PUR01ASE SURPWS REAL PROPERlY
WHEREAS, certain offers to purchase parcels of real property owned wholly or
jointly by New Hanover Connty and/or the City of v?ilmington have been advertised
for upset bid in compliance with North Carolina General Statute 160A-269 and
pursuant to resolutions adopted by the City Conncil of the City of Wilmington on
February 14, 1984 and the Board of Ccmnissioners of New Hanover Connty on
February 22, 1984: and
WHEREAS, there have been no further qualifying upset bids entered for the
property described on the attached list within the statutory pericx:1 allowed by
NCGS 160A-269: and
WHEREAS, the offerors indicated on the attached list have agreed to pay the
amount indicated on the attached list for the parcels of real property shov.'I1
thereon: and
WHEREAS, the property is declared by the Connty Comnissioners to be surplus and
not neeCied for public purposes: and
\v1-!EREAS, it is in -b.'1e best public interest and welfare to dispose of this
property in accordance wi-b.'1 the negotiated tenns and conditions.
NQIV THEREFORE BE IT RESOLVED:
1. That pursuant to NCGS 160A-269, the Connty Commissioners do hereby
accept the offers to purchase as indicated on the attached list
fran the offerors as indicated.
2 . That the City of Wilmington and/or New Hanover Connty will retain any
deposit posted by the offerors and liquidated daJt1ages if the offerors
fail to pay the balance of an approved offer due in cash within ten
(10) days of receipt of a notice by certified mail of availability
of the deed of conveyance.
3. That the Chairman of the Board of Cammissioners of New Hanover
Cbnnty be and is hereby authorized to execute a deed vli thout warranties
to the offerors as designated on the attached list.

RESOLUTIQ~ PROPOSING ACCEPTANCE OF OFFERS
TO P(JRCHASE SURPLUS REAL PROPERTY
WHEREAS, certain parcels of real property awned wholly or jointly by New Hanover
County and/or the City of Wilmington have been offered for sale pursuant to North
Carolina General Statute 160A-269: and
V'v"BEREAS, the offerors indicated on the attached list have agreed to pay the

WHEREAS, the properties are declared by the County Carrrnissioners to be surplus and
not needed for public purposes: arrl
h'HEREAS, it is in the best public interest and welfare to dispose of these
properties in accordance with the negotiated tenns and condi lions.
NCW THEREFORE BE IT RESOLVED:
1. That pursuant to NCGS l60A-269, the Connty Commissioners propose to accept
the offers to purchase indicated on the attached list from the offerors as
indicated.
2. That the Connty of New F.anover and/or the City of Wilmington v-Till retain
any deposit posted by the offerors \.vhen:
a. tl.:e offer is withdrawn after posting the deposit: or
b. the offeror fails to pay the balance of an approved offer, due
in cash, within ten (10) days of receipt of a notice by
certified mail of availability of the deed of conveyance.
3. That the Connty of New Hanover reserves the right to reject any and all
offers.
4. That the County of New Hanover will require the offerors to deposit five (5%)
percent of the offered prices immediatley following adoption of this resolution.
5. Tbat t.he Clerk of the Board of Cornnissioners will publish a notice of the offers
as req:uired by NCGS 160A-269.

