RESOLUTION OF THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS WHEREAS, the Board of Commissioners of New Hanover County hereby determines that it is necessary and in the public interest to acquire an interest in certain real property owned by MILES C. HIGGINS, III AND WIFE COLLEEN MITCHELL HIGGINS, for the public purpose of providing a sewage collection and disposal system in the unincorporated area of New Hanover County; and WHEREAS, representatives of New Hanover County have been unable to acquire the needed interest in this property by negotiated conveyance; NOW, THEREFORE, BE IT RESOLVED as follows: 1. New Hanover County shall acquire by condemnation, for the public purposes above stated, the property and interest described as follows: An easement or right-of-way interest 15 foot wide permanent utility easement, 10 foot wide temporary construction easement, and approximately 226 feet, more or less, in length, running parallel to Masonboro Sound Road across the eastern portion of that 3.22 acre tract designated as Tax Parcel No. 6700005002006. 2. The New Hanover County Attorney is directed to institute the necessary proceedings under Chapter 40A of the ~. North Carolina General Statutes to acquire the property interest herein described. WILLARD, for the public purpose of providing a sewage collection and disposal system in the unincorporated area of New Hanover County; and WHEREAS, representatives of New Hanover County have been unable to acquire the needed interest in this property by negotiated conveyance; NOW, THEREFORE, BE IT RESOLVED as follows: 1. New Hanover County shall acquire by condemnation, for the public purposes above stated, the property and interest described as follows: An easement or right-of-way interest 15 foot wide permanent utility easement, 10 foot wide temporary construction easement, and approximately 178 feet, more or less, in length, running parallel to Masonboro Sound Road across the eastern portion of that 59.42 acre tract designated as Tax Parcel No. 6700005002004. 2.
