RESOLUTION
OF THE
BOARD OF COUNTY COMHISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, after due advertisement, bids were received
and publicly opened by the Finance Department
at 10 o'clock A.M./P.M. on the 28 day of February
19 83, at the County Administration Building, 320 Chestnut
Street, Wilmington, North Carolina, and the following bids were
received for resurfacing work at Hugh MacRae Park
Dickerson, Incorporated
$12,605
$13,090
Trans Con Group, Incorporated
AND WHEREAS, the Parks and Recreation Department,
the Finance Director and the County Manager recommend that the
contract be awarded to Trans Con Group, Incorporated
the lowest responsible bidder, in the amount of
Six Hundred and Five
Twelve Thousand
Doll a r s ($ 12 , 6 05 ) ;
AND WHEREAS, funds have been previously appropriated

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the contract for
Resurfacing Work at Hugh MacRae Park
be awarded to Trans Con Group, Incorporated
in the amount of Twelve Thousand Six Hundred and Five
Dollars ($ 12,605 );
and that the Chairman of the Board of County Commissioners or the
County Manager is hereby authorized and directed to execute the
contract on behalf of New Hanover County, contract form to be
approved by the County Attorney and bid deposit to be retained
until the successful bidder has executed and delivered the
contract and, if required, satisfactory bond.
BE IT FURTHER RESOLVED that the Purchasing Agent is
hereby authorized to return the bid deposits of the unsuccessful
bidders.

AN ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORTH CAROLINA AMENDING THE
THE ZONING ORDINANCE OF
NEW'!HANOVER COUNTY ADOPTED
OCTOBER 6, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Zoning"Ordinance' of -'the County of NelrJ Hanover'adopted
October 6, 1969, as amended be, and the same is hereby further amended as
fo 11 ows :
A. Amend Article VI, Supplementary District Regulations,
Section 63, Erection of More Than One Principal Structure
on a Lot to read as follows:
"...However, any parcel of land upon which are placed at
least three (3) or more mobile homes shall be considered
a mobile home park and regulated by the New Hanover
County Mobile Home and Travel Trailer Park Ordinance."
B. Amend Article XII, Board of Adjustment, Section 120-2, Meetings
to read as follows:
". ..The Chairman, or in his absence, the acting Chairman may
administer oaths. All, meetings of the Board shall be open
to the public. The Board shall keep minutes of its pro-
ceedings, showing the vote of each member upon every question,
or his absence or failure to vote, indicating such fact, and;
also keep records of its examination and any other official action."
C. Amend Article XII, Section 122-1 (3) to'read as follows:
"...In granting any variance, the Board may prescribe appropriate
conditions and safeguards in conformity with this Ordinance. A
concurring vote of four-fifths (4/5) of the members of the Board
shall be necessary to grant a variance. A variance from the
terms of this Ordinance shall not be granted by the Board unless
and until the following findings are made: II
D. Amend Article XII, Section 123-1, by adding a new Section 123-1
to read as follows:
"An appeal from the decision of the Zoning Board of Adjustment
shall be subject to review by the Superior Court by proceedings
in the nature of certiorari. Any petition for review by the
Superior Court shall be filed with the Clerk of Superior Court
within 30 days after the decision of the Board is filed in the
Office of the Clerk to the Board, or after a written copy
thereof is delieverd to every aggrieved party who has filed
a written request for such copy with the Clerk or Chairman of
the Board at the time of the hearing of the case, which is later:1I
Section 2. Any ordinance or any part of any ordinance in conflict with this
ordinance, to the extent of such conflict, is hereby repealed.
Section 3. This ordinance is adopted in the interest of public health,
safety, morals, and general welfare of the inhabitants of the County of New
Hanover, North Carolina, and shall be in full force and effect from and after
its adoption.

lng resolution and moved that it be adopted:
WHEREAS, the bond order hereinafter described has
taken effect and the Board of Commissioners of the County of
New Hanover has issued $390,000 Sanitary Sewer Bond Antici-
pation Notes dated September 14, 1982, payable March 16,
1983 to borrow money for the purposes for which bonds are
authorized to be issued by said order; and
WHEREAS, the Board of Commissioners of the County
of New Hanover desires to renew the foregoing notes in
anticipation of the receipt of the proceeds of the sale of
said bonds, as hereinafter provided; NOW, THEREFORE,

BE IT RESOLVED by the Board of Commissioners of
the County of New Hanover, as follows:
(1) The outstanding $390,000 Sanitary Sewer Bond
Anticipation Notes payable March 16, 1983 which have been
issued in anticipation of the sale of the bonds authorized
by a bond order adopted by the Board of Commissioners of the
County of New Hanover on June 7, 1982, shall be renewed by
the issuance of $390,000 Sanitary Sewer Bond Anticipation
Notes, in anticipation of the receipt of the proceeds of the
sale of the bonds authorized to be issued by said order.
Said notes shall consist of nine notes of the denomination
of $10,000 each, numbered
to 9, inclusive, and twelve
notes of the denomination of $25,000 each, numbered 10 to
21, inclusive. Said notes shall be dated March 16, 1983,
shall be payable September 14, 1983 and shall bear interest
at the rate of 5.50% per annum, payable at maturity.
(2) . The Chairman and Clerk of the Board of
Commissioners are hereby authorized and directed to cause
said notes to be prepared and to execute said notes.
(3) The Chairman and Clerk of the Board of
Commissioners are hereby authorized to make application to
the Local Government Commission of North Carolina for its
approval of said notes in the manner prescribed by The Local
Government Finance Act. The Local Government Commission
is hereby requested to deliver said notes through the

State Treasurer in exchange for said outstanding notes upon
payment of the interest payable with respect to said
outstanding notes to the holder of said outstanding notes.
The motion having been duly seconded, and the
resolution having been considered, it was adopted, Messrs.
voting for the resolution and no one voting against it.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS

NEW HANOVER COUNTY
WHEREAS, the New Hanover County Board of Commissioners
~
is aware that .08 mile in length of State Road #1412, in the
#
vicinity of the intersection of U.S. Highway #76, State Road
#1409 and State Road #1411 near Airlie Gardens, is no longer in
existence as a result of the construction of the new intersection
of said roads and highways, and
WHEREAS,
the Office of the District Engineer,
Department of Transportation, State of 0l'orth Carolina, has
advised the Board of Commissioners that this section of said road
is not now maintained by the Department of Transportation as a
resul t of said construction,
and tha t said Department of
Transportation desires to delete said .08 mile in length from its
system;
NOW, THEREFORE, BE IT RESOLVED that the New Hanover
County Board of Commissioners does hereby concur with the
Department of Transportation in its effort to update County maps
by deleting .08 mile in length of State Road #1412 from the State
