THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section I. The Zoning Map of Zoning Area: Castle Hayne is
hereby amended by removing the hereinafter described tract from
the R-15 Residential Zoning District Classification and placing
it in the B-2 Highway Business Zoning District Classification,
said land being described as follows:
Beginning at a point, said point being the intersection of the
southern right-of-way of Hickory Avenue and the eastern right-
of-way of US 117, thence in a southerly direction along the eastern
right-of-way of US 117, 170± feet to a point, thence due east 200±
feet to a point, thence 170± feet due north to a point in
the southern right-of-way of Hickory Avenue, thence due west 200±
feet to the point and place of beginning.
Section 2. The County Clerk is hereby authorized and directed
under the supervision of the County Commissioners to change the Zoning
Map of Zoning Area: Castle Hayne on file in the office of the County
Commissioners, so as to make it comply with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict
with this ordinance, to the extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public
health, safety, morals and general welfare of the inhabitants of the
County of New Hanover, North Carolina, and shall be in full force and
effect from and after its adoption.

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of the Castle Hayne Zoning Area
is hereby amended by removing the hereinafter described tract
from the R-15 and R-20 Residential Zoning District Classification
and placing it in the B-2 Highway Business Zoning District
Classification, said land being described as follows:
All of Parcels 004, 005, and 006 of Tax Map 11-17, Block
006, and Parcels 001, 001.1, and 005, Tax Map 11-00, Block
010. Said parcels are located on the southwest and
northeast sides of NC 132, just south of the NC 132 - US 117
intersection.
Section 2. The County Clerk is hereby authorized and
directed under the supervision of the County Commissioners to
change the Zoning Map of the Castle Hayne Zoning Area on file in
the office of the County Commissioners, so as to make it comply
with this ordinance.
Section 3. Any ordinance or any part of any ordinance in
conflict with this ordinance, to the extent of such conflict, is
hereby repealed.
Section 4. This ordinance is adopted in the interest of
public health, safety, morals and general welfare of the
inhabitants of the County of New Hanover, North Carolina, and
shall be in full force and effect from and after its adoption.

AMENDING THE ZONING MAP OF THE CASTLE HAYNE ZONING AREA
OF NEW HANOVER COUNTY, NORTH CAROLINA
ADOPTED JULY 1, 1985
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of the Castle Hayne Zoning Area
is hereby amended by removing the hereinafter described tract
from the RA Rural Agricultural Zoning District Classification and
placing it in the B-2 Highway Business Zoning District
Classification, said land being described as follows:
Beginning at a stake in the northern line of Castle Avenue
at a point where the said northern line of Castle Avenue
intersects the eastern line of Cedar Street, and running
thence 330 feet eastwardly along the northern line of Castle
Avenue to a stake in the western line of Peachtree Street;
running thence and at right angles to the said northern line
of Castle Avenue 330 feet northwardly along the said western
line of Peachtree Street to a stake; running thence, and
parallel to the said northern line of Castle Avenue 355 feet
westward to a point on the centerline of Cedar Avenue;
running thence, and at right angles to the said northern
line of Castle Avenue, 330 feet southward to a point on the
northern line of Castle Avenue; thence 25 feet eastwardly
along the said northern line of Castle Avenue to the point
of beginning, the same being all of Block 26 and the eastern
one-half of Cedar Street parallel to Block 26 as shown on a
map of Castle Hayne's Townsite recorded in the office of the
Register of Deeds of New Hanover County, North Carolina, in
Book 48, at Page 150, on March 20, 1906.
And being the same property conveyed to Andrew Lorek and
wife, Sophia Lorek, by deed recorded in Book 404 at Page 161
in the Office of the Register of Deeds of New Hanover
County, North Carolina. That 25 feet by 330 feet parcel
being the eastern one-half of Cedar Street lying adjacent to
Block 26 having been withdrawn from dedication pursuant to a
declaration of withdrawal which was recorded on July 26,
1954, in Book 528, at Page 64, in the Office of the Register
of Deeds of New Hanover County, North Carolina.
Section 2. The County Clerk is hereby authorized and
directed under the supervision of the County Commissioners to
change the Zoning Map of Zoning Area No. on file in the office
of the County Commissioners, so as to make it comply with this
ordinance.
Section 3. Any ordinance or any part of any ordinance in
conflict with this ordinance, to the extent of such conflict, is
hereby repealed.

directed under the supervision of the County Commissioners to

the office of the County Commissioners, so as to make it comply
with this ordinance.

hereby repealed.

