WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the County of New Hanover requesting that the above de-
scribed road, the location of which has been indicated in red on the attached
map, be added to the Secondary Road System; and
WHEREAS, the Board of.County Commissioners is of the oplnlon that the
above described road should be added to the Secondary Road System, if the
road meets minimum standards and criteria established by the Division of
Highways of the Department of Transportation for the addition of roads to
the System.
NOW, THEREFORE, be -it resolved by the Board of County Commissioners of
the County of New Hanover that the Division of Highways is hereby requested
to review the above described road, and to take over the road for maintenance

JOINT
RESOLUTION OF THE
NEW HANOVER COUNTY BOARD OF COUNTY COMMISSIONERS
AND THE WILMINGTON CITY COUNCIL
WHEREAS, the City of Wilmington and New Hanover County desire to encourage
the location of a crane manufacturing firm in this region; and
WHEREAS, as an entitlement city under Federal guidel ines, the City of
Wi Imington is inel igible to apply. for Community Development Block Grant funding
to assist in this project; and
WHEREAS, New Hanover County is el igible to apply for Community Development
Block Grant funding to assist in this project; and
WHEREAS, Article 20 of Chapter 160A of the North Carol ina General Statutes
authorizes cities and counties to enter into contracts or agreements with each
other in order to execute any undertaking; and
WHEREAS, the proposed location for the manufacturing firm is located within
the Wi Imington City Limits; and
WHEREAS, the City of Wilmington desires to encourage industrial development
within its corporate limits;
NOW, THEREFORE, BE IT JOINTLY RESOLVED BY THE NEW HANOVER COUNTY BOARD OF
COUNTY COMMISSIONERS AND THE WILMINGTON CITY COUNCIL:
I. That New Hanover County possesses legal authority to submit an
appl ication for a Community Development Block Grant to encourage the location of
a crane manufacturing firm in the City of Wi Imington.
2. That New Hanover County is authorized to submit an application for
funding of this project.
3. That New Hanover County shal I perform al I administrative
responsibi litles establ ished upon receipt of the grant, and shal I continue to
administer the grant until al I required grant conditions have been satisfied.
4. This agreement between the City of Wilmington and New Hanover County
shal I be automatically terminated if the County's application for Community
Development Block Grant funding is denied. If funding is obtained, this
agreement may not be terminated until the County certifies that al I gran
administration activities have been completed.

EXTRACTS FROM MINUTES OF BOARD OF COMMISSIONERS
The Board of Commissioners of the County of New
Hanover, North Carolina, met in regular session in the
Assembly Room, County Administration Building, Wilmington,
North Carolina, the regular place of meeting, at 7:00 o'clock,
P.M., on October 1, 1984. The following commissioners were:
Present: Karen E. Gottovi, Chairman, Jonathan
Barfield, Donald P. Blake, Nolan O'Neal,
Claud O'Shields

The Chairman stated that The New Hanover County
Industrial Facilities and Pollution Control Financing Authority
had adopted a resolution expressing its intention to issue
revenue bonds and authorizing the execution and delivery of an
inducement agreement pertaining to the financing of a pollu-
tion control project for Corning Glass Works. The Chairman
submitted copies of the resolution and the inducement agree-
ment to the Board. The Chairman then stated that a notice had
been published on September 15, 1984 that the Board would hold
a public hearing on October 1, 1984 on the proposed project
and the issuance of revenue bonds to finance the project.
Commissioner O'Shields moved that the Board proceed
to hold a public hearing on the project and the issuance of
revenue bonds to finance the project. The motion was seconded
by Commissioner O'Neal and was unanimously adopted.

Commissioner O'Neal inquired about the State's
resp?nsi~ility to check on the adequacy of the controls and
Mr. McQuaid replied that this was done through the permitting
process and the company would be applying for the necessary
permits in October. Commissioner O'Neal also inquired about
the $10,000,000 cost of the equipment and Mr. McQuaid said
that certain byproducts were generated which had to be removed
from exhaust fumes, that ducts carry the byproducts to the
pollution abatement facility, the actual particles or
particulates are moved through the bag house and then to a
landfill and the fumes are scrubbed through a water jet
technology.
Commissioner O'Shields said he was glad to see the
success story involved with Corning and its use of revenue
bonds and that he appreciated the expansion and vote of
confidence of the company.
James Ferger of 4521 Middlesex Road, Wilmington,
N. C, said that he was a member of the Sierra Club, which was
seeking federal legislation for cleaner air, and that from
what he understood the air pollution control regulations were
causing the development of industries to produce the needed
equipment and that this could have an effect on the economy of
the country.

