THE ZONING ORDINANCE OF NEW HANOVER COUNTY, ADOPTED OCTOBER 6, 1969 THE BOARD OF COUNTY COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New Hanover County ~. adopted October 6, 1969, as amended be and the same is hereby further amended as follows: 1. Amend Article XI, Amendments, Section 112, by adding a new Subsection 112-3 to read as follows: Section 112-3 A cause of action as to the validity of this zoning ordinance, or amendment thereto, adopted by the County Commissioners shall accrue upon adoption of the ordinance, or amendment thereto, and shall be brought within nine months as provided in.General Statutes 1-54.1, as amended. Section 2. Any ordinance or part of any ordinance in,conflict with this ~..' ordinance, to the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general welfare of the habitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: ~, \. Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby further amended as follows: 1. Amend Article II, Definitions by adding the following three new Sections 23-72, 23-73 and 23-74 to read: 23-72 S61idWaste - shall mean any garbage, refuse, septage, sludge or any other waste material which is not considered hazardous by the U. S. Environmental Protection Agency (EPA) or the North Carolina State Department of Human Resources, Solid and Hazardous Waste Branch. 23-73 Sludge - shall mean any solid, semi-solid, or liquid waste generated from a residential, commercial, municipal, or industrial wastewater treatment plant or water supply treatment plant not considered to be hazardous by EPA or the N. C. Dept. of Human Resources, Solid and Hazardous Waste Branch. Sludge shall be considered that waste which has been treated by a process to significantly reduce pathogens. 23-74 Septage - shall mean a waste that is a fluid mixture of partially treated sewage solids, liquids and sludge of human or domestic waste orgin, pumped from septic tanks, residential grease traps, or privies. Septage shall be considered that waste which has not been treated by a process to significantly reduce pathogens. 2. Amend Article V, District Regulations, Section 50-2, Tabulation of Permitted Uses to read as follows: Sludge disposal Septage Disposal R-15 S-- S 1-2 p-- P 3. Amend Article VI, Supplementart District Regulations by adding a new Section 69.7 to read: Section 69.7 SeptageandSludgeDisp6sal - Septage and sludge disposal is a permitted use in the 1-2 District provided each disposal site is located a minimum of 250 feet in horizontal distance from a residence, place of bu~iness or church, and 100 feet in horizontal distance from any stream, canal, marsh, coastal water, lake or impoundment, subsurface drainage or drainage ditch; and, the operation and responsibility of said use is carried out in accordance with all standards and rules prescribed by the North Carolina Division of Health Services and the County Health Department. 4. Amend Article XIII, Provisions for Uses Allowed as Special Uses by adding a new Section 72-36 to read: 72-36Septage and Sludge Disp6sal - Septage and sludge disposal may be permitted in anR-15 District subject to the requirements of the district and provided that: 1) Each disposal site shall be located a minimum of 1,cOOO' feet in horizontal distance from a residence, place of business or church, and 100 ~eet in horizontal distance from any stream, canal, marsh, coastal water, lake or impoundment, subsurface drainage or drainage ditch. 2) A planted buffer strip (as specified in Section 67 of the New Hanover County Zoning Ordinance) shall be provided along all front, side and rear property lines, except in areas designated for ingress and egress. 3) Each site shall be posted "No Trespassing: and at each entrance legible signs of at least two square feet must be posted stating "Caution - Sludge or Septage Disposal Area" or other similar language conveying this warning. 4) No septage or sludge shall be deposited and no building or structures shall be located within 100 feet of the nearest property line in the disposal site area. 5) The operation and responsibility of said use shall be carried out in accordance with all standards and rules pre- scribed by the North Carolina Division of Health Services and the County Health Department. <- Section 2.
