A RESOLUTION REGARDING THE ADOPTION BY THE UNITED STATES ARMY
CORPS OF ENGINEERS OF A WRITTEN POLICY AND PROCEDURE GOVERNING
THE PLACEMENT OF DREDGED MATERIAL IN COASTAL AREAS
WHEREAS, many factors
oceanic currents move sand, and
affect the manner
in
which
WHEREAS, after years of observation, there appears a
natural tendency because of these factors for both the erosion
and the accretion of beach material to occur, the realization has
come to the Board of Commissioners of New Hanover County that,
though Nature may take away our beaches' strand material and may
bring it back, the intrusion of man can seriously contribute to
an imbalance of the two processes.
WHEREAS, the United States Army Corps of Engineers has
been given the responsiblity to maintain waters navigable, and
WHEREAS, in the area of New Hanover County, the Corps
has enjoyed a large inventory of areas upon which dredged
material can be placed, and

BE . IT FURTHER RESOLVED that such a beach strand
renourishment policy be written and incorporated as part of a
written procedure whereby affected beach communities and counties
have the opportunity to establish perpetual easements and mutual
agreements with the United States Army Corps of Engineers for
facilitating the Corps' responsibility of exploring all feasible
means to place suitable dredged material as described hereinabove
on the Ocean Strand, thereby not depleting Nature's supply of
material for its own renourishment efforts,

acceptance of such bid and the execution of a contract with

or applicant for employment because of race, religion, color, sex
or national origin. Vendor agrees to take affirmative actions to
insure that applicants are employed, and that employees are
treated during this employment, without regard to their race,
religion, color, sex or national origin.

RESOLUTION ACCEPTING DEED
FOR PROPERTY IN WIUUNGTON BEACH
TO PROVIDE PUBLIC ACCESS TO OCEANFRONT
WHEREAS, New Hanover County's Policies for Growth and
Development stipulate that adequate public recreational
faci1ities will be provided and maintained in proportion to area
needs; and
WHEREAS,
public access to the area's natural
recreational amenities such as the ocean, rivers and sounds is a
basic right of all residents; and
WHEREAS, New Hanover County is the most urbanized
coastal county in the State and, indeed, is the fastest-growing
metropolitan area in North Carolina; and
WHEREAS, Wilmington Beach Investment Corp. has offered
to convey to the County certain portions of streets located in
WiJ.mington Beach Subdivision where such streets provide access
for the property owners in said subdivision and the general
public to the strand of the Atlantic Ocean; and
WHEREAS, New Hanover County intends to improve said-
property as part of the County's efforts to provide beach access;
and
WHEREAS, New Hanover County lS authorized to acquire
property by any lawful method and use it for beach access by the
public;
NOW, THEREFORE, BE IT RESOLVED tha t the Board of
County Commissioners of New Hanover County does hereby accept the

Those certain tracts or parcels of land lying and being
in New Hanover County, State of North Carolina, Federal
Point Township, and more particularly' described as

Highway 421, as the same are shown on the map of

IN THE MA'ITER OF RENAMING
ORDINANCE
It appearing to the Board of County Corrunissioners of New Hanover County that
consideration has been given to the renaming of 1st, 3rd, 4th, 5th, 6th, 7th, and
Georgia Avenues as shown on P.B. 3 Pg. 37; 8th, 9th, and lOth Avenues as shown on
P.B. 2 Pg. 30; 2nd Street and 2nd Avenue (south) as shown on P.B. 5 Pg. 37 and
PoB. 5 Pg. 26 and it further appearing that a public hearing was held on
August 1, 1983, at which time all persons were heard on the question of whether or
not the renaming would be in the public interest, and it further appearing that
notice of said hearing was transmitted to all resident owners and prominently
posted in at least two (2) flocations along said road, and published in the Star
News local newspaper, and the Board of County corrunissioners is of the opinion that
said public roads in New Hanover County should be renamed and the renaming of same
is in the public interest, the description of which is delineated on the attached
exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above described roads are
hereby renamed as follows:
43 1st Avenue changed to Lake Park Blvd.

