That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby further amended as follows: I. Amend Section 50-2, Tabulation of Permitted Uses, Page 22 of the New Hanover County Zoning Ordinance to allow wholesaling with no outside storage as a permitted use in the B-2 District. Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. Chairman and Commissioner C mmissioner ~. ~'. ~ Commissioner > AN ORDINANCE OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NE41 HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New Flanover adopted October 6, 1969, as amended be and the same is hereby further amended as follows: I. Amend Section 46, Abandonment and Discontinuance of Non-Conforming Situations, Subsections 46-2 and 46-3 to read: 46-2 For purposes of determining whether a right to continue a non-conforming situation is lost pursuant to this Section, all of the buildings, activities and operations maintained on a lot are generally to be considered as a whole. For example, the failure to rent one (1) apartment in a non- conforming apartment building or one (1) space in a non- conforming mobile home park for one hundred eighty (180) days shall not result in the loss of the right to rent that apartment or space thereafter so long as the apartment building or mobile home park as a whole is continuously maintained. But if a non-conforming use is maintained in conjunction with a conforming use, discontinuance of a non- conforming use for the required period shall terminate the right to maintain it thereafter. And so, if a mobile home is used as a non-conforming use on a residential lot where a conforming residential structure also is located, removal of that mobile home for one hundred eighty (180) days terminates the right to replace it. 46-3 When a structure or operation made non-conforming by this Ordinance is vacant or discontinued at the effective date of this Ordinance, the one hundred eighty (180) day period for purposes of this Section, begins to run at the effective date of this Ordinance. Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of such conflict is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals, anal general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. That the Subdivision Regulations of the County of New Hanover adopted February 16, 1969 be and the same is hereby further amended as follows: 1. Change "Wilmington-New Hanover Planning Commission" to "New Hanover County Planning Board" in each of the following sections: Article II: Section 1 (15) Article III: Sections 3.3 (1), 3.3 (2), 4.1, 4.2, 4.4 (10), 4.5, 4.5(1), 4.5(2), 4.5(3), 4.5(4), 4.5(5), 4.5(6), 4.6(1) Article U: Sections 3.3, 3.4(b) (1) (a), 3.4(b) (2) Article VI: Sections 2, 3, 4, 8 Article VII: Appendix , 2. Change "Wilmington-New Hanover Planning Department" to "New Hanover County Planning Department" in each of the following sections: Article III: Sections 2.1, 2.2, 2.3, 3.1 3. Delete Article II, Section 3.1 and stubsitute a new Section 3.1 to read as follows: 3.1 The subdivider shall submit one sepia print of the preliminary plan and ten additional copies to the New Hanover County Planning Department at least ten working days prior to the Planning Board meeting at which the subdivider desires to have the plat reviewed. Planning Board meeting dates can be obtained from the Planning Department. 4. Delete Article II~,Section 4.1 and substitute a new Section 4.1 to read as follows: 4.1 The subdivider shall submit one original print (drawn in ink on film or linen not more than 21x30 inches nor less than 82x11 inches) and ten additional copies of the final plat to the Planning Department not less than ten working days prior to the Planning board meeting at which the subdivider desires to have the plat reviewed. Planning Board meeting dates can be obtained from the Planning Department. Section 2. Any ordinance or any part of any ordinance in conflict with this ordinance, to the extent of such conflict, is hereby repealed. Section 3. RESOLUTION AUTHORIZING THE APPLTCA'TION ~WTTH THE STATE OF NORTH CAROLINA FOR A GRANT UNDER THE NORTH CAROLINA CLEAN WATER BOND ACT OF 1977 WHEREAS, The North Carolina Clean Water Bond Act of 1977 has. authorized the making. of grants to aid eligible units of government in financing the cost of construction of wastewater treatment works, wastewater collection systems, and water supply systems, and 1VHEREAS, The County of New Hanover has need for and intends to construct a second water supply well with connecting waterline in the Flemington area; and WHEREAS, The County of New Hanover intends to request State grant assistance for the project, NOW THEREFORE BE IT RESOLVED, BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF NEW HANOVER: That New Hanover County will arrange financing for all remaining costs of the project, if approved for a State grant award. That New Hanover County will adopt and place into effect on or before completion of the project a schedule of fees and charges which will provide adequate funds for proper operation maintenance and administration of the system. That New Hanover County will provide for efficient operation and maintenance of the project on completion of construction thereof. That George F. Cooper, County Manager, and successors so titled, is hereby authorized to execute and file an application on behalf of New Hanover County with the State of North Carolina for a grant to aid i.n the construction of the project described above.
