PUlOIASE SURPWS REAL PROPERlY
WHEREAS, a certain offer to purchase a parcel of real property ~ed wholly or
jointly by NeW Hanover County and/or the City of Wilmington has been advertised for
upset bid. in. canpliance with North Carolina General Statute l60A-269 and pursuant to
resolutions adopted by the City Council of the City of Wilmington on August 28, 1984
and the Board of Carmissioners of New Hanover County on September 4, 1984; and
WHEREAS, there have been no further qualifying upset bids entered for the property
described on the attached list within the statutory period allowed by NCGS l60A-269; and
WHEREAS, the offeror indicated on the attached list has agreed to pay the amount
indicated on the attached list for the parcel of real property shown thereon; and
WHEREAS, the property is declared by the County Camlissioners to be surplus and
not needed for public purposes; and
WHEREAS, it is in ttle best public interest and welfare to disfXJse of this property
in accordance with the negotiated terms and conditions.
NCM THEREFORE BE IT RESOLVED:
1. That pursuant to NCGS l60A-269, the County Carmissioners do hereby
accept the offer to purchase as indicated on the attached list fran
the offeror as indicated.
2. That the City of wLlmington and/or New Hanover County will retain any
defXJsit posted by the offeror as liquidated damages if the offeror
fails to pay the balance of an approved offer due in cash within ten
(10) days of receipt of a notice by certified mail of availability of
the deed of conveyance.
3. That the Chairman of the Board of Carmissioners .of New Hanover County
be and is hereby authorized to execute a deed without warranties to
the offeror as designated on the attached list.

RESOLUTION PROPOSING ACCEPTANCE OF OFFERS
TO PURCHASE SURPLUS REAL PROPERTY
WHEREAS, certain parcels of real property owned wholly or jointly by New Hanover
, County and/or the City of Wilmington have been offered for sale pursuant to North
Carolina General Statute l60A-269; and
WHEREAS, the offerors indicated on the dttached list have agreed to pay the
amounts indicated on the attached list for the parcel of real property shown; and
WHEREAS, the properties are declared by the County Commissioners to be surplus
and not needed for public purposes; and
WHEREAS; it is in the best public interest and welfare to dispose of these
properties in accordance with the negotiated terms and conditions.
NOW THEREFORE BE IT RESOLVED:
1. That pursuant to NCGS l60A-269, the County Commissioners propose to accept
the~offers to purchase indicated on the attached list from the offerors as
indicated.
2. That the County of New Hanover and/or the City of Wilmington will retain
any deposit posted by the offerors when:
a. the offer is withdrawn after posting the deposit; or
b. the offeror fails to pay the balance of an approved offer, due
in cash, within ten (lO) days of receipt of a notice by
certified mail of availability of the deed of conveyance.
3. That the County of New Hanover reserves the right to reject any and
all offers.
4. That the County of New Hanover will require the offerors to deposit five
(5%) percent of the offered prices immediately following adoption of this
resolution.
5, That the Clerk of the Board of Commissioners will publish a notice of the
offers as required by NCGS l60A-269.

THIS AGREEMENT, made and entered into this

Terminal
and bids were received and opened as required by law~ and
WHEREAS,
after careful consideration of the bid
submitted b~ Vendor, the Board of County Commissioners of New
Hanover County has adopted a resolution authorizing the

acceptance of such bid and the execution of a contract with
Vendor covering the purchase and delivery of
Microimage
Terminal
NOW, THEREFORE,
in consideration of the mutual bene-
fits inuring to the parties hereto, said parties covenant and
agree as follows:
1. In accordance with County's specifications and
Vendor's proposal, copies of both of which are attached hereto
and made a part hereof, Vendor will deliver to County the
Microimage Terminal
specifically referred to as Item(s) No. N/A
and more particularly described
in the proposal or in the specifications attached hereto.
2. The total purchase price for said goods in the sum
of Eiqhteen thousand nine hundred forty dollars
and no /lOOths Dollars ($ 18,940.00
) shall be paid by County
in cash within
30
days after the deli very of the goods
and their acceptance by County.
3. The specifications, the proposal, the advertise-
ment by County, the Instructions to Bidders, and the performance
bond for Vendor are attached hereto and made a part of this
contract as though fully written herein.
4. Risk of loss to County for the goods purchased
shall remain with Vepdor until the goods are delivered to County

. 5. Vendor shall deliver all goods purchased by County

insure that applicants are employed, and that employees are
treated during this employment, without regard to their race,
religion, color, sex or national origin.

