Request the listing penalty assessed to Edith Friedberg in
the amount of $87.29 be released. Ms. Friedberg's doctor has
certified she was sick during the months of December and January, 1980.
Request these items be placed on the consent agenda for the
County Commissioners' meeting on February 16, 1981. I recommend approval
of these abatements as the Commissioners have approved these types of
releases in the past.

SECTION 1. That said

AMENDMENT NO. 2 TO GRANT AGREEMENT FOR PROJECT NO. 8-37-0084-01
WHEREAS, the Federal Aviation Administration (hereinafter referred
to as the FAA) has determined it to be in the interest of the United
States that the grant agreement between the FAA, acting for and on
behalf of the United States, and New Hanover County (hereinafter
referred to as the Sponsor), accepted by said Sponsor on the 24th day
of June, 1974, be amended as hereinafter provided.
NOW THEREFORE WITNESSETH:
That, in consideration of the benefits to accrue to the parties hereto,
the FAA on behalf of the United States, on the one part, and the Sponsor,
on the other part, do hereby mutually agree that the terms and conditions
of the grant agreement between the United States and the Sponsor,
accepted by said Sponsor on the 24th day of Jlme, 1974, be further. amended:
1. The project description on page 1 of the grant which reads
T1Acquire land, clear zones and approach and transitional areas
(75.01 acres in Parcels C, D, E, and F; all property interests
satisfactory to the Administrator); install security (10,800 l.f.)
and safety (25,800 l.f.) fencing; install mediwn intensity taxiway
lighting for TIN B, TW C, 'fIN D, TW F, apron TIN, and connecting TIN;
install lighted wind cone; approach and line-of-sight clearing;
acquire fire and crash rescue equipment (one quick response vehicle
and related incidental equipment)"
is hereby revised to read as follows:
Acquire land, clear zones and approach and transitional areas
~4.5 acres in Parcels C, D, E, and F; all pr~perty interests
satisfactory to the Administrator); install security and safety
fencing; install mediwn intensity taxiway lighting for TW B, TIN C,
TIN D, TIN F, apron TIN, and connecting TIN; install lighted wind cone;
approach and line-of-sight clearing; acquire fire and crash rescue
equipment (one quick response vehicle and related incidental equipment)
2. Special Condition No. 16 is added and reads as follows:
l6. The parties agree that the mortgage holders of Parcel F, Rivenbark
Tract and Wrigh~ Tract have not yet subordinated their interest in
these tracts to the County's easement interests. The County agrees
that it will protect its own right to keep these tracts free of
obstructions in the future to the extent described in the easements
even if condemnation becomes necessary. On the basis of this commit-
ment, the FAA determines that the property rights now obtained are
satisfactory to the Administrator. It is understood that any future
expense necessary to secure the rights described in the easements
will not be eligible for federal participation. Numbered paragraph
15 of the Sponsors Assurances in the project application dated
May 1, 1974, is referenced in support of this agreement.
3. Revised Exhibit A dated January 22, 1979, supersedes Exhibit A
dated ~~y 1, 1974, and is incorporated herein.
It is understood and agreed that all the other terms and conditions
of the grant agreement remain in full force and effect and are not
changed or altered except as hereinabove provided.
The United States shall not be obligated under any provision hereof
unless this amendment has been executed by the Sponsor, on or before
March 5, 1981, or such subsequent date as may be prescribed in writing
by the Administrator.
IN WITNESS WHEREOF, the parties hereto have caused this amendment
to the grant agreement to be duly executed as of day of

OF SURPLUS CITY/COUNTY OWNED PROPERTY
WHEREAS~ the County of New Hanover owns wholly or jointly with the
City of Wilmington, certain parcels of real property to be declared surplus and
WHEREAS~ these certain parcels of real property have been offered
for sale for cash in "as is" condition pursuant to G. S. l60A-269 and
WHEREAS, the bidders indicated on the attached list have offered to
purchase the properties described on such list for cash in "as is" condition subject
to outstanding unpaid taxes, assessments or other liens and encumbrances including,
but not limited to, restrictive covenants~ easements or leases and have tendered
deposits sufficient to assure compliance with the bid, and
WHEREAS, the bid amounts have been advertised in compliance with
the requirements of G. S. l60A-269 and there have been no further qualifying upset
bids received within the time limits specified in said advertisement.
NOW THEREFORE BE IT RESOLVED THAT:
1. The property owned wholly by the County of New
Hanover or jointly with the City of Wilmington
as per the attached list be and the same is hereby
declared surplus.
2. The property described on the attached list be
sold for cash in "as is" condition to the bidders
indicated on such list for the bid amounts so speci-
fied subject to outstanding unpaid taxes, assessments
or other liens and encumbrances including, but not
limited to, restrictive covenants, easements or leases.
3. The Chairman of the Board of Commissioners of New
Hanover County be and is hereby authorized to execute
deeds without warranty or covenants to the bidders
specified on the attached list on behalf of the
Board of Commissioners of New Hanover County.
