Request these items be placed on the consent agenda for the County Commissioners' meeting on February 16, 1981. 1 recommend approval of these abatements as the Commissioners have approved these types of releases in the past. Jonathan Barfield read in full, considered and adopted: RESOLUTION AUTHORIZING, ADOPTING, APPROVING, ACCEPTING AND RATIFYING THE EXECUTION OF AMENDMENT NO. 2 TO GRANT AGREEMENT FOR PROJECT NO. 8-37-0084-01 BETWEEN THE UNITED STATES OF AMERICA AND.New Hanover CountZ BE IT RESOLVED, by the Board of Commissioners County, North Carolina of New Hanover SECTION 1. That said Board of Commissioners hereby authorizes, adopts, approves, accepts and ratifies the-e kecution of Amendment No. 2 44;"':�' to Grant Agreement between theiF6deral Aviation Administration on beha lf of the United States of America and the,New Hanover County SECTION 2. I SO FORM 5100-17 (10/75) (Supersedes previous edition) UNITED STATES OF AMERICA FEDERAL AVIATION ADA/UNISTRATION Page 1 of 3 Pages Contract No. DOT-FA-74-SO-8706 New Hanover County Airport Wilmington, North Carolina AMENDMENT NO. 2 TO GRANT AGREEMENT FOR PROJECT NO. 8-37-0084-01 WHEREAS, the Federal Aviation Administration (hereinafter referred to as the FAA) has determined it to be in the interest of the United States that the grant agreement between the FAA, acting for and on behalf of the United States, and New Hanover County (hereinafter referred to as the Sponsor), accepted by said Sponsor on the 24th day of Junel 1974, be amended as hereinafter provided. NOW THEREFORE WITNESSETH: That, in consideration of the benefits to accrue to the parties hereto, the FAA on behalf of the United States, on the one part, and the Sponsor, on the other part, do hereby mutually agree that the terms and conditions of the grant agreement between the United States and the Sponsor, accepted by said Sponsor on the 24th day of June, 1974, be further,amended: 1. The project description on page 1 of the grant which reads "Acquire land, clear zones and approach and transitional areas (75-01 acres in Parcels C, D, E, and F; all property interests satisfactory to the Administrator); install security (10,800 l.f.) and safety (25,800 l.f.) fencing; install medium intensity taxiway lighting for TW B, TW C, TW D, TW F, apron TW, and connecting TW; install lighted wind cone; approach and line -of -sight clearing; acquire fire and crash rescue equipment (one quick response vehible and related incidental equipment)" is hereby revised to read as follows: Acquire land, clear zones and approach and transitional areas (24.5 acres in Parcels C, D, E, and F; all property interests satisfactory to the Administrator); install security and safety fencing; install medium intensity taxiway lighting for TW B, TW C, TW D, TW F, apron TW, and connecting TW; install lighted wind cone; approach and line -of -sight clearing; acquire fire and crash rescue equipment (one quick response vehicle and related incidental equipment) 2. Special Condition No. 16 is added and reads as follows: 26. The parties agree that the mortgage holders of Parcel F, Rivenbark Tract and Wright Tract have not yet subordinated their interest in these tracts to the County's easement interests. The County agrees that it will protect its own right to keep these tracts free of obstructions in the future to the extent described in the easements even if condemnation becomes necessary. On the basis of this commit- ment, the FAA determines that the property rights now obtained are satisfactory to the Administrator. It is understood that any future expense necessary to secure the rights described in the easements will not be eligible for federal participation. Numbered paragraph 15 of the Sponsors Assurances in the project application dated May 1, 1974, is referenced in support of this agreement. 3. Revised Exhibit A dated January 22, 1979, supersedes Exhibit A dated May 1, 1974, and is incorporated herein. It is understood and agreed that all the other terms and conditions of the grant agreement remain in full force and effect and are not changed or altered except as hereinabove provided. The United States shall not be obligated under any provision hereof unless this amendment has been executed by the Sponsor, on or before March 5, 1981, or such subsequent date as may be prescribed in writing by the Administrator.
