WHEREAS, a certain parcel of real property owne:1 wholly or jointly by New Hanover
County and/or the City of wilmington has been offere:1 for sale pursuant to North
Carolina General Statute l60A-269; and
WHEREAS, the offeror indicated on the attached list has agreed to pay the anount
indicated on the attache:1 list for the parcel of real property shown; and
WHEREAS, the property is declared by the County Corrmissioners to be surplus and
not needed for public purposes; and
WHEREAS, New Hanover County' proposes to convey title to the property identified
in the attachment hereto by general warranty deed pursuant to NCGS 160A-275; and
WHEREAS, it is in the best public interest and Vv'elfare to dispose of this property
in accordance with the negotiated terms and conditions and to convey title by general
warranty deed pursuant to NCGS160A-275.
NOO THEREFORE BE IT RESOLVED THAT:
1. Pursuant to NCGS 160A-269, the County CaTmissioners propose to accept
the offer to purchase indicated on the attached list fram the offeror
as indicated.
2. The County of New Hanover and/or the City of v.Jilmington will retain
any derosit posted by the offeror when:

Dear Mr. Cooper:
The attached resolution relates to the sale of surplus real
property .acquired through tax foreclosure proceedings. The
resolution proposes acceptance of an offer to purchase submitted
by Audrey B. Shaw and Walter L. Clark.
The offe.rors propose to construct a new 1,000 square foot
brick veneer dwelling on the subject property for which construction
they have already secured financing. In order to facilitate the
steps necessary to further their efforts the b.fferors have requested
conveyance of the property by general \varranty deed vJhich action is
pern1itted under North Carolina General Statute160A~275. Staff has
oonducted a prel:i1ninaxy search of the public records realtive to
the chain of title for subject property and nothing has been revealed
during the cursory check \'Jl'iich nri:ght subsequently serve as a basis

RESOLUTION OF THE
NEW HANOVER COUNTY BOARD OF
COUNTY COMMISSIONERS
WHEREAS the boundaries of Masonboro Island encompass sufficient land and
water areas to approximate an ecological unit, and to ensure conservation; and
WHEREAS Masonboro Island represents a pristine, non-drowned rivet mouth
estuary associated with an entire undisturbed barrier island and would be a
unique component in the North Carolina National Estuarine Sancutary Program; and
WHEREAS Masonboro Island has significant value as a scientific and
educational laboratory for the University of North Carolina at Wilmington, the
North Carolina Marine Resource Center and other educational institutions; and
WHEREAS ~~sonboro Island is dynamically unstable due to inlet migration and
long-term erosion, which would endanger the establishment of permanent
communities; and
WHEREAS ~~sonboro island is unique on the North Carolina coast as a
virtually untouched barrier island located within a major urban area; and
WHEREAS Masonboro, Island includes economically and scientifically valuable
primary shellfish and finfish nursery grounds; and
WHEREAS Masonboro Island is classified "Conservation" in the County Land Use
Plan because of its environmental, scientific and recreational values; and
WHEREAS the provision of public services on undeveloped barrier islands
would conflict with the County's Policies for Growth and Development, and would
be prohibitively expensive when compared with service costs in other areas of the
County; and
WHEREAS the preservation of Masonboro Island would be in harmony with the
principles of the National Estuarine Sanctuary Program; and
WHEREAS the Draft Environmental Impact Statement for the National Estuarine
Sanctuary Program has been found tobeessentially complete, comprehensive,
accurate, and objective;
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of New
Hanover County unanimously endorses the preferred alternative of adding all of
Masonboro Island to the North Carolina National Estuarine Sanctuary Program, as
analyzed in the Draft Environmental Impact Statement-Masonboro Island Component,
and that the Office of Coastal Zone Management in the National Oceanic and
Atmospheric Administration and the State of North Carolina are respectfully
requested to continue in the process to deSignate and acquire l~sonboro Island as
an estuarine sanctuary.

RE: Comments on the DEIS for the proposed addition of the Hasonboro
Island Component to the North Carolina National Esturine Sanctuary
Dear Dr. Foster:
The above referenced DEIS'is accurate, comprehensive, and well done. We
feel, however, that the description of support by the New Hanover County Board of
Commissioners for the inclusion of Masonboro Island in the Sanctuary Program
should be expanded with regard to the County's growth policies and land use
regulations.
On August 1, 1983, the, 'C01DlDissioners declared a 90 day moratorium on
building on undeveloped barrier islands in response to proposed development on
Masonboro Island, and concurreritly directed the Planning Department to prepare a
Hurricane Protection Study. This study resulted in an amendment to the County
Land Use Plan's Policies for Growth and Development that esentially prohibits
residential development on undeveloped barrier islands that do not have permanent
access (Attachment 1). The Island was already classified Conservation in the
County's Land Use Plan in recognition,at least partially, of its value in the
estuarine system.
Furthermore, the County presently is preparing a Conservation Overlay
District (COD) for the County Zoning Ordinance. This Overlay District, which
will almost assuredly include Masonboro Island, will place restrictions on
impervious surface areas, drainage, and require the peservation of certain
sensitive environmental areas, such as primary nursery areas, The County also
has passed subdivision regulations requiring hurricane evacuation planning,
adequate boat facilities, and waterfront access on barri~r islands (Attachment
2).
These land use policies and regulations are in addition to the County's
offer to donate its 15.2 acres of land on Masonboro Island as a partial match for
obtaining Federal acquisition funds. The Board of Commissioners has also
strongly supported the State in its eforts to secure funds for acquisition of the
Island.
The County wholeheartedly endorses the present efforts to include Masonboro
Island in the Estuarine Sanctuary program. We will be glad to provide further
comments as required.

The land is a barrier island or part of a barrier
island with a density equal tD or less than one
residential unit pe~ five acres.
( 2)
The barrier island area has been assiQned the most
severe rank with reqard to vulnerability to hurricane
forces. This most severe rank is assigned to
areas that are Inlet Hazard Areas of Environmental
Concern, Ocean Erodible Areas of'Environmental
Concern, or Estuarine Shoreline Areas of Environmental
Concern.
The barrier island area iS,not connected to the
mainland by a pennanent network of roads and bridges
that would allow safe and timely evacuation by
,land rather than by boat.
(4) The barrier island area does not Qualify for the
National Flood Insurance Program as administered by

In no case shall the name for a proposed subdivision duplicate
or be phonetically similar to existing subdivisions in New Hanover

2.10 Roads within the subdivision must be designed to provide.
sufficient capacity for safe and timely evacuation of residents
in case of a hurricane, if the subdivision or parts of it are
located in a V-zone. Factors involved in determinirq the safety
and ti1re1iness of evacuation include the 'presence of low points,
bridges, or other evacuation route bottlenecks, and vehicle capacities
of the roads.

bridges shall establish a community boating facility on the

2.12 Waterfront Access-
Subdivisions that are located on Barrier Islands with lots containing
beach front or sound front property shall dedicate sufficient property
to ensure PUblic access to the beach and sound. Such accesS shall
not be less than 10% of the beach frontage aOO 5% of the scum
frontage arrl shall be spaced at'intervals of no more than 1000'.
Access ways shall not be less than 15' in width. These facilities
