be from. If any member of the Fire Commission has interest in the appeal for personal reasons, he or serve in the three member panel for that particular a pa,rticular she shall not meeting. Section 1.1 Meetings e Upon receipt of an appeal, the Chairman of the Fire Commission shall select a three member panel from the Commission. The Fire Marshal shall be present to keep the minutes of the meeting, showing the vote of each member upon every question, or his failure to vote, indicating such fact, and also keeping records of its examination and any other decisions. The Fire Marshal shall advise the Board on technical aspects of fire prevention and safety, advise the Board regarding specific aspects of fire prevention and safety, advise the Board regarding specific aspects of the appeal or request, keep all records and conduct all correspondence of the Board. All minutes shall be filed in the Office of the Fire Marshal and become public record. The Fire Marshal shall not be eligible to vote upon any matter. A quorum shall consist of two-thirds (2/3) of the membership of the Board. The concurring vote of two-thirds of the members of the Board shall be necessary to reverse any order, requirement, decision, or determination of the Fire Marshal or Inspector, or to decide in favor of the applicant any matter which it is required to pass upon under the Ordinance. 1.2 Duties of the Fire Marshal, Fire Board of Appeals, and County Commissioners as to Matters of Appeal. (a) It is the intention of the Ordinance that all questions arising in connection with enforcement of the Ordinance shall be presented first to the Fire Marshal and that such questions shall be presented to the Fire Board of Appeals only on appeal from the Fire Marshal; and that from the decision of the Fire Board of Appeals recourse shall be to courts as provided by law. e ,e ., e e ~b) It is further the intention of the Ordinance that the duties of the County Commissioners in connection with the Ordinance shall not include the hearing and passing of disputed questions that may arise in connection with the enforcement thereof, but only considering and passing upon proposed amendment or repeal of the Ordinance. Section 2. Filing and Notice for an Appeal Any person seeking relief from a decision of the Office of. the Fire Marshal regarding provisions of the Ordinance may appeal to the Board of Fire Conunissioners within thirty (30) da,ys after receipt of written notice of violation. Such an appeal shall be in writing and directed toward the Fire Marshal. Copies of, the appeal shall be promptly forwarded to the chairman of t.he Fire Commission by the Fire Marshal. Upon no less that five (5) business days notice to the persons interested, a hearing shall be held. An appeal stays all proceedings in furtherance of action appealed from, unless the Fire Marshal submits a Certificate stating that in his opinion, a stay would interfere with the enforcement of the Ordinance because the violation is transitory in nature, or would cause an imminent peril to life or property. The Fire Marshal shall have one ( 1) copy of said Certificate delivered by registered mail to the appellant and to each member of the Fire Board of Appeals within ten (10) calendar days from the, date the appeal is filed with the Fire Marshal. The Certificate shall also be placed on file in the Office of the Fire Marshal for public inspection and recorded in the minutes of the next meeting of the Fire Board of Appeals. Where said Certificate is filed by the Fire Marshal, proceedings in furtherance of the original order shall not be ~tayed except by a restraining order which may be granted by a court of record within New Hanover County. 2.1 Types of Appeals; Powers and Duties The Board of Appeals shall hear and decide all appeals from and review any order, requirement, decision, or determination made by the Fire Marshal/Inspector. It shall also hear and decide all matters referred to it upon which it is required to pass by the Fire Ordinance of the County of New Hanover, North Carolina. ~. 2.2 Hearing of an Appeal After receipt of the notice of an appeal, the Fire Commission Chairman shall schedule the time of the hearing, which shall be at a regular meeting. 2.3 Notice Notice of - Public Hearing shall be published 48 hours in advance of the upcoming appeal, in the local newspaper. .e e e , . 2.4 Fees 'for Appeal Variances A fee to be established by the Fire Commissioners shall be paid to the County of New Hanover, North Carolina to cover necessary administrative and advertising expenses. 2.5 Rehearings An application for a rehearing may be made in the same manner as provided for an original hearing. Evidence in support, of the application shall initially be limited to that which is necessary to enable the Board to determine whether there. has been a substantial change in the facts, evidence, or conditions in the case. A rehearing shall be denied by the Board if in its judgement there has been no substantial change in the facts, evidence, or condition in the case. If the Board finds that there has been such a change, it shall thereupon treat the request in the same manner as any other application. Section 3.0 Miscellaneous: (a) Amendments - The by laws may be amended or repealed and new by laws adopted by the affirmative vote of two-thirds of the total membership of the Committee at any regular or special meeting of the Board of Fire Commissioners. The by laws shall become effective upon approval by the New Hanover County Board of Commissioners. ... '.'
