2007-11-05 Water & Sewer NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 3 REGULAR MEETING, NOVEMBER 5, 2007 PAGE 259 ASSEMBLY The District Board of Commissioners of the New Hanover County Water and Sewer District met in Regular Session on Monday, November 5, 2007, at 9:42 p.m. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington, North Carolina. Members present were: District Chairman William A. Kopp, Jr.; District Vice-Chairman Robert G. Greer; District Commissioner William A. Caster; District Commissioner Ted Davis, Jr.; District Commissioner Nancy H. Pritchett; County Attorney Wanda M. Copley; Clerk to the District Board Sheila L. Schult and County Manager Bruce T. Shell. NON-AGENDA ITEMS District Chairman Kopp announced that time had been reserved for anyone from the public to present an item that was not listed on the Regular Agenda. He requested all persons to limit their remarks to three minutes. No items were presented. APPROVAL OF MINUTES District Chairman Kopp called for a motion to approve the minutes of the Water and Sewer District Regular Meeting held on October 15, 2007, as presented by the Clerk to the District Board. Motion: District Commissioner Caster MOVED, SECONDED by District Vice-Chairman Greer, to approve the minutes of the Water and Sewer District Regular Meeting held on October 15, 2007, as presented by the Clerk to the District Board. Upon vote, the MOTION CARRIED UNANIMOUSLY. APPROVAL OF INTERLOCAL AGREEMENT WITH NEW HANOVER COUNTY BOARD OF EDUCATION Deputy County Attorney Kemp Burpeau reported that on July 9, 2007, the District approved construction of a water tower and a sewer pumping station adjacent to the proposed Holly Shelter Road elementary and middle school sites. These improvements are a part of a regional utilities project having a total construction cost of $6.67 million. The District has agreed to waive tap fees and associated fees and make allocation available for at least 1,800 students. New Hanover County School Board is contributing $1.75 million toward the water and sewer improvements. Staff is requesting the District Board approve the proposed Interlocal Agreement. The School Board needs to have the agreement finalized in order to close on the property which is currently under contract. District Chairman Kopp requested direction from the District Board. Motion: District Commissioner Caster MOVED, SECONDED by District Commissioner Pritchett, to approvethe Interlocal Agreement outlining the terms of the agreement with New Hanover County Board of Education for the proposed Holly Shelter Road elementary and middle school sites. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the interlocal agreement is on file in the Legal Department. APPROVAL OF TORCHWOOD BOULEVARD WASTEWATER FORCE MAIN IMPROVEMENTS AND ADOPTION OF BUDGET ORDINANCE AMENDMENT 2008-50 Interim County Engineer Dennis Ihnat reported that in 2003, two segments of a 12-inch diameter gravity sewer line installed on Torchwood Boulevard in the Courtney Pines/Whitney Pines neighborhood were designed and permitted without obtaining the necessary design variance authorization. One of these segments was placed in operation in 2004. The remaining segment, constructed in 2007, is waiting on a variance from the Department of Water Quality prior to being placed into operation. These two segments will connect with sewer lines designed with the same parameters and previously permitted with a variance from the Department of Water Quality. NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 3 REGULAR MEETING, NOVEMBER 5, 2007 PAGE 260 As a condition of granting the pending variance, the Department of Water Quality is requiring that an existing sewer force main at the intersection of Market Street and Torchwood Boulevard be extended and connected to the 12-inch gravity line. This will provide for flushing the gravity line or adding flow as needed to insure adequate flow velocity in the gravity sewer line. It will also provide limited system redundancy and event management potential. At the request of staff, Tony Boahn, McKim and Creed Engineering, has submitted a proposed Scope of Services for this project that will provide a Preliminary Engineering Report, new force main design, permitting, bid and award, and construction administration and observation services. The cost of these additional services will be $56,580. At a later date, when the design, cost estimate and permitting work is completed, a capital project will be established to construct this force main extension. Staff is requesting the District Board approve the proposed Amendment 6 to the current McKim and Creed Engineering contract for the 2006 Wastewater Master Plan Update in the amount of $56,580 for the Torchwood Boulevard Wastewater Force Main Improvements and adopt budget ordinance amendment 2008-50 in the amount of $113,160. In response to questions by District Chairman Kopp, Tony Boahn, McKim and Creed Engineering, clarified that the Master Plan is moving independent of the amendment additions and that the amendments are not hindering the timeline that is in place. District Chairman Kopp requested direction from the District Board. Motion: District Vice-Chairman Greer MOVED, SECONDED by District Commissioner Caster, to approve Amendment 6 to the current McKim and Creed contract in the amount of $56,580 for the Torchwood Boulevard Wastewater Force Main Improvements and adopt budget ordinance amendment 2008-50. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the budget ordinance amendment is hereby incorporated as a part of the minutes and is contained in Water and Sewer Exhibit Book 3, Page 21.1. ADDITIONAL ITEM ADOPTION OF RESOLUTION PROMOTING WATER CONSERVATION Interim County Engineer Dennis Ihnat reported that a resolution has been prepared for the District Board?s consideration promoting the continuation of water conservation for all New Hanover County water systems with the following actions: 1) Establish a Stage 1 Water Conservation Alert for all New Hanover County Water and Sewer District well water systems, which encourages voluntary water conservation, including guidelines limiting irrigation to two nights per week per household; and 2) Maintain the Stage 2 Water Shortage Mandatory Conservation measures for the Airport Water System in coordination with the City of Wilmington; and 3) Continue to monitor well water supply levels for the New Hanover County Water and Sewer District well water systems; and 4) Continue participating with the City of Wilmington in the water conservation education program; and 5) Strongly encourage all residents and businesses to conserve water in all activities, in order for all persons to continue to enjoy the high quality of life and strong economy in our community. NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 3 REGULAR MEETING, NOVEMBER 5, 2007 PAGE 261 In closing, Interim County Engineer Ihnat reported that residents will be notified of the water conservation measures via press release and publication on the County?s website. District Vice-Chairman Greer stated that there has been confusion whether the conservation measures that are currently in place are mandatory or voluntary. The proposed resolution will clarify the issue. In response to Board questions, Interim County Engineer Ihnat reported that aquifer levels are within seasonal norms and currently there is not a need for mandatory measures. After brief discussion, the District Board requested that all New Hanover County residents practice water conservation. District Chairman Kopp requested a motion for approval. Motion: District Vice-Chairman Greer MOVED, SECONDED by District Chairman Kopp, to adopt the resolution promoting the continuation of water conservation for all New Hanover County water systems. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the resolution is hereby incorporated as a part of the minutes and is contained in Water and Sewer Exhibit Book 3, Page 21.2.
