PROJECT ORDINANCE
INDUSTRIAL AIRPARK - WATER AND SEWER
BE IT ORDAINED, by the Board of Commissioners of New
Hanover County:
WHEREAS:
1. New Hanover County (County) is engaged in the
construction of water and sewer lines to serve the Industrial
Airpark which capital project involves the construction or
acquisition of a capital asset.
2. County desires to authorize and budget for said
capital project in a project ordinance adopted pursuant to
North Carolina General Statute ~159-13.2, such ordinance to
authorize all appropriations necessary for the completion of
said project.
NOW, THEREFORE, WITNESSETH THAT:
1. This project ordinance is adopted pursuant to North
Carolina General Statute 1159-13.2.
2. The capital project undertaken pursuant to this
ordinance is the construction of water and sewer lines to
serve the Industrial Airpark, which project is herewith
authorized.
3. The revenue that will finance said project is:

COURTHOUSE RENOVATION ~ NEW HANOVER COUNTY
BE IT ORDAINED, by the Board of Commissioners of New
Hanover County:

WHEREAS:
1. New Hanover County (County) is engaged in the
renovation of the Courthouse which capital project involves
the construction or acquisition of a capital asset.
2. County desires to authorize and budget for said
capital project in a project ordinance adopted pursuant to
North Carolina General Statute 1 159-13.2, such ordinance to
authorize all appropriations necessary for the completion of
said project.
NOW, THEREFORE, WITNESSETH THAT:

RESOLUTION OF INTENT
TO CLOSE A PUBLIC ROAD
WHEREAS, a petition has been filed pursuant to G. s. 153A-
241, requesting the Board of Commissioners of New Hanover County
to close the following described public road:
Portions of Avery Drive located in the Magnolia Heights
Subdivision as recorded in Map Book 6, Page 8 of the New Hanover
County Registry in 1955.
Magnolia Heights is located Northeast
of Bradley Drive and adjoins Bradley Creek in Harnett township.
The portions consist of all three segments of Avery Drive
except 120.0 feet located at the Northwestern end of the most
Northern segment.
NOW, THEREFORE, BE IT RESOLVED, that this Board is
considering closing said road to public use, and that a public
hearing on this question will be held on the j7~_ day of
9~ 1983, at 7:00 o'clock P.M. in the Assembly Room of the
County Administration Building, 320 Chestnut Street, Wilmington,
North Carolina, at which time the Board will hear all interested
citizens and make a final determination as to whether the road
shall be closed.
The foregoing resolution was adopted by the New Hanover
County Board of Commissioner

RESOLUTION OF THE
BOARD OF' COMi'lISSIONERS OF
NEW HANOVER COUNTY
T'he Board of Commissioners of New Hanover County, at
its regular meeting in the Commissioners' Assembly Room, on the
first floor of the New Hanover County Administration Building,
320 Chestnut Street, Wilmington, North Carolina, at 7:00 p.m. on
Monday, October 3, 1983, with the following members present:
Karen B. Gottovi, Chairman
Jonathan Barfield, Sr.
Donald P. Blake
Nolan O'Neal
Claud O'Shields, Jr.
discussed the request of the New Hanover County Board of
Education for school building construction and additions.
Commissioner Barfield introduced, and moved the following
Resolution be adopted:
WHEREAS, the New Hanover County Board of Education has
presented a request for Capital Outlay Funds to build several new
schools and add to some existing schools; and
WHEREAS, the Board of Commissioners has determined that
the total cash requirement to pay the capital cost for improving
public school facilities ln New Hanover County, including the
construction of three new school buildings and additions to two
existing schools, would be $11,500,000, and that in order to
ralse the money to pay these capital costs, in addition to any
funds which may be made available for such purpose from any other
sources, the Board of Commissioners will apply for and seek
authorization to issue bonds of the County of New Hanover,
pursuant to the Local Government Finance Act of North Carolina,

in the amount of $11,500,000; and
WHEREAS, the repayment of these bonds can be reasonably
expected from revenues from non-property sources, such as the
1/2% sales tax, thus avoiding any additional tax increase in New
Hanover County; and
WHEREAS, the New Hanover County Attorney and Finance
Officer shall be the representatives of New Hanover County to
file application for approval of such general obligation bonds,
with the Local.Government Commission;
NOW, THEREFORE, BE IT RESOLVED that Robert W. Pope,
County Attorney, and Andrew J. Atkinson, County Finance Officer,
are designated representatives of New Hanover County to file
application with the North Carolina Local Government Commission
for i~suance of general obligation bonds, in an amount not to
exceed $11,500,000, for the construction of and additions to
schools in New Hanover Count.y; and BE IT FURTHER RESOLVED that
Robert W. Pope, County Attorney, lS authorized to employ the firm
of LeBoeuf, Lamb, Leiby & MacRae, New York, New York, as bond
counsel to represent New Hanover County in the authorization arid
lssuance of said bonds.
The motion was seconded by Commissioner O'Neal and was
adopted by the following vote:

RESOLUTION OF THE
NEW HANOVER COUNTY BOARD OF EDUCATION .
WHEREAS, the New Hanover County Board of Education is
of the opinion that existing school facilities in the New Hanover
County Schools Administrative Unit are not adequate for the
maintenance of the public schools in said Administrative Unit for
the school term prescribed by law;
NOW, THEREFORE, BE 1'1' RESOLVED by the New Hanover
County Board of Education:
That the New Hanover County Board of Education has
ascertained and determined and finds that it is necessary to
provide additional public school facilities in the New Hanover
County Schools Administrative Unit, including the construction of
new school buildings and additions to existing school buildings
and the acquisition and installation of furnishings and equipment
necessary for such school facilities, and that it will be
necessary to expend for such purpose, from proceeds of general
obligation bonds and apart from other funds which may be avail-
able therefor, not less than $11,500,000.
The Board of Commissioners of New Hanover County is
hereby requested to provide the funds required for the improve-
ments hereinbefore set out and to issue general obligation bonds
of New Hanover County to raise the required funds and to submit
the question of issuing said bonds to accomplish such financing
to the voters of New Hanover County.
The Secretary of the New Hanover County Board of

Education is hereby directed to transmit a copy of this
resolution to the Board of Commissioners of New Hanover County.