AN ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORI'H CAROLINA AMENDING
THE ZONING ORDINANCE OF
NEW HANOVER COUNTY
ADOPTED OCTOBER 6, 1969
/
WHEREAS, North Carolina General Statutes 153A - 340, as amended permits a
county
to regulate development over estuarine waters and over lands covered by navigable
waters owned by the State pursuant to G.S. 146 - 12, within the bonds of that
county: and
WHEREAS, North Carolina Coastal Resource Commission policies (15 NCAC 7M,
Section .0600) prohibit floating structures within the public trust waters except
in permitted marinas and require that all floating structures shall be in confor-
mance with local regulations for on-shore sewage treatment.
NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY rorH ORDAIN:
Section 1. That the Zoning Ordinance of the County of New Hanover adopted
October 6, 1969, as amended be and the same is hereby further amended as follows:
A. Amend Article II, Definitions, Section 23 by adding the following two
new definitions:
23-76 Boat .... A vessel or watercraft of any type or size specifically
designed to be self-propelled, whether by engine, sail, oar, or
paddle or other means, which is used to travel from place to
place by water.
23-77 Floating Structure .... Any structure or vessel in fact used,
designed and occupied as a permanent dwelling unit, business
office, or source of any occupation or any private or social
club, which floating structure or vessel is primarily immobile
and out of navigation or which functions substantially as a
land structure while the same is moored or docked on waters
within County jurisdiction: whether such floating structure
is self-propelled or not.
B.Amend Article V, District Regulations, Section 50-2, Tabulation of Per-
mitted Uses to read as follows:

C. Amend Article VII, provisions for Uses Allowed as Special Uses, Section
72, Additional Restrictions Imposed on Certain Special Uses by adding a
new Section 72-31. 5 to read as follows:
72-31.5 Commercial Marina With Floating Structures -- A commercial
marina with floating structures may be permitted in the R-20S,
R-20, R-15, B-1, B-2, I-lor 1-2 Districts provided:
(1) Floating structures shall not be located within fifteen
(15) feet of the waterward extension of all property
lines:
(2) Not more than one dwelling unit per floating structure
shall be permitted:
(3) A permanent pier, dock or walkway with adequate night
lighting shall join each floating structure and the
adjacent shoreline:
(4) Each floating structure shall be inspected and approved
by the Building Inspector prior to placement in the
Marina. This approval shall be dependent upon, but not
limited to, approval of the electrical system and the
method of exiting.

(5) Each floating structure shall be provided with permanent
water and sewer systems approved by the New Hanover County
Health Department. All wastewater piping from the unit
shall be constructed to the N.C. State Plumbing Code. No
overboard discharge openings thru the hull or structure
shall be permitted except for one (1) dewatering pipe
which may not be connected to wastewater piping:
(6) A system for collection and removal of solid wastes and
refuse shall be approved by the New Hanover County
Health Department;
(7) A minimum of two (2) off-street parking spaces per float-
ing structure shall be provided on-shore:
(8) A minimum of two thousand (2,000) square feet of gross
land area contingous and above mean high water shall be
provided for each floating structure on-shore;
(9) A site plan shall be submitted for approval showing all
improvements as required by this Ordinance; and,
(10) Any floating structure existing prior to the adoption
of this ordinance shall have one (1) year to comply with
all of the requirements of the New Hanover County Zoning
Ordinance.
Section 2. Any ordinance or any part of any ordinance in conflict with this
ordinance, to the extent of such conflict, is hereby repealed.
Section 3. This ordinance is adopted in the interest of public health,
safety, morals, and general welfare of the inhabitants of the County of New
Hanover, North Carolina, and shall be in full force and effect from and after
its adoption.

ADOPTED ccroBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY rom ORDAIN:
Section 1. That the Zoning Ordinance of the County of New Hanover adopted
October 6, 1969, as amended be and the same is hereby further amended as follows:
A. Amend Article VII, Section 72-4 concerning Convenience Food Stores
in Residential Districts to read as follows:
(7) Fuel sales may be approved provided such sales shall be
limited to one (1) pump island located a minimum distance of
thirty (30) feet from any street right-of-way and forty (40)
feet from any side or rear lot line. Overhead canopies shall
be measured in accordance with Section 23-55. (6/7/76) (4/2/84)
Section 2. Any ordinance or any part of any ordinance in conflict with this
ordinance, to the extent of such conflict, is hereby repealed.
Section 3. This ordinance is adopted in the interest of public health,
safety, morals, and general welfare of the inhabitants of the County of New
Hanover, North Carolina, and shall be in full force and effect from and after its
adoption.
