HomeMy WebLinkAbout1981-07-07 RM Exhibits .. ~ -&i.,:-fl.Ji-, fJ. !,S. .~ AN ORDINANCE OF THE COUNTY OF NEW HANOVER AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY, NORTH CAROLINA ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended, be, and the same is hereby further amended as follows: I. Amend Section 94-2 Outdoor Advertising Signs by deleting Subsections 1 through 8 and adding the following: (1) Each outdoor advertising sign shall require a permit. (2) No outdoor advertising sign shall be closer than four hundred (400) feet from a place of worship, nor two hundred (200) feet from a school, public park, or residential zone as measured along the same side of the street from the closest point of said use to the sign structure. (3) No outdoor advertising sign shall be closer than four hundred (400) feet from a place of worship nor two hundred (200) feet from a school or public park as measured from the closest point of said use across the street to the sign structure. (4) No two (2) outdoor advertising sign structures shall be spaced less than one thousand (1000) feet apart. This minimum dis- tance between signs shall be measured along the nearest edge of the pavement between points directly opposite the sign along each side of the highway and shall apply to signs located on the same side of the highway. (5) No outdoor advertising sign shall be located closer than one hundred fifty (150) feet from an imaginary line running from the center of any existing outdoor advertising sign structure perpendicular across all streets immediately opposite the sign. (6) All outdoor advertising signs shall be set back at least ten (10) feet from any right-of-way or property line. All out- door advertising signs shall be fifty (50) feet from a right- of-way intersection. (7) The area of an outdoor advertising sign shall not exceed four hundred fifty (450) square feet. In no case shall the sign exceed forty (40) feet in length. (8) No outdoor advertising sign shall exceed forty (40) feet in height, measured from the finished grade of the property or the finished grade of the nearest roadway, whichever is higher, to the top of the sign structure, including border trim. Roof top outdoor advertising signs are prohibited. (9) An outdoor advertising sign shall be considered as one sign structure when it is designed to be viewed from: a) One direction and consists of a single sign face placed in such a manner to be viewed by one directional flow of traffic, or b) Two directions and consists of two sign faces arranged either back-to-back or in a v-shape. V-shaped or back- to-back signs shall not be considered as one sign struc- ture if located more than fifteen (15) feet apart at the nearest points. In no case shall there be more than one (1) sign face per directional flow of traffic. 1"- (10) The backs of all outdoor advertising signs shall be painted in a neutral color to blend with the surrounding area and to prevent the reflection of car lights and sun light. (11) Sign messages which advertise a discontinued activity or use of a building or premise shall be removed within sixty (60) days from the date the activity or use was ter- minated. (12) Any lawfully erected outdoor advertising sign which is made nonconforming by this ordinance or amendment to it may con- tinue to exist as such at the time when the sign became non- forming. II. Amend Section 50-2, Table of Permitted Uses, by adding: Outdoor Advertising as a Permitted Use in the A-I Airport Industrial District. Section 2. Any ordinance or any part of any ordinance in conflict with this ordinance, to the extent of such conflict, is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption.
