It was an honor to receive the Local Health Department Recognition Award on behalf of our Refugee Health Program. Our department's efforts to improve the lives of children and families are an inspiration to us and many others throughout New Hanover County and across the state of North Carolina. A monetary award in the amount of $5,000 was received and may be used for special projects, staff development, and /or educational materials. This recommendation is based on our cost to provide this service and a comparison of fees charged by other local health departments. Based on 10/11 Fiscal Year patient count for this service this would result in an estimated revenue increase of $11,810. No matching County funds are required and no new positions are requested. They are children of all races. Many have been neglected, abandoned, abused and /or exposed to drugs and alcohol. Others are brothers and sisters who want to grow up together. They need our care and they need security; and WHEREAS, many children find permanent homes through adoption by their foster families or relatives, thereby creating an ongoing need for new foster and adoptive families; and 37 children in New Hanover County found permanence through adoption this past year. NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that November 2011 be recognized as "Adoption Awareness Month" in New Hanover County. General Statutes 153 -A -345, 266.17. The Commissioners increased to 3 alternates 11/21/94 (officially 4/1/96). The Zoning Ordinance requires members to be appointed from different areas within the County's zoning jurisdiction. Brief on Functions: The Board of Adjustment is recognition of human frailty. If it were possible for the legislative body to write a perfect zoning ordinance which would meet the needs of the community while at the same time avoiding hardship in individual cases, there would be no need for this board. Because that has been found near impossible, the Board of Adjustment has been introduced as an integral part of almost every smoothly operating zoning enforcement mechanism, serving as a "pop -off valve" to relieve pressures resulting from hardship cases. In New Hanover County, the duties of the Board fall into two general categories: Interpretation and Granting Variances. Interpretation: The function of the Board of Adjustment which is most closely similar to that of the courts is interpretation of the Ordinance. This function involves (a) interpreting the meaning of parts of the Ordinance which are unclear, (b) applying the Ordinance to particular fact situations, and, if necessary, (c) correcting any mistakes or abuses of discretion which the zoning official may have made in administering the Ordinance. In exercising this power, the basic principle for the Board to keep in mind is that it must not vary the Ordinance. Its function here is to interpret and apply what the governing body has written, not to vary that legislative pronouncement to fit its own ideas. Its decisions must be in accord with what the Board believes to be the actual meaning and intent of the Ordinance. Granting of Variances: General Statute 153A- 345(d) provides that, "when practical difficulties or unnecessary hardships would result from carrying out the strict letter of a zoning ordinance, the Board of Adjustment may, in passing upon appeals, vary or modify any regulation or provision of the Ordinance relating to the use of land, so that the spirit of the Ordinance is observed, public safety and welfare secured, and substantial justice done." Basically, a variance is a permit, which the Board may grant in certain situations, enabling a property owner to make use of his property in some way which is in conflict with the literal provisions of the Ordinance. Sometimes a lot so small or so peculiarly shaped that the owner would have great difficulty in complying with the yard requirements and yet erecting a suitable building. Sometimes contours of the terrain are such as to create hardships in complying with these requirements. Sometimes the lot is located in a cluster of nonconforming uses which will prevent the owner from securing any reasonable return from his land if he complies with the Ordinance (as where a lot in a residential district is surrounded by nonconforming business structures). When the Board grants exemptions from harsh provisions, it is "granting a variance." Board of Commissioners Meeting 10/17/2011 12 -0 NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION SUPPORTING AN AGREEMENT WITH THE NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES TO ADDRESS POTABLE WATER SUPPLY WHEREAS, counties proximate to the coast need to address potable water supply sources and storage, given anticipated demands on Cape Fear River water and ongoing saline intrusion into aquifers; and WHEREAS, regional water supply planning can best address the needs of the Counties of New Hanover, Brunswick, Pender, Bladen, Columbus and the Lower Cape Fear Water and Sewer Authority and Cape Fear Public Utility Authority; and WHEREAS, the local maximum safe withdrawal from the Cape Fear River is 20% of the 7Q10 or 106 MGD and this allocation is shared equally between the Cape Fear Public Utility Authority and the Lower Cape Fear Water and Sewer Authority; and WHEREAS, projections for demand indicate that the region's needs approach the maximum safe allocation within 30 years with no provision for storage or suitable safety factor for increased upstream demands, unanticipated regional demand, depletion of local aquifer resources, prolonged drought, or increased environmental base flow requirements; and WHEREAS, the General Assembly in Session Law 