Beginning at an iron pipe in the eastern line of U.S.
Highway #117, said iron pipe being located south 40 degrees
26 minutes west 319.77 feet from the intersection of the
eastern line of U.S. Highway #117 with the centerline of
County Road 1335 (also known as the Skippers Corner Road,
said U.S. Highway #117 having a width of 60 feet and County
Road 1335 having a width of 40 feet for the purpose of this
description), said beginning point also being the dividing
line between Tracts 11 and 12 as shown on a map of a
re -division of a section of the Hermitage Estate made by
M.H. Lander, C.E., September 22, 1942, and recorded in Map
Book 4, Page 22 of the New Hanover County Registry; thence

East 271.02 feet to an iron pipe; running thence, at right
angles to said dividing line, South 30 degrees 35 minutes
West 295.64 feet to an iron pipe in aforementioned dividing

the point of beginning, containing 2.67 acres of land, more

line of said Forty (40) foot N.C. State Road, and twenty

degrees, twenty-five (25) minutes East ten hundred and forty
five (1045) feet to the run of Peter Spring Branch; thence
South following the run of said Branch as it meanders to a
point in the dividing line of Lots 11 and 12, thence West,

of way line of U.S. Highway #421, said point being thirty

IN A CONDITIONAL USE ZONING DISTRICT

The County Commissioners for New Hanover County having held a public hearing on
Monday January 8, 2001 to consider application number Z-714 submitted by Berrie Marshburn, a
request for a special use permit to use the property located at 4331 Castle Hayne Road and
having heard all of the evidence and arguments presented at the hearing, make the following
FINDINGS OF FACT and draw the following CONCLUSIONS:
1. The County Commissioners FIND AS A FACT that all of the specific requirements set forth
in Section 72-27 of the County Zoning Ordinance WILL be satisfied if the property is developed
in accordance with the plans submitted to the County Commissioners.
2. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the first
general requirement listed in the Ordinance; namely that the use will not materially endanger the
public health or safety if located where proposed and developed according to the plan as submitted
and approved. In support of this conclusion, the Commissioners make the following FINDINGS
OF FACT:
A. The site is served by individual well and septic.
B. The site is located within the Castle Hayne VFD.
C. Access to the site is through an existing improved access easement.
3. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the
second general requirement listed in the Ordinance; namely that the use meets all required
conditions and specifications. In support of this conclusion, the Commissioners make the
following FINDINGS OF FACT:
A. A site plan showing existing features and setbacks has been provided.
B. Any additions to the site will have to meet the setbacks and buffer requirements of the
ordinance.
4. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the third
general requirement listed in the Ordinance; namely that the use will not substantially injure the
value of adjoining or abutting property, or that the use is a public necessity. In support of this
conclusion, the Commissioners make the following FINDINGS OF FACT:
A. No additional parking or buildings are proposed.
B. The warehouse is existing on the property.
5. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the
fourth general requirement listed in the Ordinance; namely that the location and character of the
use if developed according to the plan as submitted and approved will be in harmony with the area
in which it is to be located and in general conformity with the plan of development for New
Hanover County. In support of this conclusion, the Commissioners make the following
FINDINGS OF FACT:
A. Other areas nearby are zoned I-1 Light Industrial.
B. According to the Comprehensive Plan, the property is located in the resource protection land
classification which was established to provide for the preservation and protection of natural
resources.
6. Therefore, because the County Commissioners conclude that all of the general and specific
conditions precedent to the issuance of a SPECIAL USE PERMIT HAVE been satisfied, IT IS
ORDERED that the application for the issuance of a SPECIAL USE PERMIT BE GRANTED subject
to the following conditions:
A. That the applicant shall fully comply with all of the specific requirements stated in the
ordinance for the proposed use, as well as any additional conditions hereinafter stated.
B. If any of the conditions imposed by this special use permit shall be held invalid beyond the
authority of this Board of Commissioners by a court of competent jurisdiction, then this permit
shall become void and of no effect.
C. Other:
1) All other applicable federal, state and local laws.
2) The use will be limited to the Motorcycle shop
3) The motorcycle shop can only be operated by the current property owner
4) A 60' wide strip connecting to the 1-1 district across Castle Hayne Road will be provided
on the petitioners property adjacent and south of the subject property to be utilized for
access to the Motorcycle shop.
5) Improvements to this access drive must be completed within 6 months of the rezoning.

AN ORDINANCE OF THE COUNTY OF NEW HANOVER
AMENDING THE OFFICIAL ZONING MAP
OF NEW HANOVER COUNTY, NORTH CAROLINA
ADOPTED October 15, 1969 respectively and subsequently amended
CASE:Z22-06
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The New Hanover County Zoning Map is hereby amended by removing the hereinafter
described tract from an R-20, Residential District, and placing it in (CZD) CS, Conditional
Commercial Services (CS) District, said land consisting of approximately 30.41 Acres and being
described legally as follows:
Beginning at an existing iron pipe in the northern margin of Hermitage Road,
having NC Grid Coordinates of N: 210464.51, E: 2329053.82, and being the
northeastern corner of the lands shown in Map Book 14, Page 7, and running
thence across Hermitage Road S 02°09'11"W—60.43'to a new iron rod set in
the southern margin of the road;
Thence with the line of the lands shown in Map Book 16, Page 35; Deed Book
5400, Page 38; and Map Book 53, Page 248, S 01°03'25" E — 1241.56' to an
existing iron rod;
Thence continuing S 01°03'25" E—21.10' to a new iron rod, the southeastern
corner of Map Book 14, Page 7 on the northern line the lands of General
Electric Co. as shown in Deed Book 807, Page 569;
Thence with the line of the lands of General Electric Co.the following three(3)
calls:
S 89°31'18"W—403.94' to an existing concrete monument;
S 89°31'18" W—197.75'to a new iron stake;
S 89°25'18" W—440.54' to a new iron stake, the southwestern corner of Map
Book 14, Page 7;
Thence with the line of the lands of North Carolina State University as shown
in Deed Book 404, Page 318, N 02°16'11"W—1242.40'to an existing iron pipe,
said iron pipe being located 12.29' north of the southern margin of Hermitage
Road and being the northwestern corner of Map Book 14, Page 7;
Thence within the margin of Hermitage Road the following two (2) calls:
S 88°35'41" E—474.00' to an existing iron pipe;
N 80°15'03" E — 605.32' to an existing iron pipe, the Point and Place of
Beginning.
Said parcel as described containing 1,326,003 square feet or 30.411 acres,

more or less, including the area within the margins of Hermitage Road, and
1,291,303 square feet or 29.644 acres, more or less, excluding the area with
the margins of Hermitage Road.
Section 3. Any ordinance or any part of any ordinance in conflict with this ordinance,to the extent
of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health, safety, morals and general
welfare of the inhabitants of the County of New Hanover, North Carolina and subject to the
conditions also approved as part of this action, shall be in full force and effect from and after its
adoption.
Section 5. The County Commissioners find, in accordance with the provisions of NCGS 160D that
the zoning map amendment of approximately 30.41 acres of land from an R-20, Residential
District, and placing it in a (CZD) CS, Conditional Commercial Services(CS) District, is:
Consistent with the purposes and intent of the Comprehensive Plan because it will allow
for the types of commercial uses encouraged in the Employment Center place type. The
County Commissioners also find approval of the rezoning request is reasonable and in the
public interest because the proposed district will provide a transition between light
industrial uses to the east and current lower intensity development that may transition
in the future.
Section 6. The County Commissioners find that all of the specific requirements set forth in
Sections 3.4.8, and 10.3.3 of the County Unified Development Ordinance WILL be satisfied if the
property is developed in accordance with the plans submitted to the County Commissioners and
attached as part of this approval. IT IS ORDERED that the application for the issuance of a
Conditional Zoning District BE GRANTED subject to the following conditions:
A. The total square footage of business park flex space shall be limited to a maximum
130,000 square feet.
Section 7. In accordance with Section 10.3.3.C.7.c of the ordinance, revocation of the Conditional
Zoning District approval may be considered if no building permit has been issued for the subject
tract within two years of the date of this approval.
Section 8. The applicant shall fully comply with all of the specific requirements sta -• in the
Ordinance for the proposed use; and all other state, federal and local rules.

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The New Hanover County Zoning Map is hereby amended by removing the hereinafter
described tract from a R-15, Residential 15 District, and placing it in a Community Business CB,
and R-10, Residential R-10 District, said land consisting of approximately 1.84 acres and being
described legally per the survey entitled Map of Survey for Doug Reeves prepared September
1,2021 by F.W. Jones Surveying Company, as shown in exhibit A.
Section 2. The County Clerk is hereby authorized and directed underthe supervision oftheCounty
Commissioners to change the New Hanover County Zoning Map on file in the office of the County
Commissioners,so as to make it comply with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with this ordinance,to the extent
of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health, safety, morals and general
welfare of the inhabitants of the County of New Hanover, North Carolina and subject to the
conditions also approved as part of this action, shall be in full force and effect from and after its
adoption.

types of residential and commercial uses encouraged in the Community Mixed Use place
type.The County Commissioners also find approval of the rezoning request is reasonable
and in the public interest because the site is located on an arterial street near existing
commercial services and would serve as a transition between the Castle Hayne
commercial node to the south and residential properties to the north and east.
Section 6. The County Commissioners find that all of the specific requirements set forth in
Sections 3.3.7, and 10.3.4 of the County Unified Development Ordinance WILL be satisfied if the
property is developed in accordance with the plans submitted to the County Commissioners and

attached as part of this approval. IT IS ORDERED that the application for the issuance of a Planned
Development Zoning District BE GRANTED subject to the following conditions:
Section 7. In accordance with Section 10.3.2.B.6.c of the ordinance,a Zoning Map shall not expire
and shall remain valid unless and until the land that was subject of the amendment is
subsequently reclassified to a different zoning district in accordance with Section 10.3.2, Zoning
Map Amendment, Section 10.3.3, Conditional Zoning, or Section 10.3.4, Master Planned
Development.
Section 8. The applicant shall fully comply with all of the specific requirements stated in the
Ordinance for the proposed use; and all other state, federal and local rules.
