AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby further amended as follows: 1. Amend Article XIII, ilLegal Provisions," Section 132, Penalties for Violation of the New Hanover County Zoning Ordinance by replacing the first paragraph in this Section with the following: . "Violation of the provisions of this Ordinance or failure to comply with any of its requirements shall constitute a misdemeanor and shall be punishable pursuant to the provisions of NCGS 14-4 which provides that violation of a County Ordinance is a misdemeanor punishable by either a maximum fine of fifty dollars ($50.00) or imprisonment for not more than 30 days as amended. Each day such violation continues shall be considered a separate offense." 2. Amend the Enactment Section of the Zoning Ordinance to read as follows: ENACTMENT: AN ORDINANCE ESTABLISHING COMPREHENSIVE ZONING REGULATIONS FOR CERTAIN AREAS OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA, AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT, AND AMENDMENT THEREOF, IN ACCORDANCE WITH THE PROVISIONS OF NORTH CAROLINA GENERAL STATUTES 153A-340 THROUGH 153A-348, INCLUSIVE... 3. Delete Zoning Ordinance Section 71-1 (7). Replace with the following: "Every decision by the Board of Commissioners issuing or denying a special use permit shall be subject to review by the Superior Court by proceedings in the nature of certiorari. Any petition for review by the Superior Court shall be filed with the Clerk of Superior Court within 30 days after the decision of the Board is filed in the Office of the Clerk to the Board, or after a written 'copy thereof is delivered to every aggrieved party who has filed a written request for such copy with the Clerk or Chairman of the Board at the time of the hearing of the case, whichever is later." Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. AN ORDINANCE OF THE COUNTY DF NEW HANOVER, NORTH CAROLINA AMENDING THE MOBILE HOME AND TRAVEL TRAILER PARK ORDINANCE OF NEW HANOVER COUNTY ADOPTED MARCH 2, 1970 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Mobile Home and Travel Trailer Park Ordinance of the County of New Hanover adopted March 2, 1970, as amended be and the same is hereby further amended as follows: 1. Amend Section XI, Legal Provisions, Section 11.3, Penalties for Violation (G.S. 14-4) to read: "Violation of the provisions of this Ordinance or failure to comply with any of its requirements shall constitute a misdemeanor and shall be punishable pursuant to the provisions of NCGS 14-4 which provides that violation of a County Ordinance is a misdemeanor punishable by either a maximum fine of fifty dollars ($50.00) or imprisonment for not more than 30 days as amended. Each day such violation continues shall be considered a separate offense. Nothing herein contained shall prevent the County of New Hanover from taking such other lawful action as is necessary to prevent or remedy any violation." Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to_the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general welfare of the inhabitants of the County of New Hanover, and shall be in full force and effect from and after its adoption.
