AN ORDINANCE OF THE COUNTY OF NEW HANOVER
'AMENDING THE ZONING ORDINANCE
OF NEW HANOVER COUNTY
ADOPTED OCTOBER 6, 1969

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. That the Zoning Ordinance of the County of New Hanover adopted
October 6, 1969, as amended be and the same is hereby further amended as follows:
1. Amend Section 54, B-1 Business District by adding a new Subsection
54-4(4) to establish a maximum building height of 35 feet to read
as follows:

2. Amend Article VII, Off-Street Parking and Loading, Section 80-1 .
to make elevated parking a special use in all residential districts,
B-1, B-2 and 0 & I districts and a permitted use in 1-1, 1-2 and
AI districts to read as follows:
80-1 "...Such off-street parking may be provided on graded improved
open space or in an elevated parking structure, except that
no parking shall be permitted within ten (10) feet of a
street right-of-way line or other property line of residentially
zoned property. This provision shall not apply to off-street
parking requirements of Residential Districts.
Elevated parking structures may be permitted in Residential
Districts, B~l, B-2 Business Districts, and 0 & I Office
and Institutional Districts by Special Use Permit upon
re~iew and recommendation of the Planning Board and
subsequent final approval by the Board of County Commissioners
in the manner prescribed in Article VII, Section 71."
Non-residential off-street parking may be permitted in
Residential Districts...1I
3. Amend Section 72-28 Non-Residential Off-Street Parking (2) to
read as follows:
72-28 "That the sites shall be used solely for ground level
parking in conjunction with the principal use..."
4. Amend Article V, Section 50-2 to allow Children1s Day Care Service
as a permitted use in B-2 Highway Business Districts.
5. Amend Ar1itcle V, Section 50-2 to make Retail Nurseries permitted by
right in B-1, B-2, 1-1, and AI districts and Wholesale Nurseries
and Greenhouses, other than Landscapping Contracting Services
permitted by right in all districts to read as follows:
Agricultural, Forestry, Fishing
Wholesale Nurseries and Greenhouses - Permitted in all districts
Construction
Landscapping Contractors - Permitted in B-2, 1-1, 1-2 and AI Districts
Retail Trade
Retail Nurseries - Permitted in B-1, B-2, 1-1 and AI Districts
Section 2. Any ordinance or part of any ordinance in conflict with this
ordinance, to the extent of such conflict is hereby repealed.
Section 3. This ordinance is adopted in the interest of public health, safety,
morals, and general welfare of the inhabitants of the County of New Hanover, North
Carolina, and shall be in full force and effect from and after its adoption.
