1980-10-03 Special Meeting o o o MINUTES OF SPECIAL MEETING, SEPTEMBER 26, 1980 AND SEPTEMBER'29, 1980 (CONTINUED) 669 DISCUSSION ON SOLID WASTE DISPOSAL PROBLEMS Vice-Chm. Gottovi introduced,Mr. O. W. Strickland, Head of the Solid Waste and Vector Control Division of the N. C. Department of Human Resources, and his Assistant, Mr. Gordon Layton. Vice-ChID. Gottovi then turned the meeting over to County Manager Cooper to give a brief rundown on where the County was in the solid waste disposal situation. County Manager Cooper and County Attorney Fox explained the procedures involved in the lawsuit filed against the Corps of Engineers requesting the Court to keep,the Corps of Engineers and the Department of the Army from closing the landfill on Sep- tember 30. Vice-Chm. Gottovi asked the representatives from the municipalities present to explain how they intended to handle the situation when the landfill closed on Sep~ tember 30, and the following persons commented: Mayor Ben Halterman, City of Wilmington Mayor Ted Seawell, Town of Carolina Beach Mayor Robert Sawyer, Town of Wrightsville Beach County Manager Cooper reported on alternatives to the immediate problem. Vice-Chm. Gottovi summarized where the County stood at that'point. Mr. O. W. strickland commented. BREAK Vice-Chm. Gottovi recessed the meeting for a break from 2:52 o'clock p. m. until 3:08 o'clock p. m. DISCUSSION ON SOLID WASTE DISPOSAL PROBLEMS (CONTINUED) Mr. O. W. Strickland reiterated the willingness of his Department to help New Hanover County find a solution to the solid waste problems. The following persons offered comments. Rusmisell Clerk to the Board MINUTES OF SPECIAL MEETING WITH PLANNING BOARD, OCTOBER 3, 1980 ASSEMBLY The New Hanover County Board of Commissioners met in Special Session with members of the New Hanover County Planning Board on Friday, October 3, 1980, at 8:00 o'clock a. m. in the Assembly Room, New Hanover County Administration Building. Members present were Commissioners Karen E. Gottovi; Janet S. Morgan; Claud O'Shields, Jr.; Chairman Ellen C. Williams; County Manager George F. Cooper, Attorney Wallace Murchison of the County Attorney'~ Office; and Clerk to the Board Alyce B. Rusmisell. Carom. Howard L. Armistead, Jr: was absent. Planning Board members present were Mr. Richard Sniffen, Acting Chairman. I ~r. I Larry Flowers, Mr. Charles Hollis and , , Chm. Williams called the meeting to order at 8:38 o'clock a. m. (The meeting was delayed in anticipation of the arrival of the 4th member of:the Planning Board.) Chm. Williams stated that the joint meeting had been called to consider a Special Use Permit for a Sanitary Landfill on property owned ~y New Hanover County off of the Blue Clay Road in an I-2 Zoning District. 670 MINUTES OF SPECIAL MEETING WITH PLANNING BOARD, OCTOBER 3, 1980 (CONTINUED) PUBLIC HEARING TO CONSIDER AN APPLICATION FOR SPECIAL USE PERMIT TO USE PROPERTY LOCATED OFF THE BLUE CLAY ROADlDJACENT TO THE JUVENILE SERVICES CENTER FOR A SANITARY LANDFILL IN AN I-2 (INDUSTRIAL) DISTRICT. Planning Director Dexter Hayes reported that this matter was being considered jointly by the County Commissioners and the Planning Board due to the time constraints and the urgent nature of the situation. Mr. Hayes gave the physical characteristics of the property and the surrounding area and stated that, if reviewed alone, the en- vironmental constraints would place severe limitations on the use of this site for a sanitary landfill, but that since October 1, 1980, the citizens of New Hanover County had been without a facility for the disposal of solid waste and that an interim site was needed immediately to avoid an imminent threat to the public health and safety of County residents; therefore, the Planning Staff recommended approval of the Special Use Permit with certain conditions in that the threat to public health and safety would certainly be greater if the site was not approved. o Chm. Williams opened the floor to the public for comments and outlined the rules of procedure for the hearing. Gottovi's question, the Planning Director explained the soil types in the area being considered. The following persons offered further comments: Mr. R. M. Williams recessed the meeting from 9:33 o'clock a. m. until 10:04 o'clock a. m. in order for the Planning Board to deliberate and make a recommendation to the County Commissioners. SPECIAL USE PERMIT FOR SANITARY LANDFILL (CONTINUED) County Manager Cooper reported that the State's tentative approval of the pro- posed site was in the mail. Comm. Morgan MOVED, SECONDED by Comm. Gottovi, to have the Engineers and ~he State solid waste people come to a meeting when the plan for the operation of the landfill was completed to explain the plan and answer questions from the public. Upon vote, the motion carried as follows: Voting Aye: Absent: Comm. Gottovi, Morgan, O'Shields and ChID. Williams Comm. Armistead After the Commission had considered the following four items and found them to be fact, (a) that the use would not materially endanger the public health or 0 safety if located where proposed and developed according to the plan as submitted and approved; (b) that the use met all required conditions and specifications; (c) that the use would not substantially injure the value of adjoining or abutting property or the use was a public necessity; and (d) that the location and character of the use, if developed according to the plan as submitted and approved, would be in harmony with the area in which it was to be located and in general conformity with the plan of development for New Hanover County. Chm. williams MOVED to issue the Special Use Permit based on the following conditions as recommended by the Planning Board: o o o MINUTES OF SPECIAL MEETING WITH PLANNING ~OARD, OCTOBER '3, 1980 (CONTINUED) SPECIAL USE PERMIT FOR A SANITARY LANDFILL (CONTINUED) , ' , , , r 1) A 50' buffer zone shall be retained along the property line 2) The operation of the facility mu~t be carried out in accordance with the standards and specifications!of the NC Department of Human Resources. 3) The permit is sUbject to further review and consideration according to Article VII of the New Hanover County Zoning Ordinance. 4) Subject to the requirements of Section 72-13 of the Zoning Ordinance. 5) Subject to this application being reviewed in one year. 671 Comm. Gottovi requested that the Board seriously consider a final resolution of this property after it was left so that the community would have something more positive to remember the County by than a landfill and suggested that it be considered in the parks and Recreation plan for the community; that perhaps I-2 zoning for this partic- 'ular area could be changed to something that would be a little ,more satisfactory in a rural and transitional community as most of this property was. She stated that she felt a motion to do that was a little premature because it would have to go through the process but she would like to consider the final resolution of this property along with the temporary use the Board was about to make of it. Planning Board Chairman Richard Sniffen commented that it was in the long range plan of the Planning Department to redefine many of the zoning areas in the County so there was a long range plan to bring those areas out in the County into some areas that were not zoned and 'to take a hard look at other areas to see whether or not they should be zoned something else than what they were presently zoned, and when that particular area was looked at with the long range rezoning plan maybe that could be addressed. Comm. Morgan SECONDED Chm. Williams motion for approval of the Special Use Permit and stated for the record that she was seconding the motion because the County had to have it; that it was temporary and that it was an emergency, but she wanted to make sure that it was temporary and she was not seconding something that was going to be there for awhile and she knew that everybody right there ,that day did believe that it would be temporary. Cooper; County Attorney James C. Fox; and Clerk to the Board, Alyce B. Rusmisell. No Members were absent. Chm. williams called the meeting to order. Rev.
