AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE SUBDIVISION ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 18, 1965 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Subdivision Ordinance of the County of New Hanover adopted October 18, 1965, as amended be and the same is hereby amended as follows: ADD: 3.7 Park Facilities The subdivider shall be responsible for ensuring that adequate public park facilities shall be available for use by the future residents of the subdivision all pu~suant to GS 153A-331 a. Standards The following three types of City or County park facilities must be available to the subdivision within the distance specified by the service radii: Facility Regional park Medium park Neighborhood park Size Less than Greater than or equal to Service Radius Less than Greater than or equal to 50 acres 5 acres o acre 500 acres 50 acres 5 acres 2.5 miles .5 mile o mile 10 miles 2.5 miles .5 mile The service radius for an existing County or City park facility is determined by interpolating within the range of service radii listed above for that type of existing facility. For instance, the service radius for a 2.5 acre neighborhood park is .25 mile. The distance of the subdivision from the park facility shall be measured by the distance from the perimeter of the park to the nearest point of access to the subdivision. The locations of all existing park facilities and their service radii are available from the County Planning Department. b. Compliance with Standards The subdivision should be located so as to be served within the specified radius by at least one existing regional park, one existing medium park, and one existing neighborhood park of the County park system. High density developments and Planned District developments, as defined by the New Hanover County Zoning Ordinance, shall be exempt from this requirement for neighborhood parks. If the subdivision does not meet this location requirement, then the subdivider shall either pay a fee or dedicate land in lieu of the fee, as specified below, for each type of park facility that it is not adequately served by. PaYment of the fee or dedication of the land shall be completed before the final plat is recorded. 1. Calculation of Fee If the subdivision is not served by adequate park facilities, the subdivider shall calculate and pay the following Total Park Fee: , Total = Park Fee (Regional park fee) + (medium park fee) + (neighborhood park fee) Regional = Park Fee ($ value/acre parkland + $1000 improvements/acre parkland) x ( units in subdivision) x (2.84 persons/unit) x (:0045/acre parkland/person) ($ value/acre parkland + $.1000 improvements/acre parkland) x ( units in subdivision) x (2.84 persons/unit) x (:003/acre parkland/person) Medium = Park Fee Neighborhood Park Fee = ($ value/acre parkland + $1000 improvements/acre parkland) x ( units in subdivision) x (2.84 persons/unit) x (:O005/acre parkland/person) The following terms used in the calculations are explained: The ($ value/acre parkland) is equal to the average value per acre of -Unimproved land in the subdivision as determined by the assessed market value of the land. The ($1000 improvements/acre parkland) is a conservative estimate of land improvements and capital facilities required per acre of land needed for a suitable park. The (__ units in subdivision) is dependent upon the number of lots to be platted or units constructed. The 2.84 persons/unit) equals the present estimated average household size in the unincorporated County. The subdivider may use a smaller household size provided that the subdivider can adequately demonstrate that the subdivision will have smaller household sizes due to the use of restrictive covenants or the construction of one bedroom units. In no case, however, shall the household size be reduced to less than 1.5 persQns/unit. 2. Dedication of Land in Lieu of Fees (a) The subdivider may dedicate land to the County in lieu of all or part of the above fees provided the fOllowing conditions are met: 1) The value of the land dedicated shall be of a value equal to the required fee. The value of the land shall be determined either by its assessed market value or by a certified appraiser, who shall be chosen by the County and whose fee shall be paid by the subdivider. 2) The land to be dedicated shall be evaluated and accepted by the County as being suitable for use in the park system, with regard to such criteria as location access, physical characteristics,and size. (b) If the subdivision has only private roads, the subdivider may plat, reserve and improve an area of land suitable for recreation, as determined by the County, within the subdivision in lieu of the neighborhood impact fee. The park shall be owned and maintained by the Homeowners Association. The improvements shall include, at a minimum, two or more benches or picnic tables, a trash receptacle, and tot lot play equipment for children. The improvements shall be reviewed and approved by the County Parks and Recreation Department before the final plat is recorded. The minimum area of recreational land to be platted and reserved shall be calculated as follows, but shall be at least 0.25 acre: ~ Recreational Area = (__ units in subdivision) x (2.84 persons/unit) x (.0005 acre/person) Impact fees or land dedication shall still be required for regional and medium park facilities, as necessary. Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. That, the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby amended as follows: 1. Amend Article II, Definitions, by adding the following definition: 23-82 Inoperative Motor Vehicle - a motor vehicle which meets anyone of the following criteria: (1) Is presently unable to satisfy the vehicle inspection standards of the State of North Carolina, regardless of whether said vehicle possesses a currently valid inspection certificate. Motor vehicles which lack such an inspection certificate, or which display an expired certificate, shall be presumed to be inoperative; or (2) Is partially dismantled or wrecked; or (3) Cannot be self-propelled or moved in the manner in which it originally was intended to move; 2. Amend Article VI, Supplementary District Regulations by adding the following: 68.1 Storage of Inoperative Motor Vehicles in Residential Zoning Districts. It shall be unlawful for any person to store, keep, or maintain more than one (1) inoperative motor vehicle in any residential district. Vehicles exceeding this number shall be removed by the property owner within ninety (90) days of the effective date of this amendment. ' Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. This resolution establishes procedures for the legal representation of the following quasi-judicial bodies (hereinafter referred to as "Boards or Commissions"): Zoning Board of Adjustment, Human Relations Commission, Clean Communi ty Commission, and Board of Health. 2. Legal Assistance at Board or Commission Hearings. Upon the request of the Chairman of a Board or Commission, the County Attorney's office will advise said Board or Commission on legal questions arising at quasi-judicial hearings. l'he County Attorney's office shall not serve as a hearing officer, and shall not determine factual issues. 3. Appeals Into Court. Upon appeal by an interested party of a Board or Commission decision into Court, the County Attorney's off ice shall not represent the Board or Commission. In the event the County Attorney determines that the Board or Commission needs representation (for example, when a lawsuit names the Board or Commission as a defendant), the County Attorney may retain an attorney at County expense. 4. Representation of the Board of Commissioners at Board or Commission Hearings. ~otwithstanding Paragraph 1 above, J> upon the request of the Board of Commissioners, -the County Attorney's office shall represent the Board of Commissioners at hearings conducted by other County Boards or Commissions. In these cases, separate counsel shall be provided to assist the Board or Commission in conducting the hearing. The performance of Item 4 above depends upon prompt notification to the Board of Commissioners of, and prompt decision by the Board of Commissioners on, all significant cases in which the Board of Commissioners may be interested.