7. This contract constitutes the entire understanding
of the parties and contains all of the terms agreed upon with
respect to the subject matter hereof.
No modification or
rescission of this contract shall be effective unless evidenced
by a signed writing.

It appearing to the Board of Covnty Commissioners of New Hanover County that
a Resolution of the County Commissioners of New Hanover County of intent to close
a section of Forty-Eight Street was adopted by the County Commissioners on the
17th day of September, 1984, and it further appearing that said resolution called
for a hearing to be held on the 15th day of October, 1984, at which time the,
County Commissioners would hear complaints and comments of interested persons,
and it further appearing that notice of said hearing was publ ished in the
Wi Imington Star-News Newspaper in accordance with the Road Closing Ordinance of
New Hanover County, and after conducting such hearing the County Commissioners
are of the opinion that said Forty-Eight Street in the County of New Hanover
should be closed and are satisfied that the closing,of same is not contrary to
the publ ic interest, and that no individual owning property in the vicinity of
the roads wi I I be deprived of reasonable measn of ingress and egress to his
property by such closing; the legal description of said roads being as fol lows:

RECOMMENDATIONS
Courthouse Development Task Force
1. Ownership of the old Courthouse should be retained by the County. The
Courthouse should be redeveloped with its primary' use being a'visit'ors
information center. It appears that the benefits of creating a visitors
information center to assist in the development of the tourism industry
in the County far outweigh the benefits of developing this building as
an office center complex. The Task Force realizes that the visitors
information center will not require all of the space available, therefore,
consideration should be given to leasing available space to appropriate
government related agencies and tourist related businesses. Specific
interest for leasing space in the Courthouse has been expressed by the
Committee of 100, D.A.R.E., and C.O.G. Revenues generated from leasing
will be for the operation and maintenance of the building. Every effort
should be made to establish the lease rates at a level so as not to create
unreasonable competition with private sector businesses who lease space in
the downtown area.
2. Parking
The TaskForce recommends that some type of parking facility be constructed
at the corner of Market and Third Streets. The success of the Courthouse
being developed into a functional use is highly contingent upon a parking
facility being constructed and interfaced with the activities in the Court-
house and the Judicial Buildings. The Task Force is strongly committed to
the concept that the Courthouse should not be developed unless construction
of a parking facility is also considered and developed simultaneously. In
light of the fact that the primary function of the Courthouse is to be a
visitors information center, free parking should be made available to those
persons visiting the information center.
The Task Force is also aware of the need to keep the appearance of the parking
facility within the context of its historical surroundings. Therefore, the
Task Force recommends that the design of the parking facility be such that it
blends with the surroundings of the downtown area.
3. Princess Street
The Task Force recommends that Princess Street between Third and Fourth Streets
be closed to automobile traffic and made into a pedestrian mall. It is also
recommended that a walkway be constructed from the Princess Street level to the
parking facility proposed for the corner of Third and Market Streets.
The Task Force also recommends that the area below the walkway be designed as
a "minipark", with appropriate landscaping and benches to attract pedestrians.
4.
Historical Exhibits
It is recommended that areas in the Courthouse be designed for exhibits of
historical or cultural significance. These exhibits could be the responsibility

of the County Museum, Historical Society, or samEk other appropriate agency.
The exhibits would be located in areas easily ac~essib1e to the public.
Also, because of the historical significance of the original.desigp of the
courthouse, the Task Force recommends that serioqs consideration be given
to rehabilitating as much of the courthouse as possible to its original
state. Particularly, the Task Force recommends that the entrance! on the north
and south sides of the building be reopened and the interior finishes
be restored to their original state.

Third Street
It is recommended that City Council take appropriate steps to prohibit
truck/heavy vehicles through traffic on Third Street. Upon completion of
the new bridge on Highway 421 in April 1985, there should be no reason for
vehicles of this nature to use Third Street as a thruway to the industrial
sectors located on the outskirts of Wilmington.