2011-374 authorizes the State to work with localities and water authorities to identify water needs and sources, plan and budget for proposed new water supply projects, and apply for governmental permits for appropriate regional water supplies; and WHEREAS, Session Law 2011-374 permits units of local government to contract with the Department of Environment and Natural Resources to conduct feasibility studies addressing long -term water supply needs and to plan and provide analysis of alternatives and technical assistance in applying for permits; and WHEREAS, it is acknowledged that the Lower Cape Fear Water and Sewer Authority along with the Cape Fear Public Utility Authority will be required to reimburse the Department of Environment and Natural Resources the cost of all analysis as outlined and agreed upon by contract. NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners supports those efforts by the Lower Cape Fear Water and Sewer Authority, Cape Fear Public Utility Authority and the State of North Carolina Department of Environment and Natural Resources to begin the process to insure that our region will have a sustainable water supply for the future. A portion of the grant is used to contract In -Home Aide Services for eligible senior citizens in New Hanover County. The County solicited proposals for a second time from providers to provide In -Home Aide Services. Sealed proposals were accepted until 1:00 PM, September 14, 2011 and were opened publicly. The County received three (3) proposals in response to this solicitation. A fourth company withdrew and did not submit a proposal. The proposal review committee consisted of members of the Home and Community Care Block Grant Advisory Committee and staff. The proposals were reviewed blindly, meaning that the company name was not visible to the reviewers. Also, each proposal was rated using an evaluation form. The federal and state funds available for the contract through June 30, 2012 are estimated to be $160,000 and the 10% match required to be provided by the proposers is $17,778. Bidders were instructed to use the total amount of $177,778 to complete their proposals. The evaluation was thorough and selection was based on the overall proposal. After careful review and calculation of the points awarded for each proposal, the review committee recommends that the contract be awarded to Interim HealthCare of Eastern Carolinas, Inc. This contract is contingent upon receipt of federal funding: any reduction or withdrawal of funding shall constitute grounds for the County to forthwith terminate all or a portion of this contract. Renewal The parties may by written agreement renew this contract for two (2) additional one (1) year periods upon the same terms and conditions as set forth herein except that to adjust for inflationary factors, price per unit of service charged will be negotiated to determine a guaranteed fixed price per unit of service. Any rate adjustments established will be effective July 1st of each renewal year and the increase shall not exceed the Consumer Price Index (CPI) inflation percentage as furnished by the NC Division of Aging. D. Harold Greene of Upper Marlboro set out to disprove that notion when he wrote, "The Rights of Passage for Males," a 62 -page book that offers a how -to for young men making the transition from carefree boyhood to the responsibility -laden life of a grown -up. Greene, a lecturer at several Washington, D.C. -area community Colleges, including Prince George's Community College in Largo. said he penned the manual when his son was 18. Teachers, Greene said, failed to give him (boys) the advice, information and guidance necessary to avoid reckless decisions and lay the groundwork for a successful family and professional life. "I found he (boys) needed a lot of information about life skills and that he wasn't getting it in school," said Greene, 61, an Upper Marlboro resident for five years. "I wrote up just about everything a young man needs to know about in life." There was one problem with writing a book full of advice aimed at teenage boys, Greene said. "Boys don't like to read," he said with a laugh. Greene set up the Faith Institute of Entrepreneurship and now hosts seminars across the country for adults hoping to use lessons in "Rites of Passage" for workshops at local community centers, schools and churches. At the end of every workshop, Greene doles out official certifications to adults ready to preach the lessons of his book. He held a workshop at Ernest Everett Just Middle School in Mitchellville on Sept. 27. " I train the trainers," he said. "And they know boys need to be [taught] life skills so they are at school age, before it's too late." "Rites of Passage" touches on a myriad of topics, including the responsibilities of having a driver's license -- Greene reminds the reader that driving is a privilege, interacting with and cooperating with police and the options available to most young men once they've earned a high school diploma. In previous generations, getting an education was followed by employment, which was followed by 30 or 40 years of hard work, then a comfortable retirement. "That model is no longer there," he said, adding that young men are sometimes lost in an adult world full of professional instability, and in need of adult guidance. "They see that the old way doesn't work for them." Greene said it is particularly tough for single mothers to lay down the facts of life for boys in their formative years. That's where "Rites of Passage" can make for a valuable tool, he said. "It's hard for them to sit down and tell there the things he needs to know about life," Greene said.