IN THE MATI'ER OF RENAMING
2ND AVENUE
ORDINANCE
It appearing to the Board of County Camnissioners of New Hanover County that
consideration has been given to the renaming of 2nd Avenue, as shown on P.B. 3 Pg.
37; and it further appearing that a public hearing was held on August 15, 1983, at
which time all persons were heard on the question of whether or not the renaming
would be in the public interest, and it further appearing that notice of said
hearing was transmitted to all resident owners and prominently posted in at least
two (2) locations along said road, and published in the Star News local newspaper,
and the Board of County Commissioners is of the opinion that said public road in
New Hanover County should be renamed and the renaming of same is in the public
interest, the description of which is delineated on the attached exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above described road is
hereby renamed as follows:

IT IS FURmER ORDERED that a copy of this Ordinance be recorded in the Office
of the Register of Deeds of New Hanover County, North Carolina, and that notice of
the action taken by the Board of County Commisioners be transmitted to the
postmaster having jurisdiction over the roads, the North Carolina Board of
Transportation and to any city within five (5) miles of said roads in accordance
with N. C. General statute 153A-230.

TO CLOSE A PUBLIC ROAD
WHEREAS, a petition has been filed pursuant to G. S, 153A-
241, request~ng the Board of Commissioners of New Hanover County
to close the following described public road:
The 90.0 foot portion of the northeast end of Second Avenue,
140.0 feet of the northeast end of Third Avenue and '86.5 feet of
the Northeast end of Fourth Avenue as appears on the map of
Seabreeze Park recorded in Map Book 69, page 11 of the New
Hanover County Registry.
NOW, THEREFORE, BE IT RESOLVED, that this Board is
considering closing said road to public use, and that a public
hearing on this question will be held on the 19th day of
September, 1983, at 9:00 o'clock A.M. in the Assembly Room of the
County Administration Building, 320 Chestnut Street, Wilmington,
North Carolina, at which time the Board will hear all interested
citizens and make a final determination as to whether the
unopened road shall be closed.
The foregoing resolution was adopted by the New Hanover
County Board of Commissioner on the

The Board of Commissioners of the County of
New Hanover, North Carolina, met in regular seSSion at the
County Administration Building in Wilmington, North Carolina,
the regular place of meeting at ~_ o'clock, A.M., on August
15, 1983. The following Commissioners were:

Facilities and Pollution Control Financing Authority

Autho~~ty proposes to adopt a bond resolution authorizing
the issuance of revenue bonds in the aggregate principal
amount of $7,500,000 and the execution and delivery of
financing documents pertaining La the financing of indus-
trial facilities in New Hanover County for Siemens-Allis,
Inc. (the "Company").
The representative submitted to the Board drafts
of a Bond Purchase Agreement among the Authority, the

Company, Chemical Bank (the "Bank") and Trust Company Bank,
as Depositary and Bond Registrar, a Loan Agreement between
the Authority and the Company, an Assignment from the
Authority to the Bank and a Guaranty among the Company,
Siemens Capltal Corporation and the Bank. The representative
further stated that the Bond Purchase Agreement set forth
the terms of the revenue bond flnancing, including the
proposed issuance and sale of the bonds to the Bank, as
purchaser, at a price of 100% of the principal amount
thereof and requested that the Board approve the lssuance ot
the bonds.

,WHEREAS, the Board of County Commissioners has
created a political subdivision and body corporate and
politic of the State of North Carolina known as "The

New Hanover County Industrial Facilities and Pollution
Control Financing Authority" (the "Authority"); and
WHEREAS, the Authority is authorized under the
Industrial and Pollution Control Facilities Financing
Act, Chapter 159C of the General Statute of North Carolina
as amendej (the "Act"), to issue revenue bonds for ihe
purpose, among others, of paying all or any part of the cost
of any industrial project for industry: to acquire, construct,
improve and equip any such project: and to make and execute

financing agreements, security documents and other contracts
and instruments necessary or convenient in the exercise of
such powers; and
WHEREAS, the Authority proposes to issue its
revenue bonds in the aggregate prlncipal amount of ~7,500,OOO
(the "Bonds") and to loan the proceeds thereof to the
Company to finance the costs of the acquisition from Gould,
Inc. and expansion of industrial facilities in Wilmlngton
for the production of residential and light industrlal
molded case circuit breakers, including an approximately 12
acre site, an existlng building and machinery and equlpment
(the "Project") and;
WHEREAS, the Board has heretofore held a public
hearing, pursuant to public notice duly given, and has
heretofore approved the Project in principle and the issu-
ance of re~enue bonds to finance the Project; and
WHEREAS, the Act provides that no bonds shall be
issued thereunder unless the issuance thereof shall hav~
been approved by the governing body of thaCounty and the
Board ,desires to approve the issuance of the Bonds by
the Authority; and
WHEREAS, the Board has considered the Bond Pur-
chase Agreement presented to it setting forth the terms of
the revenue bond financing;