After the Board had heard all persons who re-
quested to be heard, Commissioner ~Ne~l _
moved that the public hearing be closed. The motion was
seconded by Commissioner Barfield and was
unanimously adopted.
Commissioner O'Shields then intro-
duced the following resolution which was read at length:
WHEREAS, the Board of County Commissioners has
created a political subdivision and body corporate and
politic of the State of North Carolina known as "The New
Hanover County Industrial Facilities and Pollution Control
Financing Authority" (the "Authority"); and
WHEREAS, the Authority is authorized under the
Industrial and Pollution Control Facilities Financing Act,
Chapter 159C of the General Statutes of North Carolina, as
amended (the "Act"), to issue revenue bonds for the purpose,
among others, of paying all or any part of the cost of any
pollution control project for industry, to acquire, con-
struct and equip any such project, and to make and execute
financing agreements, security documents and other contracts
and instruments necessary or convenient in the exercise of
such powers; and
WHEREAS, the Authority has determined to issue its
revenue bonds in the principal amount of not more than
$10,000,000 to pay all or a portion of the costs of the

acqUisition, construction and installation of air and water
pollution control facilities as part of an expansion of the
Wilmington optical communications fibers plant of Corning
Glass Works at 310 North College Road, Wilmington, North
Carolina, including a bag house, scrubbers, ducts and other
functionally related and subordinate facilities to heat dust
particulates and gaseous chlorides (the "Project") to be
operated by Corning Glass Works; and
WHEREAS, the Authority intends to file an applica-
tion for approval of the Project with the Secretary of the
Department of Commerce (the "Department"), as required by
the Act; and
WHEREAS, the Department has, by regulation,
provided that no application for approval of a project will
be officially received until the elected board of county
commissioners of the county from which the application is
made has, by resolution after a public hearing, approved the
issue of revenue bonds and approved in principle the pro-
posed project and a certified copy of such resolution has
been provided to the Department; and
WHEREAS, the Board of County Commissioners,
pursuant to public notice duly given, has held a public
hearing on the advisability of the Project and the issuance
of revenue bonds to finance the Project and has considered
the comments of persons who requested to be heard; and

WHEREAS, the Board of County Commissioners desires
to approve the Project in principle and the issuance of
revenue bonds to finance the Project;
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners of the County of New Hanover as fol-
lows:
(1) The Project is hereby approved in principle.
(2) The issuance of revenue bonds by the Author-
ity to finance the Project is hereby ap-
proved.
(3) The Clerk of the Board of Commissioners is
hereby authorized and directed to provide a
certified copy of this resolution to the
Department of Commerce.
(4) This resolution shall take effect immediately
upon its passage.

Section I. That the Zoning Ordinance of the County of New Hanover adopted
October 6, 1969, as amended be and the same Is hereby further amended as
fo I lows:
I. Amend Article V, District Regulations by adding a new
Conservation Overlay District to Section 59.4 (see attached)
2. Amend Article V, Section 50-1 by adding the Conservation
Overlay District as fol lows:
(14) CD Conservation Overlay District
3. Amend Article I I, Definitions, as fol lows:
23-78 A Professional Historian shall have a graduate degree In
history or closely related field plus one of the following:
A. At least two years of ful I-time experience In research
writing, teaching, interpretation or other demonstrable
professional activity with an academic institution,
historic organization or agency, museum or other
professional institution; or
B. Substantial contribution through research and publication
to the body of scholarly knowledge in the field of history.

archaeology, anthropology, or closely related field plus:

Conservation Resource Areas - Conservation resources consist
of those important environmental resources described In Section
59.4-3. The minimum amounts that shar I remain conservation
space shal I be calculated as described in Section 59.4-4.
5. Amend Section 102, Application for Bui Iding Permits, by adding the
following:
102-5 If the use is located within a COD and performance controls
are required under Section 59.4, an application plan for a
building permit shal I include information as to the types,
boundaries, areas, and required setbacks for al I conservation
resource areas. Information concening these areas is available
at the County Planning Department. The applicant shat I obtain
a letter'of verification from the Planning Department that
the conservation resource areas are accurately mapped on the
applfcation plan.
102-6 If a building permit is appl ied for a use within a COD and If
requied by Section 59.4-5, a drainage plan and calculations
meeting the design standards shal I be submitted to the County
Eng i neer for approva I. The County Eng i neer sha II ana lyze the
plan in accordance with the applicable regulations and
provide a written response approving or disapproving the
plan within three working days of its receipt of the plan.
Disapproved plans shal I be forwarded to the applicant.
Approved plans shal I be forwarded to the Building Inspector
to be processed under the requirements of Section 102.

