HomeMy WebLinkAbout1983-01-04 RM Exhibits ~ ,If ,,-. ~~.1r -t?~eAfJ RESOLUTIO~ PROPOSI~G ACCEPT.~~CE OF OFFERS TO PURCHASE SURPLUS REAL PROPERTY WHEREAS, certain parcels of real property owned wholly or jointly by New Hanover County and/or the City of Wilmington have been offered for sale pursuant to NCGS l60A- 269; and wnEREAS, the offerors indicated on the attached list have agreed to pay the amounts indicated on the attached list for the parcels of real property shown; and WHEREAS, the properties are declared by the County Commissioners to be surplus and not needed for public purposes; and wnEREAS, it is in the best public interest and welfare to dispose of these properties in accordance with the negotiated terms and conditions. NOW THEREFORE BE IT RESOLVED: 1. That pursuant to ~CGS l60A-269, the County Co~issioners propose to accept the offers to purchase indicated on the attached list from the offerors as indicated. 2. That the County of New Hanover reserves the right to reject any and all offers. 3. That the County of New Hanover and/or the City of Wilmington will retain any deposit posted by the offerors when: a. the offer is withdrawn after posting the deposit; or b. the offer is withdrawn after approval ot the resolution of intent to accept the offer; or c. the offeror fails to pay the balance of an approved offer, due in cash, within ten (10) days of receipt of a notice by certified mail of availability of the deed of conveyance. 4. That the County of New Hanover will require the offerors to deposit five (5) percent of the offered price immediately following adoption of this resolution. 5. RESOLUTIO~ ACCEPTI~G OFFERS TO PURCHASE SURPLUS REAL PROPERTY WHEREAS, certain offers to purchase parcels or real property owned wholly or jointly by New Hanover County and/or the City of \{ilmington have been advertised for upset bid in compliance with North Carolina General Statute l60A-269 and pursuant to resolutions adopted by the City Council of the City of Wilmington on July 27, 1982, amended on August 10, 1982 and the Board of Commissioners of New Hanover Countv on August 2, 1982, amended on August 16, 1982; and . - WHEREAS, there have been no further qualifying upset bids entered for the properties described on the attached list within the statutory period allowed by NCGS l60A-269; and \VHEREAS, the offerors indicated on the attached list have agreed to pay the amounts indicated on the attached list for the parcels of real property shown thereon; and WHEREAS, the properties are declared by the County Commissioners to be surplus and not needed for public purposes; and w~EREAS, it is in the best public interest and welfare to dispose of these properties in accordance with the negotiated terms and conditions. ~OW THEREFORE BE IT RESOLVED: 1. That the City of Wilmington and/or New Hanover County will retain any deposit posted by the offerors as liquidated damages if the offeror fails to pay the balance of an approved offer due in cash within ten (10) days of receipt of a notice by certified mail of availability of the deed of conveyance. 3. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is' hereby further amended as follows: 1. Amend Article II, Definitions by adding a new Section 23-73 to define "Resort" Hotel/~10tel. ~ Section 23-73 Resort Hotel/Motel - an establishment containing multiple guest rooms designed with independent cooking faciliites and intended for temporary lodging, entertainment and various personal services for pay to the traveling public. 2. Amend Article VIII, Off-Street Parking and Loading, Section 81 Minimum Parking Requirements by deleting existing Hotel oarking requirements and changing Motel parking requirements to Hotel/ Motel and establishing the following parking requirements for Resort Hotel/Motel: Uses Resort Hotel/Motel Required Off-Street Parkinq One and a half (1.5) spaces for each unit, plus one (1) space for each two (2) employees, plus requirements for other uses associated with the establishment. 4. Amend Article V, District Regulations, Section 50-2, Table of Permitted Uses by changing Accessory Building to read Accessory Building or Use as follows:' Accessory Building or Use (see Section 62) Permitted in all districts 5. Amend Article II, Definitions, Section 23-17, Lot to read as follows: Section 23-17, Lot - For purposes of this Ordinance, a lot is one or more contiguous properties, or portions thereof, not separated by a public right-of-way. Such "lots" shall be of sufficient size to meet minimum zoning requirements for use, coverage, and area and to provide such yards and open space as are herein required for the location of a principal building or use and its accessory buildings and uses. Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of such conflict is hereby repealed. Section 3. That the Subdivision Regulations of the County of New Hanover adopted February 17, 1969, as amended be, and the same is hereby further amended as follows: ARTICLE III - Subdivision Ordinance Section 4.2 - The subdivider shall submit a final plat for all or part of the approved preliminary plan within one year of the preliminary approval date. Otherwise, the preliminary plan approval shall become void, unless an extension of time is applied for prior to the expiration of one year. The Planning Director may approve one-year extensions of preliminary plan approval. Section 2. Any ordinance or any part of any ordinance in conflict with this ordinance, to the extent of such conflict, is hereby repealed. Section 3.
