1986-02-03 RM Exhibits ',. ,. RESOLUTION OF INTENT TO CLOSE A PUBLIC ROAD , WHEREAS, a petition has been filed pursuant to G. S. 153A-241, requesting the Board of Commissioners of New Hanover County to close the.fol lowing described public road: Being a section of an Unnamed Road located approximately 1550' west of the Intersection of Castle Hayne Road/Marathon Avenue on the southern side of Marathon Avenue extending south for a distance of 250'. Being the same section of said road as shown In Map Book 23, Page 16, Marathon Colony. NOW, THEREFORE, BE IT RESOLVED, that this Board Is considering closing said road to public use, and that a public hearing on this question will be held on the 10th day of March, 1986, at 7:00 PM In the Assembly Room of the County Administration Building, 320 Chestnut Street, Wilmington, North Carolina, at which time the Board wll I hear al I interested citizens and make a final determination as to whether the unopened road shal I be closed. AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section I. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby further amended as fol lows: 1. ADD: 23-80 Special Highways - Any highway, such as but not limited to Interstate corridors, freeways, arterials and col lectors, designated by the Board of County Commissioners for Its scenic qualities and Its ability to provide safe and efficient traffic flow. 2 . ADD: 59.6 SPECIAL HIGHWAY OVERLAY DISTRICT . 59.6-1 Purpose. The purpose of the Special Highway Overlay District (SHOD) Is to protect the natural beauty and scenic vista that exist along Interstate Highways and other specially designated roadways that serve as major access ways and gateways Into New Ha~over CouftTY. Protection of these roadways is important and necessary to maintain and preserve the County's undisturbed roadsides that are characterized by their natural woodlands and open ~paces. The continued protection of these scenic highways Is also a valuable asset to the County's tourism economy and enhances the attractiveness of the area for trade and Investment. 0'.- - The Special Highway District shall be In addition to any other zoning districts where applied so that any parcel of land lying In a SHOD may also lie In one or more of the zoning districts provided for by this Ordinance. The development of al I uses permitted by right or by special use permit In the underlying district, If any, shal I be subject to the requirements of both the SHOD and the underlying district, If any. In the event the SHOD requirements conflict ~Ith the underlying district requirements, .the requirements of the SHOD shall take precedence. If requirements for a particular Item are not specified In the SHOD but are specified by the underlying district, then the requirements of the underlying district shall be fol lowed. 59.6-2 Procedu~es -In creating a Special Highway Overlay District (SHOD), the same procedures shall be fol lowed as those for making any other amendments to the Zoning Ordinance under Article XI hereof. 59.6-3 Applicability - It Is hereby required that al I structures, buildings and Improvements to property located within the SHOD comply with the fol lowing regulations. Access roads and utility (communications, gas,electrlcal, sanitary services) structures are exempted from /' these control s. . (1) Dimensional Requirements - All non-residential buildings and accessory uses shal I setback no less than 100 feet from the right-of-way of the designated highway. No building shal I be located less than 25 feet from any property II ne. (2) Enclosed Facilities - AI I manufacturing, storage, offices, wholesal lng, retail sales or similar uses shal I be conducted within an enclosed building. (3) Outside Storage - Outside storage can be/permitted If It Is looated directly to the rear of the principal building and is not visible from the designated highway. The outside storage area shal I not.. occupy an area wider than the principal building or larger th~n one-half (t) the area of the principal building. A three (3) row screen shall be provided In accordance<wlth the Landscape standards of Section 67. No storage shal I be permitted above the height of the screen. Junkyards and scrap processors sha II not be perm I tted. .. ,~ .. .. (4) Parking and Loading (a) Parking and loading shal I be provided in accordance with the provisions set forth In Article VI I I and Section 67. All loading shal I be from the side or rear of the principal structure as viewed from the designated highway. If loading Is performed on the side of the building, as viewed from the designated 'hlghway, a three (3) row screen shal I be provided In accordance with the Landscape Standards of Section 67. (b) No vehicular or equipment parking except automobile parking shal I be permitted In the yard area adjacent to, the designated highway. All automobile parking shal I be set back at least one hundred (100) feet from the right-of-way of the designated highway If such highway Is an Interstate or thoroughfare with control led access. Other U.S. and N.C. Numbered highways shal I require a fifty (50) feet setback for automobile parking. (5) Lot Coverage - The total ground area covered by principal buildings and al I accessory buildings shall not exceed fifty (50) percent of the site. (6) Signs - Signs shal I be in accordance with Article IX except'fhat only one free standing ground sign not to exceed six (6) feet In height and & maximum surface area of 150 square feet may be permitted. No Outdoor Advertising signs shall be permitted. 3. ADD: Under Article IX, Section 94-2 (13) Outdoor advertising signs shall not be constructed within 1000 feet of the right-of-way of special highways designated on the New Hanover County Thoroughfare Classification Plan. 4. DELETE: Section 66.1 Special Highways: AI I non residential development shal I set back a minimum of 1000 feet of the right-of-way of special highways designated by the County Commissioners. This area of open space shall remain unoccupied and completely free of all non-residential structures. Section 2. Any ordinance or any part of any ordinance In conflict with this ordinance, to the extent of such conflict, Is hereby repealed. Section 3. This ordinance Is adopted In the Interest of public health, safety, morals, and general welfare of the Inhabitants of the County of New Hanover, North Carolina, and shal I be In ful I force and effect from and after Its adoption. The total district width Is 1000 feet on either side of the road right-of-way along this stretch. 2. N.C. 132: Beginning at Big Gum Branch on N.C. 132, running thence In a southerly direction along N.C. 132 to Its Intersection with Market Street. Eastwood Road: Beginning at the intersection of Eastwood Road and Market Street, running thence in an easterly direction along Eastwood Road to Its Intersection with U.S. 76 (Wrlghtsvllle Avenue.)
