RESOLUTION ACCEPTING OFFER TO
PURCHASE SURPLUS REAL PROPERTY
WHEREAS, a certain offer to purchase a parcel of real property owned
wholly or jointly by Hew Hanover County and/or the City of Wilmington
have been advertised for upset bid in compliance with North Carolina General
Statute 160A~269 and pursuant to resolutions adopted by the City Council
of the City of Wilmington and the Board of Commissioners of New Hanover
County; and
WHEREAS, there has been no further qualifying upset bid entered for
the property described on the attached list within the statutory period
allowed by North Carolina General Statute 160A-269; and
WHEREAS,the offerors indicated on the attached list have agreed to
pay the amount indicated on the attached list for the parcel of real
property shown thereon; and
WHEREAS, the property is declared by the County Commissioners to
be surplus and not needed for public purposes; and
WHEREAS, it is in the best public interest and welfare to dispose
of this property with the negotiated terms and conditions.
NOW THEREFORE BE IT RESOLVED:
1. That pursuant to NCGS 160A-269, the County Commissioners do
hereby ac~ept the offer to purchase as indicated on the
attached list from the offerors as indicated.
2. That the City of Wilmington and/or New Hanover County will
retain any deposit posted by the offerors as liquidated damages
if the offerors fail to pay the balance of an approved offer
due lin cash within ten (10) days of receipt of a notice by
certified mail of availability of the deed of conveyance.
3. That the Chairman of the Board of Commissioners of New Hanover
County be and is hereby authorized to execute a deed without
warranties to the offerors as designated on the attached list.

TO PURCHASE SURPLUS REAL PROPERTY

amounts indicated on the attached list for the parcel of real property shown; and

properties in accordance with the negotiat.ed terms and conditions.
NOW THEREFORE BE IT RESOLVED:
1. That pursuant t.o NCGS 160A-269, tIle County Co~nissioners propose to accept
the offers to purchase indicated on the attached list from the offerors as
indicated.
2. That tIle County of New Hanover and/or the City of Wilmington will r~tain
any deposit posted by the offerors when:
a. the offer is withdrawn after posting the deposit; or
b. the offeror fails to pay the balance of an approved offer, due
in cash, tvitbin ten (10) days of receipt of a notice by
certified mail of availability of the deed of conveyance.
3. That the County of New Hanover reserves the right to reject any and
all offers.
4. That the County of New Hanover will require the offerors to deposit five
(5%) percent of the offered prices immediately following adoption of this
resolution.
5. That the Clerk of the Board of Commissioners will publish a notice of the
offers as required by NCGS 1601\-269.

WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the County of New Hanover requesting that the above de-
scribed road, the location of which has been indicated in red on the attached
map, be added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the
above described road should be added to the Secondary Road System, if the
road meets minimum standards and criteria established by the Division of
Highways of the Department of Transportation for the addition of roads to
the Sys tem.
NOW, THEREFORE, be it 'resol ved by the Board of County Commi ss i oners of
the County of New Hanover that the Division of Highways is hereby requested
to review the above described road, and to take over the road for maintenance
if it meets established standards and criteria.

New Hanover County; and,
WHEREAS, New Hanover County wishes to have Community
Services Block Grant funded programs provided to its citizens
by a community action agency located in New Hanover County;

Dear Mr. Roberson:
Enclosed is a resolution unanimously adopted by the New
Hanover County Board of Commissioners requesting DOT to perform
a traffic impact study on Gordon Road (SR 1327 and 2048). I
cannot overly emphasize the importance of improving this two lane
road which will serve as a connector to Interstate 40. We, as a
Board, are deeply concerned for the safety of residents and
visitors traveling this route in New Hanover County.
Your attention to this urgent request will be greatly
appreciated.

Whereas, the North Carolina Department of
Transportation projects a November 1, 1985, completion date for
New Hanover County's segment of Interstate 40; and
Whereas, the projected volume and behavior of
interstate highway traffic entering and existing from Gordon Road
(SR 1327 and 2048) is uncertain at this time; and
Whereas, the current traffic count on Gordon Road is
already heavy for a residental neighborhood; and
Whereas~ the Board of Commissioners is deeply concerned
for the safety of residents and visitors who are traveling and
will be traveling this two lane road as a connector to an
interstate highway; now
THEREFORE BE IT RESOLVED, the New Hanover County Board of
Commissioners requests a traffic impact study be conducted by the
Department of Transportation as soon as possible in order that
necessary improvements to Gordon Road can be made in a timely
fashion to correspond with the completion of Interstate 40.

(the "County"), and that the following resolutions have been presented to and
duly adopted by the County Commissioners at a meeting duly and regularly held
and convened in accordance with applicable law on the 7th day of October, 1985:
WHEREAS, the County has entered or is entering an Equipment Lease/Purchase
Agreement dated September 1, 1983, and a Commitment Letter dated October 7,
1985, with First Union: National Bank;
NOW THEREFORE, be it RESOLVED that the Agreement and Letter be, and is
hereby approved and that the action of the official or officials of the County
in signing the Agreement and Letter on behalf of it be, and is hereby, ratified,
confirmed and approved; and be it further
RESOLVED, that an official of the County be, and is hereby, authorized, em-
powered and directed to sign on its behalf the Agreement and any addenda,
schedules, notes, UCC financing statements or other instruments issued under the
provisions of the Agreement and any other instrument or document which may be
necessary or expedient in connection with agreement upon or fulfillment of the

AN ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORTH CAROLINA AMENDING
THE SUBDIVISION REGULATIONS
OF NEW HANOVER COUNTY
ADOPTED OCTOBER 18, 1965
THE BOARD OF COMMISSIONERS OF NEW HANO~ER COUNTY DOTH ORDAIN:
Section 1. That the Subdivision Regulations of the County
of New Hanover adopted October 18, 1965 as amended be and the
same is hereby further amended as follows:
Delete existing Article VI, Section 9 and replace with the
following:
Section 9 Enforcement of Ordinance
This ordinance may be enforced by anyone or more of the
remedies authorized by G.S. S153A-123, including but not
limited to the following:
9-1 Violation of this ordinance is a misdemeanor as
provided by G.S. 814-4, as amended, which specifies punish-
ment by a maximum fine of fifty ($50.00) dollars or imprison-
ment for not more than 30 days.
9-2 Violation of this ordinance subjects the offender to
a civil penalty of fifty ($50.00) dollars to be recovered by
the County in a civil action in the nature of debt if the
offender does not pay the penalty to the County Finance Office
within ten (10) days after the offender has been cited for a
violation.
9-3 This ordinance may be enforced by an appropriate
equitable remedy issuing from a court of competent juris-
diction.
9-4 This o~dinance may be enforced by injunction, order
of abatement, 'or both, as provided in G. S. S153A-123 (e).
9-5 Each day's continuing violation of this ordinance
is a separate and distinct offense.
Section 2. Any ordinance or any part of any ordinance in
conflict with this ordinance, to the extent of such conflict,
is hereby repealed.

of public he~l~h, safety, morals, and general welfare of the
inhabitants of the County of New Hanover, North"Caralina, and
shall be in full force and effect from and after its adoption.
