AN ORDINANCE OF THE COUNTY OF NEW HANOVER AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY, NORTH CAROLINA ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended, be, and the same is hereby further amended as follows: A. Amend Sect"ion 23 Definitions by revising item (47) to read as follows: (47) Family Care Home. A "Family Care Home" is a home providing sheltered care for not more than five (5) adults, eighteen (18) years of age or more who, because of age or disability, require some personal services along with room and board to assure their safety and comfort. The construction and operation of the home shall comply with the requirements of the licensing agency, the North Carolina Department of Human Resources, and any other applicable Federal, State or local codes. B. Amend Section 23, Definitions by revising item (25) to read as follows: (25) Nursing Home. A "Nursing Home" is an institution operated to provide nursing and/or convalescent care for three (3) or more persons unrelated to the licensee who have remedial ailments or other ailments, for which medical and nursing care is indicated; who, however, are not sick enough to require general hospital care. The construction and operation of the nursing home shall comply with the requirements of the licensing agency, the North Carolina Department of Human Resources, and any other applicable Federal, State, or local codes. C. Amend (59) Section 23 Definitions by adding the following: Home for the Aged and Infirm. A II Home for the Aged and Infirm" is a facility providing sheltered care to six or more adults, eighteen (18) years of age or over, who are aging or disabled. A Home for the Aged provides meaningful activities which are structured to the needs of the individual within a group setting. The construction and operation of the home shall comply with the requirements of the licensing agency, the North Carolina Depart- ment of Human Resources, and any other applicable Federal, State, or local codes. (60) Gro~ Home for Developmentally Disabl,ed Adults. A "Group Home for Developmentally Disabled Adults" is a home providing for the care of at least twb and not more than nine adults, eighteen (18) years of age or more, who are development~lly di~abled and who have or can develop self-help skills, are ambulatory, in need of a home and are able to participate in_activities in the community. The construction and operation of the home shall comply with the requirements of, the licensing agency, the North Carolina Department of Human Resources, and any other applicable Federal, State, or local codes. D. Amend Section 51 R-20 Residential District, subsection 51-3 Special Uses by revising item (17) to read to follows: ( 1 7) Ho s p ita 1 . E. Amend Section 51 R-20 Residential District, subsection 51-3 S~ecial Uses by adding the following: (3) Home for the Aged and Infirm. (9) Nursing Home. (26) Group Home for Developmentally Disabled Adults. F. Amend Section 52 R-15 Residential District, subsection 52-3 Special Uses by revi sing item (12TtOread as follows: (12.)' Hospital. ~I -2- G. Amend Section 52 R-15 Residential District, subsection 52-3 Special Uses by adding the following: (2) Home for the Aged and Infirm. (11) Nursing Home. (29) Group Home for Developmentally Disabled Adults. H. Amend Section 53 R-10 Residential District, subsection 53-3 Special Uses by revising item (12) to read as follows: (12) Hospital. I. Amend Section 53 R-10 Residential District, subsection 53-3 Special Uses by adding the following: (2) Home for the Aged and Infirm. (11) Nursing Home. (26) Group Home for Developmentally Disabled Adults. J. Amend Section 59.1 0&1 Office and Institutional District, subsection 59.1-2 Permitted Uses by deleting the following: (3) Nursing Home, Care Home, and/or Convalescent Home. K. Amend Section 59.1 0&1 Office and Institutional District, subsection 59.1-2 Permitted Uses by adding the following: (16) Home for the Aged and Infirm. (17) Nursing Home. (18) Group Home for Developmentally Disabled Adults. L. Amend Section 72 Additional Restrictions Imposed on Certain Special Uses, by revising subsection 72-9 Hospital, Care Home, Nursing Home and/or Convalescent Home to read as follows: 72-9 Hospital or Nursing Home - A hospital or nursing home may be permitted in a R-20, R-15 or R-10 District subject to the requirements of the district provided that: (1) The lot size shall be no less than two (2) acres; and (2) The structure shall have minimum side and rear yards of fifty (50) feet and a front yard of at least twenty- five (25) feet greater than that required of single family residences within the district in which located. Section 2. Any ordinance or any part of any ordinance in conflict with this ordinance, to the extent of such conflict, is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, , morals and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption.