7. Amend Section 51.5-2, Performance Residential by revising
subsection (4)A. as fol lows:
A. Runoff Standards
(I) Stormwater runoff wil I be managed and structures
appropriately sized such that the peak rate of
discharge from the site after completion of
development for any storm in size up to and including
peak rate of discharge from the site in its previous
natura I cond I tl on for the spec if I ed des I gn storm.
The design storm Is specified as occurring once every
10 years and lasting for 24 hours.
(2) Discharge of runoff from impervious surfaces directly
into natural waterbodles shall not be al lowed.
Runoff shal I be routed along vegetated swales,
through filter media of vegetation, gravel, sand,
or other media, or to detention ponds for the purpose
of increasing percolation and settl ing and filtering
out of non-point pollutants.
Section 2. Any ordinance or any part of any ordinance in confl ict with this
ordinance, to the extent of such confl let, is hereby repealed.
Section 3. This ordinance is adopted in the Interest of public health,
safety, morals, and general welfare of the inhabitants of the County of New
Hanover, North Carol ina, and shal I be in full force and effect from and after
December I, 1984.

ADOPTED APRIL 2, 1970
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section I. That the Mobile Home and Travel Tra i ler Park Ordiance Regulations of
the County of New Hanover adopted April 2, 1970, as amended be and the same Is hereby
further amended as fol lows:
I. Amend Section 5.1, Contents of Preliminary Plan, by adding:
(n) I f the deve I opment I s wi th i n a Conservati on
Overlay District, types, boundaries, areas, and
required setbacks for al I conservation resource
areas shall be included. Information concerning
these areas is available at the County Planning.

Section 59.4
Conservation Overlay District
September 7, 1984
59.4-1 Purpose - The purpose of the Conservation Overlay District (COD)
for conservati on resources is to protect important env I ronmental
and cultural resources within the County. Protection of these
resources is necessary to maintain the County's diverse and
ecologically important natural systems; to preserve the County's
estuarine systems important for finfishing and shel Ifishing; to
provide open space; and to retain the County's archaeological
and historical heritage. These COD's shal I be in addition to
any other zoning districts where appl ied so that any
parcel of land lying In a COD may also lie in one or more 6f
the zoning districts provided for by this Ordinance.
The development of al I uses permitted by right or
by special use permit in the underlying district, if any, shal I
be subject to the requirements of both the COD and the underlying
district, if any. In the event thf% COD requirements confl ict with the
underlying district requirements, the requirements of the COD shal I
take precedence. If requirements for a particular item are not \
specified in the COD but are specified by the underlying district,
then the requirements of the underlying district shal I be
fol lowed.
59.4-2 Appl icabi I it~ - The development and improvement of property,
including the subdivision of land, shal I be subject to these
performance controls if the parcel is located who' Iy or
partially within a COD and if conservation resources, as specified
in Section 59.4.1, are associated with the parcel on record as of
(the date of the adoption of this Ordinance.) The following uses,
however, are exempted from these controls:
(I) The development of one single family home detached
structure, one residential duplex, or the location of two
or fewer mobile homes on a parcel or lot.
(2) Commercial, industrial, office, or institutional development
inVOlVing a land disturbance, of less than 1 (one) acre:i;,in area.
59.4-3 Conservation Resources - If a parcel on record as of (date of
adoption of this Ordinance) is associated with anyone
of the conservation resources listed below then the parcel shal I
be subject t~ the fol lowing performance controls. Official maps of
and information concerning these resources shal I be maintained by
and shall be avai lable for review at the County Planning Department.
These maps sha! I be updated as needed by the Planning Department and
shal I serve as the official source by which to determine if a parcel
is associated with conservation resources. A parcel is considered to
be associated with a conservation resource if either the resource is
contained partially or wholly on the parcel or if the resource
is located next to a parcel such that the resource setback
specified in Section 59.4-5 extends into the parcel.

PROJECT ORDINANCE
AGRICULTURAL EXTENSION BUILDING
BE IT ORDAINED, by the Board of Commissioners of New
Hanover County:
WHEREAS:
1. New Hanover County (County) is engaged in the
construction of the Agricultural Extension Building, which
capital project involves the construction and/or renovation
of capital assets.
2. County desires to authorize and budget for said
capital project in a project ordinance adopted pursuant to
North Carolina General Statute $159-13.2, such ordinance to
authorize all appropriations necessary for the completion of
said project.
NOW, THEREFORE, WITNESSETH THAT:
1. This project ordinance is adopted pursuant to North
Carolina General Statute 8159.13.2.
2. The capital project undertaken pursuant to this
ordinance is the construction of the Agricultural Extension
Building, which project is herewith authorized.
3. The revenue that will finance said project is:
