ASSEMBLY
The District Board of Commissioners of the New Hanover County Water and Sewer District met in
Regular Session on Monday, November 19, 2007, at 11:53 a.m. in the Assembly Room of the New Hanover County
Courthouse, 24 North Third Street, Wilmington, North Carolina.
Members present were: District Chairman William A. Kopp, Jr.; District Vice-Chairman Robert G. Greer;
District Commissioner William A. Caster; District Commissioner Ted Davis, Jr.; District Commissioner Nancy H.
Pritchett; County Attorney Wanda M. Copley; Clerk to the District Board Sheila L. Schult and County Manager
Bruce T. Shell.
NON-AGENDA ITEMS
District Chairman Kopp announced that time had been reserved for anyone from the public to present an
item that was not listed on the Regular Agenda. He requested all persons to limit their remarks to three minutes.
No items were presented.
APPROVAL OF MINUTES
District Chairman Kopp called for a motion to approve the minutes of the Water and Sewer District
Regular Meeting held on November 5, 2007, as presented by the Clerk to the District Board.
Motion:
District Commissioner Caster MOVED, SECONDED by District Vice-Chairman Greer, to approve the
minutes of the Water and Sewer District Regular Meeting held on November 5, 2007, as presented by the Clerk to
the District Board. Upon vote, the MOTION CARRIED UNANIMOUSLY.
ADOPTION OF RESOLUTION APPROVING THE WATER AND SEWER AUTHORITY INTERLOCAL
AGREEMENT TRANSFERRING NEW HANOVER COUNTY WATER AND SEWER DISTRICT ASSETS
AND OPERATION OF THE WATER AND SEWER SYSTEM TO THE CAPE FEAR PUBLIC UTILITY
AUTHORITY
District Chairman Kopp reported that the proposed Interlocal Agreement, between New Hanover County,
New Hanover County Water and Sewer District, City of Wilmington and the Cape Fear Public Utility Authority, is a
closing document transferring title of the water and sewer system and enterprise funds to the Cape Fear Public
Utility Authority and setting forth operation arrangements with a July 1, 2008 closing date. The guiding principles
previously established by the City and County are set forth in the preamble. Various attachments to the agreement
are in the process of being completed, and the District Board is requested to consider approval of the Agreement at
this time authorizing and directing the County Manager to assist the District?s Attorney and District?s Chairman to
complete the exhibits to the Interlocal Agreement. The New Hanover County Board of Commissioners adopted a
similar resolution at their meeting today.
DistrictChairman Kopp requested direction from the Board.
Motion:
District Vice-Chairman Greer MOVED, SECONDED by District Commissioner Caster, to adopt the
resolution approving the Water and Sewer Authority Interlocal Agreement transferring title of the water and sewer
system and enterprise funds from New Hanover County Water and Sewer District to the Cape Fear Public Utility
Authority and setting forth operation arrangements and authorizing the District?s Attorney with the assistance of the
District?s Chairman and County Manager to complete the exhibits to the Interlocal Agreement. Upon vote, the
MOTION CARRIED UNANIMOUSLY.
A copy of the resolution is hereby incorporated as a part of the minutes and is contained in Water and
Sewer Exhibit Book 3, Page 22.
A copy of the interlocal agreement is on file in the Legal Department.
