Southern Import Co., Inc. request the listing penalty in the amount of $312.80 be released. G.S.105-311 states listings submitted by mail should be deemed to be filed as of the date shown on the postmark. The postmark date for this listing was February 1, 1979. The Board of County Commissioners normally disallows releases of this type; therefore, I would recommend this penalty not be released. Mr. C. G. Kerr, representative of taxpayers on Oakley Circle, has requested a refund of taxes for the individuals listed. below for 1975 through 1979 based on the valuation reduction allowed by the 1980 Board of Equalization and Review. I have advised Mr. Kerr that he would not be entitled to the adjustment for previous years based on the 1980 Board of Equalization and Review action. He further advised he had filed a petition to be heard by the 1979 Board of Equalization and Review and it was not acted opon. Therefore, Mr. Fox advised it would be legal for the Board of County Commissioners to approve refunds for 1979 only as this would be a clerical error. (See attached copy of Mrs. Williams' letter to Mr. Cummings dated May 10, 1979.) Based on the above information, I would recommend the approval of the following refunds: 1. Charles Burton 2. Cummings: I'm sorry to have goofed in not getting you on the agenda for the Boal:d of Equalization and Review and the goof was mine. ( I hope you received the copy.of the letter I received from Hr. Carmichael. Since that time, ~tr. Carmichael has carefully inspected the plant and has told them that they are not conforming .to the permit. ~tr. Burton has asked to be heard by the Board of Adjustments at their meeting in June. If they do not grant a variance (and it is my feeling they will not), he will then have 10 days to file to be heard in Court, and we both know that this can be a lengthy procedure. The petition came to me too late to be heard by the Equalization and Heview . Board this year. (The State laws govern this.) I saw it for the first time on the 21st, I think, and we met Nonday morning. Had I realized that, by law, we could not reconvene this Board this year, I could have to.ld you to just bring all those who \"ished to be heard on dmm. It would have been short notice, but you could have appeared. By sincere apologies to all of you for my goof. The best I can recommend to you is to make it known in January that you \"ish to be heard by this Board and the Board can determine relief for you that would apply to this year I s tax.
